therein. Please pay particular attention to the monitoring requirements in this permit. Failure to establish
an adequate system for collecting and maintaining the required operational information will result in future
compliance problems.
If any parts, requirements, or limitations contained in this permit are unacceptable, you have the
right to request an adjudicatory hearing upon written request within thirty (30) days following receipt of
this permit. This request must be in the form of a written petition, conforming to Chapter 150B of the
North Carolina General Statutes, and filed with the Office of Administrative Hearings, P.O, Drawer
27447, Raleigh, NC 27611-7447. Unless such demands are made this permit shall be final and binding.

amended, and other applicable Laws, Rules, and Regulations
PERMISSION IS HEREBY GRANTED TO THE
A Place at the Beach III Homeowners Association, Inc.

FOR THE
continued operation of a 55,000 GPD wastewater rotary distribution facilities consisting of a bar screen,
flow splitter box, flow measuring device, an 18,500 gallon flow equalization tank with 80 GPM surge
pumps, dual 43,500 gallon aeration tanks, dual clarifiers, dual aerated sludge holding tanks, a teritary filter
with dual beds, a chlorine contact tank with tablet chlorinator, a dosing tank with dual pumps, three (3)
rotary distributors each with approximately 1,280 square feet of bed area, a stand-by generator,
approximately 1,280 linear feet of 8-inch gravity sewer, and a 145 GPM pump station with dual
submersible pumps, high water alarms, and approximately 990 linear feet of 4-inch force main; and
the continued operation of a 500,000 gallon storm water collection and disposal facility consisting of a 354
GPM wet well pump station with duplex pumps, thirteen (13) full circle impact sprinklers, approximately
1,260 linear feet of 6-inch subsurface gravity drain pipe, 1,450 linear feet of 8-inch force main and all
related valves, piping and appurtenances; to serve
A Place at the Beach 11I, with no discharge of wastes to the surface waters, pursuant to the renewal request
received October 31, 1995, and in conformity with the project plan, specifications, and other supporting
data subsequently filed and approved by the Department of Environment, Health and Natural Resources
and considered a part of this permit.
This permit shall be effective from the date of issuance until March 31, 2001, shall void Permit
No. WQ0004230 issued April 19, 1991, and shall be subject to the following specified conditions and
limitations:
I. PERFORMANCE STANDARDS
1. In the event that the facilities fail to perform satisfactorily, including the creation of
nuisance conditions, the Permittee shall take immediate corrective actions, including those
actions that may be required by this Division, such as the construction of additional or
replacement wastewater treatment or disposal facilities.

2. This permit shall become voidable if the soils fail to adequately assimilate the wastes and
may be rescinded unless the facilities are installed, maintained, and operated in a manner
which will protect the assigned water quality standards of the surface waters and ground
waters. The ponding of wastewater on the surface of the distribution field when the dosing
cycle commences shall be considered as evidence of failure of the soils to adequately
assimilate the wastewater. Additionally, such failure shall be interpreted as a violation of
this permit condition.
3. The residuals generated from these treatment facilities must be disposed in accordance with
General Statute 143-215.1 and in a manner approved by the North Carolina Division of
Environmental Management.
4. Adequate measures shall be taken to divert stormwater from the high rate infiltration area
and to prevent wastewater runoff.
5. Diversion or bypassing of the untreated wastewater from the treatment facilities is
prohibited.
6. The issuance of this permit shall not relieve the Permittee of the rt;sponsibihLy for damagus
to surface or groundwate.-s resulting, from the operation of 0115 1ac11tty.
7. The following buffers shall be maintained:
a) 400 feet between high rate infiltration unit and any habitable residence or place of public
assembly under separate ownership or which is to be sold,
b) 200 feet between high rate infiltration unit and any private or public water supply
source and any streams classified as WS or B,
c) 200 feet from mean high water between high rate infiltration unit and any "SA" or "SB"
classified surface waters,
d) 200 feet from normal high water between high rate infiltration unit and any other
stream, canal, marsh, or coastal waters,
e) 200 feet from normal high water between high rate infiltration unit and any Class I or
Class Il impounded reservoir used as a source of drinking water,
f) 200 feet between high rate infiltration unit and any other lake or impoundment,
g) 200 feet between high rate infiltration unit and any Drainage systems (ditches, drains,
surface water diversions, etc.) and from any groundwater lowering and surface
drainage ditches,
h) 100 feet between high rate infiltration unit and property lines,
i) 50 feet between treatment units and property lines, and
j) 50 feet between high rate infiltration unit and other treatment units and public right of
ways.
Some of the buffers specified above may not have been included in previous permits for
this waste treatment and disposal system. These buffers are not intended to prohibit or
prevent modifications, which are required by the Division, to improve performance of the
existing treatment facility. These buffers do, however, apply to modifications of the
treatment and disposal facilities which are for the purpose of increasing the flow that is
tributary to the facility. These buffers do apply to any expansion or modification of the
high rate infiltration areas and apply in instances in which the sale of property would cause
any of the buffers now complied with, for the treatment and disposal facilities, to be
violated. The applicant is advised that any modifications to the existing facilities will
require a permit modification.

