be in the form of a written petition, conforming to Chapter 150E of North Carolina
General Statutes, and filed with the Office of Administrative Hearings, Post Office
Drawer 11666, Raleigh, North Carolina 27604. Unless such demands are made this
permit shall be final and binding.

For the discharge of Sewage, Industrial Wastes, or Other Wastes
In accordance with the provisions of Article 21 of Chapter 143, General Statutes
of North Carolina as amended, and other applicable Laws, Rules, and Regulations
PERMISSION IS HEREBY GRANTED TO

Durham County
FOR THE
construction and operation of a 400,000 GPD (Phase I for 7.50,000 GPI? and Phase II
for 150,000 GPD) spray irrigation wastewater treatment and disposal system consisting
of the following items:
a) a 700 GPM pump station with dual pumps, stand-by power, and high water alarm,
and approximately 6000 linear feet of 1_0 inch force main,
b) a 400,000 GPD Davco contact stabilization wastewater treatment plant
consisting of a barscreen, a 50,030 gallon contact tank, a 100,162 gallon
reaeration tank, a 68,874 gallon clarifier, a 89,850 gallon aerated sludge
digestion tank, a gaseous chlorine injector, and a 11,193 gallon chlorine
contact tank,
c) two storage ponds with a total volume of approximately 90 acre-feet,
d) a 1320 GPM pump station with dual horizontal split case pumps .for irrigation,
e) approximately 130 acres of spray irrigation disposal area with all associated
piping, valves, and appurtenances to serve the Treyburn Development with no
discharge of treated wastewater to the waters of the State, pursuant to the
application received September 14, 1988, and in conformity with the project
plan, specifications, and other supporting data subsequently filed and
approved by the Department of Natural Resources and Community Development and
considered a part of this permit.
This permit shall be effective from the date of issuance until October 31, 1993,
and shall be subject to the following specified conditions and limitations:
I. This permit shall. become voidable unless the facilities are constructed in
accordance with the approved plans, specifications and other supporting data.
2. This permit is effective only with respect to the nature and volume of wastes
described in the application and other supporting data.
3. The facilities shall be properly maintained and operated at all times.
4. This permit is not transferable.
5. The Raleigh Regional Office, phone no. 919/733-2314 shall be notified at least
twenty-four (24) hours in advance of operation of the instaI.led spray
irrigation treatment and disposal. system so that an in. -place inspection can be
made. Such notification to the regional supervisor shall be made during the
normal office hours from 8:00 a.m. until 5:00 p.m. on Monday through Friday,
excluding State Holidays.
6. The sludge generated from these treatment facilities must be disposed of in
accordance with General Statute 143-215.1 and in a manner approvable by the North
Carolina Division of Environmental Management.
7. The spray irrigation facility shall be effectively maintained and operated at
all times so that there is no .discharge to the surface waters, nor any
contamination of ground waters which will render them unsatisfactory for normal
use. In the event that the facilities fail to perform satisfactorily, including
the creation of nuisance conditions or failure of the irrigation area to
adequately absorb the wastewater, the Permittee shall take such immediate
corrective action as may be required by the Division of Environmental. Management.
8. A suitable year round vegetative cover, shall be maintained.
9. Irrigation shall not be performed during inclement weather or when the ground is
in a condition that will cause runoff.
10. Adequate measures shall be taken to prevent wastewater runoff from the spray
field.
11. Diversion or bypassing of the untreated wastewater from the treatment facility
is prohibited.
12. The Permittee, at least six (6) months prior to the expiration of this permit,
shall request its extension. Upon receipt of the request, the Commission will
review the adequacy of the facilities described therein, and if warranted, will
extend the Permit for such period of time and under such conditions and
limitations as it may deem appropriate.
13. The application rates shall not exceed 0.81 inches/week.
14. The Permittee shall employ a certified wastewater treatment plant operator to be
in responsible charge of the wastewater treatment facilities. Such operator must
hold a certificate of the grade at least equivalent to the classification
assigned to the wastewater treatment facilities by the Certification Commission.
15. Freeboard in the storage ponds, shall not be less than 2 feet at any time.
16. No wastewater connection or discharge of any type shall be made to the proposed
} system until written approval has been obtained from the Division of
Environmental Management.
17. The issuance of this permit shall not relieve the Permittee of the responsibility
for damages to surface or groundwaters resulting from the operation of this
facility.
18. The facilities shall be effectively maintained and operated as a non -discharge
system to prevent the discharge of any wastewater resulting from the operation of
this facility.
19. No type of wastewater other than domestic wastewater shall be discharged into the
treatment facility or sprayed upon the irrigation area. The Division must review
and approve any other type of wastewater, including industrial wastewater prior
to discharge into the, treatment facility.
20. Adequate inspection, maintenance, end cleaning shall be provided by the Permittee
to insure proper operation of the subject facilities.
21. In any future transfer of this land, a notice shall be given to the new owner
that gives full details of the materials applied or incorporated at this site,
22. The Permittee shall provide for the pump station and force main the following
items:
a. Pump-on/pump-off elevations located so that 2-8 pumping cycles may be achieved
per hour in the pump station.
b. An air relief valve located at all high points along the force main.
c. A screened vent for the wet well.
d. Fillets located in the wet well at the intersection of the flooring and
s idewa.l is .
e. 'Three (3) feet of. cover (minimum) over the force main or the use of ferrous
material where three (3) feet cannot be maintained.
f. Sufficient devices which will protect the pump station, from vandals.
g. Flood protection if the pump station is located below the 100 -year flood
elevation_
23. A copy of the approved plans and specifications shall be maintained on file by
the Permittee for a minimum of five years from the date of issuance.
24. Upon completion of construction and prior to operation of this permitted
facility, a certification must be received from a professional engineer
certifying that the permitted facility has been installed in accordance with the
requirements of this permit and the approved plans and specifications. Mail the
certification to the Permits and Engineering Unit, P.O. Box 27687, Raleigh, N.C.
27611-7687.
25. The following buffers shall be maintained:
a) 400 feet between irrigation areas and a residence
b) 140 feet between irrigation areas and any drainageway, stream or lake.
C) 150 feet between irrigation areas an adjacent property lines.
26. 'Adequate records shall be maintained
wastewater disposed. These records

