This permit shall be effective from the date of issuance until December 31, 1995 and shall be subject to the conditions and limitations as specified therein. If any parts, requirements, or limitations contained in this permit are unacceptable to you, you have the right to an adjudicatory hearing before a hearing officer upon written request within thirty (30) days following receipt of this permit. This request must be in the form of a written petition, conforming to Chapter 150E of the North Carolina General Statutes, and filed with the Office of Administrative Hearing, Post Office Drawer 11666, Raleigh, North Carolina 27604. Regional Supervisor EB:LWQ4516.DEC cc: Brunswick County Health Department McKim and Creed Engineers Permits and Engineering Wilmington Regional Office Central Files NORTH CAROLINA ENVIRONMENTAL MANAGEMENT COMMISSION RALEIGH DEPARTMENT OF ENVIRONMENT, HEALTH AND NATURAL RESOURCES P E R M I T For the Discharge of Sewage, Industrial Wastes or Other Wastes In accordance with the provisions of Article 21 of Chapter 143, General Statutes of North Carolina as amended, and other applicable Laws, Rules, and Regulations: PERMISSION IS HEREBY GRANTED TO Bald Head Island Utility Company for the construction and operation of a 8920 GPD wastewater treatment and disposal facility consisting of a 1200 gallon precast concrete grease trap, a 10,000 gallon precast concrete two compartment septic tank, a dual pump dosing chamber, a low pressure pipe disposal field of 1210 sq. ft. area, piping, fittings, and appurtenances to serve a new golf course club house with no discharge to surface waters of the State. This permit is granted pursuant to the application received November 21 1990 in conformity with the project plans, specifications, and other supporting data, subsequently filed and approved by the Department of Environment, Health and Natural Resources and considered a part of this permit. This permit shall be effective from the date of issuance until December 31, 1995 and shall be subject to the following specified conditions and limitations: 1. This permit shall become voidable unless the facilities are constructed in accordance with the approved plans, specifications and other supporting data. 2. This permit is effective only with respect to the nature and volume of wastes described in the application and other supporting data. Permit No. WQ0004516 Page -2- 3. Adequate inspection, maintenance, and cleaning shall be provided by the permittee to insure proper operation of the subject facilities. 4. This permit is not transferable. 5. Upon the availability of a municipal or regional sewerage collection system, the subject wastewater treatment system shall be abandoned, and all wastewater discharged into the municipal or regional sewerage system. , 6. This permit shall become voidable in the event of failure of the soil to adequately absorb the wastes, and may be rescinded unless the facilities are installed, maintained and operated in a manner which will protect the assigned water quality standards of the surface waters and groundwaters. 7. The Wilmington Regional Office, Phone No. 919/256-4161 shall be notified at least twenty-four (24) hours in advance of backfilling of the installed system so that an in-place inspection can be made of said system prior to backfilling. Such notification to the -Regional Supervisor shall be made during the normal office hours from 8:00 a.m. until 5:00 p.m. on Monday through Friday, excluding State Holidays. 8. Any monitoring deemed necessary by the Division of Environmental Management to insure surface and groundwater protection will be established and an acceptable sampling reporting schedule shall be followed. 9. The sludge generated from these treatment facilities must be disposed of in accordance with the General Statutes 143-215.1 and in a manner approvable by the North Carolina Division of Environmental Management. 10. The wastewater treatment system shall be effectively maintained and operated at all times so that there is no discharge to the surface waters, nor any contamination of groundwaters which will render them unsatisfactory for normal use. In event the facilities fail to perform satisfactorily, including the creation of nuisance conditions, or failure of the irrigation area to adequately absorb the wastewater, the Permittee shall take such immediate corrective action as may be required by the Division of Environmental Management, including the construction of additional or replacement wastewater treatment or disposal facilities. Permit No. WQ004516 Page -3- 11. Diversion or bypassing of the untreated wastewater from the wastewater treatment system is prohibited. 12. The issuance of this permit shall not relieve the permittee of the responsibility for damages to surface or groundwaters resulting from the operation of this facility. 13. No traffic or equipment shall be allowed on the disposal area except while installation occurs or while normal maintenance is being performed. 14. An acceptable reserve area as indicated on the approved plans shall be maintained at all times. 15. The low pressure pipe lines shall be purged at least twice yearly and the pressure adjusted to approved specifications. 16. A suitable vegetative cover shall be maintained on the disposal field and the field shall be kept mowed. The clippings shall be removed to prevent the build-up of thatch. 17 Upon completion of construction and prior to operation of this permitted facility, a certification must be received from a professional engineer certifying that the permitted facility has been installed in accordance with this permit, the approved plans and specification. Mail the certification to the Wilmington Regional Office, 7225 Wrightsville Avenue, Wilmington, North Carolina 28403. 18. A copy of the approved plans and specification shall be maintained on file by the Permittee for the life of the project. 19. Failure to abide by the conditions and limitations contained in this permit may subject the Permittee to an enforcement action by the Division of Environmental Management in accordance with North Carolina General Statue 143-215.6. 20. The issuance of this permit does not preclude the Permittee from complying with any and all statutes, rules, regulations, or ordinances which may be imposed by other government agencies (local, state, and federal) which have jurisdiction. Noncompliance Notification: The Permittee shall report by telephone to the Wilmington Regional Office, telephone no. 919/256-4161 as soon as possible, but in no case more than 24 hours or on the next working day following the occurrence of first knowledge of the occurrence of either of the following: a. Any process unit failure, due to know or unknown reasons, that render the facility incapable of, adequate wastewater transport such as mechanical or electrical failures of pumps, line blockage or breakage, etc. b. Any failure of a pumping station or sewer line resulting in a by-pass directly to receiving waters without treatment of all or any portion of the influent to such station or facility. Persons reporting such occurrences by telephone shall also file a written report in letter form within 15 days following first knowledge of the occurrence. This report must outline the actions taken or proposed to be taken to ensure that the problem does not recur. Permit issued this 21 day of December, 1990. SIC Code(s): 7999 Wastewater Code(s): Primary: 10 Secondary: 13 PART III - EVALUATION AND RECOMMENDATIONS Bald Head Island Utility Company proposes to construct a septic tank/LPP system to serve a new golf course club house. The system is to consist of a 10,000 gallon septic tank, a dual pump dosing chamber and a low pressure pipe disposal field. Kitchen waste is to be passed through a 1200 gallon exterior grease trap. A repair area is designated. The system is to be located approximately 120 ft. from the existing 1pp field which serves the main treatment plant. The soil in the area generally consists of fine sand with a water table of 3 to 4 feet below the surface. Soil borings were made in this area in the summer of 1989. The proposed application rate of 0.75 GPD/sq. ft. appears to be appropriate. The design calculations have been reviewed and appear to be suitable. The groundwater section has no objection.
