BOX 398 HICKORY, NC 28603-0398 Dear Mr. McGee: i,, NCDENR NORTH CAROLINA EXPARTMENT OF ENVIRONMENT AND NATURAL RESOURCES Subject: Permit No. WQ0004563 City of Hickory Regional Compost Facility (RCF) Distribution of Class A Wastewater Residuals Catawba County In accordance with your renewal and modification request received on November 3, 2000, and responses to additional information requests, received from December 28, 2000 to April 24, 2001; we are forwarding herewith Permit No. WQ0004563, dated June 1, 2001, to the City of Hickory -Regional Compost Facility (RCF) for the continued operation of a regional wastewater residuals composting facility for the distribution of Class A residuals. This current permit has been amended to reflect the changes in allotment of ownership capacities, based on the percentage of participant ownership in the RCF. In addition, this permit has been modified to include a provision for accepting up to 200 dry tons per year of the City of Hickory wastewater treatment plant's residuals, on an emergency basis. The monitoring structure of this permit has also been simplified to reflect the sampling protocol currently being implemented at the RCF on accepted residuals from participating facilities, and on the final distribution product, "Catawba ORGRO 0 High Organic Compost. This permit shall be effective from the date of issuance until May 31, 2006, shall void Permit No. WQ0004563 issued September 26, 1996, and shall be subject to the conditions and limitations as specified therein. Please pay particular attention to the monitoring and reporting requirements contained in this permit. Please take time to review this permit thoroughly. Of special interest are the following items: • The use of "Division" within the permit text, refers to the "Division of Water Quality," NOT the "Division of Environmental Management." • The name of "Department of Environment, Health and Natural Resources" has been changed to the "Department of Environment and Natural Resources." • Condition II. 2., The current permitted residual volume of 7,887 dry tons per year has been reduced to 7,300 dry tons per year based on the information submitted in Attachment I. A descriptive footnote was added to clarify Permittee residuals acceptance and distribution protocol. • Condition HI, 4., and Condition III. 6., Although the Permittee accepts 7,300 dry tons per year of residuals from documented sources, the monitoring requirements are based on the actual residuals distribution volume. Therefore, due to the distribution volume being 3,300 dry tons per year, the monitoring frequency noted in the Permit, reflects the 3,300 dry tons per year volume. * Condition III. 7_, the mailing address of the Division has changed. Box 446, Claremont, NC 28610 City of Hickory (RCF)- ATTN: Wayne Carroll, 3200 206' Avenue, SE, Newton, NC 28658 Mooresville Regional Office, Water Quality Section Technical Assistance and Certification Unit Non -Discharge Compliancc/Enforcement Unit NDPU files 2 NORTH CAROLINA ENVIRONMENTAL MANAGEMENT COMMISSION DEPARTMENT OF ENVIRONMENT AND NATURAL RESOURCES RALEIGH PERMIT FOR THE DISTRIBUTION OF CLASS A RESIDUALS In accordance with the provisions of Article 21 of Chapter 143, General Statutes of North Carolina as amended, and other applicable Laws, Rules, and Regulations PERMISSION IS HEREBY GRANTED TO City of Hickory Catawba County FOR THE continued operation of the Regional Compost Facility (RCF), which is a wastewater residuals composting facility comprised of-biosolids liquid storage, dewatering, in -vessel composting, product storage, odor control, and pre-treatment of 7,300 dry tons per year of accepted residuals from the cities of Hickory, Newton, and Conover; and Catawba County, North Carolina; for the distribution of Class A residuals, consisting of the distribution of 3,300 dry tons per year of final product residuals, produced from the sources listed in Condition II. 2., with no discharge of wastes to the surface waters, pursuant to the renewal and modification request received on November 3, 2000, and responses to additional information requests, received from December 28, 2000 to April 24, 2001; and in conformity with the project plan, specifications, and other supporting data subsequently filed and approved by the Department of Environment and Natural Resources and considered a part of this permit. This permit shall be effective from the date of issuance until May 31, 2006, shall void Permit No. WQ0004563, issued September 26, 1996; and shall be subject to the following specified conditions and limitations: I. PERFORMANCE STANDARDS 1. The distribution of Class A residuals program shall be effectively maintained and operated as a non -discharge system to prevent the discharge of any wastes resulting from the operation of this program. 2. This permit shall become voidable in the event of failure of the residuals program to adequately protect the assigned water quality standards of the surface waters and groundwaters. 3. The issuance of this permit shall not relieve the Permittee of the responsibility for damages to surface or groundwaters resulting from the operation of this program. 4. In the event that the residuals program is not operated satisfactorily, including the creation of nuisance conditions, the Permittee shall take any immediate corrective actions as may be required by the Division of Water Quality (Division). 5. Diversion or bypassing of the untreated residuals or Ieachate from the residual treatment facilities is prohibited. 6. All leachate must be reused as a wetting agent for the processing of residuals or routed to the head of the treatment plant. 7. When wastewater residuals are sold or given away, one of the Class A pathogen requirements in 40 CFR Part 503.32(a) and one of vector attraction reduction requirements in 40 CFR Part 503.33 must be met. Additionally, an evaluation must be performed which demonstrates the residuals ability to comply with this requirement. Upon request, a copy of this evaluation must be submitted including all test results and calculations. II. OPERATION AND MAINTENANCE REQUIREMENTS 1. The residuals treatment facilities shall be properly maintained and operated at all times. 