This certification is being issued to modify Attachment B to: ♦ Approve of a new sites owned by Willie C. Brinkley and Maybob E. Paye in Harnett County for land application of residuals under this program. These sites total 35.70 net acres as shown on the buffer map prepared by S&:ME dated August 2008. Please replace the existing Attachment B of Permit No. WQ0001086, previously certified on 14 August 2007 with this modified Attachment B. Note that only the vicinity and buffer maps for any new land application sites are attached to this modified Attachment B. It is the Permittee's responsibility to insure a complete permit is created by inserting, this modified Attachment B (with vicinity and buffer maps) into Permit No. NVQ0001086 issued on 8 February 2006 and making sure to retain any vicinity and buffer maps for any existing and unmodified land application sites. This modified Attachment B shall be effective from the date of certification until 31 January 2011; shall void Attachment B of Permit No. NVQ0001086, that was previously certified on 14 August 2007 and shall be subject to the conditions and limitations as specified therein and well as those specified in the above -referenced permit. As always, remember to take the time to review this modified Attachment B thoroughly, as some of the conditions contained therein may have been changed since the last certification. Since the Brinkley and Pave sites were planted in annual rye this past growing season, a application rate of 200 Ibs of Plant Available Nitrogen (PAN) may be applied to these fields if annual rye is to be planted this season and the hybrid bermudagrass pasture established in calendar year 2009. BRINKLEY FIELDS 4 BUFFER MAP HARNETT COUNTY, NC Forage Leaflet 1 May 1988 ESTABLISHMENT OF BERMUDAGRASS D. J. Undersander and B. W. Pinkerton Soil Preparation Prior to any land preparations, take a soil sample for analysis. Apply fertilizer and lime according to the soil test recommendations. It is desirable to apply sufficient lime to raise the soil pH to between 5.8 and 6.5. A small amount of nitrogen fertilizer (40 to 60 lb/A) should be applied prior to planting. Heavy nitrogen fertilization should be avoided until there is enough grass to take advantage of it. Sulfur (10-12 lb) may also be required on sandier soils. This can be supplied as part of the nitrogen fertilizer if ammonium sulfate is available as the nitrogen source. Fertilizer and lime may be broad- cast over the field and incorporated with the tillage operations preparing the seedbed. The field should be thoroughly tilled to kill any growing weeds and to loosen the hardpan, if neces- sary. Final tillage operations should break up clods to provide good sprig -to -soil contact and smooth the surface of the field for future haying operations. Where to Get Sprigs Use of certified sprigs is recommended to assure that the farmer is receiving the cultivar requested and that it is free of common bermudagrass and weeds. Certified sprigs are available in Georgia, North Carolina, and South Carolina. Names of producers can be obtained from your local county Extension agent. The farmer may also dig his own sprigs from a nurse patch. Either a commercial digger or a spring -tooth harrow is frequently used to dig the sprigs. After digging, the nursery may be cross -cut with a disk to cut the sprigs into shorter pieces. A side -delivery rake works well to shake loose excess soil and gather the sprigs into windrows. Tops may also be used to establish some of bermu- dagrass varieties. The procedure is simply to mow a field of the desired variety and immediately collect the green tops for sprigging. Some varieties (such as Tifton 78) establish well from tops and others do not - be sure to check the variety before attempting this method. Tops are easier to obtain than sprigs but result in later establishment and less yield the first year. When to Plant Bermudagrass may be sprigged anytime from Feb- ruary through the remainder of the growing season. February and March are the recommended times, if adequate moisture is available, so that the sprigs have a chance to develop a root system before the hottest, most drying weather occurs. Early planted sprigs will tend to have a competitive advantage L Extension c,iw,� CkmsonUniversity over the weeds and may allow a cutting for hay to occur during the establishment year. If seed (of the seed -producing varieties) is used, it should be planted in March or April when the soil is warm and moist to allow rapid establishment. Sprigging with tops is normally done during June. The late date is necessary to provide sufficient growth of the source patch. The late establishment will reduce the growth the first year and may reduce winter survival. How to Establish Sprigs should be kept moist and cool and replanted as quickly as possible. Drying is more of a problem when sprigs are planted later in the season under higher temperatures. If sprigs appear dehydrated they can be thoroughly wetted for 12-15 hours prior to planting. The rate of sprigging depends on how soon a stand is desired - higher rates result in