By this letter we are forwarding herewith a modified Attachment B, certified August 6, 2009, to the City
of Newton for the subject residuals land application program for the City's wastewater treatment plant.
This certification is being issued to modify the existing Attachment B to remove the Turbyfill land
application site (NC-CA-35 fields 1, 2a, 2b, 2c, 3a, and 3b) and transfer them -to another program by the
owner's request. A copy of the request is attached, along with the newly certified attachment B for the subject
permit.
Please replace the existing Attachment B of Permit No. WQ0003902 with this Attachment B
dated August 6, 2009. It is the Permittee's responsibility to ensure that a complete permit is created, by
inserting this modified Attachment B and removing the vicinity and buffer maps for the transferred fields from
Permit No. WQ0003902. Please be sure to retain any vicinity and buffer maps for any existing and unmodified
land application sites. This permit expires May 31, 2011.
This modified Attachment B shall be effective from the date of certification; shall void Attachment B of
Permit No. WQ0003902, that was previously certified, and shall be subject to the conditions and limitations as
specified therein and well as those specified in the above -referenced permit. As always, remember to take the
time to review this modified Attachment B thoroughly, as some of the conditions contained therein may
have been changed since the last certification. Note that this modified Attachment B is hereby incorporated by
reference into Permit No. WO0003902, issued on June 1, 2006.

unacceptable, you have the right to request an adjudicatory hearing upon written request within 30 days
following receipt of the certification. This request shall be in the from of a written petition, conforming to
Chapter 150E of the North Carolina General Statutes and filed with the Office of Administrative Hearings at
6714 Mail Service Center, Raleigh, North Carolina 27699-6714. Unless such demands are made, this permit
shall be final and binding.

Enclosed please find my letter to Wilce Martin, Public Works Director for NevIon NC, requestin"T
withdrawal from their lazed application program.
I, also, signaled our intention to procure solid waste from the Lincolnton plant.
The bureaucratic process for transitioning to Lincolnton's prograin is a mystery to me. However, I
assume that Synagro will assist me with that process.

With crude oil prices exliloding, and consequent radical inflation of fertilizer prices, we were gratetiil
to have saved so substantially.
RecentIv. I began a review of our farm practices which included a study of the soil -test results from past
years. along with a thorough investigation of recommendations for supplementing soil to achieve
optin3um prodUCtion- Ibifottunately, data, from recent soil test reports, indicate an unsatisfactory rise
in the Ph of soils treat ca with sludge from your facility.
Consultation i ith otli«r larin businesses and agribusiness consultants has revealed the a�,ailability of
non lithe -stabilized sludge at the Lincolnton facility that would accommodate our needs more equitably
at this time.
Consequently, the owners of this property have decided to request withdrawal of our F}roperty (Site#
NC-CA-35-, NeN tot? Laud Application Permit No. WQ0003902) from the Newton land application
program, effective as of Lhis date.

Per the enclosed letters to the City of Newton NC and NCDENR IWater Quality in Mooresville; please
initiate, at your discretion; the process for acquiring solid waste from the Lincolnton facility.
As you will recall, no land application occurred during the calender year 2008 — while we accessed
other options for disposition of the property. So, we are anxious to resume application at the earliest
feasible time.
We have a new lessee that will maintain the current cross fencing as is (for now). so previously mapped
application areas will not be affected — old maps still apply.
We look forward to continuing our synergistic relationship with Synagro during 2009 and beyond.
