Dear Mr. Hite:
On June 20, 2005, the Division of Water Quality (Division) received a written correspondence
from Mr. Todd Shearin of Synagro South, Inc. The purpose of Mr. Shearin's correspondence was to
transmit an item that was required by a condition in Permit No. WQ0004033, issued to the City of
Mebane on June 14, 2005. This is:
Footnote b of Attachment B: This condition required that the Permittee submit a
completely -executed Form LOAA (i.e., landowner agreement) for Site Nos. NC-OR-
10-01, NC-OR-10-06, and NC-OR-10-07 to the Division for review and
acknowledgment before the initiation of any residuals land application activities.
This information was required because there was uncertainty surrounding the
ownership of these land application sites. Mr. Shearin's provided a completely -
executed Form LOAA that clarified that the sites were now owned by Ms. Elizabeth
T. Walters and operated by Mr. Roland Walters (i.e., previously owned and operated
by Mr. Victor Carl Walters, Jr.).
The content of Mr. Shearin's correspondence have been reviewed and entered into our database
as well as placed on file in our central file room for the Division's future reference as needed. The
requirement of Footnote b. of the Attachment B has now been mer. Please note that nothing in this
correspondence should be construed as removing you from the responsibility for complying with your
permit in full.
Because the landowner and operator of Site Nos. NC-OR-01, NC-OR-10-06, and NC-OR-10-07
have changed from what was presented in the original permit renewal/modification application package,
the Division believed that it was necessary to issue a minor modification of this permit. Therefore, in
accordance with the information received on June 20, 2005 as required to comply with Footnote b. of the
Attachment B, we are forwarding herewith a modified Attachment B, certified on June 27, 2005, to the
City of Mebane for the subject alum residuals land application program.

Please replace the existing Attachment B of Permit No. WQ0004033 that was previously
certified on June 14, 2005, with this modified Attachment B. It is the Permittee's responsibility to
ensure that a complete permit is created by inserting this modified Attachment B into Permit No.
WQ0004033, which was issued on June 14, 2005, and making sure to retain any vicinity and buffer maps
for any existing and unmodified land application sites.
This modified Attachment B shall be effective from the date of certification; shall void
Attachment B of Permit No. WQ0004033 that was previously certified on June 14, 2005; and shall be
subject to the conditions and limitations as specified therein as well as those specified in the above -
referenced permit. As always, remember to take the time to review this modified Attachment B
thoroughly, as some of the conditions contained therein may have been changed since the last
certification. Note that this modified Attachment B is hereby incorporated by reference into Permit No.
WQ0004033, issued on June 14, 2005.
In addition, please be aware of the concern that the Division posed in Permit No. WQ0004033,
issued on June 14, 2005. Specifically, during the inspection that was performed by the Aquifer Protection
Section of the Division's Winston-Salem Regional Office, several portable toilets were observed on Site
No. NC-OR-10. The Permittee is reminded that this site should be removed from this residuals
management program if also approved by the Division of Waste Management for disposal of portable
toilet waste. Alternatively, if the portable toilets are indicative of future development, the Permittee is
also reminded that Condition II. 26. of this permit requires that public access be restricted to the site for a
period of 12 months following the last residuals land application event. The Division urges the Permittee
to communicate with the landowner/operator of this site as to the presence of the portable toilets to ensure
complete compliance with the conditions of this permit.
If any parts, requirements, and/or Iimitations contained in this certification or modified
Attachment B are unacceptable, you have the right to request an adjudicatory hearing upon written
request within 30 days following receipt of the certification. This request shall be in the form of a written
petition, conforming to Chapter 150B of the North Carolina General Statutes and filed with the Office of
Administrative Hearings at 6714 Mail Service Center, Raleigh, North Carolina 27699-6714. Unless such
demands are made, this permit shall be final and binding.

a This land application site has areas with greater than 10 percent slope. However, these inclusions are small and slight, and, at the time of the Division's inspection, there was
no evidence of erosion or poor cover crop establishment. Therefore, this site shall be exempt from the requirements of Condition 11. 6. in that residuals may be surface applied
over the entire acreage as long as no run-off of the residuals occurs.
