Wastewater Treatment and Spray Irrigation Disposal System Davidson County Dear Mr. Beck: This is in reference to your application received December 15, 1994, for the continued operation of the subject facility. In a letter dated January 12, 1995, you were asked, by Mr. John Seymour of the Division of Environmental Management's Water Quality Section, to provide additional information (copy of letter attached). The information you submitted, in reference to this request, on January 26, 1995, was not what was requested. The building plan you provided was not able to be used as a site map for locating the monitoring wells the treatment lagoon and the spray field. And, you reported the requested monitoring data from the monitoring wells as being destroyed by water damage, in a storm. A second letter was sent to you on February 2, 1995, from Mr. Seymour asking you to provide the requested additional information (copy of letter also attached). As of today, this information has not been received, therefore, the Division must return your application and support documents as incomplete in accordance with North Carolina General Statute 143-215.1. The documents are being forwarded to you under separate cover. The Division cannot perform an accurate evaluation of the permit renewal application without a site map that depicts all monitor well locations, spray irrigation area, lagoon location and all property boundaries. These locations are necessary in determining possible groundwater movements, compliance with required buffers to surface and drinking waters and property line buffers. Since monitoring well data is not available, it cannot be determined whether any of the wastewater is leaching into the groundwater below the treatment lagoon, there causing any violations. Monitoring well data gathered since the previously destroyed well data would be helpful in solving this delema. When you have obtained the requested information which is needed to make your application complete, you may submit a new application package and permit processing fee. Additionally, the subject permit expired on July 31, 1995. By this return and the expiration of the permit, this facility will be considered operating without a valid permit if allowed to operate beyond this date. During an August 28, 1995, telephone conversation with Mr. Seymour, you indicated you would like to drop the permit. This resulting from you deciding not to do any more killing at this slaughter facility and you have already installed a County permitted subsurface disposal system to handle the remaining activities at the facility. Finally, per Mr. Seymour's request, you agreed to send a letter requesting the subject permit be rescinded. This letter has not been received by the Division to date. Therefore, the Division is returning and rescinding the subject permit based on the conversations you have had with the Division Staff, P.O. L. Beck & Sons, Inc. to appropriate enforcement actions in accordance with North Carolina General Statute 143-215.6. Civil penalties of up to $10,000 per day per violation may be assessed for failure to secure a permit required by North Carolina General Statute 143-215.1.
