C & P Waste Treatment Plant Wastewater Collection, Treatment, and Non -Discharge Disposal Facilities Carteret County Dear Mr. Pittari: In accordance with your permit renewal application received on March 14, 2001, we are forwarding herewith Permit No. WQ0003067, dated March 28, 2002, to C & P Enterprises, Inc. for the continued operation of the subject wastewater collection, treatment, and non -discharge disposal facilities. This permit shall be effective from the date of issuance until February 28, 2007; shall void Permit No. WQ0003067, issued on August 8, 1990; and shall be subject to the conditions and limitations as specified therein. Make note of this permit's expiration date and the fact that a permit renewal application is due to the Division of Water Quality (Division) no later than six months prior to that date (i.e., see Condition VI. 8.), as the Division does not send reminders to you to apply for permit renewal. This pen -nit approves the continued operation of the subject wastewater collection, treatment, and non - discharge disposal facilities for another five-year cycle. Please take the tune to review this permit - thoroughly as some of the conditions contained therein may have been added, changed, or deleted since this permit was last issued. Pay particular attention to the monitoring requirements in this permit. Failure to establish an adequate system for collecting and maintaining the required operational information will result in future compliance problems. In addition, be aware that Condition 1. 1. of this permit incorporates the compliance schedule agreed to in the January 15, 2002 settlement agreement. Strict adherence to this schedule as well as the progress report submittal requirements is necessary to avoid further legal action. Note that, in accordance with your meeting with the Wilmington Regional Office on March 7, 2002, the Division has agreed to maintain the compliance and review boundaries as currently established (i.e., see Condition IV. 4.), even if the high -rate infiltration units are moved from their present location. Furthermore, Condition 1. 2. of this permit is intended to ensure that the Permittee resolves all outstanding issues with respect to obtaining a Certificate of Public Convenience and Necessity (CPCN) from the North Carolina Utilities Commission in order to be allowed to provide utility service to Ocean Glen and Ocean Bay Villas. Carteret County FOR THE continued operation of 32,500-gallon per day wastewater collection, treatment, and non -discharge disposal facilities to collect, treat, and dispose of domestic wastewater generated by the developments known as Ocean Glen and Ocean Bay Villas that are located on the north and south side of Salter Path Road, respectively, at Indian Beach in Carteret County, North Carolina (i.e., at an approximate latitude and longitude of 34° 41' 25" and 76° 51' 55"). The wastewater collection, treatment, and non -discharge disposal facilities shall be operated with no discharge of wastes to surface waters, pursuant to the permit renewal application received on March 14, 2001 and in conformity with the project plans, specifications, and other supporting data subsequently filed and approved by the Department of Environment and Natural Resources and considered a part of this permit. The wastewater collection facilities shall consist of the following minimum components: approximately 125 linear feet of eight -inch gravity sewer; an influent pump station with duplex grinder pumps; approximately 100 linear feet of six-inch gravity sewer; an influent pump station with duplex 32-gallon per minute grinder pumps; approximately 535 linear feet of two-inch force main; and all associated piping, valves, electrical and instrumentation/control systems, and other appurtenances required to make complete and functional wastewater collection facilities. The wastewater treatment facilities shall consist of the following minimum components: a bar screen; a 7,000-gallon aerated flow equalization tank with a 39-cubic foot per minute blower and duplex 50-gallon per minute pumps; a flow splitter box; four 3,750-gallon aeration tanks; four 4,374-gallon aeration tanks with duplex 149-cubic foot per minute blower; two 2,500-gallon clarifiers; two tertiary filtration units; a 2,000-gallon mudwell with duplex 50-gallon pumps; a tablet chlorination unit followed by -a chlorine contact basin; a continuously recording meter to measure and totalize wastewater flow exiting the facilities; an aerated sludge holding; and all associated piping, valves, electrical and instrumentation/control systems, and other appurtenances required to make complete and functional wastewater treatment facilities. The non -discharge disposal facilities shall consist of the following minimum components: a dosing tank with duplex 45-gallon per minute pumps; approximately 330 linear feet of two-inch force main; two 70-foot diameter high -rate infiltration units (i.e., rotary