Roberts for the continued operation of the subject non -discharge type wastewater treatment and disposal facilities. This permit shall be effective from the elate of issuance until October 31, 1993, shall void permit No. 9587, and shall be subject to the conditions and limitations as specified therein. If any parts, requirements, or limitations contained in this permit are unacceptable to you., you have the right to request an adjudicato.ry hearing upon written request. witb:in 30 days following .receipt of this permit. This request must be in the form of a written petition, conforming to Chapter. 150B of North Carolina General Statutes, and filed with the Office of Administrative Hearings, Post. Roberts Residence Durham County FOR THE continued operation of a 300 GPD non -discharge land application/spray irrigation type wastewater treatment and disposal facility consisting of a 1,000 gallon capacity baffled septic tank, a distribution box., dual 150 square feet subsurface sand filters, a chlorine contact tank with tablet -type chlorination, 2,400 gallon capacity storage/pump tank with 23.5 GPM irrigation pump and a automatic pump off controls, approximately 0.34 acres of irrigation field, and associated 2-inch diameter force main piping, & sprinklers, valving and appurtenances to serve the Ernest K. Robert's residence in Durham County with no discharge of wastewater to the surface waters of the State, pursuant to the application received February 23, 1989, and in conformity with the project plan, specifications, and other supporting data subsequently filed and approved by the Department of Natural Resources and Community Development and considered a part of this permit. This permit shall be effective from the date of issuance until October 31, 1993, shall void Permit No. 9583, and shall be subject to the following specified conditions and limitations: 1. This permit shall. become voidable unless the facilities are constructed in accordance with the approved plans, specifications and other supporting data. 2. This permit is effective only with respect to the nature and volume of wastes described in the application and other supporting data. 3. The facilities shall be properly maintained and operated at: all. times. 4. The sewage and wastewater collected by this system shall_ be adequately treated prior to being discharged into the receiving irrigation field. r 5. This permit is not transferable. 6. This permit shall become voidable in the event of failure of the soil to adequately absorb the wastes, and may be rescinded unless the facilities are .installed, maintained and operated in a manner which will protect the assigned water quality standards of the surface waters, and prevent any contamination of the ground waters which will render them unsatisfactory. 7. In event the facilities fail to perform satisfactorily including the creation of nuisance conditions, the permittee shall take such immediate corrective action as may be required by this Division, including the construction of additional or replacement wastewater treatment or disposal facilities. 8. Diversion or by-passing of the untreated wastewater from the treatment and disposal facilities is prohibited. 9. Upon the availability of a municipal or regional sewerage collection system, the subject wastewater treatment facilities shall be abandoned, and all wastewater discharged into the municipal or regional sewerage system. 10. Any monitoring deemed necessary by the Division of Environmental Management to insure surface and ground water protection will be established and an acceptable sampling reporting schedule shall be followed. 11. The sludge generated from these treatment facilities must be disposed of in accordance with General. Statute 143-215.1 and in a manner approvable by the North Carolina Division of Environmental Management, 12. A suitable year round vegetative cover shall be maintained. 13. Irrigation shall not be performed during inclement weather or when the ground is in a condition that will cause runoff. 14. The Permittee, at least six (6) months prior to the expiration of this permit, shall request its extension. Upon receipt of the request, the Commission will review the adequacy of the facilities described therein, and if warranted, will extend the Permit for such period of time and under such conditions and limitations as it may deem appropriate. 15. The application rates shall not exceed 0.2 inch/acre/week. 16. The issuance of this permit shall not relieve the Permittee of the responsibility for damages to surface or groundwaters resulting from the operation of this facility. 1.7. The facilities shall be effectively maintained and operated as a non -discharge system to prevent the discharge of any wastewater resulting from the operation of this facility. 18. No type of sludge other than that from Ernest K. Roberts shall be placed on the land application disposal site. 19. No traffic or equipment shall be allowed on the disposal area except while installation occurs or while normal maintenance is being, performed. 20. No root or leaf crops for public consumption shall be raised on these sites. 21. Adequate inspection, maintenance, and cleaning shall be provided by the Permittee to insure proper operation of the subject facilities. 2.2. The following minimum buffer distances shall. be maintained between the wetted perimeter of the spray field and the indicated facilities: a. 100 feet from Robert's residence b. 150 feet from property line C. 400 feet from any existing off -site residence or place of public assembly d. 100 feet from any portable water supply well or any surface waters.