A usable green area shall be maintained for wastewater disposal. The green area shall have
the capability of accommodating the average daily flow of the facility being served without
exceeding the loading rates of the green area. A "green area", as defined in 15A NCAC 2H
.0404 (g)(7), is an area suitable for waste disposal, either in its natural state or which has
been modified by planting a vegetative cover of grasses or low growing shrubbery.

I . The facilities shall be properly maintained and operated at all times.
2. Upon classification of the facility by the C~ertific,ttion ('nrr,t„i«ior) fh�,
employ a certified wastewater treatment plant operator to be in responsible c;harp.c; ut
the wastewater treatment facilities. The operator must hold a c:eruttcate of the type dnu
grade at least equivalent to or greater than the classification assigned to the wastewater
treatment facilities by the Certification Commission. The Permittee must also employ a
certified back-up operator of the appropriate type and grade to comply with the conditions
of Title 15A, Chapter $A, .0202. The ORC of the facility must visit each Class I facility at
least weekly and each CIass II, III, and IV facility at least daily, and must properly manage
and document daily operation and maintenance of the facility and must comply with all
other conditions of Title 15A, Chapter $A, .0202. The daily visits by the ORC shall be
done on Mondays, Wednesday, Friday, Saturday, and Sunday, including holidays during
the months of April through October.
3. The facilities shall be effectively maintained and operated as a non -discharge system to
prevent the discharge of any wastewater outside of the high rate infiltration disposal area,
which result from the operation of this facility.
4. No traffic or equipment shall be allowed on the disposal area except while installation
occurs or while normal maintenance is being performed.
5. The rotary distribution fields shall be raked twice weekly during the months April through
October and once a week during the months of November through March.

7. Vegetative growth must be kept out of the rotary distribution areas at all times. All
vegetation must be removed manually so that minimal disturbance will occur to the disposal
area.
S. The application of chemicals to the distribution field(s) is expressly prohibited.
9. An automatically activated standby power source shall be on site and operational at all
times. If a generator is employed as an alternate power supply, it shall be tested weekly by
interrupting the primary power source.
10. The flow measurement device shall be calibrated annually by a representative of a firm
which is routinely engaged in the calibration of flow measurement devices. Records of this
calibration, including all information pertinent to the calibration, shall be available during
any inspection by Division staff.
11. Diffusers shall be cleaned as needed to ensure that adequate aeration is provided.. Records
of this maintenance shall be maintained by the permittee. .
12. The chlorine tablets used in the disinfection facility shall be of the kind and type specified in
the plans and specifications approved by the Di,,i111011.
REPORTINGMONITORING AND
1. Any monitoring deemed necessary by the Division of Environmental Management to insure
surface and ground water protection will be established and an acceptable sampling
reporting schedule shall be followed.

The effluent pH shall not be less than 6.0 standard units nor greater than 9.0 standard
units.

3. Three (3) copies of all effluent monitoring data (as specified in condition 111 2) on Form
NDMR-1 shall be submitted on or before the last day of April, August, and December. All
information shall be submitted to the following address:

4. A record shall be maintained of all residuals removed from this facility. The record shall
:include the name of the hauler, the permit authorizing the disposal or a letter from a
municipality agreeing to accept the residuals, the date the residuals were hauled, and the
volume of residuals removed.
5. A maintenance log shall be maintained at this facility including, but not limited to, the
following items:
a. Daily sampling results including residual chlorine-. cPttler{hle mrttt(-r •�nrl di'NOI OO
oxygen in the aeration basin and at the chu-ifier weir;
b. Visual observations of the plant attd plaltt site;
c. Record of preventative maintenance (changing of filters, adjusting belt tensions, alarm
testing, diffuser inspections and cleanings, etc.);
d. Date of calibration of flow measurement device;
e. Date and results of power interruption testing on alternate power supply; and
f. Dates fields were raked and arms inspected.
6. Noncompliance Notification:
The Permittee shall report by telephone to the Wilmington Regional Office, telephone
number (910) 395-3900, as soon as possible, but in no case more than 24 hours or on the
next working day following the occurrence or first knowledge of the occurrence of any of
the following:
a. Any occurrence at the wastewater treatment facility which results in the treatment of
significant amounts of wastes which are abnormal in quantity or characteristic, such as
the dumping of the contents of a basin or tank, the known passage of a slug of
hazardous substance through the facility, or any other unusual circumstances;
b. Any process unit failure, due to known or unknown reasons, that renders the facility
incapable of adequate wastewater treatment, such as mechanical or electrical fail tires of
pumps, aerators, compressors,
c. Any failure of a pumping station, sewer line, or treatment facility resulting in a by-pass
of all or any portion of the influent to such station or facility; or
d. Any time that self -monitoring information indicates that the facility is not in compliance
with its permit limitations.
Persons reporting such occurrences by telephone shall also file a written report in letter
form within 15 days following first knowledge of the occurrence. This report moist outline
the actions taken or proposed to be taken to ensure that the problem does not recur.
IV. GROUNDWATER REQUIREMENTS
1. Monitor wells 1, 2, 3, 4, and 5 shall be sampled every March, July, and November, for the
following parameters:

Water and Wastewater", 17th c.d., 1989
The measurement of water levels must be made prior to sampling for the remaining
parameters. The depth to water in each well shall be measured from the surveyed point on
the top of the casing.
The measuring points (top of well casing) of all monitoring wells shall be surveyed to
provide the relative elevation of the measuring point for each monitoring well.
If TOC concentrations greater than 10 mg/l are detected in any downgradient monitoring
well, additional sampling and analysis must be conducted to identify the individual
constituents comprising this TOC concentration. If the TOC concentration as measured in
the background monitor well exceeds 10 mg/l, this concentration will be taken to represent
the naturally occurring TOC concentration. Any exceedances of this naturally occurring
TOC concentration in the downgradient wells shall be subject to the additional sampling
and analysis as described above.
If any volatile organic compounds are detected by Method 6230D, or the equivalent Method
502.2, then the Wilmington Regional Office Groundwater Supervisor, telephone number
(910) 395-3900, must be contacted immediately for further instructions regarding any
additional follow-up analyses required. The results of all initial and follow-up analyses
must be submitted simultaneously.
The results of the sampling and analysis shall be sent to the Groundwater Scction, 1'cmiits
and Compliance Unit, P.O. Box 29578 Raleigh, N.C. 2-io2b-057ti on t-orn) U W -�9
[Compliance Monitoring Report Form] every April, August, and December.
2. Any additional groundwater quality monitoring, as deemed necessary by the Division, shall
be provided.
3. The COMPLIANCE BOUNDARY for the disposal system is specified by regulations in
15A NCAC 2L, Groundwater Classifications and Standards. The Compliance Boundary
for the disposal system constructed prior to December 31, 1983 is established at either (1)
500 feet from the waste disposal area, or (2) at the property boundary, whichever is closest
to the waste disposal area. An exceedance of Groundwater Quality Standards at or beyond
the Compliance Boundary is subject to immediate remediation action in addition to the
penalty provisions applicable under General Statute 143-215.6A(a)(1).
In accordance with 15A NCAC 2L, a REVIEW BOUNDARY is established around the
disposal systems midway between the Compliance Boundary and the perimeter of the
waste disposal area. Any exceedance of standards at the Review Boundary shall require
remediation action on the part of the permittee.

V . INSPECTIONS
1. Adequate inspection, maintenance, and cleaning shall be provided by the Permittee to
insure proper operation of the subject facilities.

or lead to the release of wastes to the environment, a threat to human health, or a nuisance.
The Permittee shall maintain an inspection log or summary including at least the date and
time of inspection, observations made, and any maintenance, repairs, or corrective actions
taken by the Permittee. This log of inspections shall be maintained by the Permittee for a
period of three years from the date of the inspection and shall be made available to the
Division of Environmental Management or other permitting authority, upon request.
3. Any duly authorized officer, employee, or representative of the Division of Environmental
Management may, upon presentation of credentials, enter and inspect any property,
premises or place on or related to the disposal site or facility at any reasonable time for the
purpose of determining compliance with this permit, may inspect or copy any records that
must be maintained under the terms and conditions of this permit, and may obtain samples
of groundwater, surface water, or leachate.
V I. GENERAL NDITI N
This permit shall become voidable unless the facilities are constructed in accordance with
the conditions of this permit, the approved plans and specifications, and other supporting
data.

