Dear Mr. Rose:
In accordance with your application received December 27, 1988, we are
forwarding herewith Permit No. WQ0000986, dated. March 14, 1989, to Summey's
Island Beach and Racquet Club for the construction and operation of the subject
wastewater treatment and disposal facilities.
This permit shall be effective from the date of issuance until March 31, 1990,
shall void Permit No. 7089AIR and shall be subject to the conditions and limitations
as specified therein. This permit includes the facilities approved by Permit No.
7089AIR.
If any parts, requirements, or limitations contained in this permit are
unacceptable to you, you have the right to request an adjudicatory hearing upon
written request within 30 days following receipt of this permit. This request must
be in the form of a written petition, conforming to Chapter 150B of North Carolina
General Statutes, and filed with the Office of Administrative Hearings, Post Office
Drawer 11666, Raleigh, North Carolina 27604. Unless such demands are made this
permit shall be final and binding.

For the discharge of Sewage, Industrial Wastes, or Other Wastes
In accordance with the provisions of Article 21 of Chapter 143, General Statutes
of North Carolina as amended, and other applicable Laws, Rules, and Regulations
PERMISSION IS HEREBY GRANTED TO
Summey`s Island Beach and Racquet Club
Carteret County
FOR THE
construction and operation of a 101,460 GPD wastewater treatment and disposal
facility consisting of approximately 2,800 linear feet of 8-inch gravity sewer,
approximately 3,200 linear feet of 4-inch force main, a 210 GPM pump station, a 150
GPM pump station both with dual submersible pumps; a 20,000 gallon equalization basin
with dual 100 GPM pumps and a 100 cfm blower; dual extended aeration package plants
with aeration, clarification and dual 4,974 gallon sludge digestors, and two 360 cfm
blowers; dual 15 square foot tertiary filters; three tablet chlorinators, a 3,500
gallon chlorine contact chamber; a dosing chamber with dual 200 GPM pumps, a 75 foot
diameter and 94 foot diameter rotary distributor; an effluent flow recorder, stand by
power generator, and all associated piping, valves and appurtenances to serve the
Sheraton Hotel and Island Beach and Racquet Club with no discharge to the surface
waters, pursuant to the application received December 27, 1988, and in conformity
with the project plan, specifications, and other supporting data subsequently filed
and approved by the Department of Natural Resources and Community Development and
considered a part of this permit.
This permit shall be effective from the date of issuance until March 31, 1990,
and shall be subject to the following specified conditions and limitations;
I. Upon completion of construction and prior to operation of this permitted
facility, a certification must be received from a professional engineer
certifying that the permitted facility has been installed in accordance with the
requirements of this permit and the approved plans and specifications. Mail the
certification to the Permits and Engineering Unit, P.O. Box 27687, Raleigh, N.C.
27611-7687.
2. This permit shall become voidable unless the facilities are constructed in
accordance with the approved plans, specifications and other supporting data.
4. The facilities shall be properly maintained and operated at all times.
5. This permit is not transferable.
6. This permit shall become voidable in the event of failure of the soil to
adequately absorb the wastes and may be rescinded unless the facilities are
installed, maintained, and operated in a manner which will protect the assigned
water quality standards of the surface waters and ground waters.
7. In the event that the facilities fail to perform satisfactorily, including the
creation of nuisance conditions, the Permittee shall take such immediate
corrective action as may be required by this Division, including the construction
of additional or replacement wastewater treatment or disposal facilities..
8. The Wilmington Regional Office, phone no. 919/256-4161 shall be notified at
least twenty-four (24) hours in advance of operation of the installed
facilities so that an in -place inspection can be made. Such notification to the
regional supervisor shall be made during the normal office hours from 8:00 a.m.
until 5:00 p.m. on Monday through Friday, excluding State Holidays.
9. The sludge generated from these treatment facilities must be disposed of in
accordance with General Statute 143-215.1 and in a manner approvable by the North
Carolina Division of Environmental Management.
10. Diversion or bypassing of the untreated wastewater from the treatment facility
is prohibited.
11. The Permittee, at least six (6) months prior to the expiration of this permit,
shall request its extension. Upon receipt of the request, the Commission will
review the adequacy of the facilities described therein, and if warranted, will
extend the Permit for such period of time and under such conditions and
limitations as it may deem appropriate.
12. The Permittee shall employ a certified wastewater treatment plant operator to be
in responsible charge of the wastewater treatment facilities. Such operator must
hold a certificate of the grade at least equivalent to the classification
assigned to the wastewater treatment facilities by the Certification Commission.
13. The issuance of this permit shall not relieve the Permittee of the responsibility ✓
for damages to surface or groundwaters resulting from the operation of this
facility.
14. The facilities shall be effectively maintained and operated as a non -discharge
system to prevent the discharge of any wastewater resulting from the operation of
this facility.
15. No type of wastewater other than that from the Sheraton Hotel and the Island
Beach and Racquet Club shall be discharged into the treatment facility. a
16. The rotary distributors shall be maintained on a frequent and routine basis to
keep the surface free of vegetation.
17. This Permit shall become voidable unless the agreement between the Division of
Environmental Management, Summey Building Systems, Inc., and Island Beach and
Racquet Club Home Owners Association is in full force and effect.
18, Adequate inspection, maintenance, and cleaning shall be provided by the Permittee
to insure proper operation of the subject facilities.
19. A "green area" of approximately 250,000 square feet shall be maintained.
20. A set of approved plans and specifications for the subject project must be
retained by the applicant for the life of the project,
21. The following buffers shall be maintained:
a. 400 feet between rotarys and residences surface water
b. 100 feet between rotarys and drainage way, creek, lake or pond
C. 100 feet between rotarys and property lines
d. 200 feet between rotarys and ground water drainage systems
e. 100 feet between rotarys and potable wells,
22. The engineering plans approved by Permit No. 7089AIR shall be approved by a
issuance of this Permit.
23. The Permittee shall initiate a self monitoring program in accordance with the
following schedule:

The results of the self monitoring during the previous month shall be submitted
to the Division of Environmental Management postmarked no later that the 30th day
following the completed reporting period. Duplicate signed copies of these
reports shall be submitted to the following address:

24. Within forty (40) days of issuance of the permit amendment, the permittee shall
(a) have abandoned the four (4) existing monitor wells in accordance with the
requirements specified in 15 NCAC 2C .0113 (a)(2), and (2) have completed
installation of four (4) new monitor wells, located as shown on Attachment #1 and •;
constructed in a manner approved by the Wilmington Regional Field Office.
25. Within eighty-five (85) days of issuance of the permit amendment, the permittee
shall have sampled the four (4) new,monitor wells for the following parameters,
and shall be submitted the analyses to the Wilmington Regional. Office:
NO3 Fecal Coliform
Total Ammonia Total Coliform
TDS Purgeables (as identified by EPA method 624)
pH Base/Neutrals,and Acids (as indicated by EPA
Water levels method 625)
26. If the results of any of the analyses specified in condition No. 25 indicates a
contravention of the groundwater standards specified in 15 NCAC 2h .0200, the
permittee shall resample the wells three .(3) additional times, at two week
intervals, during the following six (6) weeks. The resamples shall be analyzed
for every constituent identified in the initial sampling which equalled or
exceeded the applicable groundwater standard. The results of each set of
resamples shall be submitted to the Wilmington Regional Office within forty (40)
days of the date of sample collection.
27. If the Department determines, as a result of the sampling and analyses required
in Conditions 25 and 26, that a contravention of groundwater standards exists, or
is probable, at the Perimeters of Compliance, as shown on Attachments #2 and #3,
the permittee shall discontinue use of the disposal structure which is cause of
the contravention of groundwater quality standards,
28. If the results of the sampling and analysis specified in Condition 25 above does
not show any existing or highly probable contravention of groundwater standards
at the Perimeter of Compliance, the permittee should sample the four (4) monitor
wells every March, duly and November for the parameters specified in Condition
25, except that the analyses for Purgeables and Base Neutrals and Acids need
only be made for those samples collected in November.
29. The results of all monitoring specified in Condition 28 above shall be submitted
to the Department, on or attached to Form GW-59, by the last day of the month
following the month in which the sample is collected.
30. The permittee will conduct any additional sampling deemed necessary by the
Department.
31, The Permittee shall replace the continuous grating covering the treatment plant
with conventional walkways and handrails. 'A
32. The application rate of rotary distributors shall nuL exceed 9.25 gallons/ft2.
