Dear Mr. Wray:
In accordance with your application received July 5, 1988, we are forwarding
herewith Permit No. WQ0000474, dated September 28, 3988, to The Caswell
Partnership, BVI Financial Corporation for the construction and opet-ati.on of the
subject wastewater treatment facility.
This permit shall be effective from the date of issuance until September 30,
1993, and shall be subject to the conditions and limitAtiol75 as specified therein -
If any parts, requirements, or limitations contained in this permit are
unacceptable to you, you have the right to request an adjudicatory hearing upon
written request within 30 days following receipt of this pormi-t. This request must.
be in the form of a written petition, conforming to Chapter ISOB of North Carolina.
General Statutes, and filed with the Office of Administrat-ive Hearings, Post Office
Drawer 11666, Raleigh, North Carolina 27604. Unless such demands are made this
permit shall be final and binding.

In accordance with the provisions of Article 21 of Chapter. 143, General Statutes
of North Carolina as amended, and other applicable Laws, Rules, and Regulations
PERMISSION IS HEREBY GRANTED TO

FOR THE
construction and operation of a 75,000 GPD wastewater treatment and disposal
facility consisting of a 15,000 gallon equalization basin,, tcdo 37,500 gallon aeration
tanks, two 6100 gallon clarifiers, a 8400 gallon sludge digestion/holding tank, four
blowers with 300 scfm total capacity, dual tertiary filters with 52 square feet of
surface area, two tablet chlorinators, a 1550 gallon chlorine contact chamber,
effluent flow meter, a. 1520 gallon effluent dosing chamber with dual. 100 GPM
submersible pumps, two rotary distributors with a total of 15,700 square feet of
disposal area., repair space for rotary distributors, and stared by power to serve the
Arboretum - Caswell Beach Plantation Subdivision with no discharge to surface waters
pursuant to the application received July 5, 1988, and in conformity with the
project plan, specifications, and other supporting data subsequently filed and
approved by the Department of Natural Resources and Community Development and
considered a part of this permit.
This permit shall be effective from the date of. .issuance until. rescinded, and
shall be subject to the following specified conditions and li.mi.tati.ons:
1. This permit shall become voidable unless the facilities are constructed in
accordance with the approved plans, specifications and other supporting data..
2. This permit is effective only with respect to the nature and volume of was -Les
described in the application and other supporting data.
3. The facilities shall be properly maintained and operated at all. times.
4. This permit is not transferable.
5. Upon the availability of a municipal or regional sewerage collection system, the
subject wastewater treatment system shall be abandoned and all wastewater
discharged into the municipal or regional sewerage system.
6. This permit shall become voidable in the event of failure of the soil to
adequately absorb the wastes and may be rescinded unless the facilities are
installed, maintained, and operated in a. manner which will protect the assigned
water quality standards of the surface waters and ground waters.
7_ In the event that the facilities fail to perform satisfactorily, including the
creation of nuisance conditions, the Permittee shall take such immediate
corrective action as may be required by this Division, including the construction
of additional or replacement wastewater treatment or disposal. facilities.
8. The Wilmington Regional Office, phone no. 919/256-4161 shall be notified at
least twenty-four (24) hours in advance of operation of the installed system so
that an in-place inspection can be made. Such notification to the regional
supervisor shall be made during the normal office hours from 13:00 a.m. until 5:00
p.m. on Monday through Friday, excluding State Holidays.
9. Any monitoring deemed necessary by the Division of Environmental Management to
insure surface and ground water protection will be established and an acceptable
sampling reporting schedule shall be followed.
10. The sludge generated from these treatment facilities must be disposed of in
accordance with General. Statute 143-215.1 and in a manner approvable by the North
Carolina Division of Environmental Management.
11. BVI Financial Corporation shall submit a sludge management and disposal plan
within 60 clays of issuance of this permit to the Wilmington Regiorna.l Office.
Failure to comply may result in revocation of this permit.
12. Diversion or bypassing of the untreated wastewater from the treatment system is
