Paul Wilms Director July 19, 1989 Subject: Permit No. WQ0002055 Stallings Oil Company Pump and Haul Activities Wake County In accordance with your application received July 12, 1989, we are forwarding herewith Permit No. WQ0002055, dated July 19, 1989, to Stallings Oil Company for the operation of the subject pump and haul activities. This permit shall be effective from the date of issuance until September 18, 1989, and shall be subject to the conditions and limitations as specified therein. If any parts, requirements, or limitations contained in this permit are unacceptable to you, you have the right to request an adjudicatory hearing upon written request within 30 days following receipt of this permit. This request must be in the form of a written petition, conforming to Chapter 150B of North Carolina General Statutes, and filed with the Office of Administrative Hearings, P.O. Box 27687, Raleigh, North Carolina 27611-7687 'T'elephone 919-733-7015 An Equal Opportunity Affirmative Action Employer NORTH CAROLINA ENVIRONMENTAL MANAGEMENT COMMISSION DEPARTMENT OF NATURAL RESOURCES AND COMMUNITY DEVELOPMENT RALEIGH PERMIT For the discharge of sewage, Industrial Wastes, or Other Wastes In accordance with the provisions of Article 21 of Chapter 143, General Statutes of North Carolina as amended, and other applicable Laws, Rules, and Regulations PERMISSION IS HEREBY GRANTED TO Stallings Oil Company Wake County Imo• 1 M.I_.. operation of pump and haul activities consisting of pumping approximately 240 GPD of wastewater from a manhole (designated as manhole #6) and hauling the wastewater to the City of Raleigh Wastewater Treatment Plant, pursuant to the application received July 12, 1989 and in conformity with the project plan, specifications, and other supporting data subsequently filed and approved by the Department of Natural Resources and Community Development and considered a part of this permit. This permit shall be effective from the date of issuance until September 18, 1989 and shall be subject to the following specified conditions and limitations: This permit shall become voidable unless the subject pump and haul activities are carried out in a manner approved by this Division. 2. This permit is effective only with respect to the nature and volume of wastes described in the application and other supporting data. The facilities shall be properly maintained and operated at all times. 4. This permit is not transferable until such timeas the permittee has requested a name change to a new permittee. Such a request must be accompanied by an application fee, documentation from the new and current permittees, and other supporting data as may be appropriate. 5. No type of wastewater other than that from Stallings Oil Company located at Wake Forest Road and Ronald Drive shall be included in the pump and haul activities. 6. The permit shall become voidable unless the agreement between Stallings Oil Company, East Side Septic Tank Cleaning Service and City of Raleigh for the collection, transportation, and ultimate disposal of wastewater is in full force and effect. 7. In the event that the facilities fail to perform satisfactorily, including the creation of nuisance conditions, the Permittee shall take such immediate corrective action as may be required by this Division, including the construction of additional or replacement wastewater treatment facilities. Upon availability of a municipal or regional sewerage collection system, the subject wastewater treatment facilities shall be abandoned and all wastewater discharged into the municipal or regional sewerage system. 9. This pump and haul permit shall expire -of September 18, 1989 and shall not be renewed 10. The permittee is liable for any damages caused by a spill or failure of the pump and haul operations. 11. Adequate inspection, maintenance, and cleaning shall be provided by the permittee to insure proper operation of the subject facilities. 12. An accurate record of the pump and haul activities must be maintained by the permittee, indicating: a) date wastewater is removed from the manhole, and b) volume of wastewater removed. 13. Failure to abide by the conditions and limitations contained in this permit will subject the Permittee to any enforcement action by the Division of Environmental Management in accordance with North Carolina General Statutes 143-215.6. 14. As per the agreement with the City of Raleigh, notification shall be given to the Wastewater Treatment Plant Superintendent twenty-four (24) hours in advance of hauling wastewater to the treatment plant Permit issued this the 19th day of July, 1989, K.