faster stand development but at higher establishment costs. Higher sprigging rates will also help control weeds. If sprigging in rows 3 feet apart, 10 to 15 bushels per acre will allow placement of a sprig every 1 to 1.5 feet and will result in rapid coverage. Broadcast sprigging requires more sprigs (25 to 40 bushels/A) because many sprigs are covered either too deeply or not deep enough and die. The ideal placement of sprigs in the ground is to have the sprig vertical, or nearly so, with all but 1/2 to 1 inch of the sprig buried. Planting can be done by hand with a hoe or stick if the area to be planted is small. It is important to firm the soil around the sprigs to provide good soil contact. Another method of planting is to dig a furrow, drop the sprigs into the soil and cover with a cultivator or a disk bedder. A third method is to use a transplanter such as a tobacco planter, a tree transplanter, or a grass sprigger. The fourth, and most common method of establishing pastures, is to use a commercial, broadcast sprigger. A fifth method sometimes used is to spread the sprigs with a manure spreader and disk lightly (about 2 inches deep) to cover the sprigs. This method, while less expensive, tends to result in poorer stands because sprigs are likely to be poorly distributed, have uneven soil coverage, and be exposed to drying conditions before being covered with soil. If the bermudagrass is to be seeded rather than sprigged, it is necessary to prepare a smooth, firm seedbed. The bermudagrass should be seeded at a depth of 1/4 to 1/2 inch when the soil is moist. The recommended seeding rate is 6 to 8 lb/A. Soil should be firmed around the seed to provide good soil contact. Weed Control Weed control during establishment is very impor- tant. Weed competition will cause the bermu- dagrass to spread less rapidly and not to provide a solid, high -yielding stand. The first step, as men- tioned previously, is to plant into a weed -free bed to delay weed competition as long as possible. Grassy weeds coming up after sprigging may be controlled by mowing or grazing after 10 inches of growth has occurred. (When grazing, be careful not to graze so closely that cattle are eating the runners of the stoloniferous types_) Severe weed problems may justify further chemical control. Most annual and perennial broadleaf weeds may be controlled with 2,4-D applied at 0.5 to 1.5 lb Ai/A. Application may be made anytime after sprigging. Repeated applications may be required. Avoid applying when very high air temperatures are expected. Milking cows must be kept off the treated areas for 7 days after application. Karmex (diuron) may be applied at the rate of 0.4 to 0.8 lb Ai/A anytime after sprigging to control most annual grasses and broadleaf weeds. This herbicide will control weeds two to four inches tall when applied with a surfactant. Some leaf burn on the bermu- dagrass will occur. Forage must not be grazed or fed to cattle for 70 days after application. Common bermudagrass has been a weed species in row crops since it was brought to Savannah, Georgia in 1751. Planting this species for grazing or hay should.be easy! Unfortunately, many producers have discovered that seed -type bermudagrass can be difficult to establish. This article will review old techniques and discuss new recommendations for establishing these popular pasture plants. Although sprigging is more expensive than establishing bermudagrass from seed, some of the advantages that vegetative establishment has over seed established bermudagrass should be mentioned. First, herbicides are available for weed control during early vegetative establishment. The lack of effective weed control is a serious issue when establishing seed -type varieties as stands can be lost to weed competition during the first year. Second, many available sprig - planted bermudagrass hybrids were developed in Tifton under local conditions and may be better adapted to our environment. Seed -type varieties have not performed well on the Coastal Plain and appear to be difficult to establish in sandy, dry soils. These characteristics make sprigging a relatively dependable method for establishing hybrid bermudagrass pastures and hay fields, particularly in the Coastal Plain. However, even after considering these advantages, many north Georgia producers are interested in planting seed -type varieties because of potential savings in establishment costs. Seeded Bermudagrass Variety Selection. Choosing a well adapted variety continues to be an important choice when establishing a seeded bermudagrass field. Two varieties have performed well in UGA tests conducted by Dr. Carl Hoveland in the Piedmont and Limestone Valley areas of Georgia. Cheyenne (Pennington Seed, Madison GA) and KF194 (KF Seed, Brawley CA) continue to be the only tested varieties which yield well and have good leaf spot resistance in our humid environment. Avoid pure sources of "Giant" bermudagrass as stands of it normally thin and fail within one or two years in Georgia. Seed Blends Bermudagrass seed varieties are often blended and sold under a different market name. If