distributors); and all associated piping, valves, electrical and instrumentation/control systems, and other appurtenances required to make complete and functional non -discharge disposal facilities. In addition to the above -described components, the combined wastewater collection, treatment, and non -discharge disposal facilities shall be provided with all-weather access; fencing and other means to restrict access to the facilities; audible and visual alarms for each control panel; an automatically -activated stand-by power generation system, capable of providing stand-by power to all essential units at the wastewater treatment and non -discharge disposal facilities in the event of a loss of the commercial power supply; and all associated piping, valves, electrical and instrumentation/control systems, and other appurtenances required to make complete and functional wastewater collection, treatment, and non -discharge disposal facilities. This permit shall be effective from the date of issuance until February 28, 2007; shall void Permit No. WQ0003067, issued on August 8, 1990; and shall be subject to the following specified conditions and limitations: L PERFORMANCE STANDARDS 1. As part of a settlement agreement with the Division of Water Quality (Division) dated January 15, 2002 as well as the subsequent memorandum of agreement, the Permittee has agreed to perform, certain activities in order to address and resolve satisfactorily the operational issues that led to the issuance of a May 10, 2000 notice of violation/notice of recommendation for enforcement and subsequent assessment of civil penalties on February 21, 2001. As such, the Permittee shall perform the following activities no later than the date indicated in this compliance schedule: Period Required Activity to Be Completed for Completion' No later than ♦ Replace the blower that is out of service. 30 calendar days ♦ Replace the effluent pump that is out of service. ♦ Repair or replace all exposed electrical wiring. ♦ Pump out and dispose of all solids in the chlorine contact chamber. No later than ♦ Meet with staff of the Division's Water Quality and 45 calendar days Groundwater Sections from the Wilmington Regional Office to present the draft plan of action and discuss its suitability to the Division prior to proceeding to a final draft. 2 i No later than ♦ Replace the generator transfer switch box. 60 calendar days ♦ Replace the influent splitter box and anchor the piping. ♦ Submit to the Division an evaluation of the generator's ability to operate all essential units of the wastewater treatment and non - discharge facilities. Should the evaluation show that the generator is not sufficient, a recommendation of an alternate generator size shall be provided. The evaluation shall be performed by and signed, sealed, and dated by a North Carolina - licensed professional engineer who specialized in electrical engineering_ This evaluation shall be submitted to the Division at the following address: NCDENR-DWQ Water Quality Section Wilmington Regional Office 127 Cardinal Drive Extension Wilmington, NC 28405-3845 Attn: Ed Beck No later than ♦ Submit to the Division a plan of action for resolving non- 90 calendar days compliance with the groundwater quality standards in 15A NCAC 2L. The plan of action shall thoroughly investigate actions such as a change in location of the non -discharge disposal units (i.e., high -rate infiltration units), and/or an upgrade of the wastewater treatment and non -discharge disposal facilities, to improve the quality of the wastewater effluent. Furthermore, the plan of action shall be accompanied by, at a minimum, a hydrogeological evaluation prepared as well as signed, sealed, and dated by a North Carolina -licensed professional geologist that substantiates that the plan of action will result in the stated goal of compliance with 15A NCAC 2L. This plan of action shall be submitted to the Division at the following address: NCDENR-DWQ Water Quality Section Wilmington Regional Office 127 Cardinal Drive Extension Wilmington, NC 28405-3845 Attn: Ed Beck ♦ In the alternative, the Permittee may relocate the high -rate infiltration units, on obtaining a permit modification, in which case the Division will undertake an assessment, consisting of review of monitoring data, of not Iess than one year's period of operation, and on the conclusion of such period, if exceedances of 15A NCAC 2L standards are shown, then the Permittee will !, propose modifications to the wastewater treatment and non - discharge disposal facilities as required for compliance with such standards. No later than ♦ Submit to the Division, for its review, a complete permit 120 calendar days modification application package, in order to obtain approval of any modifications required as a result of the plan of action as described above. The package shall also include information related to a new generator, if this is shown; to be necessary to operate all