However, the issuance of this permit, shall incorporate the continued operation of the existing Iron removal backwash Pump Station, described in the rescinded Permit No. WQ0004911, until December 31, 2003, or upon the operation of the proposed Southern Outer Banks Water System R.O. Wastewater Treatment Plant; at which time the Ocean Sands Wastewater Treatment Plant will no Ionger be operational, thereby nullifying this permit issuance. This permit shall be effective from the date of issuance until December 31, 2003, or upon operation of the proposed Southern Outer Banks Water System R.O. Wastewater Treatment Plant; and shall void Permit No. WQ0003378 issued March 27, 1996; and shall hereby rescind Permit No. WQ0004911, issued June 10, 1991, and shall be subject to the conditions and limitations as specified therein. Please pay particular attention to the monitoring requirements in this permit. Failure to establish an adequate system for collecting and maintaining the required operational information will result in future compliance problems. This permit includes the most current language present in the Division -issued Pump Station permit. The Permittee shall responsibly comply with the current requirements of the Division, in regards to the continued operation and maintenance of the existing Pump Station facility. A., P O Box 391, Elizabeth City, NC 27907-0391 NDPU files NORTH CAROLINA ENVIRONMENTAL MANAGEMENT COMMISSION DEPARTMENT OF ENVIRONMENT AND NATURAL RESOURCES RALEIGH GROUNDWATER REMEDIATION PERMIT In accordance with the provisions of Article 21 of Chapter 143, General Statutes of North Carolina as amended, and other applicable Laws, Rules, and Regulations PERMISSION IS HEREBY GRANTED TO Ocean Sands Water & Sewer District Currituck County FOR THE continued operation of a 400 GPM pump station with duplex pumps and high water alarms, and approximately 150 linear feet of six-inch force main, and all associated piping; to serve the Ocean Sands Water and Sewer District's Water Treatment Plant's iron removal filter backwash wastewater from the six - green sand filters; and the peak discharge of 3,000 GPD per filter (up to 18,000 GPD) of collected iron removal filter backwash wastewater into the Ocean Sands Water & Sewer District's existing sewerage system, pursuant to the application, received April 5, 1991; and in conformity with the project plan, specifications, and other supporting data subsequently filed and approved by the Department of Environment and Natural Resources, and considered a part of this permit; and immediate (within 30 days of issuance date) closure, via concrete sealing, of a 1,500 GPD non -discharge wastewater disposal facility consisting of an existing surface sand adsorption pit measuring 20 feet by 25 feet, and all associated piping to serve the disposal of iron backwash wastewater from the green sand filters located at Ocean Sands Water & Sewer District's Water Treatment Plant, with no discharge of wastes to the surface waters, pursuant to the expired renewal and modification request, received January 31, 2001; and subsequent additional information responses, received between April 4, 2001 and June 22, 2001; and in conformity with the project plan, specifications, and other supporting data subsequently filed and approved by the Department of Environment and Natural Resources and considered a part of this permit. This permit shall be effective from the date of issuance until December 31, 2003, or upon operation of the proposed Southern Outer Banks Water System R.O. Wastewater Treatment Plant; and shall void Permit No. WQ0003378 issued March 27, 1996; and shall hereby rescind Permit No. WQ0004911, issued June 10, 1991, and shall be subject to the following specified conditions and limitations: I. PERFORMANCE STANDARDS Within 30 days upon issuance of this permit, construct an impermeable, concrete seal for the bottom, and sides of the existing surface sand adsorption pit, in order to prevent the infiltration of iron, manganese, and related contaminants into the local groundwater supplies. 2. Upon the immediate performance of Condition 1. 1., for this permitted facility, a certification (see attached page 8) must be received from a professional engineer certifying that the permitted facility has been installed in accordance with this permit, the approved plans and specifications, and other supporting materials, if this Rroject is to be completed in phases and partially certified you shall retain the responsibility to track further construction -approved under the same permit, and shall provide a final certificate of completion once the entire project has been completed. Mail the Certification to the Non -Discharge Permitting Unit, 1617 Mail Service Center, Raleigh, NC 27604. 