Upon review of this permit, the Division has determined that a minor modification should be made to condition 26 of Permit No. WQ0000195, which was issued on May 26, 1989; therefore, please note that the requirement for submitting records to the Asheville Regional Office in condition 26 is hereby deleted. This condition is now modified to require that an annual summary report (three copies) of the records required in condition 26 be submitted on or before March 1 of the following year, by the Town of Waynesville, to the following address: NC Division of Environmental Management Water Quality Section Facility Assessment Unit PO Box 29535 Raleigh, NC 27626-0535 All other conditions and limitations expressed in Permit No. WQ0000195, which was issued on May 26, 1989, remain unchanged. If this modification is unacceptable to you, you have the right to request an adjudicatory hearing upon written request within thirty days following receipt of this permit modification. This request must be in the form of a written petition, conforming to Chapter 150B of the North Carolina General Statutes, and filed with the Office of Administrative Hearings, P. O. This permit shall be effective from the date of issuance until October 31, 1993, shall be subject to the conditions and limitations as specified therein, and shall void all previously issued permits governing the subject landfill facilities. This permit is amended to include the disposal of sludge from the Town of Clyde for a period of eight months ( see condition No. 21). If any parts, requirements, or limitations contained in this permit are unacceptable to you, you have the right to request an adjudicatory hearing upon written request within 30 days following receipt of this permit. Box 27687, Raleigh, North Carolina 27611-7687 Telephone 919-733-7015 An Equal Opportunity Affirmative Action Employer NORTH CAROLINA ENVIRONMENTAL MANAGEMENT COMMISSION DEPARTMENT OF NATURAL RESOURCES AND COMMUNITY DEVELOPMENT RALEIGH PERMIT For the discharge of Sewage, Industrial Wastes, or Other Wastes In accordance with the provisions of Article 21 of Chapter 143, General Statutes of North Carolina as amended, and other applicable Laws, Rules, and Regulations PERMISSION IS HEREBY GRANTED TO Town of Waynesville Haywood County FOR THE continued operation of sludge disposal facilities consisting of land burial of dried sludge from the Waynesville Wastewater Treatment Plant, the Waynesville Water Treatment Plant, and the Town of Clyde Wastewater Treatment Plant to 12.15 acres with no discharge of sludge or wastewater to the surface waters, pursuant to the application received March 6, 1989 and in conformity with the project plan, specifications, and other supporting data subsequently filed and approved by the Department of Natural Resources and Community Development and considered a part of this permit. This permit shall be effective from the date of issuance until October 31, 1993, and shall be subject to the following specified conditions and limitations: 1. This permit shall become voidable unless the facilities have been constructed in accordance with the approved plans, specifications, and other supporting data. 2. This permit is effective only with respect to the nature and volume of wastes described in the application and other supporting data. 3. The facilities shall be properly maintained and operated at all times. 4. This permit is not transferable. 5. This permit shall become voidable in the event of failure of the soil to adequately accept the wastes and may be rescinded unless the facilities are installed, maintained, and operated in a manner which will protect the assigned water quality standards of the surface waters and ground waters. 6. Issuance of this permit shall void all previously issued permits regulating the use of the subject landfill and all landfilling activities. 7. Adequate facilities shall be provided to prevent surface runoff from carrying any disposed or stored material into any surface waters. 8. The Permittee, at least six (6) months prior to the expiration of this permit, shall request its extension. Upon receipt of the request, the Commission will review the adequacy of the facilities described therein, and if warranted, will extend the Permit for such period of time and under such conditions and limitations as it may deem appropriate. 9. The application rates shall not exceed 46,600 cubic feet per year of dried sludge. 10. In the event that the facilities fail to perform satisfactorily, including the creation of nuisance conditions, the Permittee shall take such immediate corrective action as may be required by this Division, including the construction of additional or replacement wastewater treatment or disposal facilities. 11. The issuance of this permit shall not relieve the Permittee of the responsibility for damages to surface or groundwaters resulting from the operation of this facility. 12. The facilities shall be effectively maintained and operated as a non -discharge system to prevent the discharge of 'any wastewater resulting from the operation of this facility. 13. No type of sludge other than that from the Waynesville Wastewater and Water Treatment Plants and the Town of Clyde Wastewater Treatment plant shall be placed on the land application disposal site. 14. Adequate provisions shall be taken to prevent wind erosion and surface runoff from conveying pollutants from the sludge application area onto the adjacent property or into the surface waters. 15. No crops for direct human consumption shall be raised on these sites. 16. Adequate inspection, maintenance, and cleaning shall be provided by the Permittee to insure proper operation of the subject facilities. 17. In any future transfer of this land, a notice shall be given to the new owner that gives full details of the materials applied or incorp6rated at this site. 18. Public access to the landfill sites shall be controlled during active site use. 19. A minimum 25 foot buffer shall be maintained between the sludge disposal area and all property lines. 20. Authorization for the Town of Clyde to dispose of sludge from their wastewater treatment plant shall expire on January 31, 1990. 21. Within 90 days of permit issuance, one (1) downgradient monitor well must be installed to monitor groundwater quality. The location and construction details for these wells must be approved by the Asheville Regional Office, from which a well construction permit must be obtained. 22. The permittee must pay the annual administering and compliance fee within thirty (30) days after being billed by the Division. Failure to timely pay the fee in accordance with 15 NCAC 2H .0205(c)(4) may cause the Division to initiate action to revoke the permit. C 24. The new monitor well and the three (3) existing monitor wells shall be sampled every March, July, and November for the following parameters: NO3 pH Ammonia Nitrogen TOC TDS Chloride Water Levels Total Coliforms Aluminum Cadmium Potassium Zinc Sodium TOX (in Nov. only) SO4 Copper The measurement of water level must be made prior to sampling for the remaining parameters. The analytical methods used for TOX must be capable of detecting the total of all halogenated organic compounds present at a concentration of 5.0 parts per billion (ppb) or greater. In the event that a TOX concentration of 5.0 ppb or greater is detected, any individual halogenated organic compound(s) present at a concentration at or above the method detection limit (MDL) must be identified and quantified utilizing EPA methods 601, 602, 604, and 611. The new monitor well must be sampled (initially) immediately following construction for the parameters specified above. The results of the sampling and analysis shall be sent to the N.C. Division of Environmental Management on Form GW -59 (Compliance Monitoring Report Form) by the last day of the month following the months in which sampling is required. Co 25. Any additional groundwater quality monitoring as deemed necessary by the Department, shall be provided. 26. Adequate records shall be maintained by the permittee concerning sludge disposal activities. These records must include, but are not necessarily limited to the following: a) Date of sludge disposal, b) Volume of sludge disposed, c) Facility from which the sludge originated. These records shall be maintained on a monthly basis and submitted to the Water Quality Supervisor of the Asheville Regional Office annually on or before January 15 of the following year.
