In accordance with your application received April 16, 2002, we are forwarding herewith Permit Number. WQ0003765, dated October 10, 2002, to City of New Bern for the continued operation of the subject wastewater treatment reclaimed water utilization system. The permit is being issued to acknowledge the change of ownership of the wastewater treatment system. Please note the renaming of the existing irrigation fields to reflect current record keeping practices. Please specifically note the renaming of the soccer fields. It is essential that all future record keeping 'identify the irrigation fields as identified in this permit. This permit shall be effective from the date of issuance until September 30, 2007, shall void Permit No. WQ0003765 issued May 30, 1997, and shall be subject to the conditions and limitations as specified therein. Please pay particular attention to the monitoring requirements in this permit. Failure to establish an adequate system for collecting and maintaining the required operational information will result in future compliance problems. If any parts, requirements, or limitations contained in this permit are unacceptable, you have the right to request an adjudicatory hearing upon written request within thirty (30) days following receipt of this permit. NC 27699-1617 Internet http:/fh2o.cnr.nc.state.us/ndpu 'telephone (919)733-5083 Fax (919)715-6048 DENR Customer service Center 'telephone 1 800 623-7748 17 NCl EN.=Z NORTH CAROLINA ENVIRONMENTAL MANAGEMENT COMMISSION DEPARTMENT OF ENVIRONMENT AND NATURAL RESOURCES RALEIGH WASTEWATER TREATMENT AND RECLAIMED WATER UTILIZATION PERMIT In accordance with the provisions of Article 21 of Chapter 143, General Statutes of North Carolina as amended, and other applicable Laws, Rules, and Regulations PERMISSION 1S HEREBY GRANTED TO City of New Bern Craven County FOR THE continued operation of a wastewater collection system consisting of the routine maintenance of the septic tank effluent pump (STEP) units which are connected to this system along with the associated tanks, pumps, high water alarms, connections, valves, cleanouts, and appurtenances, booster lift stations Nos. 1, 2, 3, 4, and 5 with dual 650 GPM, 310 GPM, 400 GPM, 373 GPM, and 110 GPM submersible pumps, respectively, with approximately 5,128 linear feet of 4-inch force main, approximately 3,994 linear feet of 6-inch force main, approximately 8,778 linear feet of 8-inch force main, approximately 11,900 linear feet of 10-inch force main, and' approximately 824 linear feet of 12-inch force main, nineteen (19) cleanouts, twenty-one (21) gate valves and boxes; and continued operation of a 0.515 MGD reclaimed wastewater irrigation facility to include a 1.6 million gallon aerated equalization basin with dual 900 SCFM, 15 hp blowers; an equalization pump station with dual 300 GPM pumps; dual 260,000 gallon aeration basins each with a 25 hp mechanical aerator; an aeration basin pump station with two 400 GPM pumps and one 800 GPM pump; dual 31 foot diameter clarifiers; a 198 square feet traveling bridge filter with standby pumps, motors and blowers; a dual channel chlorine contact tank with dual calcium hypochlorite mixing and feed facilities; continuous turbidity monitoring and recording; autodialer alarm system; ultrasonic effluent flow measuring; a 860,000 aerobic digester with dual 25 Hp mechanical aerators; a five-day side stream storage pond; approximately 15,325 linear feet of eight inch effluent force main; a 260,000 gallon steel reclaimed water storage tank, and two fixed nozzle spray irrigation fields with a total wetted area of 109 acres consisting of a pump station with dual 1900 GPM pumps and a 20 GPM pressure maintenance pump, approximately 1100 linear feet of 12 inch manifold, approximately 3600 linear feet of 10-inch manifold, approximately 4500 linear feet of 8-inch manifold, approximately 7600 linear feet of 4-inch irrigation pipe, approximately 3800 linear feet of three inch irrigation pipe, approximately 28,000 linear feet of two inch irrigation pipe, approximately 2500 linear feet of one inch riser pipe, 425 - 12 GPM sprinkler heads, 14 - 8 GPM sprinkler heads, 14 - 13.5 GPM sprinkler heads, planting six acres of buffer and 109 acres of spray fields, a reclaimed water pump stateion with dual 30 hp, 250 gpm pumps and approximately 6000 linear feet of 6-inch force main to serve Creekside Park, and a 125 kW standby generator with automatic transfer switch; and associated appurtenances, site and electrical work, and the continued operation of the existing 45 day storage lagoon and effluent chlorination facilities, dual 1000 GPM, vertical turbine irrigation pumps with approximately 11,925 linear feet of force main, two