In accordance with a discussion on February 18, 2002 with your legal counsel, Mr. Steven J.
Levitas of Kilpatrick Stockton, L.L.P., we are forwarding herewith a corrected Page 3 and Page 4 of
Permit No. WQ0000094, issued on January 17, 2002, for the subject residuals land application program.
It is the Division of Water Quality's (Division) understanding that the City of Winton -Salem has
agreed not to file a petition for a contested case hearing with the Office of Administrative Hearings
regarding this permit. In return, the Division has agreed to clarify some language in this permit as
follows:
Condition II. 2. of the permit requires that the Permittee obtain information about other
sources of nutrients that are applied to a particular land application site. The Division's
intent of this condition is to ensure that the Permittee use this information to adjust additional
application of residuals such that the total nutrient loadings do not exceed the agronomic
needs of the crop. In order to clarify this condition, the Division has added language that the
information is limited to applications of other sources of nutrients on the same crop during its
cropping or growing season.
2. Condition II. 5. of the permit provides guidance regarding the application of residuals on land
application sites that have multiple crops during the same calendar year. Language has been
added to one of these guidance requirements to clarify that it is intended by the Division to
refer to overseeding situations only. Specifically, the second crop in an overseeding situation
may only receive an additional 50 pounds of plant available nitrogen (PAN) and only if the
second crop is to be harvested.
3. Condition II. 11. of the permit requires that surface -applied residuals be incorporated within
24 hours on any land application site that does not have a cover crop established. The
Division has removed the requirement that the cover crop be established within 30 days of
the land application event. However, please note that Condition II. 17. does require that
residuals be land applied at agronomic rates, unless as otherwise approved by the Division.
The Division hopes that the City of Winston-Salem will be active in assisting the Division in
the near future to develop guidance regarding residuals management so that minimum
standards and expectations are well-documented and available to the regulated community.

In addition to the above -listed clarifications, please note that the landowner agreement signatory
issue regarding the Jessie and Glenn Smitherman sites (i.e., Site Nos. WSY-1-1 and WSY-1-2) and the
Bessie and Hal Smitherman site (i.e., Site No. WSDV-33B) should not have been referenced in the cover
letter of Permit No. WQ0000094, issued on January 17, 2002. The sites were approved in September 22,
2000 with the landowner agreements as originally executed and submitted to the Division. This issue will
not have to be revisited again until the sites have to be renewed in 2004. We apologize for any confusion
that the cover letter that was sent with the January 17, 2002 issuance of this permit may have caused you
in this regard.

IL OPERATION AND MAINTENANCE REQUIREMENTS
The facilities and land application sites shall be properly maintained and operated at all times.
Prior to applying residuals to any land application site that has previously received or is intended to
receive animal waste (e.g., poultry litter, etc.) or other source of nutrients (e.g., fertilizer, etc.) on the
same crop during its cropping or growing season, the Permittee shall obtain information pertaining to
the volume and analysis of the applied waste form the landowner and /or lessee/operator of the site.
The Permittee shall be responsible for verifying the volume of residuals that may be land applied to the
site such that the plant available nitrogen (PAN) loading rate for the specified crop (i.e., see Condition
II. 5.) is not exceeded by all sources of PAN applied. Should the maximum PAN loading rate be met,
then no additional residuals shall be applied to the site for the remainder of the cropping season.
A suitable vegetative cover, as listed in Condition II. 5., shall be maintained in accordance with the
crop management plan outlined by the local Extension Office, the Department of Agriculture, the
Natural Resource Conservation Service, or other agronomist, and approved by this Division.
4. An acceptable pH must be maintained in the soil, residual and lime mixture, greater than 6.0, on all
land application sites to ensure optimum yield for the crop(s) specified in Condition II. 5. The
agronomist shall provide information on the pH best suited for the specified crop and the soil type.
The application rates of residuals shall be such that the following plant available nitrogen (PAN)
loadings shall not be exceeded for the specified crops:

If the approved land application sites are to be overseeded (i.e., bermuda grass in the summer and rye
grass in the winter with BOTH crops to receive residuals), then the second crop shall receive an
application of PAN at a rate of no greater than 50 pounds of per acre per year. This practice will be
allowed as long as the second crop is to be harvested. If the second crop is to be planted for erosion
control only, and is to be tilled into the soil, then no wastewater residuals shall be applied to these
fields because the PAN will essentially be returned to the soil.
In situations, other than overseeding, where two crops are planted on the same land application site, at
different times during the same cropping year, additional residuals may be applied to meet the nitrogen
requirements of the successive crop. If a land application site will receive two agronomic nitrogen
applications (from residuals source) in a single cropping year, the loading rate for the second residuals
nitrogen application shall be reduced to compensate for the PAN mineralized from the organic nitrogen
supplied from the initial year's residuals application to the previously grown crop.

9. Upon classification of the residuals land application program by the Water Pollution Control System
Operators Certification Commission (WPCSOCC), the Permittee shall employ a certified land
application/residuals operator to be in responsible charge (ORC) of the land application program. The
operator shall hold a certificate of the type classification assigned to the land application program by
the WPCSOCC. The Permittee shall also employ a certified back-up operator of the appropriate type
to comply with the conditions of 15A NCAC 8G.0202.
10. Adequate procedures shall be provided to prevent surface runoff from carrying any disposed or stored
residuals into any surface waters.
11. Surface applied residuals will be plowed or disced within 24 hours after application on lands with no
cover crop established.
