Normally, in the absence of oxygen, typical activated sludge organisms would be unable to assimilate the soluble carbon (SBOD). However, specific organisms can absorb SBOD through the use of chemical energy liberated by the hydrolysis of phosphate to orthophosphate. The anaerobic selector allows for,the proliferation of these organisms. In the subsequent anoxic zone of the treatment process, these.organisms oxidize the absorbed and remaining BOD to generate energy to resynthesize the polyphosphate from soluble orthophosphate and to form new cells, resulting in a net uptake of phosphorus. The orthophosphate is therefore removed from the wastewater and becomes incorporated in the waste sludge. There will be two anaerobic tanks each 7,023 gallons in volume. Energy utilization by the phosphorus removing microorganisms for the purpose of BOD absorption during the anaerobic phase is provided by the breakdown of stored 'polyphosphate. The polyphosphate is a linear molecule formed by linking together orthophosphate molecules. As the polyphosphate breaks down in the anaerobic phase, soluble orthophosphate is formed inside the cell. The orthophosphate then diffuses to the liquid outside the cell causing an increase in the soluble phosphate in the mixed liquor of the anaerobic bioreactor. The amount of polyphosphate released is proportional to the amount of soluble CBOD present in the influent wastewater. Biomass in this tank will be mixed by means of a submersible propeller mixer. Mixed liquor is recycled to this tank from the primary anoxic tank by means of the centrifugal pump. Mixed liquor is conveyed by gravity from this bioreactor to the primary anoxic tank. Primacy Anoxic Tank The single stage anoxic bioreactor will provide the oxygen free environment necessary for the exogenous denitrification process, which utilizes the carbon available in the influent CBOD. IN removal is accomplished in the primary anoxic zone by the conversion of nitrate -nitrogen to nitrogen gas. Although the primary anoxic zone is maintained free of dissolved oxygen, it contains oxygen in the form of nitrates recycled in the mixed liquor from the aeration tank. The carbon source required for biological denitrification is provided by the influent wastewater. Oxygen. required for the oxidation of BOD and NH3-N is supplied by the chemically bound oxygen freed from the nitrate ion. The result is the reduction. of nitrates, contributing to the total nitrogen concentration, and decreasing the overall oxygen transfer requirements in the aeration tank. There will be two anoxic tanks each 14,600 gallons in volume. Carbon dioxide and water are also produced, resulting from the degradation of BOD. In addition, approximately half of the alkalinity consumed during the notification is restored through, the denitrification process. Mixed liquor in this tank will be In suspension by means of a submersible propeller mixer. Mixed liquor is recycled from the tank to the anaerobic tank by means of a centrifugal pump. Mixed liquor is conveyed by gravity from this bioreactor to the aeration tank. Aeration Tank This single"stage aerobic bioreactor will provide the oxygen rich environment required for nitrification. The raw wastewater influent ammonia and a portion of the organic, nitrogen, which can be readily hydrolyzed to ammonia, can'be oxidized in an aerobic environment'to form nitrite and finally nitrate. This step is termed"nitrification and is carried out by the autetrophic bacteria, Nitrosomonas and Nitrobacter. These microorganisms are slow -growing and require a longer sludge retention, time (SRT) than the heterotrophic bacteria responsible for BOD removal. In the presence of dissolved oxygen and a sufficient SRT, microorganisms will oxidize the BOD and ammonia. Nitrification involves the conversion of ammonia by nitrified bacteria to nitrate. Nitrate rich mixed liquor is recycled from this tank to the primary anoxic tank by means of a centrifugal pump. Uptake of the released and influent soluble P takes place in this bioreactor. In order to meet the low effluent total phosphorus requirement, a metal salt coagulant (Alum) may be added to this bioreactor to achieve chemical precipitation of phosphorus. Oxygen is supplied via compressed air through fine bubble membrane diffusers arranged in a full floor, coverage configuration. There will be two aerobic tanks each 25,900 gallons in volume. Secondary Anoxic Tank The single stage secondary anoxic bioreactor will provide the oxygen free environment necessary for the endogenous denitrification. This secondary denitrification zone is required as the polishing step in order to meet the low effluent total nitrogen requirement. Because ammonia must be nitrified under, aerobic or oxic conditions,. it is physically impossible to recycle all of the nitrates back to the primary anoxic zone for denitrification. This remaining nitrate can be denitrified in a secondary anoxic bioreactor. Thus for systems with stringent requirements for effluent total nitrogen; secondary anoxic basins following the aeration tank must be utilized. Typically there is little to no available CBOD remaining in the system at this point. Remaining nitrate is removed very slowly because the only source of carbon is the mixed liquor itself. As some bacteria die and decompose, they,provide BOD for the other bacteria. This process is very slow and.is known as endogenous