Land Application of Residuals from the
Treatment of Wastewater and Water
Lincoln County
In accordance with a request received via telephone from Mr. Robert Hamilton and Mr. Bill
Cotter of Wheelabrator Water Technologies, Inc. - Bio Gro Division on January 3, 2000, we are
forwarding herewith a corrected Page 8 of Permit No. WQ0002712, issued December 8, 1999, for the
subject residuals land application program. The following correction has been made to the permit:
1. Condition IV. 2. of Permit No. WQ0002712 originally required that land application of
residuals on Site No. LT 5-5, Site No. LT5-6, and Site No. LT 19-3 be seasonally limited to
the period between the months of April and October, inclusive. This condition has been
deleted by this correction, and conditions pertaining to groundwater requirements have been
renumbered accordingly. The Division of Water Quality's (Division) Groundwater Section
originally recommended this condition because of the presence of typically shallow
groundwater tables on these sites. Upon review of Mr. Hamilton's and Mr. Cotter's request
that the Division withdraw this condition, the Groundwater Section determined that,
although these sites are prone to flooding, they are not groundwater recharge areas. For this
reason, application of residuals should not result in a contravention of the State's
groundwater resources, provided that compliance with all other conditions of this permit is
maintained. This deletion was acknowledged by Mr. Derek Lewis of the Groundwater
Section in a project memorandum received by the Non -Discharge Permitting Unit staff on
January 29, 2000.
Please replace Page 8 with the corrected Page 8 into Permit No. WQ0002712, issued December
8, 1999.

8. Noncompliance Notification:
The Permittee shall report by telephone to the Mooresville Regional Office, telephone number (704)
663-1699, as soon as possible, but in no case more than 24 hours or on the next working day following
the occurrence or first knowledge of the occurrence of any of the following:
a. Any occurrence with the land application program that results in the land application of significant
amounts of wastes which are abnormal in quantity or characteristic.
b. Any failure of the land application program resulting in a release of material to receiving waters.
c. Any time that self -monitoring information indicates that the facility has gone out of compliance
with the conditions and limitations of this permit or the parameters on which the system was
designed.
d. Any process unit failure, due to known or unknown reasons, that render the facility incapable of
adequate residual treatment.
e. Any spillage or discharge from a vehicle or piping system transporting residuals to the application
site.
Persons reporting such occurrences by telephone shall also file a written report in letterform within five
days following first knowledge of the occurrence. This report must outline the actions taken or
proposed to be taken to ensure that the problem does not recur.
IV. GROUNDWATER REQUIREMENTS
L No land application of waste activities shall be undertaken when the seasonal high water table is less
than three feet below land surface.
2. The COMPLIANCE BOUNDARY for the land application area is specified by regulations in 15A
NCAC 2L, Groundwater Classifications and Standards. The Compliance Boundary is for the land
application area constructed after December 31, 1983 is established at either (1) 250 feet from the land
application area, or (2) 50 feet within the property boundary, whichever is closest to the land
application area. An exceedance of Groundwater Quality Standards at or beyond the Compliance
Boundary is subject to immediate remediation action in addition to the penalty provisions applicable
under General Statute 143-215.6A(a)(1).
In accordance with 15A NCAC 2L, a REVIEW BOUNDARY is established around the land
application area midway between the Compliance Boundary and the perimeter of land application area.
Any exceedance of standards at the Review Boundary shall require remediation action on the part of
the permittee.
3. Any additional groundwater quality monitoring, as deemed necessary by the Division, shall be
provided.
