In accordance with your application received February 28, 1989, we are
forwarding herewith Permit No. WQ0001304, dated June 2, 1989, to the Dare County
Board of Education for the construction and operation of the subject wastewater
treatment system.
This permit shall be effective from the date of issuance until June 1,
1994, and shall be subject to the conditions and limitations as specified
therein.
If any parts, requirements, or limitations contained in this permit are
unacceptable to you, you have the right to request an adjudicatory hearing upon
written request within 30 days following receipt of this permit. This request
must be in the form of a written petition, conforming to Chapter 150E of North
Carolina General Statutes, and filed with the Office of Administrative Hearings,
Post Office Drawer 11666, Raleigh, North Carolina 27604.

If you wish to have the hearing before the Hearing Officer with this
Department, you must indicate in the petition that you waive the right to
have the contested case conducted by a Hearing Officer in the Office of
Administrative Hearings, and wish to have the matter conducted in the
Department of Natural Resources and Community Development. Unless such
demands are made, this permit shall be final and binding.
One (1) set of approved plans and specifications is being forwarded to
you. If you need additional information concerning this matter, please

For the Discharge of Sewage, Industrial Wastes, or Other Wastes
In accordance with the provisions of Article 21 of Chapter 143 ,
General Statutes of North Carolina as amended, and other applicable
Laws, Rules, and Regulations,
PERMISSION IS HEREBY GRANTED TO

construction and operation of a Phase 18,060 gpd & Phase II 11,682 gpd
non -discharge type domestic wastewater treatment and disposal facility
consisting of Ph I - "system I" 4,1.70 gal. septic tank, 1616 pump tank,
9-100 l.f. nitrification lines "system II" 3366 gal. septic tank, 3000
gal. combination septic & pump tank, 11-81 l.f. nitrification lines /
Ph II - "system I" 8,265 gal. septic tank, 4,821 gal. pump tank, total
13-100 l.f. nitrification lines "system II" 8,515 gal. septic tank,
3000 gal. pump tank, total 16-81 1.f, nitrification lines to serve the
Cape Hatteras School. There will be no discharge of any wastewater to
the surface waters of the State,pursuant to the application received
February 28, 1989 and in conformity with the project plans,
specifications, and other supporting data, subsequently filed and
approved by the Department of Natural Resources and Community
Development and considered a part of this Permit.
This Permit shall be effective from the date of issuance until
June 1, 1994 and shall be subject to the following specified conditions
and limitations;
1. This permit shall become voidable unless the facilities
were constructed in accordance with the approved plans,
specifications and supporting data.

2. This permit is effective only with respect to the nature
and volume of waters described in the application and
other supporting data.
3. The facilities shall be properly maintained and operated
at all times.
4. This permit is not transferable.
5. This permit shall become voidable in, the event of failure
of the soil to adequately absorb the wastes, and may be
rescinded unless the facilities are maintained and
operated in a manner which will protect the assigned water
quality standards of the surface waters, and prevent any
contamination of the ground waters which will render them
unsatisfactory for normal use.
6. In the event the facilities fail to perform
satisfactorily, the Permittee shall take such immediate
corrective action as may be required by the Department.
7. Solids, sludges, or other pollutants removed or resulting
from the wastewater treatment process shall be contained
and disposed of in such a manner as to prevent any
contamination of the surface or ground waters of the
State.
8. Diversion or bypassing of the untreated wastewater from
the treatment facilities is prohibited.
9. Monitoring wells shall be constructed and sampling
schedules arranged as required by the Division of
Environmental Management.
10. Wastewater flows shall be monitored for each system
and reported to A.R. Hodge , N. C. D. of N. R. & C. D.
,p.o. box 1507, Washington N.C. 27889. Monitoring shall be
performed and submitted as set forth by the Division of
Environmental Management.

11. The Washington Regional Office, telephone no. (919)
946-6481 shall be notified at least twenty-four (24)
hours in advance of backfilling of the installed
subsurface disposal system so that an in-place inspection
can be made of said system prior to back -filling. Such
notification to the Regional supervisor shall be made
during the normal office hours from 8:00 AM until 5:00 PM
on Monday through Friday, excluding state holidays.
12. A professional engineer shall certify that the
Cape Hatteras School wastewater treatment system was
constructed according to the approved plans and
specifications. The certification should be send to A.R.
Hodge , North Carolina Department of Natural Resources and
Community Development ,p.o. box 1507, Washington N.C.
27889.
13. The phase II construction shall be initiated within sixty
days in the event either of the following conditions are
met:
a. The wastewater flow is equal too or greater than 900
of phase I design flow (7,254 gpd)
b. The expected or actual enrollment is equal to or
greater than 900 of phase I design capacity (550
students)
