Dear Mr. Naert:
In accordance with your application received March 14, 1989, we are
forwarding herewith Permit No. WQ0001364, dated May 15, 1989, to NAREX NC, Inc.
for the construction and operation of the subject wastewater collection system
extensions.
This permit shall be effective from the date of issuance until April 30, 1994,
and shall be subject to the conditions and limitations as specified therein.
If any parts, requirements, or limitations contained in this permit are
unacceptable to you, you have the right to request an adjudicatory hearing upon
written request within 30 days following receipt of this permit. This request must
be in the form of a written petition, conforming to Chapter 150B of North Carolina
General Statutes, and filed with the Office of Administrative Hearings, Post Office
Drawer 11666, Raleigh, North Carolina 27604. Unless such demands are made this
permit shall be final and binding.
One (1) set of approved plans and specifications is being forwarded to you. If

For the discharge of Sewage, Industrial Wastes, or Other Wastes
In accordance with the provisions of Article 21 of Chapter 143, General Statutes
of North Carolina as amended, and other applicable Laws, Rules, and Regulations
PERMISSION IS HEREBY GRANTED TO
NAREX NC, Inc.
McDowell County
FOR THE
construction and operation of approximately I MGD recycle facility consisting of a
dredge pool, a 1,600 GPM pump, screen separator, cyclone separator and all associated
pipes and appurtenances to serve NAREX NC, Inc., pursuant to the application received
March 14, 1989, and in conformity with the project plan, specifications, and other
supporting data subsequently filed and approved by the Department of Natural
Resources and Community Development and considered a part of this permit.
This permit shall be effective from the date of issuance until April 30, 1994,
and shall be subject to the following specified conditions and limitations.
1. This permit shall become voidable unless the facilities are constructed in
accordance with the approved plans, specifications and other supporting data.
2. This permit is effective only with respect to the nature and volume of wastes
described in the application and other supporting data.
3. The facilities shall be properly maintained and operated at all times.
4. This permit is not transferable.
5. Construction of the sewers shall be so scheduled so as not to interrupt service
by the existing utilities nor result in an overflow or bypass discharge of
wastewater to the surface waters of the State.
6. All disturbed areas shall be stabilized prior to establishing waterways.
7. Upon completion of construction and prior to operation of this permitted
facility, a certification must be received from a professional engineer
certifying that the permitted facility has been installed in accordance with the
requirements of this permit and the approved plans and specifications. Mail the
certification to the Permits and Engineering Unit, P.O. Box 27687, Raleigh, N.C.
27611-7687.
8. This permit shall become voidable in the event of failure of the soil to
adequately absorb the wastes and may be rescinded unless the facilities are
installed, maintained, and operated in a manner which will protect the assigned
water quality standards of the surface waters and ground waters.
9. In the event that the facilities fail to perform satisfactorily, including the
creation of nuisance conditions, the Permittee shall take such immediate
corrective action as may be required by this Division, including the construction
of additional or replacement wastewater treatment or disposal facilities.
10. Any monitoring deemed necessary by the Division of Environmental Management to
insure surface and ground water protection will be established and an acceptable
sampling reporting schedule shall be followed.
11. The facility shall be effectively maintained and operated at all times so that
there is no discharge to the surface waters, nor any contamination of ground
waters which will render them unsatisfactory for normal use. In the event that
the facilities fail to perform satisfactorily, including the creation of nuisance
conditions or failure of the irrigation area to adequately absorb the wastewater,
the Permittee shall take such immediate corrective action as may be required by
the Division of Environmental Management.
12. Diversion or bypassing of the untreated wastewater from the treatment dredge
pool is prohibited.
13. The Permittee, at least six (6) months prior to the expiration of this permit,
shall request its extension. Upon receipt of the request, the Commission will
review the adequacy of the facilities described therein, and if warranted, will
extend the Permit for such period of time and under such conditions and
limitations as it may deem appropriate.
14. Freeboard in the dredge pool shall not be less than 1 foot at any time.
15. ,Adequate facilities shall be provided to prevent surface runoff from carrying any
disposed or stored material into any surface waters.
16. The issuance of this permit shall not relieve the Permittee of the responsibility
for damages to surface or groundwaters resulting from the operation of this
facility.
17. The facilities shall be effectively maintained and operated as a non -discharge
system to prevent the discharge of any wastewater resulting from the operation of
this facility.
i8. Any additional groundwater quality monitoring as deemed necessary by the
Department, shall be provided.