essential units at the wastewater treatment and non - discharge disposal facilities as modified. This package shall be submitted to the Division at the following address: NCDENR-DW Q Water Quality Section Non -Discharge Permitting Unit 1617 Mail Service Center Raleigh, NC 27699-1617 Attn: Kim H. No later than ♦ Complete and make operational all construction associated with 180 calendar days any permit modification approval as described above. ♦ Should the plan of action as described above not involve a move of the high -rate infiltration units, repair and/or replace both units in their existing locations. This repair/replacement shall be to the complete satisfaction of the Division and shall be such as results in the consistent and reliable operation of both units. As part of the repair/replacement, the Permittee shall remove soil to a depth sufficient to remove all organic matter, replacing such soil with clean sand suitable to the Division. In addition, masonry walls shall be installed, or other means suitable to the Division shall be used around both units, to delineate the units from the ambient surroundings as well as to impede encroachment of vegetation into the units. ♦ If a repair only of the high -rate infiltration units is selected, then the Permittee shall, at a minimum, complete the following: a. Replace all cabling; b. RepIace all spray heads; c. Replace all leaking gaskets and seals; d. Replace the gear mechanism; e. Wire -brush clean all exposed metal; f. Paint all exposed metal with corrosion -resistant paint. ♦ Should repairs fail to be to the Division's complete satisfaction, or should they fail to meet the goal of consistent and reliable operation of both units, then the Permittee shall replace both units. a All dates shall be calculated from January 30, 2002. 9 To demonstrate compliance with the requirements of the foregoing schedule, the Permittee shall submit monthly reports detailing the Permittee's actions to date. These progress reports shall contain copies of invoices or other suitable documentation supporting the fact that the actions described have been completed. These progress reports shall be submitted no later than the last day of every month until all actions required by the schedule have been completed. Within 30 calendar days of this permit's issuance, the Permittee shall make application to the North Carolina Utilities Commission to obtain a Certificate of Public Convenience and Necessity approving the Permittee to provide wastewater utilities to the proposed service area. A copy of the Certificate of Public Convenience and Necessity shall be sent to the Division within 30 calendar days of its receipt. Mail one copy of this certificate to NCDENR-DWQ, Non -Discharge Permitting Unit, 1617 Mail Service Center, Raleigh, NC 27699-1617. 3. In the event that the wastewater collection, treatment, and non -discharge disposal facilities fail to perform satisfactorily, including the creation of nuisance conditions, the Permittee shall take immediate corrective actions including those actions that may be required by the Division, such as the construction of additional or replacement facilities. 4. This permit shall become voidable if the soils fail to assimilate the wastewater effluent adequately and may be rescinded unless all of the wastewater collection, treatment and non - discharge disposal facilities are installed, maintained, and operated in a manner that will protect the assigned water quality standards of the surface waters and groundwater. Ponding of wastewater effluent on the land surface of the high -rate infiltration units of the non - discharge disposal facilities when the dosing cycle commences shall be considered evidence that the soils are failing to assimilate the wastewater effluent adequately. Such failure shall be interpreted as a violation of this permit condition. The issuance of this permit shall not relieve the Permittee of the responsibility for damages to surface waters or groundwater resulting from the operation of the wastewater collection, treatment and non -discharge disposal facilities. 6. Diversion or bypassing of untreated or treated wastewater from the wastewater collection, treatment, and/or the non -discharge disposal facilities shall be strictly prohibited. 