2. This accepted volume is blended and composted by RCF to produce a Class A biosolids product of 3,300 dry tons per year. The processed volume of 3,300 dry tons per acre is the amount available for distribution by the RCF. 3. All residuals shall be adequately stored to prevent leachate runoff until treated. The finished product may be placed on a concrete pad, placed under shelter or covered until such time as it is distributed to the buyer. if an alternate storage site is to be used, approval must be obtained from the Division. 4. No other residuals other than those specified under Condition 11. 2., above may be accepted or processed for final distribution. The Permittee shall request and obtain a permit amendment from the Division for each additional residual source prior to acceptance of that residual. 5. Upon classification of the facility by the Water PoIIution Control System Operators Certification Commission (WPCSOCC), the Permittee shall employ a certified residuals operator to be in responsible charge (ORC) of the residuals program. The operator must hold a certificate of the type classification assigned to the residuals program by the WPCSOCC. The Permittee must also employ a certified back-up operator of the appropriate type to comply with the conditions of 15A NCAC 80.0202. 7. Adequate provisions shall be taken to prevent wind erosion and surface runoff from conveying pollutants from the residuals treatment area onto the adjacent property or into any surface waters. 8. A label shall be affixed to the bag or other container in which residuals that are sold or given away for application to the land, or an information sheet shall be provided to the person who receives the residuals sold or given away in an other container for application to the land. The label or information sheet shall contain the following information_ a. The name and address of the person who prepared the residuals that is sold or given away in a bag or other container for application to the land. b. A statement that application of the residuals to the land is prohibited except in accordance with the instructions on the label or information sheet. c. A statement which identifies that this material shall be prevented from entering any public or private water supply source (including wells) and any stream, lake, or river. d. Information on all applicable buffers including a 10 foot buffer between application site and any public or private water supply source (including wells) and any stream, lake, or river. e. Residuals shall not be applied to any site that is flooded, frozen or snow-covered. f. Adequate procedures shall be provided to prevent surface runoff from carrying any disposed or stored residuals into any surface waters. The Regional Composting Facility shall follow the protocol established in the application package concerning the domestic septage received from Catawba County. A three -page log sheet shall be completed for each load of septage brought to the Regional Composting Facility. All septage shall be domestic in nature and shall be determined to be non -hazardous and non -toxic. An annual composite sample shall be analyzed as outlined in Condition III. 2. III. MONITORING AND REPORTING REQUIREMENTS Any monitoring (including groundwater, surface water, residuals, soil, or plant tissue analyses) deemed necessary by the Division to insure protection of the environment will be established and an acceptable sampling and reporting schedule shall be followed. 2. Prior to being combined with residuals at the Permittee facility, incoming residuals from the sources listed in Condition II. 2., will be monitored for the contaminants listed in Condition II. 5., and TCLP constituents listed in Condition III. 5. Should the incoming residuals fail to meet required acceptable federal limits, combination with residuals at the Permittee facility shall be - prohibited. 3. Proper records shall be maintained by the Permittee tracking all residual activities. These records shall include, but are not necessarily limited to the following information: a. source, volume and analysis of residuals b. name of residuals' initial recipient, volume received, and intended use 4. A residual analysis on the finished compost shall be conducted EVERY 60 DAYS from the date of permit issuance by the Permittee. The results of all analysis shall be maintained on file by the Permittee for a minimum of five years. The residuals analysis shall include the following parameters: Arsenic Cadmium Copper Lead Mercury Molybdenum Nickel Selenium Zinc Aluminum Ammonia -Nitrogen Calcium Magnesium Nitrate -Nitrite Nitrogen % Total Solids pH Phosphorus Potassium Sodium TKN Plant Available Nitrogen (by calculation) After the residuals have been monitored for two years at the above frequency, the Permittee may submit a request to the Division for a permit modification to reduce the frequency of monitoring for pollutant concentrations. In no case, however, shall the frequency of monitoring be Iess than once per year when residuals are sold or given away. 4 5. A Toxicity Characteristics Leaching Procedure (TCLP) analysis on the finished compost shall be conducted by the Permittee ANNUALLY. In no case, however, shall the frequency of TCLP monitoring be less than once per permit cycle when residuals are sold or given away. 6. The Permittee must monitor for compliance with Condition I. 7. of this permit, EVERY 60 DAYS, from the date of permit issuance. Data to verify stabilization of the residuals must be maintained by the Permittee. The required data is specific to the stabilization process utilized, but should be sufficient to clearly demonstrate compliance with the Class A pathogen requirements in 40 CFR Part 503.32(a) and the vector attraction reduction requirements in 40 CFR Part 503.33. In addition, the EPA certification statements concerning compliance with pathogen requirements, vector attraction reduction requirements and management practices must be completed EVERY 60 DAYS: by the proper authority or authorities