DOUGLAS W. GOODwrN — HATCHERY MANAGER
OMTRON USA, LLC _
POST OFFICE Box 709
SILER CiTy, NORTH CAROLINA 27344
Dear Mr. Goodwin:
Dee Freeman
Secretary
Subject: Permit No. WQ0002428
Townsends Hatchery
Wastewater Irrigation System
Chatham County
In accordance with your permit change of ownership request received March 16, 2011, and
subsequent additional information received April 8, 2011, we are forwarding herewith Permit No.
WQ0002428 dated April 15, 2011, to Omtron USA, LLC for the continued operation of the subject
wastewater treatment and irrigation facilities.
Please note the Permittee has been changed from Townsend Farms, Inc. to Omtron USA, LLC.
On August 5, 2009, Session Law 2009-406, entitled "An Act to Extend Certain. Government
Approvals Affecting the Development of Real Pr-operty Within the State," was enacted by the General
Assembly and signed into law. The Act, known as the Permit Extension Act of 2009, extends the
expiration date of certain government approvals and permits. On August 2, 2010, this Act was extended
an additional year. The subject permit falls within the scope of this Act and is therefore being
extended to October 31, 2015.
This permit shall be effective from the date of issuance until October 31, 2015, shall void Permit
No. WQ0002428 issued November 21, 2006, and shall be subject to the conditions and limitations as
specified therein. Please pay particular attention to the monitoring requirements listed in Attachments A,
B and C for they may differ from the previous permit issuance. Failure to establish an adequate system
for collecting and maintaining the required operational information shall result in future compliance
problems.
Note the following permit condition is specific to your permit and require your attention:
Condition I.I. — This condition requires the Perrnittee to install an influent Dow meter when
daily flows exceed 60% of the permitted flow. In addition to the installation of the influent
flow meter, when daily flows exceed 15,000 GPD, the Perminee shall evaluate storage at the
treatment facility. The Division of Water Quality has determined that the storage of the
facility is inadequate for daily flows exceeding 15,000 GPD. At influent flows exceeding this
value, the facility approaches a critical point where the system could not accept any more
waste without the possibility of overflows.

Note the following condition has been removed since the last permit issuance dated
November 21, 2006:
➢ Condition VI.9. — This condition was removed because Permit No. WQ0004652 was
rescinded on December 31, 2000, therefore this condition is no longer applicable.
Please note the following permit conditions and attachments are new since the last permit
issuance:
Condition I?. — This condition'requires that the Permittee install waste level gauges in the
two aerated lagoons within 60 days of permit issuance.
➢ Condition 11.7. — This condition requires the Permittee to modify their permit prior to the sale
of any land that may affect the existing compliance boundary.
'v Condition II_$. — This condition prohibits the construction of any well, other than monitoring
wells, inside the compliance boundary. Please note the previous permit was subject to this
requirement under 15A NCAC 02L .0107(d), therefore, this condition is intended to voice
this rule.
➢ Condition 11.9. — This condition requires any landowner who owns land within the
compliance boundary, but who is not the Permittee, to execute and file with the County
Register of Deeds an easement with the requirements listed in the said Condition. Please note
the previous permit was subject to this requirement under 15A NCAC 02L .0107(f),
therefore, this condition is intended to voice this rule. ,
➢ Condition 111.6. — This condition requires that all irrigation equipment be tested and calibrated
at least once per permit cycle.
➢ Condition N.Z. — This condition requires that all laboratory analyses for effluent, ground
waters, or surface waters be made by a Division certified laboratory.
➢ Condition 1V.8. — This condition requires the Permittee to keep a record of all residuals
removed from this facility
➢ Condition IV.9. — This condition requires the Permittee to keep a log of all maintenance at the
facility.
> Condition VI.7. — This condition requires the Permittee to maintain this permit until all
permitted facilities are properly closed or permitted under another permitting authority.
➢ Condition VI.8. -- This condition notes that this permit is subject to revocation or unilateral
modification within 60 days notice from the Division if the terms in 15A NCAC 02T .0110
are violated.

➢ Attachment A — This attachment contains the parameter monitoring and sampling frequency
information previously located in old Condition U1.3. from the permit dated November 21,
2006. Please note that per the Division of Water Quality's Aquifer Protection Section
Wastewater Monitoring Policy, all non -discharge systems are having their effluent
monitoring schedules reevaluated for all permit issuances after January 2007. Accordingly,
the existing sampling parameters and frequencies are located in Point Prior to Irrigation (PPI)
002, and are set to expire on April 30, 2012. Replacing PPI 002 will be PPI 003 that is set to
activate on May 1, 2012, which should provide the Permittee with sufficient time to prepare
for the minor increase in sampling frequency for some parameters. In PPI 003, the sampling
frequency for BOD3, Ammonia, Total Suspended Solids. Nitrate and Fecal CoIiform is now
four times per year with samples required in March, June, September and December. In
addition, pH shall now be sampled weekly. Finally, four new parameters have been added to
the monitoring schedule: Total Kjeldahl Nitrogen shall be sampled four times per year,
Chlorides and Total Dissolved Solids shall be sampled three times per year during April,
August and November and Total Residual Chlorine shall be sampled weekly.
T Attachment B — This attachment consists of information contained in old Condition U.7.
regarding the six irrigation zones, their physical location and their loading rate.
➢ Attachment C — This attachment consists of the information previously contained in old
Condition IV.1.
If any parts, requirements or limitations contained in this permit are unacceptable, the Permittee
has the right to request an adjudicatory hearing upon written request within 30 days following receipt of
this permit This request shall be in the form of a written petition, conforming to Chapter 150B of the
North Carolina General Statutes, and filed with the Office of Administrative Hearings at 6714 Mail
Service Center, Raleigh, NC 27699-6714. Unless .such demands are made, this permit shall be final and
binding.
If you need additional information concerning this matter, please contact Nathaniel Thornburg at

I. 3 x Year monitoring shall he conducted in April. August & November: Annual monitoring shall he conducted even, November.
2. The measurement of water levels shall he made prior to Purging the ~sells. The depth 10 water in each well shall he measured lrrnn the suneNed point on the top of the casing. 'I Ile measurement
of pl I shall be made after purging and prior to sampling for the remaining parameters.
3. 1lle measuring points (lop of well casing) of all monitoring wells shall be surveyed to provide the relative elevation of tire measuring point for each monitoring well. The measuring points (top
of casing) of all monitoring wells shall he surveyed relative to a common datum.
4. If TOC concentrations greater than 10 mg/L are detected in any downgradient monitoring well. additional sampling and amlysis must be conducted to identify the individual constituents
comprising this TOC concentration. If the TOC concentration as measured in the background monitor well exceeds 10 mg/L. this concentration iNill he taken to represent the naturally occurring
TOC' concen[ratio n. Any exceedances of this naturally occurring TOC concentration in the dmvngradient wells shall he subject to the additional sampling and analysis as described above.
5. Monitoring wells shall he reported consistent with the nomenclature and location information provided in Figure I and this attachment.