5 7. The residuals generated from the wastewater treatment facilities shall be disposed in accordance with North Carolina General Statute § 143-215.1 and in a manner approved by the Division. & The following buffers shall be maintained by the wastewater treatment and non -discharge disposal facilities: a. 50 feet between wastewater treatment units and any property line; b. 50 feet between wastewater treatment units and high -rate infiltration units and any public right-of-way; c. 400 feet between high -rate infiltration units and any habitable residence or place of public assembly under separate ownership or which is to be sold; d. 200 feet between high -rate infiltration units and any private or public water supply source; e. 200 feet between high -rate infiltration units and any stream classified as WS or B; f. 200 feet between high -rate infiltration units and any water classified as SA or SB (i.e., at mean high water); g. 200 feet between'high-rate infiltration units and any other stream., marsh, or coastal water not previously identified in this condition; h. 200 feet between high -rate infiltration units and any Class I or Class II impounded reservoir used as a source of drinking water (i.e., at normal high water); i. 200 feet between high -rate infiltration units and any lake or impoundment not previously identified in this condition; j. 100 feet between high -rate infiltration units and any property line; and k. 200 feet between high -rate infiltration units and any drainage system (i.e., upslope or downslope interceptor drain or surface water diversion) and any groundwater lowering or surface drainage ditch. Some of the buffers specified above may not have been included in previous approvals for the wastewater treatment and non -discharge disposal facilities. These buffers are not intended to prohibit or prevent modifications that may be required by the Division to improve the performance of the existing facilities. These buffers, however, shall apply to modifications of the facilities that are for the purpose of increasing the flow that is tributary to the facilities. Unless as otherwise approved by the Division, these buffers also shall apply to any expansion or modifications of the facilities and apply in instances in which the sale of property would cause any of the buffers now complied with to be violated. 9. A usable green area shall be maintained for wastewater effluent disposal. The green area shall have the capability of accommodating the average daily flow of the wastewater treatment and non -discharge disposal facilities being served without exceeding the maximum instantaneous and cumulative Ioading rates of the green area, as recommended by a North Carolina -licensed soil scientist. The green area shall be as defined in 15A NCAC 2H .0404(g)(7), specifically an area that shall be suitable for wastewater effluent disposal, either in its natural state or in one that has been modified through establishment of a suitable vegetative cover. A 11. OPERATION AND MAINTENANCE REQUIREMENTS 1. The wastewater collection, treatment, and non -discharge disposal facilities shall be effectively maintained and operated as a non -discharge system to prevent the discharge of any wastewater, treated or untreated, resulting from the operation of these facilities. 2. Upon classification of the wastewater collection, treatment, and non -discharge disposal facilities by the Water Pollution Control System Operators Certification Commission (WPCSOCC), the Permittee shall employ a certified operator to be in responsible charge (ORC) of the facilities. The ORC shall hold a certificate of the type and grade at least equivalent to or greater than the classification assigned to the facilities by the WPCSOCC. The Permittee shall also employ a certified back-up ORC of the appropriate type and grade to comply with the conditions of 15A NCAC 8G .0202. The ORC of the facilities shall visit Class I facilities at least weekly and Class II, III, and IV facilities at least daily, excluding weekends and State Holidays; shall properly manage and document daily operation and maintenance of the facilities; and shall comply with all other conditions of 15A NCAC 8G .0202. Durin the period from April through October, inclusive the ORC's five visits each week shall be Rerformed on Monday,Wednesday, Friday, Saturday, and Sunda and shall include State Holidays. The wastewater collection facilities shall be properly maintained and operated at all times. The Permittee shall maintain compliance with an individual system -wide collection system permit for the operation and maintenance of the facilities as required by 15A NCAC 2H .0.227. If an individual permit is not required, the following performance criteria shall be met as provided in 15A NCAC 2H .0227: a. The sewer system shall be effectively maintained and operated at all tunes to prevent discharge to land or surface waters, and any contravention of the groundwater standards in 15A NCAC 2L .0200 or the surface water standards in 15A NCAC 2B .0200. b. A map of the sewer system shall be developed prior to January 1, 2004 and shall be actively maintained. c. An operation and maintenance plan shall be developed and implemented. d. Pump stations that are not connected to a telemetry system shall be inspected every day. Pump stations that are connected to a telemetry system shall be inspected at least once per week. e. High -priority sewer lines shall be inspected at least once per every six-month period of time. f. A general observation of the entire sewer system shall be conducted at least once per year. g. Inspection and maintenance records shall be maintained for a period of at least three years. h. Overflows and bypasses shall be reported to the appropriate Division regional office in accordance with 15A NCAC 2B .0506(a), and public notice shall be provided as required by North Carolina General Statute § 143-215.1 C. 7 4. 