respiration. An external carbon source may be -required and will. be included in the design. There will be two anoxic tanks each 25,900 gallons in volume. This power reactor can be bypassed in -one of the two activated sludge trains, allowing aerated mixed liquor to be conveyed directly to the MBR tanks. Membrane Tanks Mixed Liquorfrom each secondary anoxic zone is evenly distributed to an array of five (5) membrane tanks. Any individual membrane tank can betaken off-line by means of gate or plug valves. Each MBR tank contains five (5) ,emerged membrane modules which facilitate solid and liquid separation. Each tank, has been provided for one future module space. Scour aeration is provided by means of coarse bubble diffusion. This scour aeration also meets oxygen and respiration requirements of the biomass within these tanks. In order to control the solid concentration gradient at the membranes, mixed liquor is recirculated at relatively high rates (4-5Q) from the membrane tanks to the aeration tanks. Permeate is pulled through the membranes, by means of the manifold piping in the suction of centrifugal pumps: One permeate pump is dedicated to each MBR tank. The permeate is then conveyed to the disinfection units. From the sludge recirculation line, excess sludge (WAS) can be wasted to the aerated sludge holding tanks. The excess sludge concentration will be approximately 1 % dry solids. There will be five membrane tanks each 14,220 gallons in volume. �A total of 57,400 gallons of sludge holding is provided in four tanks. Chemical Addition In order to meet the target effluent total phosphorus concentrations, liquid alum can be added to the aeration tanks or to the MBR tank flow distribution box. The chemical feed system consists of the duplex pump skid and the alum storage tank with liquid level control. As a side benefit, coagulation addition is also believed to improve MBR flux performance due to the coagulation/floculation mechanism of colloidal material. Ultraviolet Disinfection The wastewater is disinfected by ultraviolent disinfection and discharged to the infiltration basin. The ultraviolet disinfection will be a dual train arrangement utilizing chambered vessels with low pressure `high -intensity' lamps. The system is designed to provide an ultraviolet dose not less than 80,000 uW-s/cm2 after 12,000 hours of system operation measured in wastewater with a 70% UN transmission at 253.7 nm and with a lamp output of 80% of its initial level after one yearof operation. The effluent standard shall be a maximum of 14 FC/100 ml. the system shall have a manual quarts wiping system to allow protective sleeves to be cleaned on a predetermined basis. Infiltration Basin The infiltration basins shall be located next to the wastewater treatment plant. The infiltration basin will be constructed under a proposed elevated parking facility. Two basins shall be constructed so that maintenance can be performed, on the sand beds and spray distribution system beneath.the first floor of the parking deck. Subsurface drains shall be installed 50 feet from the infiltration basin surface to manage groundwater. This groundwater will be pumped to existing irrigation ponds. Five -Day Side -stream Detention Tank Effluent from the treatment facility will be continuously monitored for turbidity. If either the turbidity exceeds 10 NTU or if they permitted fecal coliform levels canhot be met, effluent will be discharged to the 2,600,000 five-day side -stream detention time. Condition 11.11. — This condition requires any landowner who owns land within the compliance boundary, but who is not the Permittee, to execute and file with the County Register of Deeds an easement with the requirements listed in the said Condition. Please note the previous permit was subject to this requirement under 15A NCAC 02L .0107(f), therefore, this condition is intended to voice this rule. 6. Condition 11.13.c. —This condition includes the 15A NCAC 02T .0506(b) setbacks for the new DAF units. ' 7. Condition 111.6. — This condition requires that all waste application equipment must be tested and calibrated at least once per permit cycle. 8. Attachment A — A maximum daily flow limit of 4,311,206 gallons per day.(GPD) has been instituted due to recent compliance issues regarding ponding and runoff from the irrigation fields. Once Field H has been constructed and the Engineering Certification submitted, the maximum daily flow may increase to 5,039,515 GPD. In addition, per the Aquifer Protection Sections Monitoring Policy, passive treatment systems disposing of more than 500,000 GPD shall sample all effluent parameters at a minimum of 2 times per month, unless noted otherwise. In addition, note that Lead has been removed from the monitoring parameters. 13. Attachment C — Monitoring well MW-10 has been added back into the groundwater monitoring regimen. In addition, note.that Fecal Coliforms have been removed from the monitoring parameters. Upon completion of construction and prior to operation of the permitted facility modifications, a certification (see attached form) must be received from a professional engineer certifying that the permitted facility modifications have been installed in accordance with this permit, the approved plans and specifications, and other supporting materials including the location of all monitoring wells as applicable. If this protect is to be completed in phases and partially certified you shall retain the responsibility to track further construction approved under the same permit, and shall provide a final certificate of completion once the entire project has been completed. Mail the Certification to the Aquifer Protection Section, Division of Water Quality, 1636 Mail Service Center, Raleigh, NC 27699-1636. 