Piedmont Landfill & Recycling Center Landfill Leachate Transport & Disposal Forsyth County In accordance with your permit modification application received May 1, 1992 we are forwarding herewith Permit No. WQ0003566, as amended, dated November 19, 1992, to Waste Management of Carolinas, Inc. for the continued operation of a Landfill Leachate Transport and Disposal operation to serve the Piedmont Landfill & Recycling Center. This permit shall be effective from the date of issuance until October 31, 1995, hereby voids Permit Number WQ0003566 issued June 14, 1991, and shall be subject to the conditions and limitations as specified therein. Please pay particular attention to the monitoring requirements in this permit. Failure to establish an adequate system for collecting and maintaining the required operational information will result in future compliance problems. If any parts, requirements, or limitations contained in this permit are unac;ueptable to you, you have the right to request an adjudicatory hearing upon written request within 30 days following receipt of this permit. This request must be in the form of a written petition, conforming to Chapter 150B of North Carolina General Statutes, and filed with the Office of Administrative Hearings, P.O. Box 11666, Raleigh, NC 27604. Unless such demands are made this permit shall be final and binding. Prest Howard, Jr., P.E. cc: Forsyth County Health Department Winston-Salem Regional Office City of Winston-Salem Environmental Compliance Corporation NORTH CAROLINA ENVIRONMENTAL MANAGEMENT COMMISSION DEPARTMENT OF ENVIRONMENT, HEALTH AND NATURAL RESOURCES RALEIGH LANDFILL LEACHATE TRANSPORT AND DISPOSAL PERMIT In accordance with the provisions of Article 21 of Chapter 143, General Statutes of North Carolina as amended, and other applicable Laws, Rules, and Regulations PERMISSION IS HEREBY GRANTED TO Waste Management of Carolinas, Incorporated Forsyth County FOR THE continued operation of a 25,000 GPD daily average flow (40,000 GPD peak flow) Landfill Leachate Transport and Disposal System consisting of a leachate collection and storage system as permitted by the Solid Waste Section, the construction and operation of a vehicle wash pad wastewater collection system consisting of a coated concrete washpad with a wastewater collection sump and approximately 1,935 linear feet of four inch, dual wall piping to carry the washpad wastewater to the existing leachate storage facilities, and the continued transportation of the collected leachate to the treatment and disposal location(s) identified in Condition 7 below to serve the Piedmont Landfill and Recycling Center (PLRC) with no discharge of wastes to the surface waters, pursuant to the application permit modification received May 1, 1992 and in conformity with the project plan, specifications, and other supporting data subsequently filed and approved by the Department of Environment, Health and Natural Resources and considered a part of this permit_ This permit shall be effective from the date of issuance until October 31, 1995 and shall be subject to the following specified conditions and limitations: 1. This permit shall become voidable unless the subject landfill leachate transport and disposal activities are carried out in a manner which has been approved by this Division. 2. This permit is effective only with respect to the nature and volume of wastes described in the application and other supporting data. 3. The facilities shall be properly maintained and operated at all times. 4. This permit is not transferable. In the event there is a desire for the facilities to change ownership, or there is a name change of the Permittee, a formal permit request must be submitted to the Division of Environmental Management accompanied by an application fee, documentation from the parties involved, and other supporting materials as may be appropriate. The approval of this request will be considered on its merits and may or may not be approved. 5. No type of waste other than that from the PLRC leachate collection system approved by the Solid Waste Section and the washpad wastewater collection system approved herein shall be included in the landfill leachate transport and disposal activities. 6. In the event that the facilities fail to perform satisfactorily, including the creation of nuisance conditions, the Permittee shall cease operation of all landfill leachate transport and disposal activities and take such immediate corrective action, as may be required by this Division. 7. The wastewater collected by this system shall be pretreated by Environmental Compliance Corporation (EEC), Winston-Salem, NC prior to discharge into the City of Winston-Salem's existing sewerage system. The discharge of this waste into the City's sewerage system is governed by Pretreatment Permit 1994A issued to Environmental Compliance Corporation by the City of Winston-Salem. Should there be a failure of EEC's treatment works, caused by the disposal of PLRC leachate or not, the Division may require PLRC to immediately cease disposing of leachate at EEC's facilities and provide an alternate disposal location until such time that the Division determines that EEC's facilities are again capable of properly treating PLRC leachate. The Division's Winston-Salem Regional Office shall be notified within one business day of any change in these leachate disposal arrangements. The Winston-Salem Regional Supervisor may, at his discretion, approve of the modified arrangements or require that Waste Management of the Carolians file a permit modification application with the Permits and Engineering Unit in a timely manner. The Winston-Salem Regional Office should be notified or the proposed alternate disposal site if any such arrangements have been made in advance. 