5 RI The wastewater treatment and non -discharge disposal facilities shall be properly maintained and operated at all times._ At a minimum, the following activities shall be performed: a. Screenings removed from the influent wastewater at the wastewater treatment facilities shall be properly disposal in a sanitary landfill or by other means that have been approved by the Division. b. Diffusers in the aeration tanks shall be cleaned as needed to ensure that adequate aeration is provided. c. Chlorine tables of the kind and type approved by the Division shall be added to the tablet chlorination system as needed to provide proper disinfection to the wastewater effluent generated by the facilities. d. Vegetative growth shall be kept out of the high -rate infiltration units of the non -discharge disposal facilities at all times. All vegetation shall be removed manually so that minimal disturbance will occur. The application of chemicals shall be expressly prohibited_ e. The high -rate infiltration units of the non -discharge disposal facilities shall be raked at least twice each week during the months of April through October, inclusive, and at least once per week during the months of November through March, inclusive. f. The automatically -activated stand-by power generation system shall be on -site and operational at all times. The system shall be tested under load weekly by interrupting the primary power source, As an indicator of proper operation and maintenance, the wastewater treatment facilities shall produce a wastewater effluent in compliance with the following Iimitations: Parameter Monthly Avera ea Dail Instantaneous Maximum b Flow 32,500 GPD Ammonia as Nitrogen 4 mg/L 6 mg/L Biochemical Oxygen Demand 10 mg/L 15 mg/L (5-day, 20°C) Fecal Coliform 14 per 100 mL 43 per 100 mL Total Suspended Solids 20 mg/L 30 mg/L pH shall not be less than 6.0 standard units nor greater than 9.0 standard units. Monthly averages for all parameters except fecal coliform shall be the arithmetic mean of all samples collected during the reporting period. The monthly average for fecal coliform shall be the geometric mean of all samples collected during the reporting period. The daily maximum shall be the maximum value of all samples collected during the reporting period. Note that if the groundwater monitoring program indicates or predicts problems with compliance to any of the groundwater quality standards as stipulated in 15A NCAC 2L, this permit may be modified to include additional and/or more restrictive limitations for wastewater effluent parameters. Such modification may or may not require the design, permitting, and construction of replacement and/or additional wastewater treatment facilities. No type of wastewater effluent other than that from the C & P Waste Treatment PIant shall be applied onto the high -rate infiltration units of the non -discharge disposal facilities. 0 7. The application rate onto the high -rate infiltration units of the non -discharge disposal facilities shall not exceed 10 gallons per minute per square foot. 8. No traffic or equipment shall be allowed in the high -rate infiltration units of the non - discharge disposal facilities except while installation is occurring or when normal maintenance is being performed. 9. Adequate measures shall be taken to divert stormwater away from and to prevent wastewater effluent runoff from the high -rate infiltration units of the non -discharge disposal facilities. III. MONITORING AND REPORTING REQUIREMENTS I. Any monitoring (i.e., including groundwater, surface water, soil, or plant tissue analyses) deemed necessary by the Division to ensure surface water and groundwater protection shall be established and an acceptable sampling reporting schedule shall be followed. 2. Influent or effluent wastewater flow to or from the wastewater treatment facilities shall be continuously monitored and recorded. Daily flow values shall be reported on Form NDMR- 1. The Permittee shall maintain an appropriate flow measurement device consistent with approved engineering and scientific practices to ensure the accuracy and reliability of flow measurement. The selected device shall be capable of measuring flows with a maximum deviation of less than 10 percent from true flow, accurately calibrated at a minimum of once per year, and maintained to ensure that the accuracy of the measurements is consistent with the accepted capability of that type of device. Calibration records for the device shall be kept on file by the Permittee for a period of at Ieast three years. At a minimum, data to be included in this documentation shall include: a. Data of flow measurement device calibration, b. Name of person performing flow measurement device calibration, and c. Percent from true flow during flow measurement device calibration. 