2. The Fayetteville Regional Office, telephone number (910) 433-3300, shall be notified at least forty- eight (48) hours in advance (excluding weekends and holidays) of operation of the installed modified facilities so that an in -place inspection can be made. Such notification to the regional supervisor shall . be made during the normal office hours from 8:00 a.m. until 5:00 p.m. on Monday through Friday, excluding State Holidays. 3. Within ninety (90) days of permit issuance, the Permittee shall submit two original copies of a scaled site map (scale no greater than 1"=100); however, special provisions may be granted upon prior approval for large properties. The map(s) must include the following information: a. The location and identity of each monitoring well. b. The location of major components of the waste disposal system. c. The location of property boundaries within 500 feet of the disposal area(s). d. The latitude and longitude of the established horizontal control monument. e, The elevation of the top of the well casing (which shall be known as the "measuring point") relative to a common datum. f. The depth of water below the measuring point at the time the measuring point is established. g. The location of review and compliance boundaries. h. The date the map is prepared and/or revised. Control monuments shall be installed in such a manner and made of such materials that the monument will not be destroyed due to activities that may take place on the property. The maps and any supporting documentation shall be sent to the N.C. Division of Water Quality, Aquifer Protection Section, 1636 Mail Service Center, Raleigh, N.C. 27699-1636. The Permittee is responsible for the geographic accuracy of any map submitted, however producer. 4. No later than six months prior to the expiration of this permit, the Permittee shall request renewal of this permit on official Division forms. Upon receipt of the request, the Division will review the adequacy of the facilities described therein, and if warranted, will renew the permit for such period of time and under such conditions and limitations as it may deem appropriate- Please note that Rule 15A NCAC `,02T :0105(d) requires,. an updated' site,map' to Ire- submitted `with the -permit renewal application. The Operator in Responsible Charge (ORC), the designated back-up ORC or a person under the supervision of the ORC shall inspect the land application sites as often as necessary, but in no case shall the time between inspections be more than -120 minutes, -during the application of ;wastewater to the permitted fields. A record of each inspection shall be recorded.on forms approved by the Division and shall include, at a minimum, the date, time, spray field, inspected and name of the inspector. Comments shall be noted on the forms as to the condition(s) observed during the inspection of the fields in use at the time of the inspection. i 2. The surface irrigation facilities shall be effectively maintained and operated at all times so that there is no discharge to the surface waters, nor any contravention of groundwater or surface water standards. In the event that the facilities fail to perform satisfactorily, including the creation of nuisance conditions due to improper operation and maintenance, or failure of the irrigation area to adequately assimilate the wastewater, the Permittee shall take immediate corrective actions including those actions that may be required by the Division, such as the construction of additional or replacement wastewater treatment and disposal facilities. 3. The issuance of this permit shall not relieve the Permittee of the responsibility for damages to ground or surface waters resulting from the operation of this facility. 4. All wells that are constructed for .purposes of groundwater monitoring shall be constructed in accordance with 15A NCAC 02C .0108 (Standards of Construction for Wells Other than Water Supply) and any other state and local laws and regulations pertaining to well construction. 5. Effluent limitations shall not exceed those specified in Attachment A. I 6. Application rate(s), whether hydraulic, nutrient, or other pollutant shall not exceed those specified in Attachment B. i i 7. The compliance boundary for the disposal system is specified by rules in 15A NCAC 02L .0100, Groundwater Classifications and Standards. The disposal system consisting of Fields A `R C; D, and E was individually, permitted.prior.. to December 30, 1983; therefore; the. compliance. -boundary is established at either 500 feet -from the waste disposal area, or at=the property boundary, whichever is closest to the waste disposal . area. An exceedance of groundwater standards at or beyond the compliance boundary is subject to remediation action according to 15A NCAC 02L .0106(d)(2) as well as enforcement actions in accordance with North Carolina General Statute 143-215.6A through 143-215.6C. I' 8. The compliance boundary for the disposal system is specified by rules in 15A NCAC 02L, Groundwater Classifications and Standards. The disposal system consisting of Fields ,,G, I=and J was individually. permitted on .or after December. 