Dear Ms, Palmer:
In accordance with your application received October 21, 1988, we are
forwarding herewith Permit No. WQ0000632, dated February 1, 1989, to the Town of
Spencer for the operation of the subject sludge land application facilities.
This permit shall be effective from the date of issuance until January 31,
1994, and shall be subject to the conditions and limitations as specified therein.
If any parts, requirements, or limitations contained in this permit are
unacceptable to you, you have the right to request an adjudicatory hearing upon
written request within 30 days following receipt of this permit. This request must
be in the form of a written petition, conforming to Chapter 150B of North Carolina
General Statutes, and filed with the Office of Administrative Hearings, Post Office
Drawer 11666, Raleigh, North Carolina 27604. Unless such demands are made this
permit shall, be final and binding.

For the discharge of Sewage, Industrial Wastes, or Other Wastes
In accordance with the provisions of Article 21 of Chapter 143, General Statutes
of North Carolina as amended, and other applicable Laws, Rules, and Regulations
PERMISSION IS HEREBY GRANTED TO
Town of Spencer
Rowan County
FOR THE
operation of a sludge land application program which consists of applying sludge
from the Town of Spencer's Wastewater Treatment Plant to approximately 71.53 total
acres of land which are owned by Mr. George Small in Rowan County, pursuant to the
application received October 21, 1988, and in conformity with the project plan,
specifications, and other supporting data subsequently filed and approved by the
Department of Natural Resources and Community Development and considered a part of
this permit.
This permit shall be effective from the date of issuance until. January 31, 1994,
and shall be subject to the following specified conditions and limitations:
1. This permit is effective only with respect to the nature and volume of wastes
described in the application and other supporting data.
2. The facilities shall be properly maintained and operated at all times.
3. This permit is not transferable.
4. This permit shall become voidable in the event of failure of the soil to
adequately absorb the wastes and may be rescinded unless the facilities are
installed, maintained, and operated in a manner which will protect the assigned
water quality standards of the surface waters and ground waters.
5. The Permittee, at least six (6) months prior to the expiration of this permit,
shall request its extension. Upon receipt of the request, the Commission will
review the adequacy of the facilities described therein, and if warranted, will
.extend the Permit for such period of time and under such conditions and
limitations as it may deem appropriate.

6. Any monitoring deemed necessary by the Division of Environmental Management to
insure surface and ground water protection will be established and an acceptable
sampling reporting schedule shall be followed.
7. The land application sites shall be effectively maintained and operated at all
times so that there is no discharge to the surface waters, nor any contamination
of ground waters which will rendez them unsatisfactory for normal use. In the
event that the facilities fail to perform satisfactorily, including the creation
of nuisance conditions or failure of the application area to adequately absorb
the sludge, the Permittee shall take such immediate corrective action as may be
required by the Division of Environmental Management.
8. Adequate facilities shall be provided to prevent surface runoff from carrying any
disposed or stored material into any surface waters.
9. The issuance of this permit shall not relieve the Permittee of the responsibility
for damages to surface or groundwaters resulting from the operation of this
facility.
10. The facilities shall be effectively maintained and operated as a non -discharge
system to prevent the discharge of any wastewater resulting from the operation of
this facility.
11. No type of sludge other than that from the Town. of Spencer's Wastewater
Treatment Plant shall be placed on the land application disposal site.
Adequate provisions shall be taken to prevent wind erosion and surface runoff
from conveying pollutants from the sludge application area onto the adjacent
property or into the surface waters.
13. Sludge shall not be applied in inclement weather or until 24 hours following a
rainfall event of 1/2 -inch or greater in 24 hours. Emergency sludge disposal
measures shall be approved by the Division of Environmental Management.
14. No crops for direct human consumption shall be raised on these sites for a period
of 18 months following sludge application.
15. Maximum slope for sludge application shall be 10% for surface application and 18%
for subsurface applications.
16. Surface applied sludge will be plowed or disced in immediately after application
on lands with no cover crop established.
17. Public access to the land application sates shall be controlled during active
site use and for the 12 -month period following the land application event.
18. A set of approved plans and specifications for the subject project must be
retained by the applicant for the life of the project.

19. Each site shall be adequately limed to a soil pH of 5.5 prior to initial sludge
applications. Thereafter, soil tests shall be performed annually and lime
additions will be made in accordance with the recommendations of a recognized
soil scientist or agronomist. The Permittee shall submit a copy of the soil test
results and a report of lime additions in accordance with the schedule indicated
in Condition. No. 29.
20. A recorded log of sludge applications, which includes but shall not necessarily
be limited to the following, shall be maintained at the Spencer Wastewater
Treatment Plant as a permanent record:
a. date sludge applied;
b. site location;
c. method of application;
d. weather conditions;
e, quantity of sludge applied.
21. The owner of the disposal site shall be furnished with an annual analysis of the
sludge which is delivered to his site.
22. Sludge shall not be disposed of within areas prone to flooding by the 100 -year
storm, except during the period between May 1st and October 30th and only by
subsurface application.
23. Sludge applications shall not exceed:

24. Sludge shall be uniformly applied so as to avoid runoff, ponding or erosion.
25. Sludge applications should not exceed the needs of the crop being grown, based
upon current soil and sludge analysis.
26. This Permit shall become voidable unless the agreements between the Town of
Spencer and the land owners listed below are in full force and effect:

27. If any nuisance conditions (including odor problems) arise concerning this land
application program, including problems related to transportation, storage, or
application, the Town of Spencer shall terminate sludge disposal immediately
atter notification by the Division of Environmental Management.
28. Lactating dairy animals shall not be grazed on sludge applied areas for a
period of one year following sludge application. All other animals should not be
grazed on sludge applied land within thirty (30) days following sludge
application. Application sites that are to be used for grazing shall have
fencing that will prevent access.
29. The Permittee shall submit a current annual composite sludge analysis report
-and summary of all applications to the North Carolina Department of Natural
.Resources and Community Development, Mooresville Regional Office (919 North Main
Street, Mooresville, North Carolina 28115). The sludge analysis report shall
contain at least the following:

Note: The report period shall be for the calendar year (January 1 -
December 31) and shall be submitted no later than February 1 of each
following calendar year,
30. The summary of sludge applications shall specify the date of application,
location of application, method of application, weather conditions, and loading
rates for nutrients, metals and hydraulic load.
31. The Permittee shall contact the Mooresville Regional Office to obtain proper
forms and assistance in maintaining proper records and submitting reports.
32. No land application of sludge shall be conducted where the depth to the seasonal
high water table is less than three feet.
33. Should cumulative applications of metals exceed those limitations indicated in
condition No. 23, the Permittee shall take whatever remedial actions may be
required by the Division of Environmental Management including, but not limited
to, inclusion of the following statement as a part of the property deed:
"Portions of this property have received solid waste at high metals application
rates and care should be taken if food chain crops are grown due to a possible
health hazard."
34. This Permit shall become voidable unless the facilities are operated in
accordance with the approved plans, specifications and other supporting data.
35. No sludge shall be applied in the form of subsurface application within a
50 -foot buffer zone of a water course or wet -weather drainage area, within a
100 -foot buffer zone of a WS classified water course and its tributaries, or
within 100 feet of any well.
36. No sludge shall be applied within a 100 -foot buffer zone of any property line or
right of way boundary.
37. The following buffer zones shall be maintained between any applied sludge and a
permanent residence, depending on the method of application and the location of
the residence:
a. 100 feet from any on-site residence, surface or subsurface
b. 200 feet from any off-site residence, subsurface only
G. 400 feet from any off-site residence, surface only