3. The Washington Regional Office, telephone number (252) 946-6481, shall be notified at least 48 hours in advance of the closure of the existing surface sand adsorption pit, so that an in -place inspection can be made. Such notification to the regional supervisor shall be made during the normal office hours from 8:00 a.m. until 5:00 p.m. on Monday through Friday, excluding State Holidays. 4. Division approval is based on the acceptance of the certification provided by a North Carolina Professional Engineer (see attached Page 9), for the modification of the existing pump station, after the existing surface sand adsorption pit is sealed. It is the Division's understanding that the closure of the existing surface sand adsorption pit may affect the current performance of the existing pump station. It shall be the permittee's responsibility to ensure the plans and specifications meet the appropriate design criteria and rules. Failure to comply may result in penalties in accordance with North Carolina General Statute 143-215.6A — 143-215.6C, construction of additional facilities, and/or referral of the N.C. Professional Engineer to the licensing board. 5. In the event that the facilities fail to perform satisfactorily, including the creation of nuisance conditions, the Permittee shall take immediate corrective action, including those actions that may be required by the Division of Water Quality (Division), such as the construction of additional or replacement treatment or disposal facilities. 6. The issuance of this permit shall not relieve the Permittee of the responsibility for damages to surface or groundwaters resulting from the opefation of this facility. 7. Any residuals generated from these treatment facilities must be disposed in accordance with North Carolina General Statute 143-215.1 and in a manner approved by the Division. Diversion or bypassing of the untreated groundwater from the treatment facilities is prohibited. This permit shall become voidable, and may be rescinded, unless the facilities are installed, maintained, and operated in a manner which will protect the assigned water quality standards of the surface waters and groundwaters. 10. This permit shall become voidable, and may be rescinded, unless the facilities are constructed, maintained and operated, in accordance with the conditions of this permit, 15A NCAC 2H .0200, the Division of Water Quality's Gravity Sewer Minimum Design Criteria adopted February 12, 1996, the approved plans and specifications, and other supporting data unless specifically mentioned herein. 11. This permit is effective only with respect to the nature and volume of wastes described in the application and other supporting data. 12. The sewage and wastewater collected by this system shall be treated in the Ocean Sands Water & Sewer District's Wastewater Treatment Facility prior to being land applied. 2 13. Maintenance and or construction of the sewers, pump station(s), and force main shall be scheduled so as not to interrupt service by the existing utilities nor result in an overflow or bypass discharge of wastewater to the surface waters of the State. 14. Failure to abide by the conditions and limitations contained in this permit or to construct the facilities in accordance with the conditions of this permit, 15A NCAC 2H .0200, the Division's Gravity Sewer Minimum Design Criteria adopted February 12, 1996, the approved plans and specifications, and other supporting data may subject the Permittee to an enforcement action by the Division, in accordance with North Carolina General Statute 143-215.6A to 143-215.6C. 15. The issuance of this permit does not exempt the Permittee from complying with any and all statutes, rules, regulations, or ordinances that may be imposed by other government agencies (i.e., local, state, and federal) having jurisdiction, including but not limited to applicable river buffer rules in 15A NCAC 2B .0200, soil erosion and sedimentation control requirements in 15A NCAC Chapter 4, and under the Division's General Permit NCG0100000, and any requirements pertaining to wetlands under 15A NCAC 2B .0200 and 15A NCAC 2H .0500. 16. The wastewater collection facilities shall be properly maintained and operated at all times. The Permittee shall maintain compliance with an individual system -wide collection system permit for the operation and maintenance of these facilities as required by 15A NCAC 2H .0227, if an individual permit is not required, the following performance criteria shall be met as provided in 15A NCAC 2H .0227: a. The sewer system shall be effectively maintained and operated at all times to prevent discharge to land or surface waters, and any contravention of the groundwater standards in 15A NCAC 2L .0200 or the surface water standards in 15A NCAC 2B .0200. b. A map of the sewer system shall be developed prior to January 1, 2004 and shall be actively maintained. c. An operation and maintenance plan shall be developed and implemented. d. Pump stations that are not connected to a telemetry system shall be inspected at least three times per week until July 1, 2000; thereafter, pump stations shall be