This permit shall be effective from the date of issuance until October 31, 1989, and shall be subject to the conditions and limitations as specified therein. If any parts, requirements, or limitations contained in this permit are unacceptable to you, you have the right to request an adjudicatory hearing upon written request within 30 days following receipt of this permit. This request must be in the form of a written petition, conforming to Chapter 150B of North Carolina General Statutes, and filed with the Office of Administrative Hearings, P.O. Box 11666, Raleigh, NC 27604. Unless such demands are made this permit shall be final and binding. Box 27687, Raleigh, North Carolina 27611-7687 Telephone 919-733-7015 An Equal Opportunity Affirmative Action Employer NORTH CAROLINA ENVIRONMENTAL MANAGEMENT COMMISSION DEPARTMENT OF NATURAL RESOURCES AND COMMUNITY DEVELOPMENT RALEIGH PERMIT For the discharge of sewage, industrial Wastes, or Other Wastes In accordance with the provisions of Article 21 of Chapter 1.43, General Statutes of North Carolina as amended, and other applicable Laws, Rules, and Regulations PERMISSION IS HEREBY GRANTED TO Cazwell Development, Inc Durham County FOR THE continued operation of pump and haul activities consisting of pumping 1,080 GPD of wastewater from an on-site collection manhole at Montvale Subdivision and hauling the wastewater to the City of Durham's Farrington Road Wastewater Treatment Plant, pursuant to the application received June 12, 1989 and in conformity with the project pian, specifications, and other supporting data subsequently filed and approved by the Department of Natural Resources and Community Development and considered a part of this permit. This permit shall be effective from the date of issuance until October 31, 1989 and shall be subject to the following specified conditions and limitations: 1. This permit shall become voidable unless the subject pump and haul activities are carried out in a manner approved by this Division. 2. This permit is effective only with respect to the nature and volume of wastes described in the application and other supporting data. 3. The facilities shall be properly maintained and operated at all times. 4. This permit is not transferable until such time as the permittee has requested a name change to a new permittee. Such a request must be accompanied by an application fee, documentation from the new and current permittees, and other supporting data as may be appropriate. 5. No type of wastewater other than that from Montvale Subdivision shall be included in the pump and haul activities. No other homes shall be included in this permit other than those mentioned in the original application dated September 14, 1989. 6. The permit shall become voidable unless the agreement between Cazwell Development, Inc and the City of Durham for the collection, transportation, and ultimate disposal of wastewater is in full force and effect. 7. In the event that the facilities fail to perform satisfactorily, including the creation of nuisance conditions, the Permittee shall take such immediate corrective action as may be- required erequired by this Division, including the construction of additional or replacement wastewater treatment facilities. 8. Upon availability of a municipal or regional sewerage collection system, the subject wastewater treatment facilities shall be abandoned and all wastewater discharged into the municipal or regional sewerage system. 9. This pump and haul permit shall expire of October 31, 1989. 10. The permittee is liable for any damages caused by a spill or failure of the pump and haul operations. 11. Adequate inspection, maintenance, and cleaning shall be provided by the permittee to insure proper operation of the subject facilities. 12. Failure to abide by the conditions and limitations contained in this permit will subject the Permittee to any enforcement action by the Division of Environmental Management in accordance with North Carolina General Statutes 143-215.6.