if more than one is involved, either the person who generates the residuals or the person who prepares the residuals to be sold or given away. 7. Three copies of all required monitoring and reporting requirements as specified in Conditions III. 1., III.2., III. 3., III. 4., III. 5., and III.6., shall be submitted annually on or before March V of the year following the distribution event, to the address below: NC Division of Water Quality Water Quality Section Non -Discharge CompIiance/Enforcement Unit 1617 Mail Service Center Raleigh, North Carolina 27699-1617 8. Noncompliance Notification: The Permittee shall report by telephone to the Mooresville Regional Office, telephone number (704) 663-1699, as soon as possible, but in no case more than 24 hours or on the next working day following the occurrence or first knowledge of the occurrence of any of the following: a. Any occurrence with the distribution program which results in the land application of significant amounts of wastes which are abnormal in quantity or characteristic. b. Any failure of the distribution program resulting in a release of material to receiving waters. c. Any time that self -monitoring information indicates that the facility has gone out of compliance with the conditions and limitations of this permit or the parameters on which the system was designed. d. Any process unit failure, due to known or unknown reasons, that render the facility incapable of adequate residual treatment. e. Any spillage or discharge from a vehicle or piping system during transportation of residuals. Persons reporting such occurrences by telephone shall also file a written report in letter form within five days following first knowledge of the occurrence. This report must outline the actions taken or proposed to be taken to ensure that the problem does not recur. IV. GROUNDWATER REQUIREMENTS 1. The COMPLIANCE BOUNDARY for the disposal system is specified by regulations in 15A NCAC 2L, Groundwater Classifications and Standards. The Compliance Boundary is for disposal systems initiated after December 31, 1983, and is established at either (1) 250 feet from the waste disposal area, or (2) 50 feet within the property boundary, whichever is closest to the waste disposal area. An exceedance of Groundwater Quality Standards at or beyond the Compliance Boundary is subject to immediate remediation action in addition to the penalty provisions applicable under North Carolina General Statute 143-215.6A(a)(1). In accordance with 15A NCAC 2L, a REVIEW BOUNDARY is established around the disposal systems midway between the Compliance Boundary and the perimeter of the waste disposal area. Any exceedance of standards at the Review Boundary shall require remediation action on the part of the permittee. 2. Any groundwater quality monitoring, as deemed necessary by the Division, shall be provided. V. INSPECTIONS 1. The Permittee or his designee shall inspect the ri*duals storage, transport, and treatment facilities to prevent malfunctions and deterioration, operator errors and discharges which may cause or lead to the release of wastes to the environment, a threat to human health, or a nuisance. The Permittee shall maintain an inspection log or summary including at least the date and time of inspection, observations made, and any maintenance, repairs, or corrective actions taken by the Permittee. This log of inspections shall be maintained by the Permittee for a period of five years from the date of the inspection and shall be made available to the Division or other permitting authority, upon request. 2. Any duly authorized officer, employee, or representative of the Division may, upon presentation of credentials, enter and inspect any property, premises or place on or related to the treatment site or facility at any reasonable time for the purpose of determining compliance with this permit; may inspect or copy any records that must be kept under the terms and conditions of this pen -nit; and may obtain samples of groundwater, surface water, or leachate. VI. GENERAL CONDITIONS 1. This permit shall become voidable unless the distribution activities are carried out in accordance with the conditions of this permit, the supporting materials, and in the manner approved by this Division. 2. This permit is effective only with respect to the nature and volume of residuals described in the application and other supporting data. 3. This permit is not automatically transferable. In the event that there is a desire for the facilities to change ownership or a name change of the Permittee, a formal permit request must be submitted to the Division accompanied by documentation from the parties involved, and other supporting materials as may be appropriate. The approval of this request will be considered on its merits and may or may not be approved. 4. Failure to abide by the conditions and limitations contained in this permit may subject the Permittee to an enforcement action by the Division in accordance with North Carolina General Statute 143-215.6A to 143-215.6C. 5. The annual administering and compliance fee must be paid by the Permittee within 30 days after being billed by the Division. Failure to pay the fee accordingly may cause the Division to initiate action to revoke this permit as specified by 15 NCAC 2H .0205 (c)(4). 6. The issuance of this permit does not preclude the Permittee from complying with any and all statutes, rules, regulations, or ordinances which may be imposed by other government agencies (local, state, and federal) which have jurisdiction. 7. The Permittee, at least six months prior to the expiration of this permit, shall request its extension. Upon receipt of the request, the Commission will review the adequacy of the facilities described therein, and if warranted, will extend the permit for such period of time and under such conditions and limitations as it may deem appropriate. 8. This permit may be modified, or revoked and reissued to incorporate any conditions, Iimitations and monitoring requirements the Division deems necessary in order to adequately protect the environment and public health.
