Pursuant to your letter of May 3, 1991, the Division is hereby returning your project as requested. Please be advised that an extensive review of the project was conducted by the Division's staff; therefore, the permit processing fee cannot be returned to the Town of Conway. If the Town of Conway wishes to pursue the use of pine trees in the future, additional land will be required to assimilate the constituents contained in the Town's wastewater. Box 365 Conway, NC 27820 SUBJECT: Permit No. WQ0001284 Town of Conway Spray Irrigation Wastewater Treatment and Disposal System Northampton County Dear Mayor Garris: In accordance with your application received February 28, 1989, we are forwarding; herewith Permit No. WQ0001284, dated April 4, 1989, to the Town of Conway for the continued operation of the subject spray irrigation wastewater treatment and disposal system. This permit shall be effective from the date of issuance until April 1, 1994, shall void Permit No. 7947, and shall be subject to the conditions and limitations as specified therein. If any parts, requirements, or limitations contained in this permit are unacceptable to you, you have the right to request an adjudicatory hearing upon written request within 30 days following receipt of this permit. This request must be .in the form of a written petition, conforming to Chapter 150B of North Carolina General Statutes, and filed with the Office of Administrative Hearings, Post Office Drawer 11666, Raleigh, North Carolina 27604. Box 27687, Raleigh, Forth Carolina 27611-7687 Telephone 919-733-7015 An Equal Opportunity Affirmative Action Employer NORTH CAROLINA ENVIRONMENTAL MANAGEMENT COMMISSION DEPARTMENT OF NATURAL RESOURCES AND COMMUNITY DEVELOPMENT RALE IGH P E R M I T For the discharge of Sewage, Industrial Wastes, or Other Wastes In accordance with the provisions of Article 21 of Chapter 143, General Statutes of Forth Carolina as amended, and other applicable Laws, Rules, and Regulations PERMISSION IS HEREBY GRANTED TO Town of Conway Northampton County FOR THE continued operation of 2,500 linear feet of 6-inch force main, 500 linear feet of 8-inch and 10--inch gravity sewer, a 260 GPM pump station; a 0.15 MGD wastewater treatment facility consisting of a 65 day storage/treatment lagoon, a gaseous chlorinator, chlorine contact chamber, a 600 GPM spray irrigation pump station with approximately 18.5 acres of irrigation fields and three (3) groundwater monitoring wells to serve the Town of Conway, with no discharge to the surface water pursuant to the application received February 28, 1989, and in conformity with the project plan, specifications, and other supporting data subsequently filed and approved by the Department of Natural Resources and Community Development and considered a part of this permit. This permit shall be effective from the date of issuance until April 1, 1994, and shall. be subject to the following specified conditions and limitations: 1. This permit shall become voidable unless the facilities are constructed in accordance with the approved plans, specifications, and other supporting data. 2. This permit is effective only with respect to the nature and volume of wastes described in the application and other supporting data. 3. The facilities shall be properly maintained and operated at all times. 4. The spray irrigation disposal facilities shall be effectively maintained and operated at all times so that there is no discharge to the surface waters, nor any contamination of ground waters which will render them unsatisfactory for normal use. In the event that the facilities fail to perform satisfactorily, including the creation of nuisance conditions or failure of the irrigation area to adequately absorb the wastewater, the Permittee shall take such immediate corrective action as may be required by the Division of Environmental Management. 5. The sludge generated from these treatment facilities must be disposed of in accordance with General Statute 143-215.1 and in a manner approvable by the North Carolina Division of Environmental Management. 6. Diversion or bypassing of the untreated wastewater from the treatment facility is prohibited. 7. The application rates shall not exceed 2.1 inches per acre per week. 8. A suitable year round vegetative cover shall be maintained. 9. Adequate measures shall be taken to prevent wastewater runoff from the spray field. 10. Irrigation shall not be performed during inclement weather or when the ground is in a condition that will cause runoff. 11. Freeboard in the lagoons shall not be less than 1.5 feet at any time. 12. No type of wastewater other than that from the Town of Conway shall be sprayed onto the irrigation area. 13. The Permittee shall employ a certified wastewater treatment plant operator to be in responsible charge of the wastewater treatment facilities. Such operator must hold a certificate of the grade at least equivalent to the classification assigned to the wastewater treatment facilities by the Certification Commission. i 14. The issuance of this permit shall not relieve the Permittee of the responsibility for damages to surface or groundwaters resulting from the operation of this facility. 15. Construction of the sewers shall be scheduled so as not to interrupt service by the existing utilities nor result in an overflow or bypass discharge of wastewater to the surface waters of the State. 16. The Permittee, at least six (6) months prior to the expiration of this permit, shall request its extension. Upon receipt of the request, the Commission will review the adequacy of the facilities described therein, and if warranted, will extend the Permit for such period of time and under such conditions and limitations as it may deem appropriate. 17. Adequate inspection, maintenance, and cleaning shall be provided by the Permittee to insure proper operation of the subject facilities. 18. No crops for direct human consumption shall be raised on the irrigation site. 19. A minimum separation from the spray irrigation wetted area shall be maintained as follows; a. 50 feet from any public right of way b. 50 feet from creeks or streams C. 25 feet from any wet weather ditch d. 100 feet from any potable well. 20. Adequate records tracking the operation of the spray irrigation system shall be maintained by the Permittee. These records shall include, but are not necessarily limited to the following: a. Date of irrigation b. Volume irrigated c. Field or zone .irrigated d. Weather conditions e. Weekly, monthly and year-to-date hydraulic loadings in inches per acre The records shall be maintained monthly and submitted annually to the Water Quality Supervisor of the Raleigh Regional Office on or before January 31 of the following year.. 21. An annual soil analysis shall be conducted on the irrigation field and maintained by the Permittee for five (5) years. 22. The three (3) existing monitoring wells shall be sampled every March, July, and November for the following parameters; PH Total Ammonia TOG Nitrate TDS Chloride Water level The measurement of water level must be made prior to sampling for the remaining parameter. If TOG concentrations greater than 10 mg/I are detected in any downgradient monitoring well, additional sampling and analysis must be conducted to identify the individual constituents comprising this TOG concentration. If the TOG concentration as measured in the back,rg ound monitor well exceeds 10 mg/l, this concentration will be taken to represent the naturally occuring TOG concentration- Any exceedances of this naturally occuring TOC concentration in the downgradient wells shall be subject to the additional sampling and analysis as described above. The results of the sampling and analysis shall be sent to the NC Division of Environmental Management of form GW-59 Compliance Monitoring Report Form] every April, August and December. The Perimeter of Compliance delineated on the attached site map for the disposal system is specified by regualtions in 15 NCAC 2L, Classifications and Water Quality Standards Appl-icable to the Groundwater of North Carolina. An exceedance of Groundwater Quality Section beyond the Perimeter of Compliance is subject to the penalty provisions applicable under General Statute 143-215.6(1)a. The sale of property, by the Permittee, which is within or contiguous to the disposal system site may alter location of the Perimeter of Compliance. If the title to any property which may affect the boundary of the Perimeter of Compliance is changed, the Permittee shall notify -the DEM Director within 14 days, The Director shall then establish a modified Perimeter of Compliance which will be done as a modification to the Permit. For the facilities permitted prior to December 30, 1983, the compliance perimeter is established at a distance 500 feet from the lagoon and irrigation fields, or the property boundary, whichever is less. 23. Any additional groundwater quality monitoring, as deemed necessary by the. Division, shall be provided. 24. The facilities shall. be effectively maintained and operated as a non -discharge system to prevent the discharge of any wastewater resulting from the operation of this facility. 25.
