RENEWAL AND MODIFICATIONAPPLICATIONS (use Previous section for new or maior modification systems) Description Of Waste(S) And Facilities Are there appropriately certified ORCs for the facilities? ® Yes or ❑ No. Operator in Charge: Hope Walters Certificate 4:SI-15687 & WW-4 (24385) Backup- Operator in Charge: James Wilson Certificate 4:SI 26721 2. Is the design, maintenance and operation (e.g. adequate aeration, sludge wasting, sludge storage, effluent storage, etc) of the treatment facilities adequate for the type of waste and disposal system? ❑ Yes or ® No. If no, please explain: The facility is currently under two NOV's (with a enforcement case and penalty forthcoming) for discharges from Fields D & E and Fields F & G. The discharges resulted from ponding of water on the irrigation fields, very cold weather conditions that contributed to saturated ground surface freezing . and continual irrigation of fields during plant operations. The treatment system doesn't have a storage facility for holding water during inclement weather. Also contributing to the poor management of wastewater at the facility is the lack of a cover crop that can expire large volumes of water during the coldest time of the year. The facility overseeds the bermuda fields with a annual rye that grows during the months of October and November, but doesn't. progressively grow during December January February and March therefore the rye doesn't transpire the large volumes of wastewater that Campbell Soup produces duringpeak soup production season (starts in September and runs thru the 1" of March) Campbell Soup is currently plannning to plant small test plots (approx. 1 acre in size) in various fields in the different soil types present to see if a more aggressively crop can be planted verses the. standard annual rye grass. 3. Are the site conditions (soils, topography, depth to water table, etc) maintained appropriately and adequately assimilating the waste? ❑ Yes or ® No. If no, please explain: During the peak soup production ' season, which coinsides with the worst crop growing season, Campbell Soup generates the highest volumes of wastewater routinely. The spray irrigation system is a "on demand design" in that the irrigation system is spraying during plant production, no matter what the weather conditions. Recently, the facility has experience several run-off events. The run-off of wastewater and stormwater was made worst by Campbell Soup clearing and cleaning of vegetation (trees, sapplings, volunteer grasses and weeds) from the borders of the spray irrigation fields. Also, perimeter ditches were denuded after removing all trees underbrush and vegetation Along with this clearing regrading of the field perimeters also took place that allowed for ponded water in the fields to migrate from the fields to perimeter ditches. Campbell Soup has of late been aerating fields to enhance water penetration and absorption Campbell Soup also plans to regrade Field "B" (wet weather, pumphouse overflow field) by removing sediments not removed by the DAF unit at the plant along with the organics that have built up from cutting the volunteer grasses that have grown in Field "B" for the last 20+ years The thatch/reminant grass has built up to a point that the storage capacity of Field "B" had been reduced and current FORM: APSARRcampbellsoupPermitRenwa1WQ0003626March09.doc AQUIFER PROTECTION SECTION REGIONAL, STAFF REPORT Campbell Soup personnel believe that Field "B" was never constructed to the maximum contour (storage volume) that was initially designed for. 4. Has the site changed in any way that may affect permit (drainage added, new wells inside the compliance boundary, new development, etc.)? If yes, please explain: See comments in item 3 above. 5. Is the residuals management plan for the facility adequate and/or acceptable to the Division? ® Yes or ❑ No. If no, please explain: 6. Are the existing application rates (hydraulic or nutrient) still acceptable? ❑ Yes or .® No. If no, please explain: No biological treatment taking place since very little organic material being introduced into the treatment system. The material beingland and applied and wastewater irrigated is from the DAF unit at the plant treatment system. DAF residuals consist of very fine vegetable material along plant residue that is washed fi-om the vegetables processed at the plant for soup products. Under the current NOV's/enforcement actions taking place, information is being requested to address the hydraulic loading rates at the facility in light of the recent discharges. At this time the information requested by the second NOV has not been submitted. 