This permit shall be effective from the date of issuance in)ti.1 September 30, 1991 and shall void Permit No. 6566R. issued September 23, 1985, Ond shall be subject to the conditions and limitations as specified therein. If any parts, requirements, or limitations contained in this permit are unacceptable to you, you have the right to request an adjudicatory hearing upon written request within 30 days following receipt of this permit. This request must be in the form of a written petition, conforming to Chapter. 1.508 of North Carolina General Statutes, and filed with the Office of Administrative Hearings, Post Office Drawer 11666, Raleigh, North Carolina 27604. This permit is effective only with respect to the nature and volume of wastes described in the application and other supporting data. 2. The facilities shall be properly maintained and oper.itod nt all times. 3. This permit is not transferable. 4. In event the facilities fail to perform satisfactorily, the Permittee shall take such immediate corrective action as may be required by this Department. 5. Solids, sludges, or other pollutants removed or resulting from the wastewater storage facilities shall be contained and disposed of in such a manner as to prevent any contamination of the surface or groundwaters of the State. 6. Diversion or bypassing of the untreated wastewater from the recycle facility is prohibited. 7. Freeboard in the settling lagoons shall not be less than ont, (1) foot at any time. 8. The Permittee, at least six (6) months prior to the expiration of this permit, shall request its extension. Upon receipt of the request, the Commission will review the adequacy of the facilities described therein, and .if indicated, will. extend the Permit for such period of time and under such conditions and limitations as it may deem appropriate. 9. Satisfactory controls shall be provided to contain the accidental discharge or spillage of hazardous or toxic substances either stored or being used in the pretreatment facilities on project site. 10. The City of Henderson shall be notified immediately -if an ovo.r flow from the wet well into the Henderson Sewerage System is anticipated. 11. The facilities shall be effectively maintained and operatorl as a non -discharge system to prevent the discharge of any wastewater into the surface, waters of the State. 12. Any monitoring deemed necessary by the Division of Environmental Management to insure surface and ground water protection will be. established and an acceptable sampling reporting schedule shall. be followed. 13. The Permittee shal.l. employ a certified wastewater tr.eat:ment plant operator to be in responsible charge of t:he wastewater treatment fac.i_l i.tins. Such operator must hold a certificate of the grade at: least- equivalent to the classification assigned to the wastewater treatment fac:il.i.ti.es by the.. Ci�rt i f-icat:ic,n Commission.. 14. Reports on the operations of the wastewater recycle system slhal.l be submi.tt,?.d to the Raleigh Regional Office at r.egtilar Uitervnls and in such form and detail as may be required by this Division. Volume of waste oil, disposal firm and dates removed should be maintained on site. 15. Within 90 days of permit issuance, three (3) mon.i.tor wells, 1 rnpgr.adient and 2 downgradient, must be installed to monitor groundwater qual.it.y. The location and construction details for these wells must be by approval of 0)e Raleigh Regional Office, from which a well. construction permit must be obtainerl. 16. The monitor wells must be sampled initially after c_onstr,irtion and thereafter every March, July, and November for the following parameters: TOC pH COD Oil. & Grease (RPA TDS method 413.1.) Water Levels TOX (in November only) The measurement of water level must be made prior to sampling for the remaining parameters. N The analytical methods used for TOX must be capable of detecting the total of all halogenated organic compounds present- at a concentration of 5.0 parts per billion (ppb) or greater. In the event that a TOX concentration of 5.0 ppb or greater is detected, any individual halogenated organic compound(s) present at a concentration at or above the method detection limit (MDT,) must be ident.i.fi.ed and quantified utilizing EPA methods 601, 602, 611 and 61.2. The results of the sampling and analysis shall be sent to the N.C. Division of Environmental Management on Form GW -59 (Compliance Monitoring Report Form) every April, August and December. 17. Any additional groundwater quality monitoring, as deemed necessary by the Department, shall be provided. Permit issued this the 16th day of September, 1988.