inspected at least daily, as defined in 15A NCAC 2B .0503(5), until July 1, 2001; and thereafter, pump stations shall be inspected every day. Pump stations that are connected to a telemetry system shall be inspected at least once per week. C. High -priority sewer lines shall be inspected at least once per every six-month period of time. f. A general observation of the entire sewer system shall be conducted at least once per year. g. inspection and maintenance records shall be maintained for a period of at least three years. h. Overflows and bypasses shall be reported to the appropriate Division regional office in accordance with 15A NCAC 2B .0506(a), and public notice shall be provided as required by North Carolina General Statute § 143-2I5.1C. 17. The Pernvttee shall provide for the pump station and force main the following items: a. Pump on/off elevations located so that 2-8 pumping cycles may be achieved per hour in the pump station, b. An air relief valve located at all high points along the force main, c. A screened vent for the wet well, d. Fillets located in the wet well at the intersection of the flooring and sidewalls, e. Three feet of cover (minimum) over the force main or the use of ferrous material where three feet cannot be maintained, f. Sufficient devices which will protect the pump station from vandals, and g. Flood protection if the pump station is located below the 100-year flood elevation. h. Adherence with the following minimum separations: (i) Storm sewers (vertical): 12 inches (ii) Water mains (vertical -water over sewer): 18 inches, or (horizontal): ten feet (iii) In benched trenches (vertical): 18 inches (iv) Any private or public water supply source, including any WS-1 waters or Class I or Class H impounded reservoirs used as a source of drinking water: 100 feet (v) Waters classified WS (other than WS-I), B, SA, ORW, HQW, or SB [from normal high water (or tide elevation)]: 50 feet (vi) Any other stream, lake or impoundment: ten feet (vii) Any building foundation: five feet (viii) Any basement: ten feet (ix) Top slope of embankment, or cuts of two feet or more vertical height: ten feet (x) Drainage systems (1) Interceptor drains: five feet (II) Ground water lowering, and surface drainage ditches: ten feet (xi) Any swimming pool: ten feet (xii) Ferrous sewer pipe with joints equivalent to water main standards, shall be used where these minimum separations cannot be maintained. The minimum separation shall however not be less than 25 feet from a private well, or 50 feet from a public water supply well. II. OPERATION AND MAINTENANCE REQUIREMENTS The facilities shall be properly maintained and operated at all times. 2. Upon classification of the facility by the Water Pollution Control Systems Operators Certification Commission (WPCSOCC), the Permittee shall employ a certified wastewater treatment plant operator to be in responsible charge (ORC) of the wastewater treatment facilities. The operator must hold a certificate of the type and grade at least equivalent to or greater than the classification assigned to the wastewater treatment facilities by the WPCSOCC. The Permittee must also employ a certified back-up operator of the appropriate type and grade to comply with the conditions of 15A NCAC 8G .0202. The ORC of the facility must visit each Class I facility at least weekly and each Class H, III, and IV facility at least daily, excluding weekends and holidays, and must properly manage and document daily operation and maintenance of the facility and must comply with all other conditions of 15A NCAC 8G .0202. The facilities shall be effectively maintained and operated as a non -discharge system to prevent the discharge of any wastewater resulting from the operation of this facility. III. MONITORING AND REPORTING REQUIREMENTS Any monitoring deemed necessary by the Division to insure surface and ground water protection will be established and an acceptable sampling reporting schedule shall be followed. Z. Noncompliance Notification: The Permittee shall report by telephone to the Washington Regional Office, telephone number (252) 946-6481, as soon as possible, but in no case more than 24 hours or on the next working day following the occurrence or first knowledge of the occurrence of any of the following: a. Any occurrence at the wastewater treatment facility, which results in the treatment of significant amounts of contaminated wastes, such as the dumping of the contents of a basin or tank, the known passage of a slug of hazardous substance through the facility, or any other unusual circumstances; b. Any process unit failure, due to known or unknown reasons, that renders the facility incapable of adequate wastewater transport, such as mechanical or electrical failures of pumps, aerators, compressors, line blockage, or breakage, etc.; c. Any failure of a pumping station, sewer line, or treatment facility resulting in a by-pass directly to receiving waters without treatment of all or any portion of the influent to such station or facility; or d. Any time that self -monitoring information indicates that facility is not in compliance with any specified permit Iimitations. Persons reporting such occurrences by telephone shall also file a written report in letter format within five days following first knowledge of the occurrence. This report must outline the actions taken or proposed to be taken to ensure that the problem does not recur. IV. GROUNDWATER REQUIREMENTS 1. Any additional groundwater quality monitoring, as deemed necessary by the Division, shall be provided. 