Dear Mr. Rolan:
On March 30, 1993, the Division of Environmental Management issued Permit No. WQ0003329
to the City or Durham for the continued operation of a Cement Kiln Dust Sludge Stabilization Program.
Condition 111.5 of that permit required that all information required to meet the monitoring and reporting
requirements, as specified in conditions III.2, 111.3, and IIIA, be submitted to the Assistant Chief of
Operations. This condition is being administratively amended to change the address for the submittal of
this information and to establish a deadline of March 1 of each year for the submittal of this information.

This permit shall be effective sixty days from the date of issuance until June 30, 1994. All other
conditions and limitations as specified in Permit No. WQ0003329, issued March 30, 1993, are in full
force and effect. Please pay particular attention to the monitoring requirements in this permit. Failure to
establish an adequate system for collecting and maintaining the required operational information will result
in future compliance problems.
If this modification is unacceptable to you, you have the right to request an adjudicatory hearing on
the modified portion of this permit upon written request within 30 days following receipt of this permit.
This request must be in the form of a written petition, conforming to Chapter 150B of North Carolina
General Statutes, and filed with the Office of Administrative Hearings, P.O. Drawer 27447, Raleigh, NC
27611-7447. Unless such demands are made this permit modification shall be final and binding.

In accordance with an error brought to our attention on June 8, 1990, we are forwarding
this Permit No. WQ0003329 as amended to expire on November 25, 1990, to the City of Durham
for the operation of a Cement Kiln Dust Sludge Stabilization program.
This Permit shall be. effective from the date of issuance until November 25, 1990, and
shall be, subject to the conditions and limitations as specified therein. Please pay particular attention
to the monitoring requirements in this Permit. Failure to establish an adequate system for collecting
and maintaining the required operational information will result in future compliance problems.
Please be advised that this permit is only for the operation of the Cement Kiln Dust Stabilized
Sludge process and that land application, marketing or distribution is not approved without the
written permission of the Director of the Division of Environmental Management.
If any parts, requirements, or limitations contained in this Permit are unacceptable to you,
you have the right to request an adjudicatory hearing upon written request within 30 days
following receipt of this to Permit. This request must be in the form of a written petition,
conforming to Chapter 150B of North Carolina General Statutes, and filed with the Office of
Administrative Hearings, P.O. Box 11666, Raleigh, NC 27604. Unless such demands are made

In accordance with the provisions of Article 21 of Chapter 143, General Statutes of North
Carolina as amended, and other applicable Laws, Rules, and Regulations
PERMISSION IS HEREBY GRANTED TO

construction and operation of a 100 ton per day Cement Kiln Dust Sludge Stabilization Pilot
Program to serve the City of Durham pursuant to the request received March 28, 1990 and in
conformity with the project plan, specifications, and other supporting data subsequently filed and
approved by the Department of Environment, Health and Natural Resources and considered a part
of this permit.
This Permit shall be effective from the date of issuance until November 25, 1990, and shall
be subject to the following specified conditions and limitations:
I. PERFORMANCE STANDARDS
1. The Raleigh Regional Office, phone no. (919) 733-2314, shall be notified so that
an in-place inspection can be made prior to commencing operation of the Cement
Kiln Dust Stabilization process. Such notification to the regional supervisor shall be
made during the normal office hours from 8:00 a.m. until 5:00 p.m. on Monday
through Friday, excluding State Holidays.
2. In the event that the facilities fail to perform satisfactorily, including the creation of
nuisance conditions, the City of Durham shall take immediate corrective action,
including those as may be required by this Division.
II. OPERATION AND MAINTENANCEREOUIREMENTS
1. The Cement Kiln Dust Sludge Stabilization facilities shall be effectively maintained
and operated at all times in such a manner as to produce a product which will meet
the requirements of the Process to Further Reduce Pathogens.
111. MONITORING AND REPORTING REQUIREN NTS
1. Any monitoring deemed necessary by the Division of Environmental Management to
insure surface and ground water protection will be established and an acceptable
sampling reporting schedule shall be followed.
2. The City of Durham shall implement a monitoring program for the Cement Kiln Dust
Sludge Stabilization Program at the time of operation. This program shall include a
sludge analysis and EP Toxicity analysis to be conducted by the City of Durham and
the results maintained on file by the City of Durham through out the life of the pilot
program. The sludge analysis shall include but is not necessarily limited to the
following parameters:

daily samples shall be taken prior to processing, after initial mixing, and three
(3) days after initial mixing.
** Temperature measurements shall be taken at varying depths in the processed
sludge pile such that a representative temperature profile can be created to show
a uniform temperature of 52 degrees Celsius. The temperature measurements
shall be made initially after mixing, and for the first three days at intervals of
three (3) hours for the first twelve (12) hours after an initial uniform reading of
52 degrees Celsius occurs. After the first three days and for the duration of the
test the temperature shall be measured every twelve (12) hours after an initial
uniform reading of 52 degrees Celsius.
The sludge analysis shall be of a composite of all material processed for the first
thirty days unless otherwise stated. Note the testing frequency for percent total
solids, pH and temperature are not to be composite samples and shall be sampled as
outlined above.
The EP Toxicity analysis shall include the following parameters:
Arsenic
Barium
Cadriiium
Chromium
Lead
Mercury
Selenium
Silver
Endrin
Lindane
Methoxychlor
Toxaphene
2,4-D
2,4,5 -TP Silvex
The EP Toxicity test shall be performed with a daily composite of three (3) random
days for the first week of operation and thereafter monthly.

3. Three copies of all monitoring and reporting requirements as specified in conditions
III 2,shall be submitted to the Assistant Chief of Operations at the following address:

4. Noncompliance Notification:
The Permittee shall report by telephone to the Raleigh Regional Office, telephone no.
(919) 733-2314, as soon as possible, but in no case more than 24 hours or on the
next working day following the occurrence or first knowledge of the occurrence of
any of the following:
a_ Any occurrence at the cement kiln dust sludge stabilization facilities which
results in the treatment of significant amounts of sludge which are abnormal in
quantity or characteristics.
b. Any process unit failure, due to known or unknown reasons, that render the
facility incapable of adequate sludge stabilization such as mechanical or
electrical failures of equipment.
c. Any time that self-monitoring information indicates that the facility is not in
compliance with its permit limitations. Any occurrence of this shall cause the
stabilized sludge to be reprocessed so that the Process to Further Reduce
Pathogens can be met.
Persons reporting such occurrences by telephone shall also file a written report in
letter form within 15 days following first knowledge of the occurrence. This report
must outline the actions taken or proposed to be taken to ensure that the problem
does not recur.
IV. INSPECTIONS
1. Adequate inspection, maintenance, and cleaning shall be provided by the Permittee to
insure proper operation of the subject facilities.
2. The City of Durham or his designee shall inspect the cement kiln dust sludge
stabilization facilities to prevent malfunctions and deterioration, operator errors and
discharges which may cause or lead to the release of wastes to the environment, a
threat to human health, or a nuisance. The City of Durham shall keep an inspection
log or summary including at least the date and time of inspection, observations
made, and any maintenance, repairs, or corrective actions taken by the City of
Durham, This log of inspections shall be maintained by the Permittee for a period of
three years from the date of the inspection and shall be made available upon request
to the Division of Environmental Management or other permitting authority.

3. Any duly authorized officer, employee, or representative of the Division of
Environmental Management may, upon presentation of credentials, enter and
inspect any property, premises or place on or related to the disposal site and
facility at any reasonable time for the purpose of determining compliance
with this permit; may inspect or copy any records that must be kept under the terms
and conditions of this Permit; or may obtain samples of sludge, processed sludge,
groundwater, surface water, or leachate.
V. GENERAL CONDMONS
1. This Permit is subject to revocation unless the cement kiln dust
sludge stabilization facilities are operated in accordance with the conditions of this
Permit, the approved plans and specifications.
2. This Permit is effective only with respect to the nature and volume of wastes
described in the application and other supporting data.
3. The following facilities are approved sites for the operation of the Cement Kiln Dust
Sludge Stabilization Pilot Program:

t The maximum amount of cement kiln dust stabilized sludge shall not exceed
100 tons per day for both Farrington Road WWTP and Northside WWTP.
This maximum production rate is based on the use of only 1 processing unit
serving both facilities.
4. Failure to abide by the conditions and limitations contained in this Permit may
subject the Permittee to an enforcement action by the Division of Environmental
Management in accordance with North Carolina General Statute 143-215.6.
5. The issuance of this Permit does not preclude the Permittee from complying with any
and all statutes, rules, regulations, or ordinances which may be imposed by other
government agencies (local, state, and federal) which have jurisdiction.
6. No Cement Kiln Dust Stabilized Sludge shall be land applied without
written authorization from the Director of Environmental Management,
Cement Kiln Dust Stabilized Sludge may be disposed of at a sanitary landfill
following approval from the Division of Solid Waste Management.
7. Within thirty (30) days of permit issuance the Permittee shall submit a map of the
areas which are within WS -1 water sheds for the counties surrounding Durham
County and including Durham County (the map should include landmarks such as
state roads for the boundaries of the WS -1 watersheds); these areas will be
prohibited from the application area of the Cement Kiln Dust Stabilized Sludge.
Also a marketing plan which specifically outlines suggested application rates, limits
the quantity to be applied per site based on heavy metal concentrations, areas in
which the application of the Cement Kiln Dust Stabilized Sludge is prohibited, and