fixed nozzle spray irrigation fields with 1,091,178 square feet and 564,538 square -feet, respectively, and a Iinear move spray irrigation system with a wetted area of 2,921,250 square feet, approximately 1170 Iinear feet of two inch water line and all associated piping, valves, and appurtenances to serve the New Bern Seven Water Reclamation Facility (previously the Neuse Water and Sewer District) Nvith no discharge of wastes to the surface waters, pursuant to the application received April 16, 2002 and in conformity with the project plan, specifications, and other supporting data subsequently filed and approved by the Department of Environment and Natural Resources and considered a part of this permit. This permit shall be effective from the date of issuance until September 30, 2007, shall void Permit No. WQ0003765 issued May 30, 1997, and shall be subject to the following specified conditions and limitations: I. PERFORMANCE STANDARDS 1. The treatment and irrigation shall be effectively maintained and operated at all times so that there is no discharge to the surface waters, nor any contamination of ground waters which will render them unsatisfactory for normal use. In the event that the facilities fail to perform satisfactorily, including the creation of nuisance conditions or failure of the irrigation area to adequately assimilate the wastewater, the Permittee shall take immediate corrective actions including those actions that may be required by the Division of Water Quality (Division), such as the construction of additional or replacement wastewater treatment and disposal facilities. 2. The issuance of this permit shall not relieve the Permittee of the responsibility for damages to surface or groundwaters resulting from the operation of this facility. 3. The residuals generated from these treatment facilities must be disposed in accordance with General Statute 143-215.1 and in a manner approved by the Division. 4. Diversion or bypassing of the untreated wastewater from the treatment facilities is prohibited. 5. The following buffers shall be maintained for the Arthur Farm and Reedy Branch sites and the Treatment Plant: a) 400 feet between wetted area and any residence or places of public assembly under separate ownership, b) 150 feet between wetted area and property lines, c) 100 feet between wetted areas and water supply wells, d) 100 feet between wetted areas and drainageways or surface water bodies, e) 50 feet between wetted areas and public right of ways, f) 100 feet between wastewater treatment units and wells, and g) 50 feet between wastewater treatment units and property lines. The followina buffers shall be maintained for Creekside Park site: a) 0 feet between wetted area and any residence or places of public assembly under separate ownership, b) 0 feet between wetted area and property lines, c) 100 feet between wetted areas and water supply wells, d) 100 feet between wetted areas and drainageways or surface water bodies classified SA, including wetlands as delineated and designated by the appropriate state or federal agency, and e) 25 feet between wetted areas and drainageways or surface water bodies not classified SA. including wetlands as delineated and designated by the appropriate state or federal agency, or any swimming pool. Some of the buffers specified above may not have been included in previous permits for this waste treatment and disposal system. These buffers are not intended to prohibit or prevent modifications, which are required by the Division, to improve performance of the existing treatment facility. These buffers do, however, apply to modifications of the treatment and disposal facilities which are for the ; purpose of increasing the flow that is tributary to the facility. These buffers do apply to any expansion or modification of the spray irrigation areas and apply in instances in which the sale of property would cause any of the buffers now complied with, for the treatment and disposal facilities, to be violated. The applicant is advised that any modifications to the existing facilities will require a permit modification. b. The owner of all houses, buildings or properties used for human occupancy, employment, recreation, or other purposes, situated within the Township and abutting on any street, alley, or right-of-way in which there is now located or may in the future be located a public sanitary sewer of the City of New Bern, is hereby required (at the owner(s)' expense) to connect such facilities directly with the proper pubic sewer should the existing nitrification field fail. Application to the City of New Bern shall be made within thirty days and connection to the public sewer shall be completed within