Piedmont Sanitary Landfill Landfill Leachate Transport and Disposal Forsyth County In accordance with your application received February 19, 1991 and your request for renewal dated June 4, 1991 we are forwarding herewith Permit No. WQ0003566, as amended, dated June 14, 1991, to Waste Management of Carolinas, Inc. for a Landfill Leachate Transport and Disposal operation to serve the Piedmont Sanitary Landfill. The amendments included in this permit include a change of leachate receiver, a change of leachate hauler, and the construction of a piping network to convey leachate from individual sumps to a central loading/storage area. This permit shall be effective from the date of issuance until May 31, 1993, hereby voids Permit Number WQ0003566 issued December 31, 1990, and shall be subject to the conditions and limitations as specified therein. Please pay particular attention to the monitoring requirements in this permit. Failure to establish an adequate system for collecting and maintaining the required operational information will result in future compliance problems. If any parts, requirements, or limitations contained in this permit are unacceptable to you, you have the right to request an adjudicatory hearing upon written request within 30 days following receipt of this permit. This request must be in the form of a written petition, conforming to Chapter 150E of North Carolina General Statutes, and filed with the Office of Administrative Hearings, P.O. Box 11666, Raleigh, NC 27604. Unless such demands are made this permit shall be final and binding. Si e Geor cc: Forsyth County Health Department Winston-Salem Regional Office City of Winston-Salem Environmental Compliance Corporation Barrow Oil Company NORTH CAROLINA ENVIRONMENTAL MANAGEMENT COMMISSION DEPARTMENT OF ENVIRONMENT, HEALTH AND NATURAL RESOURCES r,.' a 91 A LANDFILL LEACHATE TRANSPORT AND DISPOSAL PERMIT In accordance with the provisions of Article 21 of Chapter 143, General Statutes of North Caz•olina as amended, and other applicable Laws, Rules, and Regulations PERMISSION IS HEREBY GRANTED TO Waste Management of Carolinas, Incorporated Forsyth County FOR THE construction and operation of a Landfill Leachate collection piping network and loading station consisting of approximately 1,400 linear feet of dual walled HDPE piping (with a 4 inch diameter carrier pipe), two 6,200 gallon HDPE leachate storage tanks with high water alarms, a spill containment area with high water alarms, transfer pump for truck loading, and an alternate loading station with a vacuum truck connection and the continued operation of a 25,000 GPD Landfill Leachate Transport and Disposal operation to serve the Piedmont Sanitary Landfill with no discharge of wastes to the surface waters, pursuant to the application received February 19, 1991, the request for renewal dated June 4, 1991, and in conformity with the project plan, specifications, and other supporting data subsequently filed and approved by the Department of Environment, Health and Natural Resources and considered a part of this permit. This permit shall be effective from the date of issuance until May 31, 1993 and shall be subject to the following specified conditions and limitations: 1. This permit shall become voidable unless the subject landfill leachate transport and disposal activities are carried out in a manner which has been approved by this Division. 2. This permit is effective only with respect to the nature and volume of wastes described in the application and other supporting data. 3. The facilities shall be properly maintained and operated at all times. 4. This permit is not transferable. In the event there is a desire for the facilities to change ownership, or there is a name change of the Permittee, a formal permit request must be submitted to the Division of Environmental Management accompanied by an application fee, documentation from the parties involved, and other supporting materials as may be appropriate. The approval of this request will be considered on its merits and may or may not be approved. No type of waste other than that from the Piedmont Sanitary Landfill leachate collection sumps draining Module 1, Module 2, Module 5, and Module 6 shall be included in the landfill leachate transport and disposal activities. Removal or transport of leachate from any additional leachate sumps requires a formal permit amendment be issued by the Division. 6. In the event that the facilities fail to perform satisfactorily, including the creation of nuisance conditions, the Permittee shall cease operation of all landfill leachate transport and disposal activities and take such immediate corrective action, as may be required by this Division. The wastewater collected by this system shall be pretreated by Environmental Compliance Corporation, Winston-Salem, NC prior to discharge into the City of Winston-Salem's existing sewerage system. The discharge of this waste into the City's sewerage system is governed by the Pretreatment Permit issued to Environmental Compliance Corporation by the City of Winston- Salem. Violation of any conditions of the Pretreatment Permit, caused by the disposal of leachate or not, shall be sufficient cause for the Division to require Waste Management of Carolinas, Incorporated to dispose of collected leachate at an alternate location. 8. The Permittee is liable for any damages caused by a spill or failure of the landfill leachate transport and disposal operations. 9. Adequate inspection, maintenance, and cleaning shall be provided by the Permittee to insure proper operation of the leachate collection, storage, and loading facilities. 