7. Is the existing groundwater monitoring program (number of wells, frequency of monitoring, monitoring parameters, etc.) adequate? ® Yes ❑ No ❑ N/A. Attach map of existing monitoring well network if applicable. Indicate the review and compliance boundaries. If No, explain and recommend any changes to the groundwater monitoring program: Monitoring wells at the facility are detecting Nitrates levels around Fields C, D, E, F, G, & H. Current study of the monitoring data past and present is underway to see if loading rates and nitrate concertrations in the wastewater are the culprit for the nitrate levels being reported. 8. Will- seasonal or other restrictions be required for added sites? ❑ Yes ® No ❑ N/A If yes, attach list of sites with restrictions. (Certification B?) 9. Are there any buffer conflicts (treatment facilities or disposal sites)? ❑ Yes or ® No. If yes, please attach a map showing conflict areas or' attach any new maps you have received from the applicant to be incorporated into the permit: 10. Is the description of the facilities, type and/or volume of waste(s) as written in the existing 'permit correct? Yes or ❑ No. If no, please explain: 11. Were monitoring wells properly constructed and located? ® Yes or ❑ No ® N/A. If no, please explain: 12. Has a review of all self -monitoring data been conducted (GW, NDMR, and NDAR as applicable)? ® Yes or ❑ No ❑ N/A. Please summarize any findings resulting. from this review: Joel Shields has reviewed the 2008 NDNfR/NDAR's. MW-5 associated with Field E has a history of Nitrate standard violations above 2L of 10 mg,/1 from M04 to 2008 ( of the 12 samples collected 5 have been above 2L). The most recent GW-59 indicated a nitrate level of 10 MWI. Further investigation is to be done by the regional office concerning the sampling results from MW-5. According to sources familiar with the site; the location of Field E and Field D, along with MW-5 and MW-6 is on a former poultry farm. Review of orthophotos and file review will be done FORM: APSARReamp6ellsoupPermitRenwa1WQ0003626March09.doc 4 AQUIFER PROTECTION SECTION REGIONAL STAFF REPORT to determine if past farming activities are the culprit for groundwater standard violations or contributing to the violation. 13. Check all that apply: ❑ No compliance issues; ® Notice(s) of violation within the last permit cycle Current enforcement action(s) ❑ Currently under " SOC; ❑ Currently under JOC; ❑ Currently under moratorium. If any items checked, please explain and attach any documents that may help clarify answer/comments (such as NOV, NOD etc): A meeting was convened on 12 March with DWQ staff and Campbell Soup staff, including their consultant, to discuss the two NOV"s and pending enforcement. Discussion was had concerning the implimentatio of a SOC if Campbell Soup chose to enter into such a agreement. Campbell Soup was instructed to visit the-DWO website, review the SOC process and decide if it want to initiate and enter into a SOC with the Division. Hopefully a final decision by Campbell Soup will be known the week of 16 March. Communication with Campbell Soup will be ongoing over the next few weeks either in the form of the SOC or enforcement package. 14. Have all compliance dates/conditions in, the existing permit, (SOC, JOC, etc.) been complied with? ❑ Yes ® No ❑ Not Determined ❑ N/A.. If no, please explain: 15. Our engineers, O'Brien & Gere, have provided.both your office and the Fayetteville Regional Office with record drawings for the land application system constructed at the Campbell Soup facility in Maxton, and have certified that the facility meets the intent of the original design and permit. The requested corrections to the permit are as.follows: 11. The number of spray heads in Zones 1 and 4 were reduced based on the observed soil conditions encountered during construction. This has resulted in a change in area (acres) in those two zones. Please correct the permit by changing the area shown in the table under Section II, number 4 of the permit to 3.90 acres for Zone J-1 and 1.85 acres for Zone J-4. This change also results in a reduction to approximately 51 acres in the irrigation area constructed as described on the first page of the permit. Thank you for your assistance in this matter.