ninety days after the date of official notification by the City of New Bern to do so, provided that said public swere is within reasonable access of the property line. 7. The influent splitter box weir elevations shall be set so that no more than 1.5 times the average daily flow is sent to the aeration basins. The existing influent booster pump station #1 must be upgraded to provide for a pump capacity of 900 GPM with one pump out of service when the average daily flow for any one month reaches 374,000 GPD. 9. The existing abandoned eight inch water line may be used as a portion of the reclaimed water effluent line subject to the following conditions: a) The line shall be tested to insure zero leakage, and b) The City of New Bern shall provide written assurances that no sewer taps shall be made to this line. 10. The sprinkler systems at Creekside park shall be maintained in accordance with 15A NCAC 2H .0219(k)(1)(D). 11. The storage lagoon shall be chlorinate to attain at least a 1.0 mg/1 chlorine residuals throughout the lagoons and maintain a chlorine residual for a minimum of 24 hours prior to the initial irrigation of the Creek -side Park. 11. OPERATION AND MAINTENANCE REQUIREMENTS 1. The facilities shall be properly maintained and operated at all times. 2. Upon classification of the wastewater treatment and spray irrigation facilities by the Water Pollution Control System Operators Certification Commission ()XPCSOCC), the Permittee shall designate and employ a certified operator to be in responsible charge (ORC) and one or more certified operator(s) to be back-up ORC(s) of the facilities in accordance with 15A NCAC 8G .0201. The ORC shall visit the facilities in accordance with 15A NCAC SG .0204 or as specified in this permit and shall comply with all other conditions specified in these rules. A suitable, year-round vegetative cover shall be maintained on the irrigation areas. 4. I rig,ation shall not be performed during inclement weather or when the ground is in a condition that will cause runoff. 5. Adequate measures shall be taken to prevent wastewater runoff from the spray field. 6. The facilities shall be effectively maintained and operated as a non -discharge system to prevent the discharge of any wastewater resulting from the operation of this facility. 7. The application rates on the spray irrigation fields shall be limited as follows: Arthur Farm Site Field No. 1 25.05 Acres - The Northern most fixed nozzles beginning at hydrant No. 3 and extending north to include a total of40 fixed nozzles shall be limited to 62.4 inches over any twelve (12) month period. Field No. IA 16.47 Acres - The linear move system spray irrigation field from the Northern most point to the point halfway between hydrant No. 2 and No. 3 shall be limited to 62.4 inches over any twelve (12) month period. Field No. 2 12.96 Acres - The existing fixed nozzles in old Field No. 2 to include a total of 22 fixed nozzles shall be Iimited to 39.0 inches over any twelve (12) month period. Field No. 2A 15.29 Acres - The linear move system spray irrigation field beginning at hydrant No. 5 and extending to the Southern most point of the expanded linear move system spray irrigation field shall be limited to 39.0 inches over any twelve (12) month period. Field No. 3 35.30 Acres - The linear move system spray irrigation field beginning halfway between hydrant No. 2 and No. 3 then extending south to hydrant No. 5 shall be limited to 31.2 inches over any twelve (12) month. period. Reedv Branch Site - North Field Zone 1 14.40 Acres - The fixed nozzles at the extreme north end of the area north of the subdividing tributary of Reedy Branch consisting of Norfolk & Candor soils to include a total of 52 fixed nozzles shall be limited to 52.1 inches over any twelve (12) month period. Zone 2 13.00 Acres - The fixed nozzles in the balance of the area north of the subdividing tributary of Reedy Branch consisting of Candor soils to include a total of 154 fixed nozzles shall be limited to 65.2 inches over any twelve (12) month period. Zone 3 13.00 Acres - The fixed nozzles in the balance of the area north of the subdividing tributary of Reedy Branch consisting of Candor soils to include a total of 154 fixed nozzles shall be limited to 65.2 inches over any twelve (12) month period. Zone 4 13.80 Acres - The fixed nozzles in the balance of the area north of the subdividing tributary of Reedy Branch consisting of Candor soils to include a total of 154 fixed nozzles shall be limited to 65.2 inches over any twelve (12) month period. Reedy Branch Site - South Field Zone 5 11.00 Acres - The fixed nozzles in the a portion of balance of the south of the subdividing tributary of Reedy Branch excluding