10. The Permittee or his designee shall inspect the Piedmont Sanitary Landfill leachate collection facilities to prevent malfunctions and deterioration, operator errors and discharges which may cause or lead to the release of wastes to the environment, a threat to human health, or a nuisance. The Permittee shall keep an inspection log or summary including at least the date and time of inspection, observations made, and any maintenance, repairs, or corrective actions taken by the Permittee. This log of inspections shall be maintained by the Permittee for as Iong as the landfill leachate transport and disposal activities are being conducted and shall be made available upon request to the Division of Environmental Management or other permitting authority. 11. Any duly authorized officer, employee, or representative of the Division of Environmental Management may, upon presentation of credentials, enter and inspect any property, premises or place on or related to the Piedmont Sanitary Landfill at any reasonable time for the purpose of determining compliance with this permit; may inspect or copy any records that must be kept under the terms and conditions of this permit; and may obtain samples. ,. 12. An accurate record of the landfill leachate transport and disposal activities must be maintained by the Permittee, indicating: a) date leachate is removed from the facility, b) name of facility from which leachate is removed (including module and sump number), C) name of facility receiving leachate, d) volume of leachate removed, and e) name of organization performing the hauling activity. These records shall be made available upon request to the Division of Environmental Management or other permitting authority. 13. Failure to abide by the conditions and limitations contained in this permit may subject the Permittee to an enforcement action by the Division of Environmental Management in accordance with North Carolina General Statute 1.43-215.6. 14. The issuance of this permit does not preclude the Permittee from complying with any and all statutes, rules, regulations, or ordinances which may be imposed by other government agencies (local, state, and federal) which have jurisdiction. .15. The Permittee shall provide for the installation and maintenance of visual high water alarm set to illuminate when the leachate level reaches 3.25 feet above sump bottom. 0) 16. A copy of the approved plans and specifications shall be maintained on file by the Pernlittee for the life of the project. 17. Noncompliance Notification: The Permittee shall report by telephone to the Winston-Salem Regional Office, at telephone no. (919)896-7007, as soon as possible, but in no case more than 24 hours or on the next working day following the occurrence or first knowledge of the occurrence of any of the following: Y a. Any process unit failure, due to known or unknown reasons, that render the facility incapable of adequate wastewater treatment such as mechanical or electrical failures of pumps, aerators, corepressors, etc. b. Any failure of a pumping station, sewer line, etc. resulting in a by-pass directly to receiving waters without treatment of all or any portion of the influent to such station or facility. Persons reporting such occurrences by telephone shall also file a written report in letter form within 4 days following first knowledge of the occurrence. This report must outline the actions taken or propos to be taken to ensure that the problem does not recur. 18. The annual administering and compliance fee must be paid by the Permittee within thirty (30) days after being billed by the Division. Failure to pay the fee accordingly may cause the Division to initiate action to revoke this permit as specified by 15 NCAC 2H .0205 (c)(4). 19. The Permittee shall conduct analysis for pH, ignitability, and reactivity weekly and the resul is shall be maintained on file by the Permittee for a minimum of five years. If pump and haul operations occur at a frequency less than weekly pH, ignitability, and reactivity analysis will be required for each landfill leachate transport and disposal operation. One grab sample from each load hauled shall be collected, composited, and analyzed. 20. The Permittee shall conduct complete Toxicity Characteristic Leaching Procedure (TCLP) analysis quarterly and the results shall be maintained on file by the Permittee for a minimum of five years. If landfill leachate transport and disposal operations occur at a frequency less than quarterly TCLP analysis will be required for each landfill leachate transport and disposal operation. One grab sample from the leachate storage tank(s) shall be collected and analyzed. Samples shall be collected at the beginning of one landfill leachate transport and disposal event (prior to any leachate removal) during the given quarter. 21. The Permittee shall conduct a 126 Priority Pollutants Scan twice yearly at six month intervals and the results shall be maintained on file by the Permittee for a minimum of five years. A consecutive four day composite sample consisting of four grab samples, one per day, from the storage tank shall be. analyzed for non volatile compounds. A single grab sample from the storage tank shall be analyzed for volatile compounds. 22. The permittee shall notify the Winston-Salem Regional Office, Water Quality Section immediately if the agreements with Barrow Oil Company, the leachate hauler, or Environmental Compliance Corporation, the leachate receiver, are altered in any way. 23. Upon completion of construction and prior to operation of the additional leachate collection and piping facilities, a certification must be received from a professional engineer certifying that the permitted facility has been installed in accordance with this permit, the approved plans and specifications. Mail the Certification to the Permits and Engineering Unit, P.O. Box 29535, Raleigh, NC 27626-0535. 3 I 24. The Winston-Salem Regional Office, phone no. (919)896-7007 shall be notified at least forty- +i eight (48) hours in advance of operation of the newly installed facilities so that an in-place inspection can be made. Such notification to the regional supervisor shall be made during the normal office hours from 8:00 a.m. until 5:00 p.m. on Monday through Friday, excluding State Holidays.
