In accordance with your request received September 1, 1988, we are forwarding
herewith Permit No. WQ0000424, dated December. 21., 1988, to West Point Peppea:el.l
for the operation of the subject sludge land application facilities.
This permit shall be effective from the date of issuance until December 1, 1992,
shall void Permit No, 700483, which was issued on December 9, 1987, and shall be
subject to the conditions and limitations as specified therein.
Please be aware that the two new monitor wells referred to in condition no. 36
must be sampled prior to the start of waste disposal operations in order to
establish baseline groundwater quality.
If any parts, requirements, or limitations contained in this permit are
unacceptable to you, you have the right to request an adjudicatory hearing upon
written request within 30 days following receipt of this permit. This request must
be in the form of a written petition, conforming to Chapter 1508 of North Carolina
General Statutes, and filed with the Office of Admin[strative Hearings, Post Office
Drawer 11666, Raleigh, North Carolina 27604. Unless such demands are made this
permit shall be final and binding.

For the discharge of Sewage, Industrial Wastes, or Other Wastes
In accordance with the provisions of Article 21 of Chapter 1.43, General Statutes
of North Carolina as amended, and other applicable Laws, Rules, and Regulations
PERMISSION IS HEREBY GRANTED TO
West Point Pepperell
Martin County
FOR THE
continued operation of a 9,500 GPD sludge land application program to dispose of
stabilized liquid sludge from the West Point Pepperell Wastewater Treatment Plant to
�tes which are owned by West Point Pepperell and Mr. Dail Rodgerson and which have a.
A al area of approximately 54.5 acres, pursuant to the request received September
1, 1988, and in conformity with the project plan, specifications, and other
supporting data subsequently filed and approved by the Department of Natural
Resources and Community Development and considered a part of this permit.
This permit shall be effective from the date of issuance until December 1, 1992,
shall void Permit No. 7004R3 which was issued on December 9, 1987, and shall be
subject to the following specified conditions and limitations:
1. This permit is effective only with respect to the nature and volume of wastes
described in the application and other supporting data.
2. The facilities shall be properly maintained and operated at all times.
3. This permit is not transferable.
4. This permit shall become voidable in the event of failure of the soil to
adequately absorb the wastes and may be rescinded unless the facilities are
installed, maintained, and operated in a manner which will protect the assigned
water quality standards of the surface waters and ground waters.
5. In the event that the facilities fail to perform satisfactorily, including the
creation of nuisance conditions, the Permittee shall take such immediate
corrective action as may be required by this Division, including the construction
of additional or replacement wastewater treatment or disposal facilities.
Any monitoring deemed necessary by toe Division of: Environmental Management to
insure surface and ground water p,roLection will. be established and an acceptable
sampling reporting schedule shall be followed_
7. The sludge generated from these 'treatment facilities must be disposed of ill
accordance with General Statute 143-215..1 and in a manner approvable by the North
Garoli.rla Division of Environmental Management-.
8. The Permittee, at least six (6) mon.tbs prior to the expiration. of this permit,
shall request its extension. Upon receipt of the request, the Commission will
review the adequacy of the facilities described therein, and if warranted, will
extend the Permit for such period of time and under such conditions and
limitations as it may deem appropriate,
9. Adequate facilities shall be provided to prevent surface runoff from carrying any
disposed or stored material into any surface waters.
J.Q. The issuance of this permit shall not relieve the permittee oC the responsibility
for damages to surface or groundwaters resulting from the operation of this
facility.
11. No type of sludge other than that from West Point Pepperell's Hamilton
Wastewater Treatment Plant shall be placed on the land application disposal site.
12. Adequate provisions shall be taken to prevent: wind erosion and surface runoff
from conveying pollutants from the sludge appli.catiol-n area onto the adjacent.
property or into the surface waters.
13. Sludge shall not be applied in inclement weather or until 24 hours following a
rainfall event of 1/2 -inch or greater in 24 hours. Emergency sludge disposal
measures shall be approved by the Division of Environmental Management.
14. The site shall be adequately limed to a soil pH of 6.5 prior to sludge
application.
15. No crops for direct human consumption shall be raised on these sites for a period
of 18 months following sludge application.
16. Adequate inspection, maintenance, and cleaning shall be provided by the Permittee
to insure proper operation of the subject facilities.
17. This permit shall become voidable unless the agreement between West Point
Pepperell and Mr. Dail Rodgerson is in full force and effect.
18. in any future transfer of this land, a notice shall be given to the new owner
that gives full details of the materials applied or incorporated at this site.