8. The Permittee is liable for any damages caused by a spill or failure of the landfill leachate transport and disposal operations. 9. Adequate inspection, maintenance, and cleaning shall be provided by the Permittee to insure proper operation of the leachate collection, storage, and loading facilities. 10. Any duly authorized officer, employee, or representative of the Division of Environmental Management may, upon presentation of credentials, enter and inspect any property, premises or place on or related to the PLRC at any reasonable time for the purpose of determining compliance with this permit; may inspect or copy any records that must be kept under the terins and conditions of this permit; and may obtain. samples. 11. Failure to abide by the conditions and limitations contained in this permit may subject the Permittee to an enforcement action by the Division of Environmental Management in accordance with North Carolina General Statute 143-215.6. 12. The issuance of this permit does not preclude the Permittee from complying with any and all statutes, rales, regulations, or ordinances which may be imposed by other government agencies (local, state, and federal) which have jurisdiction. 13. A copy of the approved plans and specifications shall be maintained on file by the Permittee for the life of the project. 14. Noncompliance Notification: The Permittee shall report by telephone to the Winston-Salem Regional Office, at telephone no. (919)896-7007, as soon as possible, but in no case more than 24 hours or on the next working day following the occurrence or first knowledge of the occurrence of any of the following: a. Any process unit failure, due to known or unknown reasons, that render the facility incap&le of adequate wastewater treatment such as mechanical or electrical failures of pumps, aerators, compressors, etc. b. Any failure of a pumping station, pipe Iine, etc. resulting in a by-pass directly to receiving waters witho,ul treatment of all or any portion of the influent to such station or facility. 2 Persons reporting such occurrences by telephone shall also file a written report in letter form within 15 days following first knowledge of the occurrence. This report must outline the actions taken or proposed to be taken to ensure that the problem does not recur. Mechanical failures that do not pose an immediate danger of wastewater release and that can be corrected within 24 hours do not have to be reported to the Winston-Salem Regional office, but should be logged as required in Condition 10. 15. The annual administering and compliance fee must be paid by the Permittee within thirty (30) days after being billed by the Division. Failure to pay the fee accordingly may cause the Division to initiate action to revoke this permit as specified by 15 NCAC 2H.0205 (c)(4). 16. The Permittee or his designee shall inspect the PLRC leachate collection facilities to prevent malfunctions and deterioration, operator errors and discharges which may cause or lead to the release of wastes to the environment, a threat to human health, or a nuisance. The Permittee shall keep an inspection log or summary including at least the date and time of inspection, observations made, and any maintenance, repairs, or corrective actions taken by the Permittee. This log of inspections shall be maintained by the Permittee for as long as the landfill Ieachate transport and disposal activities are being conducted and shall be made available upon request to the Division of Environmental Management or other permitting authority. IT An accurate record of the landfill leachate transport and disposal activities must be maintained by the Permittee, indicating: a) date leachate is removed from the facility, b) name of facility receiving leachate, C) volume of leachate removed, and e) name of the hauler. 18. The Permittee shall conduct analysis for pH, ignitability, and reactivity once per quarter within the first week of the quarter and the results shall be maintained on file by the Permittee for a minimum of five years. One grab sample from each storage tank shall be collected, composited, and analyzed. 19. The Permittee shall conduct complete Toxicity Characteristic Leaching Procedure (TCLP) analysis annually and the results shall be maintained on file by the Permittee for a minimum of five years. One grab sample from each leachate storage tank shall be collected, composited, and analyzed. 20. Three copies of all inspection and maintenance records (as specified in condition. 16), all leachate hauli records (as specified in Condition 17), and all leachate monitoring data (as specified in conditions 18 a 19) and any other data as may be required shall be submitted on or before the last day of January of t following year to the following address.- NC ddress: NC Division of Environmental Management Water Quality Section Facility Assessment Unit PO Box 29535 Raleigh, NC 27626-0535 21. The Winston-Salem Regional Office, phone no. (919)896-7007 shall be notified at least forty-eight (48) hours in advance of operation of any newly installed storage, loading, or similar facilities so that an in-place inspection can be made. Such notification to the regional supervisor shall be made during the normal office hours from 8:00 a.m. until 5:00 p.m. on Monday through Friday, excluding State Holidays. The Winston-Salem Regional Supervisor may, at his discretion, require that Waste Management of the Carolians file a permit modification application detailing the changes or additions to the leachate transport and disposal system with the Permits and Engineering Unit in a timely manner. 21. Upon completion of construction and prior to operation of the vehicle wash facility, a certification must be received from a professional engineer certifying that the permitted facility has been installed in accordance with this permit, the approved plans and specifications.
