Paul Wilms Director Subject: Permit No. WQ0001307 Ron Spiegel, Owner Spiegel Residence Spray Irrigation Wastewater Treatment Facility Durham County Dear Mr. Spiegel: In accordance with your application received March 2, 1989 , we are forwarding herewith Permit No. WQ0001307, dated June 29, 1989, to Ron Spiegel for continued operation of the subject spray irrigation wastewater treatment and disposal system. .This pen -nit shall be effective from the date of issuance until May 31, 1994, and shall be subject to the conditions and limitations as specified therein.Issuance of this permit shall void Permit No. 10127, issued April 5, 1984. If any parts, requirements, or limitations contained in this permit are unacceptable to you, you have the right to request an adjudicatory hearing upon written request within 30 days following receipt of this permit. This request must be in the form of a written petition, conforming to Chapter 150B of North Carolina General Statutes, and filed with the Office of Administrative Hearings, P.O. Box 11666, Raleigh, NC 27604. Unless such demands are made this permit shall be -final and binding. Box 27687, Raleigh, North Carolina 27611-7687 Telephone 919-733-7015 An Equal Opportunity Affirmative Action Employer NORTH CAROLINA ENVIRONMENTAL MANAGEMENT COMMISSION DEPARTMENT OF NATURAL RESOURCES AND COMMUNITY DEVELOPMENT RALEIGH PERMIT For the discharge of Sewage, Industrial Wastes, or Other Wastes In accordance with the provisions of Article 21 of Chapter 143, General Statutes of North Carolina as amended, and other applicable Laws, Rules, and Regulations PERMISSION IS HEREBY GRANTED TO Ron Spiegel Durham County FOR THE continued operation of a 450 GPD spray irrigation wastewater treatment and disposal facility consisting of a 1,200 gallon baffled septic tank, distribution box, 320 square foot subsurface sand filter, tablet chlorinator, 3,000 gallon storage/pump tank with a single 10 GPM submersible pump,automatic pump controls, high water alarm six (6) sprinklers,a 0.34 acre irrigation area, and associated piping, valves, and appurtenances to serve the Spiegel Residence, pursuant to the application received March 2 ,1989 and in conformity with the project plan, specifications, and other supporting data subsequently filed and approved by the Department of Natural Resources and Community Development and considered a part of this permit. This permit shall be effective from the date of issuance until May 31, 1994, and shall be subject to the following specified conditions and limitations: This permit shall become voidable unless the facilities are constructed in accordance with the approved plans, specifications, and other supporting data. 2. This permit is effective only with respect to the nature and volume of wastes described in the application and other supporting data. The facilities shall be properly maintained and operated at all times. 4. This permit is not transferable. Diversion or bypassing of the untreated wastewater from the treatment and disposal facilities is prohibited. 6. A suitable vegetative cover shall be maintained. 7. Upon the availability of a municipal or regional sewerage collection system, the subject wastewater treatment facilities shall be abandoned, and all wastewater discharged into the municipal or regional sewerage system. 8. The sludge generated from these treatment facilities must be disposed of in accordance with General Statute 143-215.1 and in a manner approvable by the North Carolina Division of Environmental Management. 9. The spray irrigation facility shall be effectively maintained and operated at all times so that there is no discharge to the surface waters, nor any contamination of ground waters which will render them unsatisfactory for normal use. In the event that the facilities fail to perform satisfactorily, including the creation of -nuisance conditions or failure of the irrigation area to adequately absorb the wastewater, the Permittee shall take such immediate corrective action as may be required by the Division of Environmental Management. 10. Irrigation shall not be performed during inclement weather or when the ground is in a condition that will cause runoff. 11. Adequate measures shall be taken to prevent wastewater runoff from the spray field. 12. The Permittee, at least six (6) months prior to the expiration of this permit, shall request its extension. Upon receipt of the request, the Commission will review the adequacy of the facilities described therein, and if warranted, will extend the Permit for such period of time and under such conditions and limitations as it may deem appropriate. 13. The application rates shall not exceed 0.3 inch/acre/week. 14. The issuance of this permit shall not relieve the Permittee of the responsibility for damages to surface or groundwaters resulting from the operation of this facility. 15. The facilities shall be effectively maintained and operated as a non -discharge system to prevent the discharge of any wastewater resulting from the operation of this facility. 16. No type of wastewater other than that from the Spiegel residence shall be sprayed onto the irrigation area. 17. No traffic or equipment shall be allowed on the disposal area except while installation occurs or while normal maintenance is being performed. I& Adequate inspection, maintenance, and cleaning shall be provided by the Permittee to insure proper operation of the subject facilities. 19. No crops for public consumption shall be raised on the spray field. 20. Any monitoring deemed necessary by the Division of Environmental Management to insure surface and groundwater protection will be established and an appropriate sampling reporting schedule shall be followed. 21. The Permittee is responsible for the operation and maintenance of the entire treatment and disposal system including, but not limited to, the following items: The septic tank shall be checked every six (b) months and pumped out as required. b. The tablet chlorinator shall be checked every week until the actual usage rate is established and thence on a monthly basis. Tablets shall be added so as to provide proper chlorination. c. The storage system, pump system, and alarm system shall be inspected monthly. The scum layer shall be removed at the same interval as the septic tank is cleaned out. d. The spray system shall be inspected monthly to make certain of the sprayers proper operation, that the vegetative growth allows proper spray pattern, that the soil is absorbing the disposed treated wastewater with no surface runoff, and that no objectionable odors are being generated. 22. This permit shall become voidable in the event of failure of the soil to adequately absorb the wastes, and may be rescinded unless the facilities are installed, maintained, and operated in a manner which will protect the assigned water quality standards of the surface waters, and prevent any contamination of the groundwaters which will render there unsatisfactory for normal use. 23. The following buffers shall be maintained; a. 400 feet between the wetted area and any off-site residence or place of public assembly. b. 100 feet between the wetted area and property lines. C, 100 feet between the wetted area and potable wells. d. 200 feet between the wetted area and the on-site residence. 24. Issuance of this permit shall void Permit No. 10127, issued April 5, 1984.