2. The COMPLLANCE BOUNDARY for the disposal system is specified by regulations in 15A NCAC 2L, Groundwater Classifications and Standards. The Compliance Boundary for disposal systems initiated prior to December 31, 1983, is established at either (1) 500 feet from the waste disposal area, or (2) at the property boundary, whichever is closest to the waste disposal area. An exceedance of Groundwater Quality Standards at or beyond the Compliance Boundary is subject to immediate remediation action in addition to the penalty provisions applicable under North Carolina General Statute 143-215.6A(a)(1). In accordance with 15A NCAC 2L, a REVIEW BOUNDARY is established around the disposal systems midway between the Compliance Boundary and the perimeter of the waste disposal area. Any exceedance of standards at the Review Boundary shall require remediation action on the part of the permittee. V. INSPECTIONS Adequate inspection, maintenance, and cleaning shall be provided by the Permittee to insure proper operation of the subject facilities. 2. The Permittee or his designee shall inspect the wastewater and disposal treatment facilities to prevent malfunctions and deterioration, operator errors and discharges which may cause or lead to the release of wastes to the environment, a threat to human health, or a nuisance. The Permittee shall maintain an inspection log or summary including at least the date and time of inspection, observations made, and any maintenance, repairs, or corrective actions taken by the Permittee. This log of inspections shall be maintained by the Permitter, for a period of three years from the date of the inspection and shall be made available to the Division or other permitting authority, upon request. 3. Any duly authorized officer, employee, or representative of the Division may, upon presentation of credentials, enter and inspect any property, premises or place on or related to the disposal site or facility at any reasonable time for the purpose of determining compliance with this permit, may inspect or copy any records that must be maintained under the terms and conditions of this permit, and may obtain samples of groundwater, surface water, or leachate. V1. GENERAL CONDITIONS 1. Issuance of this permit does not constitute approval for reimbursement from the Leaking Petroleum Underground Storage Tank Cleanup Funds (15A NCAC 2P). 2. This permit shall become voidable unless the facilities are constructed, operated, and maintained in accordance with the conditions of this permit, the approved plans and specifications, and other supporting data. This permit is effective only with respect to the nature and volume of wastes described in the application and other supporting data. 4. This permit is not transferable. In the event there is a desire for the facilities to change ownership, or there is a name change of the Permittee, a formal permit request must be submitted to the Division accompanied by documentation from the parties involved, and other supporting materials, as may be appropriate. The approval of this request will be considered on its merits and may or may not be approved. 5. A set of approved plans and specifications for the subject project must be retained by the Permittee for the life of this project. 6. Failure to abide by the conditions and limitations contained in this permit may subject the Permittee to an enforcement action by the Division in accordance with North Carolina General Statute 143-215.6A to 143-215.6C. 7. The annual administering and compliance fee must be paid by the Permittee within 30 days after being billed by the Division_ Failure to pay the fee accordingly may cause the Division to initiate action to revoke this permit as specified by 15A NCAC 2H .0205 (c)(4). 8. The issuance of this permit does not preclude the Permittee from complying with any and all statutes, rules, regulations, or ordinances which may be imposed by other government agencies (Iocal, state, and federal) which have jurisdiction. 9. The Permittee, at least six months prior to the expiration of this permit, shall request its extension. Upon receipt of the request, the Commission will review the adequacy of the facilities described therein, and if warranted, will extend the permit for such period of time and under such conditions and limitations as it may deem appropriate.