0 The wastewater effluent from the wastewater treatment facilities shall be monitored by the Permittee at the point following all treatment processes (i.e., including disinfection) and prior to application onto the high -rate infiltration units of the non -discharge disposal facilities for the following parameters: Parameter Sampling Point Sampline Frequency Type of Sample Flow Influent or Effluent Continuous Recording PH Influent and Effluent Daily Grab Residual Chlorine Effluent Daily Grab Settleable Matter Effluent Daily Grab Ammonia as Nitrogen Effluent 2/Month' CompoSiteb Biochemical Oxygen Demand Effluent 2/Month' CompoSiteb (5-day, 20°C) Nitrate as Nitrogen Effluent 2/Month' Composite" Total Suspended Solids Effluent 2/Month' Composite" Fecal Coliform Effluent 2/Month" Grab Total Dissolved Solids Effluent Monthly CompoSiteb Total Organic Carbon Effluent Monthly CompoSiteb Chlorides Effluent Monthly Grab a The twice per month sampling frequency shall be conducted only during the months of April through October, inclusive. During the remainder of the calendar year, these parameters shall be monitored on a monthly frequency. b Composite samples shall be flow -weighted. 4. A log of all maintenance activities performed at these wastewater collection, treatment, and non -discharge disposal facilities shall be kept. This log shall include, but shall not be limited to, the following items: a. Visual observations of the wastewater treatment and non -discharge disposal facilities; b. All operation and maintenance items listed in Condition H. 3. and Condition H. 4. of this permit; c. Data related to the flow measurement device calibration as stipulated in Condition 111. 2. of this permit; d. Daily sampling results including settleable matter and dissolved oxygen in the aeration basin(s) and at the clarifier weirs; e. Record of all preventative maintenance (e.g., changing of filters, adjusting belt tensions, alarm testing, diffuser inspections and cleanings, etc.); d. Date and results of power interruption testing on the automatically -activated stand-by power generation system (i.e., see Condition H. 2. of this permit); and e. Date and volume of residuals removed from the wastewater treatment facilities, including the name of the hauling firm as well as a permit authorizing the disposal or a letter from the entity agreeing to accept the residuals. 10 Adequate records shall be maintained by the Permittee to track the amount of wastewater effluent applied onto the high -rate infiltration units of the non -discharge disposal facilities. These records shall include, but shall not necessarily be limited to, the following items: a. Date and time of application; b. Volume of wastewater effluent applied; c. High -rate infiltration unit utilized; d. Length of time high -rate infiltration unit is utilized; e. Continuous daily, monthly, and year-to-date hydraulic loadings in gallons per day per square foot for each high -rate infiltration unit; and f. Weather conditions. 6. Three copies of all operation and non -discharge disposal records, as specified in Condition 111. 5., shall be submitted on Form NDAR-2 on or before the last day of the month following the non -discharge disposal event. Three copies of all wastewater effluent monitoring data, as specified in Condition 111. 2. and Condition 11. 3., shall be submitted on Form NDMR-1 on or before the last day of the month following non -discharge disposal event. Noncompliance Notification: The Permittee shall report by telephone to the Water Quality Section of the Division's Wilmington Regional Office, telephone number (910) 395-3900, as soon as possible, but in no case more than 24 hours or on the next working day following the occurrence or first knowledge of the occurrence of any of the following at the wastewater treatment and non - discharge disposal facilities: a. Any occurrence at the facilities that results in the treatment of significant amounts of wastes which are abnormal in quantity or characteristic, such as the dumping of the contents of a sludge digester; the known passage of a slug of hazardous substance through the facilities; or any other unusual circumstances. b. Any process unit failure, due to known or unknown reasons, that render the facilities incapable of adequate wastewater treatment, such as mechanical or electrical failures of pumps; aerators; compressors; etc. c. Any failure of the facilities that results in a bypass directly to receiving waters without treatment of all or any portion of the influent to the facilities. d. Any time that self -monitoring information indicates that the facilities have gone out of compliance with its permit Iimitations. Persons reporting such occurrences by telephone shall also file a written report in letterform within five days following first knowledge of the occurrence. This report shall outline the actions taken or proposed to ensure that the problem does not recur. 