you choose to establish a seed blend, evaluate the mixture of varieties carefully as it will determine your pasture's future productivity. Usually, one variety in a blend will persist in a stand and other varieties will decline due to cold tolerance, disease tolerance, or other forms of competition. This will cause the plant composition in the field to change over time according to individual plant persistence and competitiveness. Blends that contain Giant bermudagrass may be acceptable as long as there is a productive and persistent variety present in the mixture. Seed blends which contain a combination of common bermudagrass and Giant provide high yields for one or two years, but eventually become lower - yielding common bermudagrass stands as the Giant type fails. When do I plant? Previously it was recommended that seed -type bermudagrass be established in April. This early planting date theoretically allowed bermudagrass to get a two or three week headstart on crabgrass, which tends to germinate later in the spring. Unfortunately, crabgrass has extremely vigorous seedling growth, and can outcompete bermudagrass even when penalized with a two - week germination delay. It may be beneficial to delay seeding until soil temperature is 65 degrees or higher at a 4" depth. This delay should improve bermudagrass seedling vigor and disease resistance. In locations where crabgrass or goosegrass competition will not be severe, April planting is still a good option. In fields where crabgrass is known to be present, planting can be made in June or early July. Seedbed Preparation Ideally, seed type bermudagrass should be established into a well -packed clean -tilled seedbed. Prepare the ground as soon as possible in spring to allow the soil to settle. Soil test and apply recommended P, K and lime. This early preparation will also allow crabgrass and other weed species to germinate in April. These weeds can be sprayed with glyphosate (Roundup) or paraquat (Gramoxone Max) to create a weed -free seedbed. Do not disturb the soil after spraying this flush of crabgrass. Tillage will only recruit and encourage more crabgrass seed to germinate. The "second wave" of crabgrass germination should be smaller and less competitive with bermudagrass. It is possible to establish bermudagrass in killed tall fescue or small grains using a no -till drill. Remove as much residue as possible before seeding to decrease shading and improve seed/soil contact. No -till planting into living tall fescue or common bermudagrass stands is a waste of time and money because of heavy plant competition for water and light. Seed Delivery Broadcast seeding. If an early spring planting into clean tilled land is chosen, seed can be broadcast and immediately cultipacked into a firm seedbed. A simple tool to determine if the seedbed is firm enough is to walk across the field and observe footprint depth. If your boot sinks deeper than 1/8" the soil is not firm enough. Fluffy seedbeds will result in deep seed placement which can severely impact seedling emergence. Broadcasting and packing seed has been successful where crabgrass and goosegrass are absent. If crabgrass is known to be a problem, wait until June and plant using into a weed -free seedbed. No -till seeding. June plantings should be performed using a no -till drill. Seeding depth must be controlled when using this method. Make sure that seed are not being delivered deeper than 1/8". It is often helpful to remove seed tubes from disc openers and allow seed to fall directly in front of the press wheel. This delivers seed to the soil surface and firms it into a narrow disturbed strip for good seed/soil contact. Herbicide precautions Before planting. Fields should not be sprayed with preemergence herbicides prior to planting seed -established bermudagrass. Applications of 2,4-D may also prevent establishment and should not be sprayed for a minimum three or four weeks prior to planting. Roundup or Gramoxone Max are safe when applied immediately prior to planting. These herbicides have no residual soil activity. Post planting. Broadleaf weeds can be controlled with 2,4-D after bermudagrass is well established and has developed runners that are well rooted. Again, there are no grass weed control options available for seed -established bermudagrass other than mowing. Any postemergence herbicide that injures crabgrass or goosegrass will also harm seedling bermudagrass. Frequent mowing is the only available weed control option and often is ineffective. Seeding bermudagrass can be a less expensive alternative to establishing a bermudagrass pasture. However, it also carries more risks than sprigging. Hopefully, these establishment tips will help make your seeded bermudagrass establishment a success. It appears that there are at least six distinct landowners (could be more based upon all parties that have a ownership right to said properties, besides the ones identified by the Harnett County GIS website) with Willie Calvin Brinkley being the only entity to execute a "Landowner Agreement" form (form: LOAA 070807). Although the Landowner's 'Certification