This permit shall be effective from the date of issuance until September 15, 1991, and shall be subject to the conditions and limitations as specified therein_ This permit replaces and will void Permit No. WQ0004157 issued on September- 25, 1990 which contains an expiration date of April 1, 1991_ Please pay particular attention to the monitoring requirements in this permit. Failure to establish an adequate system for collecting and maintaining the required operational information will result in future compliance problems. If any parts, requirements, or limitations contained in this permit are unacceptable to you, you have the right to request an adjudicatory hearing upon written :request within 30 days following receipt of this permit. The request must be in the form of a written petition, conforming to Chanter 150B cf North Carolina General Statutes, and filed with the Office of Administrative Hearings, P_ O. Parker NORTH CAROLINA ENVIRONMENTAL MANAGEMENT COMMISSION DEPARTMENT OF ENVIRONMENT, HEALTH, AND NATURAL RESOURCES RALEIGH PULP AND HAUL PERMIT In accordance with the provisions of Article 21 of Chapter 143, General Statutes of North Carolina as amended, and other applicable Laws, Rules, and Regulations PERMISSION IS HEREBY GRANTED TO Mountain Air Country Club Yancey County FOR THE operation of pump and haul activities consisting of pumping approximately 1460 gallons per week of wastewater from the Mountain Air Country Club to the Town of Burnsville -'s Wastewater Treatment Plant with no discharge of wastes to the surface waters, pursuant to the application received March 14, 1991, and in conformity with the project plan, specifications, and other supporting data subsequently filed and approved by the Department, of Enti•ironment, Health, and Natural Resources and considered a part of this permit. This permit shall be effectivE: from the date of issuance until September 1, 1991, and shall be subject -to the following specified conditions and limitations: 1. 2. 3. M Pump and Haul Permit No. WQ00004157 issued on September 25, 1990, which contains an expiration date of: April 1, 1991, shall become null and void upon issuance of thiC permit_ This permit shall become voidable uxiless the subject pump and haul activities are carried out in a manner which has been approved by this Division. This permit is effective only with respect to the nature and volume of wastes described in the application and other supporting data. The facilities shall be properly maint-ai.ned and operated at all times. 5. This permit is not transferable. IXC the event there is a desire for the facilities to change ownership, or there is a name change of the Permittee, a formal permit request must be submitted to the Division of Environmental Management accompanied by an application fee, documentation from the parties involved, and other supporting materials as may be appropriate. The approval of this request will h(- considered on its merits and may or may not be approved. 6. No type of wastewater other than that from Mountain Air Country Club shall be included in the pump and haul activities. 7_ The permit shall become voidable unless the agreement between Mountain Air Country Club, A Porta Jon Service and the Town of Burnsville for the collection, transportation, and ultimate disposal of the wastewater is in full force and effect. 8. In the event that the facilities fail to perform satisfactorily, including the creation of nuisance conditions, the Permittee shall cease operation of all pump and haul activities and take such immediate corrective action as may be required by this Division. 9. This pump and haul permit shall not be renewed. 10. The sewage and wastewater collected by this system shall be treated in the Town of Burnsville`s Wastewater Treatment Plant prior to being discharged into the receiving stream. 11. The Asheville Regional Office, telephone number 704/251--6208, shall be notified at least forty-eight (48) hours in advance of operation of the pump and haul. activities so that an in-place inspection can be made- Such notification to the regional supervisor shall be made during the normal office hours from 8.00 a.m. until 5:00 p.m. on Monday through Friday, excluding State Holidays. 12. The Permittee is liable for any damages caused by a spill or failure of the pump and haul operations. 13. Adequate inspection, maintenance, and cleaning shall be provided by the Permittee to in -pure proper operation of the subject facilities. 14. The Permittee or his designee shall inspect the wastewater collection facilities to prevent malfunctions and deterioration, operator errors and discharge& whish may cause or lead to the release of wastes to the environment, a threat to human health, or a nuisance. The Permittee shall keep an inspection log or summary including at least the dame and time of inspection, observations made, and any maintenance, repairs, or corrective actions taken by the Permittee. Tliis log of inspections shall be maintained by the Permittee for aF, long as the pump and haul activities are being conducted and shall be made available upon request to the Division of Envirco�mental Management or other permitting authority. 15. Any duly authorized officer, emplovee, or representative of the Division of Environmental Management:: may, upon presentation of credentials, enter and inspect any property, premises or place on or related to the wastewater collection. facilities at any reasonable time for the purpose of- determining compliance with this permit; may inspect or copy aviy records that must be kept under the terms and conditions of t-liis permit; and may obtain samples. 