Dear Mr. Haves:
On November 25, 2009, the Division provided notification of permitted residuals land
application fields within a Water Supply Critical Watershed Area as defined by Rule 15A NCAC
02B4O202, and the existing restrictions .for application within these areas. In response to the letter, the
Town indicated that the specified fields are no longer being used under the subject land application
program. The Division appreciates the'.cooperation and acknowledgement of this matter. However,
ongoing public concerns and the unforeseen extension of the permit's expiration dates as described in
further detail below have made it necessary for the Division to modify the permit to remove these fields.
Therefore, attached with this letter is a modified Attaclunent B, with a certification date of
September 16, 2010, indicated in the top right comer of the Attachment, to the Town of Granite )✓alts for
the subject residuals land application program. This certification is being issued to modify Attachment B
by removing the following fields from the subject land application program.

Please replace the existing Attachment B of Permit No. WQ0001618 that was previously certified
on August 17, 2007, with this modified Attachment B.
This modified Attachment B shall be effective from the date of certification: shall void
Attachment B of Permit No. WQ0001618 that was previously certified on August 17, 2007; and shall be
subject to the conditions and limitations as specified therein and as well as those specified in the above -
referenced permit. Note that this modified Attachment B is hereby incorporated by reference into Permit
No. WQ0001618, issued on August 17, 2007.

On August 5, 2009, Session Law 2009-406, entitled "An Act to Extend Certain Government
Approvals Affecting the Development of Real Property within the State," was enacted by the General
Assembly and signed into law. The Act, known as the Permit Extension Act of 2009, extends the
expiration date of certain government approvals and permits.
Non -discharge permit, WQ0001618, issued by the Division of Water Quality falls within the
scope of this Act and is therefore has been extended until March 31. 2015. Please note per your permit, a
renewal application must still be submitted six months in advance of the extended expiration date.
If any parts, requirements, and/or limitations contained in this modified Attachment B are
unacceptable, you have the right to request -an adjudicatory hearing upon written request within 30 days
following receipt of the certification, This request shall be in the form of a written petition, conforming to
Chapter 1508 of the North Carolina General Statutes and filed with the Office of Administrative Hearings
at 6714 Mail Service Center, Raleigh, North Carolina 27699-6714. Unless such demands are made, this
pei mit shall be final and binding.