the Goldsboro and Candor soils to include a total of 188 fixed nozzles shall be limited to 52.1 inches over any twelve (12) month period. Zone 6-A I.18 Acres - The fixed nozzles in the portion of Zone 6 consisting of Goldsboro soils along the west boundary to include a total of 14 fixed nozzles shall be limited to 31.7 inches over any twelve (12) month period. Zone 6-C 9.64 Acres - The fixed nozzles in a portion of the balance of the south of the subdividing tributary of Reedy Branch excluding the Goldsboro and Candor soils to include a total of 188 fixed nozzles shall be limited to 52.1 inches over any twelve (12) month period. Zone 7 .A 2.82 Acres - The fixed nozzles in the portion of Zone 7 consisting of Goldsboro soils along the west boundary to include a total of 14 fixed nozzles shall be limited to 31.7 inches over any twelve (12) month period. Zone 7-B 0.61 Acres - The fixed nozzles in the portion of Zone 7 consisting of Candor soils along the southeast boundary of the area south of the subdividing tributary of Reedy Branch to include a total of 14 fixed nozzles shall be limited to 65.2 inches over any twelve (12) month period. Zone 7-C 9.34 Acres - The fixed nozzles in a portion of the balance of the south of the subdividing tributary of Reedy Branch excluding the Goldsboro and Candor soils to include a total of 188 fixed nozzles shall be limited to 52.1 inches over any twelve (12) month period. Zone 8-B 1.91 Acres - The fixed nozzles in the portion of Zone 8 consisting of Candor soils along the southeast boundary of the area south of the subdividing tributary of Reedy Branch to include a total of 14 fixed nozzles shall be limited to 65.2 inches over any twelve (12) month period. Zone 8-C 10.90 Acres - The fixed nozzles in a portion of the balance of the south of the subdividing tributary of Reedy Branch excluding the Goldsboro and Candor soils to include a total of 188 fixed nozzles shall be limited to 52.1 inches over any twelve (12) month period. Zone 9-B 1.48 Acres - The fixed nozzles in the portion of Zone 9 consisting of Candor soils along the southeast boundary of the area south of the subdividing tributary of Reedy Branch to include a total of 14 fixed nozzles shall be limited to 65.2 inches over any twelve (12) month period. Zone 9-C 8.43 Acres - The fixed nozzles in a portion of the balance of the south of the subdividing tributary of Reedy Branch excluding the Goldsboro and Candor soils to include a total of 188 fixed nozzles shall be limited to 52.1 inches over any twelve (12) month period. Creekside Park Softball Fields 1. ? 3.4 0.72 Acres each - The fixed nozzles in the areas designated as softball fields 1.2, 3 and 4 to include 35 nozzles in each field shall be limited to 21 inches over any twelve month period. The instantaneous loading rate shall not exceed 0.57 inches per hour for a period not to exceed 15 minutes in any 60 minute period. Softball Fields 5.6. 7. 8 1.62 Acres each - The fixed nozzles in the areas designated as softball fields 5, 6, 7, and 8 to include 43 nozzles in each field shall be limited to 21 inches over any twelve month period. The instantaneous loading rate shall not exceed 0.57 inches per hour 'for a period not to exceed 15 minutes in any 60 minute period. Soccer Field 1 (Bach Field) 2.12 Acres - The fixed nozzles in the areas designated as soccer field 1 to include 35 nozzles in each field shall be limited to 21 inches over any twelve month period. The instantaneous loading rate shall not exceed 0.57 inches per hour for a period not to exceed 15 minutes in any 60 minute period. Soccer Field 2 (Weyerhaeuser Field 2.16 Acres - The fixed nozzles in the areas designated'as soccer field 2 to include 35 nozzles in each field shall be Iimited to 21 inches over any twelve month period. The instantaneous loading rate shall not exceed 0.57 inches per hour for a period not to exceed 15 minutes in any 60 minute period. Soccer Field 2 extension 0.91 Acres - The fixed nozzles in the areas designated as adjacent to soccer field 2 to include 15 nozzles in each field shall be limited to 21 inches over any twelve month period. The instantaneous loading rate shall not exceed 0.57 inches per hour for a period not to exceed 15 minutes in any 60 minute period. Soccer Field 3 (Sheraton Field 2.11 Acres - The fixed nozzles in the areas designated as soccer field 3 to include 35 nozzles in each field shall be limited to 21 inches over any twelve month period. The instantaneous loading rate shall not exceed 0.57 inches per hour for a period not to exceed 15 minutes in any 60 minute period. Soccer Field 3 extension. Archery Field 1 and Archery Field 2 0.76 Acres - The fixed nozzles in the areas designated as adjacent to soccer field 3 to include 4 nozzles in each field shall be limited to 21 inches over any twelve month period. The instantaneous loading rate shall not exceed 0.57 inches per hour for a period not to exceed 15 minutes in any 60 minute period. Soccer Field 4 (J.T. Thomas Field) 2.15 Acres - The fixed nozzles in the areas designated as soccer field 4 to include 35 nozzles in each field shall be limited to 21 inches over any twelve month period. The instantaneous loading rate shall not exceed 0.57 inches per hour for a period not to exceed 15 minutes in any 60 minute period. 