16. An accurate record of the pump and haul activities must be maintained by the Permittee, indicating: a) date wastewater is removed from the facility, b) name of facility from which wastewater is removed, C) name of facility receiving wastewater, and d) volume of wastewater. removed. These records shall be made available upon request to the Division of Environmental Management or other permitting authority, 17. Failure to abide by the conditions and limitations contained in this permit may subject the Permittee to an enforcement action by the Division of Environmental Management in accordance with North Carolina General Statute 143--21.5.6. 18. The issuance of this permit does not preclude the Permittee from complying with any and all statutes, rules, regulations, or ordinances which may be imposed by other government agencies (local, state and federal) which have jurisdiction. 19. The Permittee shall provide for the installation and maintenance of an audible and visual highwater alarm. 20. A leakage test shall be performed on the septic tank and dosing tank to insure that any exfiltration occurs at a rate which does not exceed twenty (20) gallons per twenty-four (24) hour per 1,000 gallons of tank capacity. The engi.neer's certification will serve as proof of compliance with this condition. 21. A copy of the approved plans and specifications shall be maintained on file by "Che Permittee. for the life of the project. 22. Non -Compliance Notification: The Permittee shall report by telephone to the Asheville Regional Office, at telephone number 704/251-6208, as soon as possible, but in no case more than 24 hours or on the next working day following the occurrence or first knowledge of the occurrence of any of the following: a. Any process unit failure, due to known or unknown reasons, that render the facility incapable of adequate wastewater treatment such as mechanical, or electrical failure of pumps. aerators, compressors, etc. b. Any failure of a pumping station, sewer line, etc. resulting in a by-pass directly to receiving waters without treatment of all or any portion of the influent to such station or facility. Persons reporting such occurrences by telephone shall also file a written report iri letter form within 15 days following first knowledge of the occurrence. This report must outline the actions taken or proposed to be taken 'to ensure that the problem does not recur. 23. Upon completion of construction and prior to operation of the subject pump and haul activities, a certification must be received form a professional engineer certifying that the permitted facilities have been installed in accordance with this permit, the approved plans and specifications. Mail the certification to the Permits and Engineering Unit, Post Office Box 27687, Raleigh, N. C. 27611--7687 and to the Asheville Regional Office at 59 Woodfin Place, Asheville, N. C_ 28801. 24. The annual administering and compliance fee must be paid by the Permittee within thirty (30) days after being billed by the Division. Failure to pay the fee accordingly may cause the Division to initiate action to revoke this permit as specified by 15 NCAC 2H.0205 (c)(4). 25. The Permittee shall notify the Town. of Burnsville prior to disposing wastewater at the Town of Burnsville's Wastewater treatment plant and shall be disposed of under the supervision of a representative of the Town. 26. All pump and haul activities shall cease upon availability of the sewage collection facilities permitted by Permit No. WQ0003081. Notification shall be given to the Asheville Regional Office upon cessation of the pump and haul activities. Permit issued this the 19th day of March, 1991. Fortunately, Mr. Parker alerted me last week to the April 1 expiration. We currently are diligently pursuing the construction of sections of our sewer system that were approved under Permits #WQ0003081 and WQ0002419. We were not able to begin construction on either of these sections as early as we had hoped, and once construction was begun, we have encountered significant delays due to weather and rock excavation. At the time that we submitted the application for the pump and haul permit, we did not anticipate the above mentioned delays, and consequently now find ourselves in a bind due to the fact that our construction schedule is behind and our pump and haul permit will expire prior to the completion of construction. The pump and haul permit was to allow us to operate our temporary golf pro shop and up to eight two bedroom vacation cottages adjacent to the pro shop. Pump and haul activities, in fact, barely began last fall before we ended our season in early November, so there has been no pump and haul activity since them. We do plan to reopen the golf pro shop in April, however, and we expect some of the vacation homes to be occupied then as well, though we don't expect all to be occupied simultaneously. P.D. I nonetheless would respectfully ask the cooperation of the Department in allowing us to resume and continue pump and haul activities (only to the extent and for the amounts and units originally permitted) until the completion of construction of the two sections of the sewer system previously mentioned. As I said, this work is currently in progress and it is our hope that (unforeseen circumstances such as weather notwithstanding) we can be complete and operational by late June or early July. We would be happy to provide your office with a letter from the engineering firms involved stating that we are proceeding in good faith to complete the construction. I would also be happy to have one of your representatives visit the site for a personal inspection if necessary. Thank you for your time.
