Acting Director Subject: Application No. WQ0000506 Wallace Woodall Vacuum Pumping Services, Incorporated Land Application of Residual Solids Chatham County Dear Mr. Shiver: In accordance with your letter received August 10, 1992, referencing the renewal of the subject permit application, we are forwarding the Division's comments. In the letter dated August 10, 1992, Chatham County raised four (4) points of interest pertaining to the subject permit renewal. These points of interest were, one (1), the County was uncertain of whether there were currently permitted lands that were not being considered for renewal, two (2), the issue of Mr. Woodall's land being located in the Cape Fear Township which falls under the Chatham County Zoning Ordinance, three (3), the requirement for landowner agreements at permit renewal, and four (4), the issue of no more sites being permitted in Chatham County until Mr. Woodall has made a request to the Board of Commissioners for these additional sites. Enclosed you will find the current permit issued to Wallace Woodall Vacuum Pumping Services, Incorporated. The permit contains all lands that have been approved by the Division for land application of residual solids. Some sites have been deleted from the previous permit. These sites include the Bray and Cockman properties in Chatham County and the Franks and Harward properties in Wake County. Please note that condition VI 9 of the enclosed permit states that, "The issuance of this permit does not preclude the Permittee from complying with any and all statutes, rules, regulations, or ordinances which may be imposed by other government agencies (local, state, and federal) which have jurisdiction." Therefore, Mr. Woodall is expected to obtain all other approvals which would be necessary for land application from the local governmental agencies. For permit renewals, the applicant is required to submit updated landowner agreements for each property which is to be considered for renewal. The local government should notify Mr. Woodall that he may need to petition before the Board of Commissioners for local approval for land application of sites in Chatham County.
