Brunswick County In accordance with your application received October 16, 1989, we are forwarding, herewith, Permit No. WQ0002531, dated November 9, 1989, for the continued operation of the existing wastewater treatment and disposal facility and the construction of a grease interceptor and pump station for pre-treatment of wastewater from a proposed crab cake processing plant and conveyance of the wastewater to the existing facility. The additional discharge should not cause the total waste flow to exceed the design capacity of the existing facilities. This permit shall be effective from the date of issuance until October 31, 1994, and shall void Permit No. 13704, issued September 19, 1986. You attention is called to the expiration date of this permit and to Condition No. 17 which has been added to the permit. If any parts, requirements, or limitations contained in this permit are unacceptable to you, you have the right to an adjudicatory hearing before a hearing officer upon written request within thirty (30) days following receipt of this permit. This request must be in the form of a written petition, conforming to Chapter 150B of the North Carolina General Statutes, and filed with the Office of Administrative Hearing, Post Office Drawer 11666, Raleigh, North Carolina 27604. B. CAROON for the continued operation of the existing 2,000 GPD wastewater treatment and disposal facility consisting of a grit chamber, a 3,000 gallon grease interceptor, a 3,000 gallon precast cement two compartment septic tank, a dosing pump tank, 680 linear feet of 3 feet wide nitrification trenches, and the construction and operation of a grease interceptor and pump tank to serve a new crab cake processing plant all located at C. B. Caroon Crab Co., Inc., with no discharge to surface waters of the State. This permit is granted pursuant to the application received October 16, 1989, and in conformity with the project plans, specifications, and other supporting data, subsequently filed and approved by the Department of Environment, Health and Natural Resources considered a part of this permit. This permit shall be effective from the date of issuance until October 31, 1994 and shall be subject to the following specified conditions and limitations: 1. This permit shall become voidable unless the facilities are constructed in accordance with the approved plans, specifications and other supporting data. 2. This permit is effective only with respect to the nature and volume of wastes described in the application and other supporting data. f Permit No. WQ002531 Page -2- 3. Adequate inspection, maintenance, and cleaning shall be provided by the permittee to insure proper operation of the subject facilities. 4. This permit is not transferable. 5. Upon the availability of a municipal or regional sewerage collection system, the subject wastewater treatment system shall be abandoned, and all wastewater discharged into the municipal or regional sewerage system. 6. This permit shall become voidable in the event of failure of the soil to adequately absorb the wastes, and may be rescinded unless the facilities are installed, maintained and operated in a manner which will protect the assigned water quality standards of the surface waters and groundwaters. 7. The Wilmington Regional Office, Phone No. 919/256-4161 shall be notified at least twenty-four (24) hours in advance of backfilling of the installed system so that an in-place inspection can be made of said system prior to backfilling. Such notification to the Regional Supervisor shall be made during the normal office hours from 8:00 a.m. until 5:00 p.m. on Monday through Friday, excluding State Holidays. 8. Any monitoring deemed necessary by the Division of Environmental Management to insure surface and groundwater protection will be established and an acceptable sampling reporting schedule shall be followed. 9. The sludge generated from these treatment facilities must be disposed of in accordance with the General Statutes 143-215.1 and in a manner approvable by the North Carolina Division of Environmental Management. 10. The wastewater treatment system shall be effectively maintained and operated at all times so that there is no discharge to the surface waters, nor any contamination of groundwaters which will render them unsatisfactory for normal use. In event the facilities fail to perform satisfactorily, including the creation of nuisance conditions, or failure of the irrigation area to adequately absorb the wastewater, the Permittee shall take such immediate corrective action as may be required by the Division of Environmental Management, including the construction of additional or replacement wastewater treatment or disposal facilities. Permit No. WQ0002531 Page -3- 11. Diversion or bypassing of the untreated wastewater from the wastewater treatment system is prohibited. 12. The issuance of this permit shall not relieve the permittee of the responsibility for damages to surface or groundwaters resulting from the operation of this facility. 13. No traffic or equipment shall be allowed on the disposal area except while installation occurs or while normal maintenance is being performed. 14. An acceptable reserve area as indicated on the approved plans shall be maintained at all times. 15. The bottom of the nitrification trench should be approximately 18 inches below the land surface but shall in no case be more than 36 inches below land surface 16. The Permittee, at lease six (6) months prior to the expiration of this permit, shall request its extension. Upon receipt of the request, the Commission will review the adequacy of the facilities described therein, and if warranted, will extend the Permit for such period of time and under such conditions and limitations as it may deem appropriate. 17. The septic tank and grease interceptors shall be inspected monthly and pumped as often as necessary to remove floating and settled solids. 18. A vegetative cover shall be established on the surface of the disposal field and it shall be kept mowed on a frequent basis. Permit issued this 14th day of November,1989.
