Wastewater Spray Irrigation Facility Martin County Dear Mr. Martin: In accordance with your application received October 25, 1988, we are forwarding herewith Permit No. WQ0000581, dated April 12, 1989, to Eagle Snacks, Inc. for the construction and operation of the subject wastewater collection system extensions. This permit shall be effective from the date of issuance until March 30, 1994, shall void Permit No. 7523R and shall be subject to the conditions and limitations as specified therein. If any parts, requirements, or limitations contained in this permit are unacceptable to you, you have the right to request an adjudicatory hearing upon written request within 30 days following receipt of this permit. This request must be in the form of a written petition, conforming to Chapter 150B of North Carolina General Statutes, and filed with the Office of Administrative Hearings, Post Office Drawer 11666, Raleigh, North Carolina 27604. Unless such demands are made this permit shall be final and binding. One (1) set of approved plans and specifications is being forwarded to you. Martin County _?8 FOR THE continued operation of the existing $8,000 GPD treatment facility and the addition of a 65,000 GPD treatment facility for a total of 153,000 GPD spray irrigation wastewater treatment facility presently consisting of a 50 GPM duplex pump station, a rotary screen, a 80 GPM transfer pump station with dual pumps, a 51,000 gallon aerated storage tank, approximately 9 acres of spray irrigation area, the addition of 38 acres of spray irrigation area and the construction of a 1.6 million gallon storage tank, and all associated sprinklers, piping, valves and appurtenances to serve the Eagle Snacks, Inc., Martin County Plant with no discharge of wastewater to the surface waters of the State, pursuant to the application received October 25, 1988, and in conformity with the project plan, specifications, and other supporting data subsequently filed and approved by the Department of Natural Resources and Community Development and considered a part of this permit. This permit shall be effective from the date of issuance until March 30, 1994, shall void Permit No. 75238, and shall be subject to the following specified conditions and limitations: 1. This permit shall become voidable unless the facilities are constructed in accordance with the approved plans, specifications and other supporting data. 2. This permit is effective only with respect to the nature and volume of wastes described in the application and other supporting data. 3. The facilities shall be properly maintained and operated at all times. 4. This permit is not transferable. 5. Construction of the sewers shall be so scheduled so as not to interrupt service by the existing utilities nor result in an overflow or bypass discharge of wastewater to the surface waters of the State. 6. Upon completion of construction and prior to operation of this permitted facility, a certification must be received from a professional engineer certifying that the permitted facility has been installed in accordance with the approved plans and specifications. Mail the certification to the Permits and Engineering Unit, P.O. Box 27687, Raleigh, N.C. 27611-7687. 7, The. Washington Regional Office, phone no. 919/946-6481 shall be notified at Idast twenty-four (24) hours in advance of operation of the installed facilities so that an in-place inspection can be made. Such notification to the regional supervisor shall be made during the normal office hours from 8:00 a.m. until._'5:00 p.m. on Monday through Friday, excluding State Holidays. B. Monitoring wells shall be constructed and sampling schedules arranged as required by the Division of Environmental Management and in accordance with 15 NCAC 2C .0100. 9. Any monitoring deemed necessary by the Division of Environmental Management to insure surface and ground water protection will be established and an acceptable sampling reporting schedule shall be followed. 10. The sludge generated from these treatment facilities must be disposed of in accordance with General Statute 143-215.1 and in a manner approvable by the North Carolina Division of Environmental Management. 11. Reports on the operations of the spray irrigation facilities shall be submitted to the Washington Regional Office at regular intervals and in such form and detail as may be required by this Division. 12. The spray irrigation facilities shall be effectively maintained and operated at all times so that there is no discharge to the surface waters, nor any contamination of ground waters which will render them unsatisfactory for normal use. In the event that the facilities fail to perform satisfactorily, including the creation of nuisance conditions or failure of the irrigation area to adequately absorb the wastewater, the Permittee shall take such immediate corrective action as may be required by the Division of Environmental Management. 13. A suitable year, round vegetative cover shall be maintained. 14. Irrigation shall not be performed during inclement weather or when the ground is in a condition that will cause runoff. 15. Adequate measures shall be taken to prevent wastewater runoff from the spray field. 16. The Permittee, at least six (6) months prior to the expiration of this permit, shall request its extension. Upon receipt of the request, the Commission will review the adequacy of the facilities described therein, and if warranted, will extend the Permit for such period of time and under such conditions and limitations as it may deem appropriate. 17. The application rates shall not exceed 0.4 3irhes/acres /week 18. The Permittee shall employ a certified wastewater treatment plant operator to be in responsible charge of the wastewater treatment facilities. Such operator must hold a certificate of the grade at least equivalent to the classification assigned to the wastewater treatment facilities by the Certification Commission and shall be employed by the time that construction of the waste treatment facility is 50% complete. 19. The issuance of this permit shall not relieve the Permittee of the responsibility for damages to surface or groundwaters resulting from the operation of this facility. 20. The facilities shall be effectively maintained and operated as a non -discharge system to prevent the discharge of any wastewater resulting from the operation of this facility. 21. Adequate inspection, maintenance, and cleaning shall be provided by the Permittee to insure proper operation of the subject facilities. 22. In any future transfer of this land, a notice shall be given to the new owner that gives full details of the materials applied or .incorporated at this site. 23. Failure of the Permittee to properly operate this system is subject to a penalty up to $10,000 per day. 24. On the Carson Tract, the spray irrigation zones located in areas with soils identified as Rains or Lynchburg Series shall not be utilized for spray irrigation during the period from November through April, inclusive. 25. Prior to beginning waste disposal operations, one (1) piezometer shall be installed in the Carson tract (in soils identified as Rains or Lynchburg) to monitor water levels in the spray fields. Water level measurements shall be obtained on a monthly basis, and recorded for future reference. The results of the water level monitoring shall be reported annually to the Washington Regional Office Groundwater Section, N.C. Division of Environmental Management. 26. Flow rates shall be monitored daily and reported monthly to the Washington Regional Office Supervisor, P.O. Box 1507, Washington North Carolina 27889. The reports shall be due no later than 30 days' follnw4 nq the end of the reporting period. 27. Soils test shall be conducted on representative areas of the irrigation site at least once each year to provide information to enable proper maintenance of crops and to determine the potential pollutant buildup in the soil system. The above tests shall also include a determination of the sodium index, value. Copies of the test results shall be furnished to the Washington Regional Office Supervisor along with an evaluation and recommendations of a recognized soil scientist. The first report is due within one year of the effective date of permit. 28. Within 90 days of permit issuance, four (4) monitor wells, one (1) upgradient and three (3) downgradient, must be installed to monitor groundwater quality. The location and construction details for these wells must be by approval of the Washington Regional Office, from which a well construction permit must be obtained. 29. The four (4) new and the four (4) existing monitor wells must be sampled every March, duly, and November for the following parameters: NO3 pH Total Ammonia TOC TDs Chloride Water Levels SO4 Oil & Grease The measurement of water level must be made prior to sampling for the remaining parameters. The four (4) new monitor wells must be sampled initially after construction (prior to start of waste disposal operations on new areas). The results of the sampling and analysis shall be sent to the N.C. Division of Environmental Management on Form GW -59 (Compliance Monitoring Report Form) every April, August and December. period, 30. A seventy five (75) feet buffer shall be maintained between drainageways. 31. Any additional groundwater quality monitoring as deemed necessary by the Department, shall be provided. 32.