3. This permit is not transferable, In the event there is a desire for the facilities to change
ownership, or there is a name change of the Permittee, a formal permit request must be
submitted to the Division of Environmental Management accompanied by an application
fee, documentation from the parties involved, and other supporting materials as may be
appropriate. The approval of this request will be considered on its merits and may or may
not be approved.
4. The subject wastewater treatment and disposal facilities shall be connected to an operational
publicly owned wastewater collection system within 180 days of its availability to the
subject facilities, if the subject wastewater treatment or disposal facilities are in
noncompliance with the terms and conditions of this non -discharge permit or the governing
statutes or regulations. Prior to the initiation of these connection activities, appropriate
approval must be received from this Division.
5. The annual administering and compliance fee must be paid by the Permittee within thirty
(30) days after being billed by the Division. Failure to pay the fee accordingly may cause
the Division to initiate action to revoke this permit as specified by 15A NCAC 2H .0205
(c)(4).

accordance with North Carolina General Statute 1.43-215.6(a) to 143-215.6(c).
7. The issuance of this permit does not preclude the Permittee from complying wilh any and
all statutes, rules, regulations, or ordinances which may be imposed by other government
agencies (local, state, and federal) which have jurisdiction.
8. A set of approved plans and specifications for the subject project must be 3c�amcd D} u3C

9. The Permittee, at least six (6) months prior to the expiration of this permit, shall request its
extension. Upon receipt of the request, the Commission will review the adequacy of the
facilities described therein, and if warranted, will extend the permit for such period of time
and under such conditions and limitations as it may deem appropriate.

This AGREEMENT made pursuant to G.S. 143-215.1 (d 1) and entered into this first day of
January , 1996 , by and between the North Carolina Environmental Management
Commission, an agency of the State of North Carolina, hereinafter known as the COMMISSION; and
A PLACE AT THE BEACH -ATLANTIC BEACH III , a non-profit corporation organized and
existing under and by virtue of the laws of the State of North Carolina, hereinafter known as the ASSOCIATION.
WITNESSETH:
1. The ASSOCIATION was formed for the purpose, among others, of handling the property, affairs and
business of the development known as A PLACE AT THE BEACH - ATLANTIC BEACH III
(hereinafter the Development); of operating, maintaining, re -constructing and repairing the common elements .
of the lands and improvements subject to unit ownership, including the Disposal System; and of collecting
dues and assessment to provide funds for such operation, maintenance, re -construction and repair.
2. The ASSOCIATION desires, to construct and/or operate a wastewater collection system with pumps,
wastewater treatment works and/or disposal facilities (hereinafter Disposal System) to provide sanitary
sewage disposal to serve the Development on said lands.
3. The ASSOCIATION has applied to the COMMISSION for the issuance of a permit pursuant to G.S. 143-
215.1 to construct, maintain, and/or operate the Disposal System.
4. The Development was created subject to unit ownership in the dwellings units, other improvements and
lands through filing of a Declaration of Unit Ownership (hereinafter Declaration), pursuant to Chapter 47C
of the North Carolina General Statutes.
5. The COMMISSION desires to assure that the Disposal System of the Development is properly constructed,
maintained and operated in accordance with law and permit provisions in order to protect the quality of the
waters of the State and the public interest therein.
NOW, THEREFORE, in consideration of the promises and the benefits to be derived by each of the parties
hereto, the COMMISSION and ASSOCIATION do hereby mutually agree as follows:
1. The ASSOCIATION shall construct the Disposal System and/or make any additions or modifications to the
Disposal System in accordance with the permit and plans and specifications hereafter issued and approved
by the COMMISSION; and shall thereafter properly operate and maintain such systems and facilities in
accordancelua applicaule rermnit provisions and ia►:.
2. The ASSOCIATION shall provide in the Declaration and Association Bylaws that the Disposal system and
appurtenances thereto are part of the common elements and shall thereafter be properly maintained and
operated in conformity with law and the provisions of the permit for construction, operation, repair, and
maintenance of the system and facilities. The Declaration and Bylaws shall identify the entire wastewater
treatment, collection and disposal system as a common element which will receive the highest priority for
expenditures by the Association except for Federal, State and local taxes, and insurance.
3. The ASSOCIATION shall provide in the Declaration and Association Bylaws that the Disposal System will
be maintained out of the common expenses. In order to assure that there shall be funds readily available to
repair, maintain or construct the Disposal System, beyond the routine operation and maintenance expenses,
the Declaration and Association Bylaws shall provide that a fund be created out of the common expenses.
Such fund shall be separate from the routine maintenance allocated for the facility and shall be part of the
yearly budget.
4. In the event the common expense allocation and separate fund(s) are not adequate for the construction,
repair, and maintenance of the Disposal System, the Declaration and Association Bylaws shall provide for
special assessments to cover such necessary costs. There shall be no limit on the amount of such
assessments, and the Declaration and Bylaws shall be provided such that special assessments can be made as
necessary at any time.
5. If a wastewater collection system and wastewater treatment and/or disposal facility provided by any city,
town, village, county, water and sewer authorities, or other unit of government shall hereinafter become
available to serve the Development, the ASSOCIATION shall take such action as is necessary to cause the
existing and future wastewater of the Development to be accepted and discharged into said governmental
system; and shall convey or transfer as much of the Disposal System, and such necessary easements as the
governmental unit may require as condition of accepting the Development's wastewater.
6. Recognizing that it would be contrary to the public interest and to the public health, safety and welfare for
the ASSOCIATION to enter into voluntary dissolution without having made adequate provision for the
continued proper maintenance, repair and operation of its Disposal System, the ASSOCIATION shall
provide in the ASSOCIATION Bylaws that the ASSOCIATION shall not enter into voluntary dissolution
without first having transferred' its said system and facilities to some person, corporation or other entity
acceptable to and approved by the COMMISSION by the issuance of a permit.
7. The e SUKTATION shall not uransfer, Co:2`.'ey, asS:bT: cr ether :::se relinquish or release its re pv^nslbillty
for the operation and maintenance of its Disposal System until a permit has been reissued to the
ASSOCIATION's successor.
8. The agreements set forth in numbered paragraphs 1, 2, 3, 4, 5, 6, and 7 above shall be conditions of any
permit issued by the COMMISSION to the ASSOCIATION for the construction, maintenance, repair and
operation of the Disposal System.
9. A copy of this agreement shall be filed at the Register of Deeds in the County(ies) where the Declaration is
filed and in the offices of the Secretary of State of North Carolina with the Articles of Incorporation of the
Association.