8..-... No type of wastewater other than that from the New Bern Seven Township shall be sprayed onto the irrigation area. 9. Freeboard in the wastewater lagoon shall not be less than two feet at any time. 12. No traffic or equipment shall be allowed on the disposal area except while installation occurs or while normal maintenance is being performed. 13_ PubIic access to the land application sites shall be controlled during active site use. Such controls may include the pasting of signs showing the activities being conducted at each site. 14. The permittee shall take the appropriate actions necessary to reduce the impacts of sodium in the wastewater or in the soil to levels which are conductive to crop growth and maintenance of good soil structure_ 15. An agronomic plan shall be developed which maximizes the assimilative capacity of the nutrients in the wastewater through the crops to be grown, for crop rotation, etc. 16. If not already installed, a waste -level gauge, to monitor waste levels in the storage pond, shall be installed within 60 days of issuance of this permit. This gauge shall have readily visible permanent j markings indicating the maximum Iiquid level at the top of the temporary liquid storage volume, minimum liquid level at the bottom of the temporary liquid storage volume, and top of the dam elevations. Caution must be taken not to damage the integrity of the liner when installing the gauge. r, 17. A protective vegetative cover shall be established and maintained on all earthen basin embankments (outside toe of embankment to maximum pumping elevation), berms, pipe runs, erosion control areas, and surface water diversions. Trees, shrubs, and other woody vegetation shall not be allowed to grow on the earthen basin dikes or embankments. Earthen basin embankment areas shall be kept mowed or otherwise controlled and accessible. 18. All wastewater shall be routed to the five-day holding pond should the limit for fecal coliform (daily maximum concentration of 25 per 100 ml) or turbidity (instantaneous maximum of 10 NTU) be exceeded, until such time that the problems associated with the treatment capability of the wastewater treatment plant have been corrected. The wastewater in the five-day holding pond shall be pumped back to the treatment plant for retreatment or treated in the five-day pond prior to discharge to the storage pond. III. MONITORING AND REPORTING -REQUIREMENTS 1. Any monitoring (including groundwater, surface water, soil or plant tissue analyses) deemed necessary by the Division to insure surface and ground water protection will be established and an acceptable sampling reporting schedule shall be followed. Influent flow shall be continuously monitored and daily flow values shall be reported on Form NDMR. The Permittee shall install an appropriate flow measurement device consistent with approved engineering and scientific practices to ensure the accuracy and reliability of influent flow measurement. Flow measurement devices selected shall be capable of measuring flows with a maximum deviation of less than 10 percent from true flow, accurately calibrated at a minimum of once per year, and maintained to ensure that the accuracy of the measurements is consistent with the accepted capability of that type of device. Records of flow measurement device calibration shall be kept on file by the Permittee for a period of at least three years. At a minimum, data to be included in this documentation shall be: a. Date of flow measurement device calibration b. Name of person performing calibration c. Percent from true flow Plans and specifications for the flow measuring device shall be prepared by a licensed Professional Engineer and submitted to the appropriate regional office 30 days prior to installation. The flow measuring device shall be installed within 1 year of the date of this permit. Daily maximum shall be the maximum value of all samples collected during, the reporting period. During the remainder of the year, these parameters shall be monitored monthly. Triannually sampling shall be conducted during April, August, and December. If Groundwater sampling indicates or predicts problems with the compliance with Groundwater Standards, this permit will be modified to include additional and/or more restrictive limitations. Adequate records shall be maintained by the Permittee tracking the amount of wastewater disposed. These records shall include, but are not necessarily limited to the following information: a_ date and time of irrigation, b. volume of wastewater irrigated, c. zone irrigated, d. length of time zone is irrigated, e. continuous weekly, monthly, and year-to-date hydraulic (inches/acre) loadings for each zone, f. weather conditions, and g. maintenance of cover crops. 