11 IV. GROUNDWATER REQUIREMENTS Sampling Requirements: a. Groundwater monitoring wells MW-1, MW-3, and MW4 shall be sampled every March, July, and October for the parameters listed below: Chloride Fecal Coliform Nitrate -Nitrogen pH Total Ammonia Nitrogen Total Dissolved Solids Total Organic Carbon Total Phosphorus Water Level Water levels in the groundwater monitoring wells shall be measured prior to sampling the groundwater for the remaining parameters. The depth to water in each well shall be measured from the surveyed point on the top of the casing, which shall be surveyed relative to a common datum. b. If total organic carbon (TOC) concentrations greater than 10 milligrams per liter are detected in any downgradient groundwater monitoring well, additional sampling and analysis shall be conducted to identify the individual constituents comprising this TOC concentration. If the TOC concentration as measured in the background well exceeds 10 milligrams per liter, this concentration shall be taken to represent the naturally -occurring TOC concentration. Any exceedances of this naturally -occurring TOC concentration in downgradient wells shall be subject to the additional sampling and analysis as described in this permit. c. Any laboratory selected to analyze parameters shall be Division -certified for those parameters required. 2. Re ortin ocumentation Requirements: a. The results of the sampling and analysis shall be received on the most -recent version. of "Groundwater Quality Monitoring: Compliance Report Form' (i.e., GW-59 Form) with copies of the laboratory analyses attached by the Division's Groundwater Section on or before the last working day of the month following the sampling month. b. All reports shall be mailed to the following address: NCDENR-DWQ Groundwater Section Permits and Compliance Unit 1636 Mail Service Center Raleigh, NC 27699-1636 Updated blank reporting and other forms may be downloaded from the web site for the Division's Groundwater Section at http://gw.ehnr.state.nc.us/ or requested from the address Iisted above. 12 Vertical Separation Requirements: a. Waste application activities shall not occur when the vertical separation between the depth or application and the water table is at less than one foot. Verification of the water table elevation can be confirmed by water level readings obtained from groundwater monitoring well(s) near to the high -rate infiltration units of the non -discharge disposal facilities or auger boring(s), which shall be performed within 24 hours, prior to application of wastewater effluent. Any open boring(s) shall be properly filled with native soil prior to application to decrease the chance of any waste contaminating the groundwater. 4. Applicable Boundaries: a. The COMPLIANCE BOUNDARY for the disposal facilities is specified by regulations in 15A NCAC 2L (i.e., Groundwater Classifications and Standards). The Compliance Boundary for facilities individually permitted prior to December 31, 1983 is established at either 500 feet from the waste disposal area or at the property boundary, whichever is closest to the surface disposal unit. An exceedance of Groundwater Quality Standards at or beyond the Compliance Boundary is subject to immediate remediation action according to 15A NCAC 2L .0106 (d)(2). b. The REVIEW BOUNDARY is established around the disposal facilities midway between the Compliance Boundary and the perimeter of the waste disposal area. Any exceedance of Groundwater Quality Standards at the Review Boundary shall require action in accordance with 15A NCAC 2L .0106 (d)(1). 5_ Other Requirements: a. Any additional groundwater quality monitoring, as deemed necessary by the Division, shall be provided. b. Within 60 calendar days of this permit's issuance, the groundwater monitoring well, MW-2, shall be permanently abandoned. The well shall be abandoned either by a North Carolina -certified well contractor, the property owner, or the property lessee according to North Carolina General Statute §87-94.4(b)(2). If the well abandonment is not performed by a North Carolina -certified well contractor, the property owner or lessee shall physically perform the actual well abandonment activities, and the well shall be abandoned according to 15A NCAC 2C .0113 (i.e., "Abandonment of Wells") and any applicable local rules. Within 30 calendar days of the well abandonment activities, a "Well Abandonment Record" (i.e., OW-30 Form) shall be completed for the abandoned well and mailed to the address listed in Condition IV. 2b. c. Piezometers, MW-5 and MW-6, shall either be abandoned as described in Condition IV. 5b. above or made into permanent groundwater monitoring wells in compliance with 15A NCAC 2L .0100. Each well shall have a lockable cap and be locked in order to reasonably ensure against unauthorized access and use in accordance with 15A NCAC 2C .0108 (c)(7). The wells shall be further secured by placing a compatible watertight cap or seal onto the riser pipe to prevent potential contamination from entering the wells. 