A004 DEFINITIONS
The following definitions shall apply throughout this Subchapter.
(1) Activated Carbon Beds. A physlcallchemical method for reducing soluble organic material from wastewater effluent; The column -type beds used in this
method will have a flow rate varying from two to eight gallons per minute per square toot and may be either upflow or downflow carbon beds. Carbon may or
may not be regenerated on the wastewater traatmart plant site;
(2) Aerated Lagoons. A basin In which all soiids are maintained In suspension and by which biological oxidation or organic matter Is reduced through artificially
accelerated transfer of oxygen on a flow -through basis;
(3) Aeration. A process of bringing about intimate contact between air or high purity oxygen in a liquid by spraying, agitation or dlffuslon;(3a) Extended
Aeration. An activated sludge process utilizing a minimum hydraulic detention lime of 18 hours.
(4) Agricufturally managed she. Any she on which a crop Is produced, managed, and harvested (Crop includes grasses, grains, trees, etc.);
(5) Air Stripping. A process by which the ammonium Ion is first converted to dissolved ammonia (pH adjustment) with the ammonia then released to the
atmosphere by physical means; or other similar processes which remove petroleum products such as benzene, toluene, and xylene;
(6) Carbon Regeneration. The regeneration of exhausted carbon by the use of a furnace to provide extremely high temperatures wtllch volatilize and oxidize the
absorbed Impurilles;
V) Carbonaceous Stage. A sbage of wastewater treatment designed to achieve "secondary' effluent llmfts;
(8) Centrifuge. A mechanical device In which centrifugal farce is used to separate solids from liquids or to separate liquids of different dens-rias;
(9) Chemical Addition Systems- The addition of chemlcal(s) to wastewater at an application point for purposes of Improving solids removal, pH adjustment,
alkalinhy control, etc.; the capability to experiment with different chemicals and different application points to achieve a specffk result will be considered one
,ystem; the capability to add chemical(s) to dual units will be rated as one system; capability to add a chemical at a different appllcWlon points for different
,)urpcses will result In the systems being rated as separate systems;
(10) Chemical Sludge Conditioning. The addition of a chemical compound such as lime, ferric chloride, or a polymer to wet sludge to coalesce the mass prior to
Its application to a dewatering device;
(11) Closed Cycle Systems. Use of holding ponds or holding tanks for containment of wastewater containing Inorganic, non -toxic materials from sand, gravel,
crushed stone or other similar operations. Such systems shall carry a maximum of two points regardless of pumping facilhles or any other appurtenances;
(12) Combined Removal of Carbonaceous BOD and Nitrogenous Removal by Nitrification- A single stage system required to achieve permit effluent limits on BOD
and ammonia nitrogen within the same biological reactor;
(13) Dechlorination, The partial or complete reduction of reslduaJ chlorine in a liquid by any chemical or physcai process;
(14) Denitriliration Process. The conversion of nitrate -nitrogen to nitrogen gas;