4. A representative soils analysis (Standard Soil Fertility Analysis) shall be, conducted in January and July on the spray irrigation fields. These analyses shall be representative of the entire irrigation area. The Standard Soil Fertility Analysis shall include, but is not necessarily limited to, the following parameters. Acidity Manganese Potassium Calcium Percent Humic Matter Sodium Copper pH Zinc Magnesium Phosphorus Base Saturation (by calculation) Cation Exchange Capacity Sodium Adsorption Ratio (by calculation) 5. Three (3) copies of all operation and disposal records (as specified in condition Ill 3) on Form NDAR-1, three (3) copies of all effluent monitoring data (as specified in condition III: 2) on Form NDMR-1 shall be submitted on or before the last day of the following month, and all soil analyses (as specified in condition 11I 4) shall be submitted on or before the last day of the following month. A record shall be maintained of all residuals removed from this facility. This record shall include the name of the hauler, permit authorizing the disposal or a letter from a municipality agreeing to accept the residuals, date the residuals were hauled, and volume of residuals reproved. 6. A maintenance log shall be maintained at this facility including but not limited to the following items: a. Daily sampling results including residual chlorine, settleable matter, and dissolved oxygen in the aeration basin and at the clarifier weir- b. Visual observations of the plant and plant site. c. Record of preventative maintenance (changing of filters, adjusting belt tensions, alarm testing, diffuser inspections and cleanings, etc.). d. Date of calibration of flow measurement device. e. Date and results of power interruption testing on alternate power supply. 7. Noncompliance Notification: The Pernaittee shall report by telephone to the Washington Regional Office, telephone number (252) 946-6481, as soon as possible, but in no case more than 24 hours or on the next working day following the occurrence or first knowledge of the occurrence of any of the following: a. Any occurrence at the wastewater treatment facility which results in the treatment of significant amounts of wastes which are abnormal in quantity or characteristic, such as the dumping of the contents of a sludge digester; the known passage of a slug of hazardous substance through the facility; or any other unusual circumstances. b. Any process unit failure, due to known or unknown reasons, that render the facility incapable of adequate wastewater treatment such as mechanical or electrical failures of pumps, aerators, compressors, etc. c. Any failure of a pumping station, sewer line, or treatment facility resulting in a by-pass directly to receiving waters without treatment of all or any portion of the influent to such station or facility. d. Any time that self -monitoring information indicates that the facility has gone out of compliance with its permit limitations. Persons reporting such occurrences by telephone shall also file a written report in Ietter form within five (5) days following first knowledge of the occurrence. This report must outline the'actions taken or proposed to be taken to ensure that the problem does not recur. IV. GROUNDWATER REQUIREMENTS 1. Monitor wells MW-4, MW-5, and MW-6 at the Arthur Farm Site; MW-7, MW-8, and MW-9 at the holding lagoons; and monitor wells MW-10, MW-I1, MW-12, MW-13, MW-14, MW-15, MW-16, MW-17, and MW-18 at the Reedy Branch Site shall be sampled every April, August, and December for the parameters listed below. Prior to sampling the parameters, the measurement of water levels must be taken. The depth to water in each well shall be measured from the surveyed point on the top of the casing. The measuring points (top of well casing) of all monitoring wells shall be surveyed relative to a common datum. Water Level pH Nitrate Nitrogen (NO -N) Total Ammonia Nitrogen (NH3-N) Chloride Sodium Iron Sulfate (SO4) TDS Fecal Coliforms TOC Volatile Organic Compounds (in December only) For Total Organic Carbon (TOC), if concentrations