page is very liberal about who/whom can authorize use of property for land application of residuals; I wish to get further clarification concerning Mr. Willie Brinkley's authority to allow ,residuals to be placed on properties not owned by him in "fee simple". Unless Mr. Brinkley has signed lease agreements with the landowners to farm said properties or has written authorization from the deed holding landowners to managed their property as he wishes; each parcel of property not owned by Willie Brinkley will need a landowner agreement signed by each owner that has vested ownership (i.e. identified on the deed for the property) and submitted as part of the application. The Permittee must request and obtain a permit modification from the Division prior to a transfer of the land application site(s) to a new, landowner. The request shall contain the appropriate forms and agreements. In addition, the current landowner shall give .a notice to the new landowner that gives full details of the residuals applied or incorporated at the land application site(s). 8. The Permittee has provided the landowner or his representative with information and data conceming the residuals land application program, including an analysis of constituents of the residuals, residuals application methods, schedules for typical cropping patterns, and a description of the equipment used by the Permittee. 9. The 'Permittee will provide the landowner or his representative with a -copy of the residuals land- application program permit that has been most -recently issued by the' Division prior to co-mmencement of, any; residuals land application event. This permit will specify maximum application rates, limitations; and other restrictions prescribed -by' the laws and regulations. 10. The land application site(s) shall be adequately limed to a soil pfl of at least 6.0 prior to residuals land application. Residuals may be applied to the sites with a pH of less than 6 provided that sufficient amounts of lime is also applied to achieve a final pH of the soil mixture of at least 6.0, or if an agronomist provides information indicating that the pH of the soil, residuals, and lime mixture is suited for the specified crop type. 11. The Permittee will furnish the landowner,or his representative with a copy of the results of each soil analysis. 12. Within the limits of the Division's residuals land application program permit, the landowner or his representative and the Permittee will determine residuals application rates and schedules based on crop patterns and the results of soil samples. 11 The landowner or his representative will furnish the Permittee with. information regarding, the amount and analysis of other sources of nutrients (e.g., fertilizer, unregulated animal waste; etc )'that .have been applied to the land application site(s). 14. The landowner or his representative will inform the Permittee of any revisions or modifications to the intended use and cropping patterns for the land application site(s) prior to each planting season to enable the Permittee to amend this Agreement and schedule residuals land application events at appropriate"periods. 15. Specific residuals land application area boundaries shall be clearly marked on the land application site(s) by the Permittee and/or the landowner or his representative prior to and during a residuals land application event. 16. Appropriate measures must be taken by the Permittee and/or the landowner or his representative to control public access to the land -application site(s) during active use and for the 42-month period following a. .residuals land, application event. Such controls may include the posting of signs that indicate, the activities being conducted at the land application site(s). 17. Animals shall not be grazed on the land application site(s) for a 30-day period following a residuals"_ land -application event. Land application sites that are to be used for grazing shall have "fencing that will 'be used to prevent access during these periods after such residuals land application events. 18. 'Crops for direct human consumption shall be harvested in accordance with the conditions of the"bivision's residuals land application program permit. 19. The landowner or his representative hereby authorizes the Permittee, local officials, :and, State officials or their representatives to inspect the land application site(s) prior to, during, and after any residuals land application event and to established monitoring .facilities on or near the land application site(s) .as required by the 'residual"s,land application program permit. 20. Any duly authorized officer, employee, or representative of the Division may, upon presentation of credentials, enter and inspect any property, premises, or place on or related to the land application site(s) at any reasonable time for the purpose of determining compliance with the Division's residuals land application program permit; may inspect or copy any records that must be kept under the terms and conditions of this permit; or may obtain samples of groundwater, surface water, or leachate. 21.