19. Solids, sludges, or other pollutants removed or resulting from the wastewater
storage facilities shall be contained and disposed of in such a manner as to
prevent any contamination of the surface or groundwaters of the State.

U.' Animals should not be grazed on sludge applied land within a 30 -day period
following the sludge application. Application sites that are to be used for
'grazing shall have fencing that will be used to prevent access during the 30 -day
periods after each application.
21. Surface applied sludge will be plowed or dzsced in immediately after application
on lands with no cover crop established.
22. Surface application of liquid sludge shall noL be used on sites that are prone to
flooding conditions. (Below the 100 -year flood level.)
23. public access to the land application sites shall be controlled during active
site use and for the 12 -month period following the land application event.,
24. At plant site B (10 acres beside plant), a 50 foot buffer shall be maintained
71 between any applied sludge and the property line on the front side of the
property and the property line on the back corner of the property.
25. The sludge shall be stabilized by liming to a p1l of 11.5 prior to application.
26. No liquid sludge shall be surface applied within a 100 -foot buffer zone of any
water course or surface drainage area.
27. No liquid sludge shall be applied by subsurface injection within a 25 -foot buffer
zone of any water course or surface drainage area.
1. The application rates shall not exceed:
A) Plant Site A (front lawn; 6.5 useable acres)
1) one inch/acre/week of liquid sludge uniformly applied so as to prevent
runoff,, ponding, or erosion;
2) 46,000 gallons/acre/year.
B) Plant Site B (coastal Bermuda field; 8.9 useable acres)
1) one inch/acre/week of liquid sludge uniformly applied so as to prevent
runoff, ponding, or erosion;
2) 46,000 gallons/acre/year until the Coastal Bermuda crop is established;
3) 80,000 gallons/acre/year after the Coastal Bermuda crop is established.
C) Farm Site (Rodgerson Farm; 38 usable acres)
1) one inch/acre/week of liquid sludge uniformly applied so as to prevent
runoff, ponding, or erosion;
2) 80,000 gallon/acre/year.
29. Any additional groundwater quality monitoring as deemed necessary by the
Department, shall be provided.
30. Except as specified in condition no. 24, a 100 foot buffer shall be maintained
between any applied sludge and the property line. A 400 foot buffer shall be
maintained between any residence and any applied sludge.
31 There shall be at least a one year lapse between the application of sludge and
the planting of peanuts on these sites.
.i2. A protective fence with warning signs shall be maintained around the West Point
Pepperell owned disposal site,
33. No sludge shall be applied within 100 feet of any water supply well.
34. No sludge shall be applied upgra.dient or within 100 feel: of monitor. well No. 5
unless a new well is constructed for the purpose of monitoring background
groundwater quality.
35. Monitor wells must be of sufficient depth to allow sampling of the water table
aquifer throughout the year.
36. Prior to beginning waste disposal. operations at Plant Site B, two (2)
downgradient monitor wells must be installed to monitor groundwater quality. The
location and construction details for the wells must be approved by the
Washington Regional Office, from which a well construction .permit must be
obtained.
37. The five (5) existing monitor wells and the two (2) additional monitor wells. must
be sampled every March, July and November :For the following parameters:
Nitrate
Total Dissolved Solids
Chemical Oxygen Demand
Total Organic Halides (TOX)
Water Level (prior to sampling)
Sulfates
Chloride
PH
Orthophosphate
Total Suspended Solids (initial sampling of new wells only)
In addition the two (2) monitor wells shall be sampled initially after
construction (and prior to start of waste disposal operations) for the parameters
specified above.
The analytical methods used for TOX must be capable of detecting the total of all
halogenated organic compounds present at a concentration of 5.0 parts per billion
(ppb) or greater. In the event that a TOX concentration of 5.0 ppb or greater is
detected, any individual halogenated organic compound(s) present at a
concentration at or above their method detection limit (MDL) must be identified
and quantified utilizing DPA methods 601, 602, 604 and 61.1.
The results of the sampling and analysis shall be sent to the N.C. Division of
Environmental Management on Form GW -59 (Compliance Monitoring Report Form) every
April, August and December.
38. A recognized soil scientist shall perform an annual soil evaluation and make
appropriate recommendations to West Point Pepperell regarding the subject land
application sites. A copy of this evaluation and these recommendations shall be
submitted to the Washington. Regional Office.
9. West Point Pepperell shall maintain appropriate records, as specified by the
Washington Regional Office, on the operation and maintenance of these
facilities. These records will be submitted to the Washington Regional Office
upon request of that office.