a) date of irrigation
b) volume of wastewater irrigated
c) field irrigated
d) length of time field is irrigated

This information shall, be submitted to the Water Quality Supervisor of the
Raleigh Regional. Office on a monthly Basis on or before the 10th day of the
following month.
27. Prior to beginning waste disposal operatiou.s, six (6) monitor wells, one (1)
upgradient and one (1.) downgradient of the lagoon and four (4) at the spray
irrigation fields, shall be installed to monitor groundwater duality. The
location end construction details for these wells must be approved by the Raleigh
Regional Office, from which a well construction permit must be obtained.
The monitor wells must be sampled initially after construction (and prior to
waste disposal operations) and thereafter every March, July, and November for the
following parameters:

The measurement of water_ level must be made prior to sampling for the remaining
parameters.
The analytical methods used for TOX must be capable of detecting the total of all
halogenated organic compounds present at a concentration of 5.0 parts per billion
(ppb) or greater. In the event that a TOX concentration of 5.0 ppb or greater is
detected, any individual halogenated organic compound(s) present at a
concentration at or above the method detection limit (MDL) must be identified and
quantified utilizing FPA methods 601, 602, 604 and. 611.
The results of the sampling and analysis shall be sent to the N.C. Division of
Environmental Management on Form GW -59 (Compliance Monitoring Report Form) every
April, August and December.
29. The northwestern half of the storage lagoon, bottom and side slopes, shall be
constructed with a compacted natural material liner. The liner shall be at least
one foo thick at all locations and shall have a maximum permeability of
1 x 10 cm/sec. Following installation and inspection of the Lagoon liner,
and prior to waste disposal. operations, verification of the liner's compliance
with permeability and thickness requirements must be provided to the Groundwater
Section by the project engineer.
30. Any additional. groundwater duality monitoring as deemed necessary by the
Department, shall be provided.
