State issued permit number WQ0003919 requires the Pathogen and Vector attraction be preformed in accordance with 40 CFR 503. This requirement is contained in section I. 11. of the state issued permit. `y The following vio]aY tiff permit number WQ0003919 have been noted. • Vector Attraction Reduction: The submitted 1997 Annual Report contains SOUR test results performed by Burlington Research, Work Order #: 7L505-005, dated 12/17/97 reported as 6.0 mg/02/Hour. 40 CFR 503.33(b)(4) states that" the specific oxygen uptake rate (SOUR) for [biosolids] treated in an aerobic process shall be equal to or less than 1.5 mg 02/hour/gm of total solids." • Pathogen and Vector Attraction Compliance Schedule: Permit condition I11.6. requires quarterly monitoring for pathogen and vector attraction compliance. The submitted data contains monitoring during the fourth quarter of 1997 only. During a meeting on November 23, 1998; between Kevin Barnett (DWQ), Joe Pearce (DWQ), Chuck Cauley (Kinston), Henry McLean (Kinston), and Chris Hill (Kinston); the Division of Water Quality requested additional information regarding biosolids stabilization. No additional information for the 1997 year has been received. Additionally, you have failed to demonstrate compliance with the pathogen reduction requirements. The submitted 1997 Annual Report contains Fecal Coliform test results performed by Burlington Research, Work Order #: 7J766-004 and 7J766-005, dated 11/7/97 reported as 2,000,000 CFU/g Dry. 40 CFR 503.32(2)(i) requires seven samples be taken and 40 CFR 503.32(2)(h) requires that the geometric mean of the density of fecal coliform in the samples be less than 2,000,000 CFU / gram of total solids (dry weight basis). No geometric mean calculations was reported as part of the 1997 annual report. You are hereby notified that these biosolids produced during calender year 1997 did not meet the proof of pathogen and vector attraction required by permit condition I. 11. and were land applied in violation of state permit number WQ0003919. You must respond within 15 days as to this non-compliance situation. Please reference the state issued Permit Number when providing the requested information. The following is a clarification of the Notice of Violation. The submitted 1997 Annual Report contains residual data Reference Number: 97 4009. This sample was taken on October 23, 1997 and received the same day at PAR Laboratories. This sample was not tested for SOUR until November 04, 1998. The holding time stated in EPA/625/R-92/013; Control of Pathogens and Vector Attraction in Sewage Sludge is 1 (one) hour. The Division of Water Quality recognizes that Troy is currently working on alternatives to meeting the requirements of 40 CFR 503.33. The following clarifications of violations of permit WQ0003945 should be addressed. 1. Sampling Requirements: Permit condition 11I. 4. requires quarterly sampling for metals and nutrients. 2. Pathogen Reduction Documentation: 40 CFR 503 Appendix B. requires that [residuals be] agitated with air or oxygen to maintain aerobic conditions for a specific mean cell residence time at a specific temperature. Values for the mean cell residence time and temperature shall be between 40 days at 20 degrees Celsius and 60 days at 15 degrees Celsius. Data to show compliance must be calculated and compiled quarterly as required by the permit. SOUR Documentation: 40 CFR 503.33(b)(4) requires that the SOUR for [residuals] treated in an aerobic process be less than 1.5mg/hour/gram of total solids. 4. Pathogen and Vector Attraction Monitoring Requirements: Permit requirement III. 6. requires that the residuals land applied be tested quarterly for Pathogen and Vector Attraction as required by 40 CFR 503.32(b) and 40 CFR 503.33. 5. Certification Form: The state supplied form Annual Land Application Certification Form (DEM FORM CF (10/94)) must be included with the land application report. It is my understanding that a potential retail tenant proposes to use a total of 57,000 square feet for a retail flea market operation- The flea market will include use of existing restroom facilities for that area, with no additional restroom facilities being added. I have reviewed the evaluation of potential wastewater volume to be generated from the flea market that was included in your January 5, 1999 notification. Based on the historical flow data, and the flea market information included in the evaluation, I am in agreement that the operation of the proposed flea market is compatible with the permitted wastewater disposal facilities at the site- The wastewater generated from the flea market is acceptable for disposal facilities under a pump and haul permit for the site as well, should that be the method of domestic wastewater disposal at the time the flea market begins operation. The acceptability of the permitted wastewater disposal system for wastewater generated from the proposed flea market is based on the flea market as described in the January 5, 1999 wastewater flow evaluation- This approval does not preclude the Permittee from complying with any and all statutes, rules, regulations, or ordinances which may be imposed by other government agencies (local, state, and federal) which have jurisdiction.
