Dear Mr. Hardee:
In accordance with your application received February 26, 1988, we are
forwarding herewith Permit No. WQ0000584, dated October 11., 1988, to Hardee's
Septic Tank Service (W. R. Hardee, Jr.) for the operation of the subject land
application program.
This permit shall be effective from the date of .issuance until October 31,
1993, and shall be subject to the conditions and lim:itat.ions as specified therein.
If any parts, requirements, or limitations contained .in this permit are
unacceptable to you, you have the right to request an. adjudicatory hearing upon
written request within 30 days following receipt of this permit. This request must
be in the form of a written petition, conforming to Chapter 150B of North Carolina
General Statutes, and filed with the Office of Administrative clearings, Post Office
Drawer 11666, Raleigh, North Carolina 27604. Unless such. rlemands are made this
permit shall be final and binding.

For the discharge of Sewage, Industrial. Wastes, or nuer Wastes
In accordance with the provisions of Article 21 of Chapter 143, General Statutes
of North Carolina as amended, and other applicable Daws, Rifles, and Regulations
PERMISSION IS HEREBY GRANTED TO
Hardee's Septic Tank Service (W. R. Harden, Jr.)
Johnston County
FOR THE
operation of a land application program
to
apply approved
wastewater sludge at
agronomic rates to a 10 acre site owned by
Mr.
W. R. Hardee, Jr.
with no discharge to
the surface waters of the State, pursuant
to
the application
roceived February 2.6,
1988, and in conformity with the project plan,
specifications,
and other supporting
data subsequently filed and approved by
the
Department or Nntural. Resources and
Community Development and considered a part
of this permit.
This permit shall be effective from the date of issuance until October 31, 1993,
and shall be subject to the following specified conditions and limitations:
1. This permit is effective only with respect to the nature and volume of wastes
described in the application and other supporting data..
2. The facilities shall be properly maintained and operated at. all times.
3. This permit is not transferable.
4. A log shall be maintained which should include, butt not he limited to, the
following:
a. Origin of wastewater treatment plant sludge
b. Volume of waste
c. Date of application
5. Prior to beginning waste disposal operations, two monitor wells, one up padient
and one downgradient, must be installed to monitor groundwater quality.' The
location and construction details for these wells must be by approval 6f the
Raleigh. Regional Office, from which a well construction perm:ik must be obtained.
6. The monitor wells must be sampled initially after construction (and prior to
waste disposal operations) and thereafter every March, July, and November for the
following parameters:
NO3 pH
Total Ammonia TOC
TDS Chloride
Water levels Total Coliforms
TOX (initially and in November only)
The measurement of water level must be made prior to sampling for the remaining
parameters.
The analytical methods used for TOX must be capable of detecting the total of all
halogenated organic compounds present at a concentration of 5.0 parts per billion
(ppb) or greater. In the event that a TOX concentration of 5.0 ppb or greater is
detected, any individual halogenated organic compound(s) present at a
concentration at or above their method detection limit (MDL) must be identified
and quantified utilizing EPA methods 601, 602, 604, and 617..
The results of the sampling and analysis shall. be sent to the N.C. Division of
Environmental. Management on Form GW -59 (Compliance Monitoring Report Form) every
April, August and December.
7. Adequate records shall be maintained for tracking the sludge applied on the
permitted sites. This program shall include, but not be limited to, the
following:
a. Date of application
b. Application rate
c. Area of land to which sludge is applied
d. field to which sludge is applied
e. Crop(s) grown on field
f. Year-to-date total in dry tons/acre, nutrient and metal loading in pounds per
acre.
This information shall be submitted to the Raleigh Regional- Office on or before
January 15th of each year for the preceding year.
8. The following minimum" buffers shall be maintained from the application areas:

9. An annual soil scientist evaluation shall be performed on the land application
system and the results of the evaluation submitted to the Rol.nigh Regional Office
on or before January 15th of each year.
10. Any monitoring deemed necessary by the Division of Environmental Management to
insure surface and groundwater protection will be established and an acceptable
sampling report schedule shall be followed.
11. In the event the facilities fail to perform satisfactorily including the creation
of nuisance conditions, the Permittee shall take such immediate corrective action
as may be required by the Division, including the construction of additional or
replacement sludge treatment or disposal facilities.
12. This permit shall become voidable in the event of failure of the soil to
adequately absorb the wastes and may be rescinded unless the facilities are
installed, maintained, and operated in a manner which will. protect the assigned
water quality standards of the surface waters and ground waters.
13. In the event that the facilities fail to perform satisfactorily, including the
creation of nuisance conditions, the Permittee shall take such immediate
corrective action as may be required by this Division, including the construction
of additional or replacement wastewater treatment or disposal. facilities.
14. A suitable year round vegetative cover shall be maintained.
15. The Permittee, at least six (6) months prior to the expiration of this permit,
shall request its extension. Upon receipt of the request, the Commission will
review the adequacy of the facilities described therein, and if warranted, will
extend the Permit for such period of time end under such conditions and
limitations as it may deem appropriate.
16. No type of sludge other than that from Carolina Power. & Dight Domestic
Wastewater Treatment Plant shall be pI.aced on. the land application disposal site.
1.7. The issuance of this permit shall not relieve the Permittee of the responsibility
for damages to surface or groundwaters resulting from thn. operation of this
facility.
18. Adequate provisions shall be taken to prevent wind erosion. and surface runoff
from conveying pollutants from the sludge application area onto the adjacent
property or into the surface waters.
19. Sludge shall not be applied in inclement weather or until 24 hours following a
rainfall event of 1/2 -inch or greater in 24 hours. Emergency sludge disposal
measures shall be approved by the Division of Environmental Management.
20. The site shall be adequately limed to a soil pH of 6.5 prior to sludge
application.
21. No crops for direct human consumption shall be raised on these sites for a period
of 18 months following sludge application.
22. Sludge application rates shall not exceed:
A. Annual Loadings
1. 50,000 gallons/acre/year
2. PAN 100 lbs/acre/year
3. Potassium 25 lbs/acre/year
4. Phosphorus 50 lbs/acre/year
5. Cadmium 0.45 lbs/acre/year
B. Cumulative Loadings
1. Cadmium 5 lbs/acre
2. Nickel 50 lbs/acre
3. Copper 125 lbs/acre
4. Zinc 250 lbs/acre
5. Lead 500 lbs/acre