30, 1983; therefore, the compliance,', boundary is established at either 250 feet from the waste disposal area; or 50 feet within the propeity boundary, whichever is closest to the -waste disposal area. An exceedance of groundwater standards at or beyond the compliance boundary is subject to remediation action according to 15A!•NCAC 02L .0106(d)(2) as well as enforcement actions in accordance with North Carolina General!: Statute 143- 215.6A through 143-215.6C. 9. The Permittee shall apply for a permit modification prior to any sale or transfer of property that affects a compliance boundary to establish a new compliance boundary. I 10. In accordance with 15A NCAC 02L .0107(d), no wells, other than monitoring wells, shall be constructed within the compliance boundary except as provided by 15A NCAC 02L .0107(g). WQ0003626 Version 3.0 Shell Version 090204 Page 3 of 10 I L Except as provided for in 15A NCAC 02L .0107(g), the Permittee shall ensure that any landowner who owns land within the compliance boundary, but who is not the permittee, shall execute and file with the Register of Deeds in the county in which the land is located an easement running with the land that contains the following items: a. A notice of the permit and number or other description as allowed in 15A NCAC 02L .0107(f)(1); b. Prohibits construction and operation of water supply wells within the compliance boundary; and c. Reserves the right of the permittee or the State to enter the property within the compliance boundary for purposes related to the permit. The Director may terminate the easement when its purpose has been fulfilled or is no longer needed. 12. The review boundary is established around the disposal systems midway between the compliance boundary and the perimeter of the waste disposal area. Any exceedance of standards at the review boundary shall require action in accordance with 15A NCAC 02L .0106. 13. The facilities shall be properly maintained and operated at aH times. The facilities shall be effectively maintained and operated as a non -discharge system to prevent the discharge of any wastewater resulting from the operation of this facility. :The Permittee shall maintain an Operation and Maintenance Plan pursuant to-15A NCAC 02T .0507 including operational functions, maintenance schedules, safety measures, and a spill response plan. 2. Upon classification of the wastewater treatment and irrigation facilities by the Water Pollution Control System Operators Certification Commission (WPCSOCC), the-Permittee shall designate and employ a certified operator to be in responsible charge (ORC) and one or more certified operator(s) to be back-up ORC(s) of the facilities in accordance with 15A NCAC 08G .0200. The ORC shall visit the facilities in accordance with 15A NCAC 08G .0200 or as specified in this permit and shall comply with all other conditions specified in these rules. 3. A suitable year round vegetative cover shall be maintained such that crop health is optimized, allows for even distribution of effluent, and allows inspection of the irrigation system. 4. _Adequate measures shall be taken to prevent wastewater ponding or wastewater runoff from the irrigation field. Inclement weather shall not affect the spray irrigation of wastewater unless the ground is in a condition that will cause runoff of applied wastewater from. sections of Fields A, C, D, E, F, G, H (when constructed), I and J. During such events, excess wastewater shall be diverted to Field B until the impacted field sections are inspected and deemed suitable for resuming irrigation. If an upset condition occurs in Field B, resulting in an overflow or discharge of wastewater, the Permittee shall contact the Division. The_Permittee shall- also: conduct-a.study:.to,determine.how and:why-this -upset condition occurred, and shall take the necessary steps to ensure that future problems do not arise. The study, and its recommendations shall be submitted to both the Regional and Central Offices upon completion.. 6. 'Ail waste application equipment must be tested and calibrated at least once per permit cycle. Records of the calibration must be maintained for five years. 7. No type of wastewater other than that from the Maxton Plant and Silgan Can Company shall be irrigated onto the irrigation area. 8. No traffic or equipment shall be allowed on the disposal area except while installation occurs or while normal maintenance is being performed. 9. Public access to the land application sites shall be controlled during active site use. Such controls may include the posting of signs showing the activities being conducted at each site. 10. The residuals generated from these treatment facilities must be disposed / utilized in accordance with 15A NCAC 02T .1100. The Permittee shall maintain a residual management plan pursuant to 1 SA NCAC 02T .0508. 1 I . Diversion or bypassing of the untreated wastewater from the treatment facilities is prohibited. 