Landfarming of Petroleum Contaminated Soil Johnston County Dear Mr. Wall: In accordance with your application received Octo':)er 20, 1988, we are forwarding herewith Permit No. WQ0000654, dated December 12, 1988, to Miles, Inc. for the construction and operation of the subject petroleum contaminated soil remediation program. This permit shall be effective from the date of issuance until May 31, 1990, and shall be subject to the conditions and limitations as specified therein. If any parts, requirements, or limitations contained in this permit are unacceptable to you, you have the right to request an adjudicatory hearing upon written request within 30 days following receipt of this permit. This request must be in the form of a written petition, conforming to Chapter 7.50E of North Carolina General Statutes, and filed with the Office of Administrative Hearings, Post Office Drawer 11666, Raleigh, North Carolina 27604. Unless such demands are made this permit shall be final and binding. One (1) set of approved plans and specifications is being forwarded to you. Johnston County FOR THE construction and operation of a landfarming site to biologically treat petroleum contaminated soil consisting of the application of 7C3 cubic yards of petroleum contaminated soil to approximate ' ly 5.2 acres of land. at a depth of one inch, pursuant to the application receved October 20, 1988, and in conformity with the project plan., specifications, and other supporting data subsequently filed and approved by the Department of Natural Resources and Community Development and considered a part of this permit. This permit shall be effective from the date of issuance until May 31, 1988, and shall be subject to the following specified conditions and limitations: 1. Upon completion of the landfarming activities, a certification must be received from a professional engineer or certified soil scientist that the permitted landfarming activities have been completed in accordance with the requirements of this permit and the approved plans and specifications. Mail this certification to the Permits and Engineering Unit, P. 0. Box 27687, Raleigh, NC 27611-7687. 2. This permit shall become voidable unless the facilities are constructed in accordance with the approved plans, specifications, and other supporting data. 3. This permit is effective only with respect to the nature and volume of wastes described in the application and other supporting data. 4. The facilities shall be properly maintained and operated at all times. 5. This permit is not transferable. 6. In the event that the facilities fail to perform satisfactorily, including the creation of nuisance conditions, the Permittee shall take such immediate corrective action as may be required by this Division, including the construction of additional or replacement wastewater treatment or disposal facilities. 7. A suitable year round vegetative cover shall be maintained. 8. Adequate facilities shall be provided to prevent surface runoff from carrying any disposed or stored material into any surface waters. 9. The issuance of this permit shall not relieve the Permittee of the responsibility for damages to surface or groundwaters resulting from the operation of this facility. 10. No contaminated soil other than that from Miles, Inc. shall be placed on the land application disposal site. 11. In any future transfer of this land, a notice shall be given to the new owner that gives full details of the materials applied or incorporated at this site. 12. A 50 -foot buffer shall be maintained between drainageways, a 100 -foot buffer shall be maintained between each landowner's property lines, and a 400 -foot buffer shall be maintained between any residence and any applied contaminated soil. 13. The site shall be adequately limed to a soil pH of 6.5 prior to contaminated soil application. 14. No food -chain crops shall be grown on the landfarming site. 15. The contaminated soils and lime shall be thoroughly i.icorporated into the top six to eight inches of the native soils by tilling or disking. 16. Application of contaminated soil shall not exceed a depth of one inch. 17. Access to the landfarming site shall be restricted and posted. 18. This permit shall expire on May 31, 1990, and shall not be renewed. 19. Prior to beginning waste disposal operations, two (2) monitor wells, one (1) upgradient and one (1) downgradient, must be installed to monitor groundwater quality. The location and construction details for these wells must be by approval of the Raleigh Regional Office, from which a well construction permit must be obtained. 20. The monitor wells must be sampled initially after construction (and prior to waste disposal operations) and thereafter every March, July, and November for the following parameters: Benzene (EPA Method 602) Toluene (EPA Method 602) Total Xylenes (EPA Method 602) Ethylbenzene (EPA Method 602) Polynuclear Aromatic Hydrocarbons (EPA. Method 610 or 625) Lead (EPA Method 239.2 or Standard Method 304) Water Level The measurement of water level must be made prior to sampling for the remaining parameters. The results of the sampling and analysis shall be sent to the N. C. Division of Environmental Management of Form GW -59 [Compliance Monitoring Report Form) every April, August and December. 21. In order to provide the extra oxygen needed for waste biodegradation to proceed, the site shall be retilled at periods of one (1) month, two (2) months and six (6) months following disposal. 22. Soil samples shall be collected, from a minimum of two (2) areas at the disposal site, at intervals of six (6) months and twelve (12) months following disposal. Each sample will be composed of the vertical column of soil, extending from land surface to the maximum depth of waste incorporation, and collected by using a soil auger, Shelby tube or split -spoon sampler. Samples at each location will be thoroughly mixed and a representative portion analyzed to determined the concentration of (i) Petroleum Fuel Hydrocarbons, and (ii) Volatile Organic Aromatic compounds. The results of the soil analyses shall be submitted to the Groundwater Section, Raleigh Regional Office, Division of Environmental Management, within thirty (30) days of sample collection. The address is; 3800 Barrett Drive, Raleigh, NC 27609. 23. Any additional groundwater quality monitoring, as deemed necessary by the Department, shall be provided. 24. No contaminated soil shall be land farmed within 100 feet of the water supply well located on the site. 25. A copy of the approved plans and specifications shall be maintained on file by the permittee for the life of the permit_ Permit issued this the 12th day of December, 1988.
