Dear Mr. Jerger:
In accordance with your application received on July 7, 1989, we are forwarding herewith
Permit No. WQ0002013, dated August 10, 1989, to Carolina Feed Products for the operation of
the subject wastewater pump and haul activities.
This permit shall be effective from the date of issuance until July 31, 1990, and shall be
subject to the conditions and limitations as specified therein.
If any parts, requirements, or limitations contained in this permit are unacceptable to you,
you have the right to request an adjudicatory hearing upon written request within thirty (30) days
following receipt of this permit. This request must be in the form of a written petition, conforming
to Chapter 150B of the North Carolina General Statutes, and filed with the Office of Administrative
Hearings, P.O. Drawer 11666, Raleigh, NC 27604. Unless such demands are made this permit
shall be final and binding.

For the discharge of Sewage, Industrial Wastes, or Other Wastes
In accordance with the provisions of Article 21 of Chapter 143, General Statutes of North
Carolina as amended, and other applicable Laws, Rules, and Regulations
PERMISSION IS HEREBY GRANTED TO
Cape Fear Feed Products
Cumberland County
FOR THE
operation of a 30,000 GPD wastewater pump and haul activity which will consist of pumping
untreated wastewater out of the Cape Fear Feed Products plant in Fayetteville and hauling this
wastewater to the Carolina and Southern Processing Company in Gastonia for final treatment and
disposal, pursuant to the application received on July 7, 1959, and in conformity with the project
plan, specifications, and other supporting data subsequently filed and approved by the Department
of Environment, Health, and Natural Resources and considered a part of this permit.
This permit shall be effective from the date of issuance until July 31, 1990, and shall be
subject to the following specified conditions and limitations:
I. This permit shall become voidable unless the facilities are operated in accordance with
the supporting information.
2. This permit is effective only with respect to the nature and volume of wastes described in
the application and other supporting data.
3. The facilities shall be properly maintained and operated at all times.
4. This permit is not transferable.
S. The wastewater collected during this operation shall be adequately treated in the
Carolina and Southern Processing Company Wastewater Treatment Facility prior to final
disposal.
6. This permit shall not be renewed or extended.
7. Cape Fear Feed Products is liable for any damages which occur as a result of a spill during
this pump and haul operation.
S. No wastewater other than that from Cape Fear Feed Products shall be included in this
pump and haul operation.
9. No wastewater shall be transported from Cape Fear Feed Products in Fayetteville to the
Carolina and Southern Processing Company in Gastonia Wastewater Treatment Facility
unless the receiving facility is in full compliance with its NPDES permit effluent
limitations.
10. Adequate inspection, maintenance, and cleaning shall be provided by Cape Fear Feed
Products to insure proper operation of these facilities.
11. In the event that the facilities fail to perform satisfactorily, including the creation of
nuisance conditions, the Permittee shall take such immediate corrective action as may be
required by this Division. This action may include the construction of additional or
replacement wastewater treatment or disposal facilities or the ceasing of the pump and haul
activities
12. The Permittee shall maintain an accurate record of daily inspection and pumping activities
associated with this operation ( including frequency and amount pumped and hauled ).
This record shall be maintained by the Permittee for the life of the permit and shall be made
available to the Division of Environmental Management staff upon request.
13. Within twenty-four hours after any pump and haul activity, the Permittee shall notify the
Division's Fayetteville Regional Supervisor at 91914$61541.
Permit issued this the 10th day of August, 1989.
