In accordance with your application received May 19, 1988, we are forwarding
herewith Permit No. 16+38, dated June 2.9, 1988, to New 'Times, Inc. for the
construction and operation of the subject recycle system.
This permit shall be effective from the date of issuance until .rescinded, and
shall be subject to the conditions and limitations ns specified therein.
If any parts, requirements, or limitations contained in this permit are
unacceptable to you, you have the right to request: an adjudicatory hearing upon
written request within 30 days following receipt of this permit. This request must
be in the form of a written petition, conforming to Chapter 150E of North Carolina
General Statutes, and filed with the Office of Administrative hearings, Post Office
Drawer 11666, Raleigh, Forth Carolina 27604. Unless such demands are made this
}permit shall be final and binding.

For the discharge of Sewage, Industrial Wastes, or Other Wastes
In accordance with the provisions of Article 21 of Chapter 143, General Statutes
of North Carolina as amended, and other applicable Laws, Rules, and Regulations
PERMISSION IS HEREBY GRANTED TO
New Times, Inc.
Swain County
FOR THE
construction and operation of a water recycle system consisting of two (2) 42 GPM
pumps, 2 settling ponds in series, and associated 1 1/2 -inch force main to serve New
Times Ruby Mine with no discharge to the surface waters of the State, pursuant to the
application received May 19, 1988, and in conformity with the project plan,
specifications, and other supporting data subsequently filed andapproved by the
Department of Natural Resources and Community Development and considered a part of
this permit.
This permit shall be effective from the date of issuance until rescinded, and
shall be subject to the following specified conditions and limitations:
1. This permit shall become voidable unless the facilities are cons_ructed in
accordance with the approved plans, specifications and other supporting data.
2. This permit is effective only with respect to the nature and volume of wastes
described in the application and other supporting data.
3. The facilities shall be properly maintained and operated at all times.
4. This permit is not transferable.
5. In the event that the facilities.fail to perform satisfactorily, including the
creation of nuisance conditions,'the Permittee shall take such.immediate
corrective action as may be required by this Division, including the construction
of additional or replacement wastewater treatment or disposal facilities.
6. Any additional groundwater quality monitoring as deemed necessary by the
Department, shall be provided.
7. The issuance of this permit shall not relieve the Permittee of the responsibility
for.damages to surface or groundwaters resulting from the: operation of this
facility.
8. Upon completion of construction and prior to operation of this permitted
facility, a certification must be received from a professional engineer
certifying that the permitted facility has been installed in accordance
with the approved plans and specifications. Mail the certification to:
Permits and Engineering Unit, Post Office Box 27687, Raleigh, NC 27611.
9. A copy of the approved plans and specifications shall be maintained on file by
the permittee for a minimum of five years from the date of issuance.
