This permit shall be effective from the date of issuance until September 30, 1993, and shall be subject to the conditions and limitations as specified therein. If any parts, requirements, or limitations contained in this permit are unacceptable to you, you have the right to request an adjudicatory hearing upon written request within 30 days following receipt of this permit. This request must be in the form of a written petition, conforming to Chapter 150B of North Carolina General Statutes, and filed with the Office of Administrative Hearings, Post Office Drawer 11666, Raleigh, North Carolina 27604. sinless such demands -are made this permit shall be final and binding. Box 27687, Raleigh, North Carolina 27611-7687 Telephone 919-733-7015 An Equal Opportunity Affirmative Action Employer NORTH CAROLINA. 4 ENVIRONMENTAL MANAGEMENT COMMISSION DEPARTMENT OF NATURAL RESOURCES AND COMMUNITY DEVELOPMENT RALEIGH P E R M I T For the discharge of Sewage, Industrial Wastes, or Other Wastes In accordance with the provisions of Article 21 of Chapter 143, General Statutes of North Carolina as amended, and other applicable Laws, Rules, and Regulations PERMISSION IS HEREBY GRANTED TO Lonnie Graves Residence Durham County FOR THE construction and operation of a 360 GPD single family spray irrigation system consisting of a 1,000 gallon septic tank, a 1,000 gallon pump tank with submersible pump, sand filter, tablet chlorinator, 1,000 gallon holding tank, 1,000 gallon pump tank with submersible pump and, high water alarms and a 8,712 sq. ft. spray irrigation field to serve the Reynolds residence with no discharge to the surface waters of the State, pursuant to the application received January 27, 1989, and in conformity with the project plan, specifications, and other supporting data subsequently filed and approved by the Department of Natural Resources and Community Development and considered a part of this permit. This permit shall be effective from the date of issuance until September 30, 1993, and shall be subject to the following specified conditions and limitations: 1. This permit shall become voidable unless the facilities are constructed in accordance with the approved plans, specifications and other supporting data. 2. This permit is effective only with respect to the nature and volume of wastes described in the application and other supporting data. 3. The facilities shall be properly maintained and operated at all times. 4. This permit is not transferable. 5. The Operational Agreement between the Permittee and the Environmental Management Commission is incorporated herein by reference and is a condition of this Permit. Noncompliance with the terms of the Operational agreement shall subject the Permittee to all sanctions provided by G. S. 143-215.6 for violation of or failure to act in accordance with the terms and conditions of this Permit. 6. A set of approved plans and specifications for the subject project must be retained by the applicant for five (5) years after completion of construction. 7. Upon the availability of a municipal or regional sewerage collection system, the subject wastewater treatment facility shall be abandoned and all wastewater discharged into the municipal or regional sewerage system. 8. This permit shall become voidable in the event of failure of the soil to adequately absorb the wastes and may be rescinded unless the facilities are installcd, maintained, and operated in a manner which will protect the assigned water quality standards of the surface waters and ground waters. 9. In the event that the facilities fail to perform satisfactorily, including the creation of nuisance conditions, the Permittee shall take such immediate corrective action as may be required by this Division, including the construction of additional or replacement wastewater treatment or disposal facilities. 10. The Raleigh Regional Office, phone no. 919/733-2314 shall be notified at least twenty-four (24) hours in advance of operation of the installed system so that an in-place inspection can be made. Such notification to the regional supervisor shall be made during the normal office hours from 8:00 a.m. until 5:00 p.m. on Monday through Friday, excluding State Holidays. 11. Any monitoring deemed necessary by the Division of Environmental Management to insure surface and ground water protection will be established and an acceptable sampling reporting schedule shall be followed. 12. The sludge generated from these treatment facilities must be disposed of in accordance with General Statute 143-215.1 and in a manner approvable by the North Carolina Division of Environmental Management. 13. The spray irrigation system shall be effectively maintained and operated at all times so that there is no discharge to the surface waters, nor any contamination of ground waters which will render them unsatisfactory for normal use. In the event, that the facilities fail to perform satisfactorily, including the creation of nuisance conditions or failure of the irrigation area to adequately absorb the wastewater, the Permittee shall take such immediate corrective action as may be required by the Division of Environmental Management. 14. A suitable year round vegetative cover shall be maintained. 15. Irrigation shall not be performed during inclement weather or when the ground is in a condition that will cause runoff. 16. Adequate measures shall be taken to prevent wastewater runoff from the spray field. 17. The Permittee, at least six (6) months prior to the expiration of this permit, shall request its extension. Upon receipt of the request, the Commission will review the adequacy of the facilities described therein, and if warranted, will extend the Permit for such period of time and under such conditions and limitations as it may deem appropriate. 18. The application rates shall not exceed; 0.04 gal/ft 2/day 0.46 in/wk 19. The issuance of this permit shall not relieve the Permittee of the responsibility for damages to surface or groundwaters resulting from the operation of this facility. 20. The facilities shall be effectively maintained and operated as a non -discharge system to prevent the discharge of any wastewater resulting from the operation of this facility. 21. No type of wastewater other than that from Graves Residence shall be sprayed onto the irrigation area. 22. The Permittee is responsible for the operation and maintenance of the entire treatment and disposal system including, but not limited to, the following items: a. The septic tank shall be checked every six (6) months and pumped out as required. b. The tablet chlorinator shall be checked every week until the actual usage rate is established and thence on a monthly basis. Tablets shall be added so as to provide proper chlorination. c. The storage system, pump system, and alarm system shall be inspected monthly. The scum layer shall be removed at the same interval as the septic tank is cleaned out. d. The spray system shall be inspected monthly to make certain of the sprayers proper operation, that the vegetative growth allows proper spray patterns, that the soil is absorbing the disposed treated wastewater with no surface runoff, and that no objectionable odors are being generated. 23. This permit may be voided if an operation and maintenance agreement is not signed by the Permittee and a signed copy returned to this Division. 24. To the maximum extent feasible, the spray irrigation field, sand filter and septic tank should not be located within 100 ft. of a potable drinking water well. In no case shall this system be located within 50 ft. of a potable drinking water well. 25. If excavation into bedrock for septic tank or sand filter installation is required, the pit shall be lined with a 10 mil synthetic liner. Permit issued this the 10th day of February, 1989.