greater than 10 mg/l are detected in any down - gradient monitoring well, additional sampling and analysis must be conducted to identify the individual constituents comprising this TOC concentration. If the TOC concentration as measured in the background monitor well exceeds 10 mg/l, this concentration will be taken to represent the naturally occurring TOC concentration. Any ex.ceedances of this naturally occurring TOC concentration in the down -gradient wells shall be subject to the additional sampling and analysis as described above. Within sixty (60) days of permit issuance, groundwater samples shall be taken from monitor wells MW-12 and MW-15 at the Reedy Branch Site, and from locations adjacent to these wells by using a Hydropunch (or a similar method which is acceptable to the Groundwater Section) to sample the surficial. aquifer, for the parameters listed below. �l Nitrate Nitrogen (NO;-N) Chloride Iron TDS TOC Volatile Organic Compounds Total Ammonia Nitrogen (NH;-NT) Sodium Sulfate (SO4) Fecal Coliforms Holes made to sample the surficial aquifer shall be properly backfilled after sample procurement. For Volatile Organic Compounds (VOCs), use only one of the following methods: 1) Standard Method 6230D, Practical Quantitation Limit (PQL) at 0.5 ug/L or Iess _1 2) Standard Method 6210, PQL at 0.5 ug/L or Iess 3) EPA Method 8021, Low Concentration, PQL at 0.5 ug/L or less 4) EPA Method 8260, Low Concentration, PQL at 0.5 ug/L or less 5) Another method with prior approval by the Groundwater Section Chief. Any of the referenced methods used for VOCs must at a minimum, include all the constituents listed in Table VIII of Standard Method 6230D. Any method used must provide a PQL of 0.5 ug/L or less, which must be supported by laboratory proficiency studies as required by the DWQ Laboratory Certification Unit. Any constituents detected above the Method Detection Limit (MDL) but below the PQL of 0.5 ug/L must be qualified (estimated) and reported. Any laboratory selected to analyze parameters must be Division of Water Quality (DWQ) certified for those parameters required. 2. If the results of the sampling from monitor wells MW-12 and MW-15 are significantly different from those of the shallow aquifer sampling, all of the monitor wells at the Reedy Branch site (MW-10 through MW-18) must be replaced within sixty (60) days by wells with more shaIIow screen settings. The replacement wells shall be constructed such that the water level in each well is never above or below the screened (open) portion of the well at any time during the year. The wells must be constructed by either a North Carolina Certified Well Contractor, the property owner, or the property lessee according to General Statutes 87-98.4(b)(2). If the construction is not performed by a certified well contractor, the property owner or lessee must physically perform the actual well construction activities, and the wells must be constructed according to the North Carolina Well Construction Standards (15A NCAC 2C .0108) and the local county rules. The Washington Regional Office, telephone number (252) 946-6481, shall be notified at least forty- eight (49) hours prior to the construction of any monitoring well so that an inspection can be made of the monitoring well location. Such notification to the regional groundwater supervisor shall be made during the normal office hours from 8:00 a.m. until 5:00 p.m. on Monday through Friday, excluding state holidays. 4. All reports and documentation (GW-59) shall be mailed to the following address: Groundwater Section. Permits and Compliance Unit 1636 Mail Service Center Raleigh, NC 27699-1636 Updated blank forms (GW-59) may be downloaded from the Groundwater Section's website at hup.-Haw.ehar.state.nc.us/ or requested from the address mentioned above. 5. The results of the sampling and analysis must be received on Form GW-59 (Groundwater Quality Monitoring: Compliance Report Form) by the Groundwater Section (address listed in the "Reporting / Documentation" section of the Groundwater Requirements), on or before the last working day of the month following the sampling month. The data of all groundwater sampling analyses required by the permit conditions must be reported using the most recent GW-59 form along with attached copies of the laboratory analyses. 6. Waste application activities shall not occur when the vertical separation between depth of application and the water table is at less than three (3) feet. Verification of the water table elevation can be confirmed by water level readings obtained from the monitor well(s) near the site or auger boring(s), which must be done within 24 hours, prior.to application of wastewater. Any open borings must be properly filled with native soil, prior to application to decrease the chance of any waste contaminating the groundwater. 