13 V. INSPECTIONS 1. Adequate inspection, maintenance, and cleaning shall be provided by the Permittee to ensure proper operation of the wastewater collection, treatment, and non -discharge disposal facilities. 2. The Permittee or his designee shall inspect the wastewater collection, treatment, and non - discharge disposal facilities to prevent malfunctions and deterioration, operator errors, and discharges that may cause or lead to the release of wastes to the environment, a threat to human health, or a nuisance. The Permittee shall keep an inspection log or summary including at least the date and time of inspection; observations made; and any maintenance, repairs, or corrective actions taken by the Permittee. This log of inspections shall be maintained by the Permittee for a period of three years from the date of the inspection and shall be made available upon request to the Division or other permitting authority. Any duly authorized officer, employee, or representative of the Division may, upon presentation of credentials, enter and inspect any property, premises or place on or related to the wastewater collection, treatment, and non -discharge disposal facilities at any reasonable time for the purpose of determining compliance with this permit; may inspect or copy any records that must be maintained under the terms and conditions of this permit; and may obtain samples of groundwater, surface water, or leachate. VI. GENERAL CONDITIONS This pernut shall become voidable unless the wastewater collection, treatment, and disposal facilities are constructed in accordance with the conditions of this permit, the approved plans and specifications, and other supporting data. 2. This permit shall be effective only with respect to the nature and volume of wastes described in the application and other supporting data. 3. This permit shall not be transferable. In the event there is a desire for the wastewater treatment and non -discharge disposal facilities to change ownership, or there is a name change of the Permittee, a formal permit request shall be submitted to the Division accompanied by documentation from the parties involved and other supporting materials as may be appropriate. The approval of this request shall be considered on its merits and may or may not be approved. 4. Failure to abide by the conditions and limitations contained in this permit may subject the Permittee to an enforcement action by the Division in accordance with North Carolina General Statutes § 143-215.6A through § 143-215.6C. The issuance of this permit does not preclude the Permittee from complying with any and all statutes, rules, regulations, or ordinances which may be imposed by other government agencies (i.e., local, state, and federal) which have jurisdiction, including, but not limited to, applicable river buffer rules in 15A NCAC 2B .0200, erosion and sedimentation control requirements in 15A NCAC Chapter 4 and under the Division's General Permit NCG0100000, and any requirements pertaining to wetlands under 15A NCAC 2B .0200 and 15A NCAC 2H .0500. 14 6. A set of approved plans and specifications for the wastewater collection, treatment, and non - discharge disposal facilities shall be retained by the Permittee for the life of the facilities. 7. The annual administering and compliance fee shall be paid by the Permittee within 30 days after being billed by the Division. Failure to pay the fee accordingly may cause the Division to initiate action to revoke this permit as specified by 15 NCAC 2H .0205 (c)(4). 8. The Permittee, at least six months prior to the expiration of this permit, shall request its extension. Upon receipt of this request, the Division shall review the adequacy of the wastewater treatment and non -discharge disposal facilities described therein, and if warranted, shall extend the permit for such period of time and under such conditions and limitations as it may deem appropriate. 9. The wastewater collection, treatment, and non -discharge disposal facilities shall be connected to an operational publicly -owned wastewater collection system within 180 days of its availability to the service area location if the facilities are in non-compliance with the terms and conditions of this permit and/or the governing statutes or regulations. Prior to the initiation of these connection activities, the Permittee shall apply for and obtain the appropriate approvals from the Division. 10. Prior to transferring the property on which the wastewater collection, treatment, and non - discharge disposal facilities are located to a new property owner, the Permittee shall provide notification that describes fully the activities that have taken place on the property, including any details regarding waste or other material applied or incorporated, to the new property owner.