12. Industrial waste shall not be applied or discharged onto or below the land surface when the vertical separation between the waste and the seasonal high water table is at less than three (3) feet, unless the Permittee has demonstrated to the Director or his delegate, by using predictive calculations or modeling methods acceptable to the Director or his delegate, that such placement will not result in the contravention of classified groundwater standards. MONITORING AND .REPORTING REQUIREMENTS Any monitoring (including groundwater, surface water, soil or plant tissue analyses) deemed necessary by the Division to ensure surface and ground water protection will be established and an acceptable sampling reporting schedule shall be followed. 2. All :laboratory analyses for effluent, groundmaters, or surface waters shall be made by a laboratory certified by the Division for the required parameter(s) under ISA NCAC 02H .0800. 3. Flow through the treatment facility shall be continuously monitored and daily flow values shall be reported on Form NDMR. The Permittee shall install and maintain an appropriate flow measurement device consistent with approved engineering and scientific practices to ensure the accuracy and reliability of flow measurement. Flow measurement devices selected shall be capable of measuring flows with a maximum deviation of less than 10 percent from true flow, accurately calibrated at a minimum of once per year, and maintained to ensure that the accuracy of the measurements is consistent with the accepted capability of that type of device. The Permittee shall keep records of flow measurement device calibration on file for a period of at least three years. At a minimum, data to be included in this documentation shall be: a. Date of flow measurement device calibration, b. Name of person performing calibration, and c. Percent from true flow. 4. The ::effluent from the subject facilities. shall be monitored by the Permiftee, at the frequencies and locations for the parameters specified in Amp/7 PA 5. The Permittee tracking the amount of wastewater disposed shall maintain adequate records. These records shall include, but are not necessarily limited to, the following information: a. Date of irrigation, b. Volume of wastewater irrigated, c.. Field irrigated, d. Length of time field is irrigated, e. Continuous weekly, monthly, and year-to-date hydraulic (inches/acre) loadings for each field, f. Continuous "monthly and year-to-date, loadings _ for ;any, non -hydraulic .parameter, .;specifically limited'in Attachment B for each field; g. Weather conditions, and h. Maintenance of cover crops. 6. An agricultural expert or licensed agronomist shall submit an annual report to the Division, and shall include at a minimum: a. Total volume of effluent applied to each field; b. Types and quantities of nutrient additives applied to each field; c. Overall evaluation of each field; d. Annual maintenance and management practices that have been performed (i.e., weed control, surface aeration, deep aeration, crop removal and final destination, plant tissue analysis of hay crop, evaluation of soil test, actual PAN application (acre/yr) and equipment repair. This record shall include the name of the hauler, permit authorizing the disposal or a letter from a municipality agreeing to accept the residuals, date the residuals were hauled, and volume of residuals removed. 8. A maintenance log shall be maintained at this facility including but not limited to the following items: a. Visual observations of the plant and plant site. b. Record of preventative maintenance (changing of equipment, adjustments, testing, inspections and cleanings, etc.). c. Date of calibration of flow measurement device. 9. Monitor wells shall be sampled after construction and within 3 months prior to initiating waste disposal operations. Monitor wells shall be sampled thereafter at the frequencies and for the parameters specified in Attachment C. All _mam)in , well construction forms well abandonment forms, and monitoring data shall refer to the permit number and the well nomenclature as provided in Attachment C and Figure 1. 10. Two' (2) copies of the results of the sampling and analysis must be received on Form. GW-59 (Groundwater Quality Monitoring: Compliance Report Form), along with: attached copies: of labo„ratory .analyses, , by the Division of Water Quality, Information Processing Unit, 1617 Mail Service Center, Raleigh, North Carolina 27699-1617 on or before the last working day of the month following the sampling month. Form GW-59 shall include the number of this permit and the appropriate well identification number. One Form GW-59a certification form shall be provided for each set of sampling results submitted. 11. Three (3) copies of all monitoring data [as specified .in Conditions IV.3. and IVA] on Form NDMR for each PPI and three (3) copies of all operation and disposal records [as specified in Condition IV.5.] on Form NDAR-1 for every field -shall be submitted on or before the last day of the following month. If no activities occurred during the monitoring month, monitoring reports are still required documenting the absence of the activity. An annual representative soils analysis (Standard Soil Fertility Analysis) shall be conducted on each irrigation field and the results maintained on file by the Permittee for a minimum of five years. The Standard Soil Fertility Analysis shall include, but is not necessarily limited to, the following parameters: Acidify Manganese Potassium Calcium Percent Humic Matter Sodium Copper pH Zinc Magnesium Base Saturation (by calculation) Phosphorus Cation Exchange Capacity Exchangeable Sodium Percentage WQ0003626 Version 3.0 Shell Version 090204 Page 7 of 10 1A 13. Noncompliance Notification: The Permittee shall report by telephone to the Fayetteville Regional Office, telephone number (910) 433-3300; as soon as possible, but in no case more than 24 hours or on the next working day following the occurrence or first knowledge of the occurrence of any of the following: a. Any occurrence at the wastewater treatment facility which results in the treatment of significant amounts of wastes which are abnormal in quantity or characteristic, such as the dumping of the contents of a sludge digester; the known passage of a slug of hazardous substance through the facility; or any other unusual circumstances including runoff from the irrigation fields due to applied wastewater. b. Any process unit failure, due to known or unknown reasons, that render the facility incapable of adequate wastewater treatment such as mechanical or electrical failures of pumps, aerators, compressors, etc. c. Any failure of disposal system resulting in a by-pass directly to receiving waters. d. Any time that self -monitoring information indicates that the facility has gone out of compliance with its permit limitations including, but not limited to, freeboard :measurements, effluent,, limitations, exceedances of groundwater standards, or overloading of any field. For any emergency that requires immediate reporting (e.g., discharges to surface waters, imminent failure of a storage structure, etc.) outside normal business hours must be reported to the Division's Emergency Response personnel at telephone number (800) 662-7956, (800) 858-0368, or (919) 733- 3300. Persons reporting such occurrences by telephone shall also file a written report in letter form within five (5) days following first knowledge of the occurrence. This report must outline the actions taken or proposed to be taken to ensure that the problem does not recur. 1. Adequate inspection and maintenance shall be provided by the Permittee to ensure proper operation of the subject facilities. 2. The Permittee or his designee shall inspect the wastewater treatment and disposal facilities to prevent malfunctions and deterioration, operator errors and discharges which may cause or lead to the release of wastes to the environment, a threat to human health, or a nuisance. The Permittee shall keep an inspection log or summary including at least the date and time of inspection, observations made, and any maintenance, repairs, or corrective actions taken by the Permittee. This log of inspections shall be maintained by the Permittee for a penod:of=five years from--the=date of the inspection and shall be made available upon request to the Division or other permitting authority. 3. Any duly authorized officer, employee, or representative of the Division may, upon presentation of credentials, enter and inspect any property, premises or place on or related to the disposal site or facility at any reasonable time for the purpose of determining compliance with this permit; may inspect or copy any records that must be maintained under the terms and conditions of this permit, and may obtain samples of groundwater, surface water, or leachate. Failure to abide by the conditions and limitations contained in this permit may subject the Permittee to an enforcement action by the Division in accordance with North Carolina General Statute 143- 215.6A to 143-215.6C. 2. This permit shall become voidable unless the facilities are constructed in accordance with the conditions of this permit, the approved plans and specifications, and other supporting data. 3: This permit is effective only with respect to the nature and volume of wastes described in the application and other supporting data. No variances -to applicable rules. governing the construction and / or operation of the permitted facilities are granted unless specifically requested and granted in this permit. . 4. The issuance of this permit does not exempt the Permittee from complying with any and all statutes, rules, regulations, or ordinances, which may be imposed by other government agencies (local, state, and federal) that have jurisdiction. Of particular concern to the Division are applicable river buffer rules in 15A NCAC 02B .0200, erosion and sedimentation control requirements in 15A NCAC Chapter 4 and under the Division's General Permit NCGO10000, and any requirements pertaining to wetlands under 15A NCAC 02B .0200 and 02H .0500. 5. In the event there is a desire for the facilities to change ownership, or there is a name change of the Permittee, a formal permit request must be submitted to the Division on official Division form(s), documentation from the parties involved, and other supporting materials as may be appropriate. The approval of this request will be considered on its merits and may or may not be approved. The Permittee of record shall remain fully responsible for compliance until a permit is issued to the new owner. 6. The Permittee shall retain a set of approved plans and specifications for the life of the facilities permitted herein. 7. The Permittee shall maintain this permit until all permitted facilities herein are properly closed or permitted under another permit issued by the appropriate permitting authority. 8. The Permittee shall pay the annual fee within thirty (30) days after being billed by the Division. Failure to pay the fee accordingly may cause the Division to initiate action to revoke this permit pursuant to 15A NCAC 02T .0105(e).
