Paul Wilms Director July 17, 1989 Subject: Permit No. WQ0001957 Weeping Radish Brewery Certificate of Approval Wastewater Pretreatment Facilities Dare County - In accordance with your application received July 3, 1989, we are forwarding herewith Certificate of Approval No. WQ0001957, dated July 17, 1989, to the Weeping Radish Brewery for the construction and operation of the subject pretreatment facilities. This Certificate of Approval shall be effective from the date of issuance until rescinded, and shall be subject to the conditions and limitations as specified therein. If any parts, requirements, or limitations contained in this permit are unacceptable to you, you have the right to request an adjudicatory hearing upon written request within 30 days following receipt of this permit. This request must be in the form of a written petition, conforming to Chapter 150B of North Carolina General Statutes, and filed with the Office of Administrative Hearings, P.O. Box 11666, Raleigh, NC 27604. Unless such demands are made this permit shall be final and binding. One set of approved plans and specifications is being forwarded to you. Box 27687, Raleigh, North Carolina 27611-7687 Telephone 919-733-7015 An Equal Opportunity Affirmative Action Employer NORTH CAROLINA ENVIRONMENTAL MANAGEMENT COMMISSION DEPARTMENT OF NATURAL RESOURCES AND COMMUNITY DEVELOPMENT RALEIGH CERTIFICATE OF APPROVAL For the discharge of Sewage, Industrial Wastes, or Other Wastes In accordance with the provisions of Article 21 of Chapter 143, General Statutes of North Carolina as amended, and other applicable Laws, Rules, and Regulations PERMISSION IS HEREBY GRANTED TO Weeping Radish Brewery Dare County FOR THE construction and operation of a 500 GPD wastewater pretreatment facility consisting of a 1,500 gallon aeration tank with three 10 CFM submersible aerators and high water alarm and a 750 gallon settling tank, to serve Weeping Radish Brewery with discharge of pretreated wastewater into the Town of Manteo's existing sewerage system, pursuant to the application received July 3, 1989 and in conformity with the project plan, specifications, and other supporting data subsequently filed and approved by the Department of Natural Resources and Community Development and considered a part of this permit. This permit shall be effective from the date of issuance until rescinded, and shall be subject to the following specified conditions and limitations: This Certificate of Approval is subject to revocation unless the wastewater pretreatment facilities are constructed in accordance with the approved plans and specifications. 2. The sludge generated from these pretreatment facilities must be disposed of in accordance with. G.S. 143-215.1 and in a manner approved by the North Carolina Division of Environmental Management. 3. Upon completion of construction and prior to operation of this permitted facility, a certification must be received from a professional engineer certifying that the permitted facility has been installed in accordance with the approved plans and specifications. Mail the certification to the Permits and Engineering Unit, P.O. Box 27687, Raleigh, NC 27611-7687. 4. This Certificate of Approval is effective only with respect to the nature and volume of wastes described in the application and other supporting data. 5. The Washington Regional Office, phone no. 919-946-6481 shall be notified at least forty-eight (48) hours in advance of operation of the installed facilities so that an in -place inspection can be made. Such notification to the regional supervisor shall be made during the normal office hours from 8:00 a.m. until 5:00 p.m. on Monday through Friday, excluding State Holidays. 6. The pretreatment facilities shall be effectively maintained and operated at all times in such a manner as to produce an effluent which will not adversely affect the Town of Manteo Wastewater Treatment Plant. 7. This Certificate of Approval shall be voidable unless the agreement between Weeping Radish Restaurant & Brewery, Inc and the Town of Manteo for the collection and final treatment of the pretreated industrial wastewater is in full force and effect. 8. This Certificate of Approval is not transferable until such time as the permittee has requested a name change to a new permittee. Such a request must be accompanied by an application fee, documentation from the new and current permittees, and other supporting data as may be appropriate. 9. The pretreated industrial wastewater from shall be adequately treated in the Town of Manteo Wastewater Treatment Plant prior to being disposed by land application. 10. Discharge from the Weeping Radish Brewery pretreatment system must comply with the present Town of Manteo sewer use ordinance and any subsequent ordinance with more stringent limitations. 11. Adequate inspection, maintenance, and cleaning shall be provided by the Permittee to insure proper operation of the subject facilities. 12. In the event that the facilities fail to perform satisfactorily, including the creation of nuisance conditions, the Permittee shall take such immediate corrective action as may be required by this Division, including the construction of additional or replacement wastewater pretreatment facilities. 13. A set of the approved plans and specifications for the subject project must be retained by the applicant for the life of the permit. 14. Failure to abide by the conditions and limitations contained in this permit will subject the Penniā‚¬tee to any enforcement action by the Division of Environmental Management in accordance with North Carolina General Statutes 143-215.6.
