.~,~.. z •d SONk~~13M-L1MQ ~ 3WHN ~689i=~Z6I6 ~ X31 9S~0ti I?J~ Z~O~-Z-B~~ ~Dla~ -- ~~~~ ~~~ Attention: Bill Biddlecome o~oi~s Subject: Request for aNW 18 permit for wetland and stream impacts resulting from the construction of a pcde'strian multi-use path on 5R 1207 (Twiford Street) in Kitty Hawk, Dare Cuunty_ The North Carolina Department of Transportation is requesting a NW I8 permit for impacts to 0.025 acres of riverine wetlansJs resulting from the construction of a multi-use pedestrian path. This path will begin at the intersection of Slt 1207 {'fwiford St.) and 5R 1206 (Woods RdJ parallelinb SR 1207 on the north side fcx approximately 2000 ft. The path will vary in width betwttn 6 and 10 ft. !t will be constructed with a gavel baxe and have a paved surface. The alignment of the path has been adjusted tU avoid impacts to wetlands as much as pcxssible_ Some wetland locations are adjacent to the road shoulder and impacts arc unavoidable. In conjunction with the installation of the bika path NCDOT is proposing one pipe replacement and pne pipe extension. At Site One the existing 40' X 24° GMP will be replaced with a 50' h 36" AAP. On the north side of the pipe, rip-rap will be placed directly around the inlet and 50 ft. to the caret along the bank as shown on the permit drawings. The 50-ft. of rip-rap will stabilize the bike path shoulder adjacent to the wetland surface water. At Site Two the existing 40' X 2A" CMP is functionins and rip-rap will be adck:d for stabilization. On the north siderip-rap will extend 55 ft. to the east and west of the inlet. The 110 ft, of rip-rap will stabilize the bike path shoulder. At Site'1"hrez-A the existing 40' X 24" CMP will be extended by 5 ft. to the north. This will allow enough shoulder to install the multi-use path. 'The inlet end of this pipe will be stabilized witL rip-rap. The pipe replacement and extension will result in a total of 15 ft. of perennial stream impact. NCDOT will mitigate for p.025 acres of riverinc wetland impacts ttubugh the Ecosystem Enhancement Program. This project ix being constructed to provide a safe menus for pedestrian bike and foot traffic along this roadway. The village of Kitty Hawk has many citizens that utilize this travelway. The current high level of vehicle traffic and lack of adeyuaic mad shoulder for pedestrian tra>i:ic creates a unsafe condition. The muti-use path wit! significantly rCducc :safety risk to pedestrian traffic along this roadway. Factors including size and type of proposed impact and function and relative value of the irXlpac`ted aquatic resource will be considered in determining acceptability of appropriate and practicable mitigation as pmposcd. Examples of mitigation that may be appropriate and practicable include, Pagc7vf12 6L•6'd ~689~~Z6L6~01 66~LSZ6ZSZ NOlJNIHStiM 3~tJSfl~wO-r~ SZ~ZL ~@@Z-Z@-83~ 0Z 'd SaNb~13M-JM0~3WdN ~689~~L6Z6~~31 6S~0ti I~3 L00B-Z-833 but are not limited tv: reducing the size of the project; establishing and maintaining wetland and/or upland vegetated buffers to protect open waters such as streams; and replacing losses of aquatic resource functions and values by Creating, restoring, enhancing, or preserving similar funcrions and values, preferable in the same watershed. if mitigation is required for this project, a copy of the mitigation plan. must be attached in order i'or CJ5AC1: or DWQ to Consider the application complete for processing.
