PERFORMANCE STANDARDS 1. The reclaimed water utilization facilities shall be effectively maintained and operated at all times so that there is no discharge to the surface waters, nor any contamination of ground waters, which will render them unsatisfactory for normal use. In the event that the facilities fail to perform satisfactorily, including the creation of nuisance conditions or failure of the irrigation area to adequately assimilate the wastewater, the Permittee shall take immediate corrective actions including those actions that may be required by the Division of Water Quality (Division), such as the construction of additional or replacement wastewater treatment and disposal facilities. 2. The issuance of this permit shall not relieve the Permittee of the responsibility for damages to surface water or ground water resulting from the operation of this facility. 3. The residuals generated from these treatment facilities must be disposed in accordance with General Statute 143-215.1 and in a manner approved by the Division. 4. Diversion or bypassing of the untreated wastewater from the treatment facilities is prohibited. 5. The following buffers shall be maintained for the Creekside Park site: a) 0 feet between wetted area and any residence or places of public assembly under separate ownership, b) 0 feet between wetted area and property lines, c) 100 feet between wetted areas and water supply wells, d) 100 feet between wetted areas and drainageways or surface water bodies classified SA, including wetlands as delineated and designated by the appropriate state or federal agency, and e) 25 feet between wetted areas and drainageways or surface water bodies not classified SA, including wetlands as delineated and designated by the appropriate state or federal agency, or any swimming pool. Some of the buffers specified above may not have been included in previous permits for this waste treatment and disposal system. These buffers are not intended to prohibit or prevent modifications, which are required by the Division, to improve performance of the existing treatment facility. These buffers do, however, apply to modifications of the treatment and disposal facilities which are for the purpose of increasing the flow that is tributary to the facility. These buffers do apply to any expansion or modification of the spray irrigation areas and apply in instances in which the sale of property would cause any of the buffers now complied with, for the treatment and disposal facilities, to be violated. The applicant is advised that any modifications to the existing facilities will require a permit modification.. 2 6. The owner of all houses, buildings or properties used for human occupancy, employment, recreation, or other purposes, situated within the Township and abutting on any street, alley, or right-of-way in which there is now located or may in the future be located a public sanitary sewer of the City of New Bern, is hereby required (at the owner(s)' expense) to connect such facilities directly with the proper pubic sewer should the existing nitrification field fail. Application to the City of New Bern shall be made within thirty days and connection to the public sewer shall be completed within ninety days after the date of official notification by the City of New Bern to do so, provided that said public sewer is within reasonable access of the property line 7. The influent splitter box weir elevations shall be set so that no more than 1.5 times the average daily flow is sent to the aeration basins The existing influent booster pump station #1 must be upgraded to provide for a pump capacity of 900 GPM with one pump out of service when the average daily flow for any one month reaches 374,000 GPD 9.
