Dear Mr. Tucker:
In accordance with your application received December 17,
1990, we are forwarding herewith Permit No. WQ0004580, dated
January 11, 1991, for the continued operation of the subject
wastewater treatment and disposal facility.
This permit shall be effective from the date of issuance
until January 31, 1996 and shall be subject to the conditions and
limitations as specified therein.
If any parts, requirements, or limitations contained in this
permit are unacceptable to you, you have the right to an
adjudicatory hearing before a hearing officer upon written
request within thirty (30) days following receipt of this permit.
This request must be in the form of a written petition,
Conforming to Chapter 150E of the North Carolina General
Statutes, and filed with the Office of Administrative Hearing,
Post Office Drawer 11666, Raleigh, North Carolina 27604. Unless
such demands are made, this permit shall be final and binding.

P E R M I T
For the Discharge of Sewage, Industrial Wastes or Other Wastes
In accordance with the provisions of Article 21 of Chapter 143,
General Statutes of North Carolina as amended, and other applicable
Laws, Rules, and Regulations:
PERMISSION IS HEREBY GRANTED TO
Brunswick County
for the
continued operation of a 100 GPD wastewater treatment and disposal
facility consisting of a 900 gallon precast concrete two
compartment septic tank, a distribution box, 134 linear feet of
three feet wide nitrification line, piping, fittings and
appurtenances to serve Ocean Isle Beach Transfer Station with no
discharge to surface waters of the State.
This permit is granted pursuant to the application received
December 17, 1990 in conformity with the project plans,
specifications, and other supporting data, subsequently filed and
approved by the Department of Environment, Health and Natural
Resources and considered a part of this permit.
This permit shall be effective from the date of issuance until
January 31, 1996 and shall be subject to the following specified
conditions and limitations:
1. This permit shall become voidable unless the facilities are
constructed in accordance with the approved plans,
specifications and other supporting data.
2. This permit is effective only with respect to the nature and
volume of wastes described in the application and other
supporting data.

3. Adequate inspection, maintenance, and cleaning shall be
provided by the permittee to insure proper operation of the
subject facilities.
4. This permit is not transferable.
5. Upon the availability of a municipal or regional sewerage
collection system, the subject wastewater treatment system
shall be abandoned, and all wastewater discharged into the
municipal or regional sewerage system.
6. This permit shall become voidable in the event of failure of
the soil to adequately absorb the wastes, and may be rescinded
unless the facilities are installed, maintained and operated
in a manner which will protect the assigned water quality
standards of the surface waters and groundwaters.
7. Any monitoring deemed necessary by the Division of
Environmental Management to insure surface and groundwater
protection will be established and an acceptable sampling
reporting schedule shall be followed.
8. The sludge generated from these treatment facilities must be
disposed of in accordance with the General Statutes 143-215.1
and in a manner approvable by the North Carolina Division of
Environmental Management.
9. The wastewater treatment system shall be effectively
maintained and operated at all times so that there is no
discharge to the surface waters, nor any contamination of
groundwaters which will render them unsatisfactory for normal
use. In event the facilities fail to perform satisfactorily,
including the creation of nuisance conditions, or failure of
the irrigation area to adequately absorb the wastewater, the
Permittee shall take such immediate corrective action as may
be required by the Division of Environmental Management,
including the construction of additional or replacement
wastewater treatment or disposal facilities.

10. Diversion or bypassing of the untreated wastewater from the
wastewater.treatment system is prohibited.
11. The issuance of this permit shall not relieve the permittee of
the responsibility for damages to surface or groundwaters
resulting from the operation of this facility.
12. No traffic or equipment shall be allowed on the disposal area
except while, installation occurs or while normal maintenance
is being performed.
13. An acceptable repair area as indicated on the approved plans
shall be maintained at all times. The repair area shall be
maintained in a natural state and shall not be modified by
mining or filling activities.
14. A suitable vegetative cover shall be maintained on the
disposal field and the field shall be kept mowed. The
clippings shall be removed to prevent the build-up of thatch.
15. A copy of the approved plans and specification shall be
maintained on file by the Permittee for the life of the
permit.
16. Failure to abide by the conditions and limitations contained
in this permit may subject the Permittee to an enforcement
action by the Division of Environmental Management in
accordance with North Carolina General Statue 143-215.6.
17. The issuance of this permit does not preclude the Permittee
from complying with any and all statutes, rules, regulations,
or ordinances which may be imposed by other government
agencies (local, state, and federal) which have jurisdiction.

18. Noncompliance Notification:
The Permittee shall report by telephone to the Wilmington
Regional Office, telephone no. 919/256-4161 as soon as
possible, but in no case more than 24 hours or on the next
working day following the occurrence of first knowledge of the
occurrence of either of the following:
a. Any process unit failure, due to known or unknown reasons,
that render the facility incapable of adequate wastewater
transport such as mechanical or electrical failures of
pumps, line blockage or breakage, etc.
b. Any failure of a pumping station or sewer line resulting
in a by-pass directly to receiving waters without
treatment of all or any portion of the influent to such
station or facility.
Persons reporting such occurrences by telephone shall also
file a written report in letter form within 15 days following
first knowledge of the occurrence. This report must outline
the actions taken or proposed to be taken to ensure that the
problem does not recur.

PART IV - EVALUATION AND RECOMMENDATIONS
An existing septic tank system serves the Ocean Isle Beach
Solid Waste Transfer Station. The operator comfort station was
recently torn down so that a new structure could be built. A
building permit can not be obtained without a letter of approval
for the wastewater treatment system. The system was built in
1981 by authorization of a Health Department Permit.
Responsibility for permitting this system now falls with this
Department.
A permit application has been submitted and plans have been
prepared. A site inspection revealed no evidence of failure in
the form of surface breakout. The system is to serve one
employee. Also, the underside of the container and the slab are
hosed down once per week. No liquid from the containers enters
the system. The inside of the container is not cleaned.
The Groundwater section has determined that
should have a low probability of adverse impact