prohibited.
13. The Permittee, at least six (6) months prior to the expiration of -this permit,
shall request its extension. Upon receipt of the request, the (commission will
review the adequacy of the facilities described therein, and if warranted, will
extend the Permit for such period of time and iinde.r such conditions and
limitations as it may deem appropriate.
1.4. The Permittee shall employ a certified wastewater treatment plant operator to be
in responsible charge of the wastewater treatment facilities. Such operator must
hold a certificate of the grade at least equivalent to the classification
assigned to the wastewater treatment facilities by the Certification Commission.
15. The issuance of this permit shall not relieve the Permittee of the responsibility
for damages to surface or groundwaters resulting from the operation of this
facility.
16. The facilities shall be effectively maintained and operated as a non -discharge
system to prevent the discharge of any wastewater resulting from the operation of
this facility.
17. No traffic or equipment shall be allowed on the disposal area except while
installation occurs or wh:-1e normal maintenance is being performed.
18. Adequate inspection, maintenance, and cleaning shall be provided by the Permittee
to insure proper operation of the subject facilities.
19. An acceptable reserve area, equal in size to the approved disposal area, shall be
maintained at all times.
20. Solids, sludges, or other pollutants removed or resulting from the wastewater
storage facilities shall be contained and disposed of in such a manner as to
prevent any contamination of the surface or gror,rndwaters of the State.
21. The sand media of the tertiary filters must comply with the Division's
specifications. The engineer's certification will serve as proof of this
compliance.
22, A copy of the approved plans and specifications shall. be maintained on file by
the Permittee for a minimum of five years from the date of issuance.
23. The Operational. Agreement between the Permittee and tha Environmental. Management
Commission is incorporated herein by reference and is a condition of this
Permit. Noncompliance with the terms of the Operational Agreement shall subject
the Permittee to all sanctions provided by G. S. 1.43-21.5.6 for violation of or
failure to act in accordance with the terms and conditions of this Permit.
24. Upon completion of construction and prior to operation of this permitted
facility, a certification must be received from a professional engineer
certifying that the permitted facility has been installed in accordance with the
requirements of this permit and the approved plans and specifications. Mail. the
certification to the Permits and Engineering Unit, P.O. Box 27687, Raleigh, N.C.
27611-7687.
25. The rotary distributors shall be raked and maintained at: such frequency as
required to keep the surface free of vegetation and organic mattes..
26. The finished surface elevation of the rotary distributors shall. be 14 feet MSL as
indicated on the approved plans.
27. Any restrictive soil material which may be encountered diiring construction of the
rotary distributors shall be removed and replaced with clean sandy soil.
28. Prior to beginning waste disposal operations, three (3) monitoring wells, one (1)
gradient and two (2) downgradient, screened from 15 ft-.. to 20 ft., must be
installed to monitor groundwater quality. The location and construction details
for these wells must be by approval of the Wilmington Regional Office, from which
a well construction permit must be obtained.

The monitor wells must be sampled initially afterconstruction
(and prior to
waste disposal operations) and thereafter every March, July, and November for the
following parameters:

TOX (in Nov. only)
Orthophosphate
The measurement of water level must be made prior to sampling for the remaining
parameters.
The analytical methods used for TOX must be capable of detecting the total of all
halogenated organic compounds present at a concentration of 5.0 parts per billion
(ppb) or greater. In the event that a TOX concentration of 5.0 ppb or greater is
detected, any individual halogenated organic componnd(s) present at a
concentration, at or above the method detection limit (MnQ must be identified and
quantified utilizing EPA methods 601, 602, 604 and 611.
The results of the sampling and analysis shall. be sent to the N.C. Division of
Environmental Management on Form OW -59 (Compliance Monitoring Report Form) every
April, August and December.
30. Any additional groundwater quality monitoring, as deemed necessary by the
Department, shall be provided.