7. The COMPLIANCE BOUINTDARY and REVIEW BOUNDARY for the waste disposal area(s) is specified by regulations in 15A NCAC 2H, Waste Not Discharged to Surface Waters, specifically .0219(k)(1)(C)(i)(M). The Compliance Boundary and the Review Boundary for groundwater shall be - established at the property boundary. An exceedance. of Groundwater Quality Standards at or beyond the Compliance Boundary is subject to immediate remediation action according to 15A NCAC 2L .0106(d)(2). Any additional groundwater quality monitoring, as deemed necessary by the Division, shall be provided. V. INSPECTIONS Adequate inspection, maintenance, and cleaning shall be provided by the Permittee to insure proper operation of the subject facilities. The Permittee or his designee shall inspect the wastewater treatment and disposal facilities to prevent malfunctions and deterioration, operator errors and discharges which may cause or lead to the release of wastes to the environment, a threat to human health, or a nuisance. The Permittee shall keep an inspection log or summary including at least the date and time of inspection, observations made, and any maintenance, repairs, or corrective actions taken by the Permittee. This log of inspections shall be maintained by the Permittee for a period of three years from the date of the inspection and shall be made available upon request to the Division or other permitting authority. 3. Any duly authorized officer, employee, or representative of the Division may, upon presentation of credentials, enter and inspect any property, premises or place on or related to the disposal site or facility at any reasonable time for the purpose of determining compliance with this permit; may inspect or copy any records that must be maintained under the terms and conditions of this permit, and may obtain samples of groundwater, surface water, or leachate. VI. GENERAL CONDITIONS This permit shall become voidable unless the facilities are constructed in accordance with the conditions of this permit, the approved plans and specifications, and other supporting data. 2. This permit is effective only with respect to the nature and volume of wastes described in the application and other supporting data. 3. The Operational Agreement between the Permittee and the Environmental Management Commission is incorporated herein by reference and shall be a condition of this permit. Noncompliance with the terms of the Operational Agreement shall subject the Perminee to all sanctions provided by North Carolina General Statutes § 143-215.6A to § 143-215.6C for violation of or failure to act in accordance with the terms and conditions of this permit. 4. This permit is not transferable_ In the event there is a desire for the facilities to change ownership_ or there is a name change of the Perntittee, a formal permit request must be submitted to the Division accompanied by an application fee, documentation from the parties involved, and other supporting materials as may be appropriate. The approval of this request will be considered on its merits and may or may not be approved. 5. Failure to abide by the conditions and limitations contained in this permit may subject the Permittee to an enforcement action by the Division in accordance with North Carolina General Statute 143-215.6A to 143-215.6C. 6. The issuance of this permit does not exempt the Permittee from complying with any and all statutes, rules, regulations, or ordinances which may be imposed by other government agencies (local, state. and federal) which have jurisdiction, including but not limited to applicable river buffer rules in 15A NCAC 213.0200, erosion and sedimentation control requirements in 15A NCAC Chapter 4 and under the Division's General Permit NCG010000, and any requirements pertaining to wetlands under 15A NICAC 2B .0200 and 2H .0500. 7. A set of approved plans and specifications for the subject project must be retained by the Permittee for the life of the project. i The annual administering and compliance fee must be paid by the Permittee within thirty days after being billed by the Division. Failure to pay the fee accordingly may cause the Division to initiate action to revoke this permit as specified by 15 NCAC 2H .0205 (c)(4). 9. The Permittee, at least six (6) months prior to the expiration of this permit, shall request its extension. Upon receipt of the request, the Commission will review the adequacy of the facilities described therein, and if warranted, will extend the permit for such period of time and under such conditions and limitations as it may deem appropriate.
