Salisbury Street Raleigh, NC 27604 Re: Trilogy Farms Subdivision Request for NWP 29 & GC 4139, and Riparian Buffer Impact Approval Sage Project # 2016.11 On behalf of Ms. Mary Alice Arvin (trustee/owner) please find attached a complete application and supplemental information requesting written concurrence from the US Army Corps of Engineers (USACE) and North Carolina Division of Water Resources (NCDWR) that the activities associated with the proposed road extension may proceed under Nationwide Permit (NWP) 29 and the associated General Certification (GC) 4139. Please find attached a complete application and supplemental information. Proiect Summary and Purpose The overall project is a single-family residential subdivision with residential streets and utilities that will connect to existing adjacent roads and utilities in the area. The 67.65 -acre project is located in southeastern Wake County southeast of the intersection of Lake Wheeler Road and Ten -Ten Road in Fuquay-Varina, NC. The purpose of the proposed project is to construct a residential subdivision to meet the demand for housing in this part of Wake County. Proiect Detail The overall project is a single-family residential subdivision that preliminarily consists of 134 - detached residential lots. Residential streets will connect to existing adjacent roads in the area. The proposed impacts will result from road and utility (sewer) construction. Temporary impacts are associated with stream dewatering or road construction and utility installation. Utilities for the proposed project will connect to existing utility lines adjacent to the project boundaries. Heavy equipment typically used for utility installation projects (e.g. back hoes, bull -dozers, etc) will be utilized. Trilogy Farm Subdivision Page 1 of 3 No recorded federally listed species are located on the project site or within a 1 -mile radius according to the NC Natural Heritage Data Base (July 2018). The Project will require the removal of trees within jurisdictional areas. No bridge maintenance or removal is required. No wind turbines are proposed on the Project. Blasting is not proposed for this project unless shallow rock is unexpectedly encountered. Three recorded historic structures were previously located on the project site. Matthews Store (WA 1274), Milton Banks House (WA1238), and House (WA6301) were all at one time located on the project site along Lake Wheeler Road but are listed as "Gone" on the HPOWEB site. These structures were not present on the project site at the time of the 2016 fieldwork effort. A house (WA6300) is present immediately north of the property but is listed as "ineligible". Project History The Site is and has previously been utilized for agricultural purposes and partially forested since the early twentieth century. The configuration of each type of land use on the site has changed only slightly over the years. The Site is currently surrounded by residential neighborhoods and agricultural land. A delineation of streams, wetlands, and riparian buffers was completed in 2016. A riparian buffer determination was made by NCDWR staff on July 11, 2016 and a determination letter (NBRRO# 16-184) was issued with the same date. A site visit was conducted by Ms. Tasha Alexander of the USACE to review the site for a Preliminary Jurisdictional Determination. A Preliminary Jurisdictional Determination was issued for the project site with the Action ID number 2016-0220 on January 27, 2017. Avoidance and Minimization The proposed roadway and sewer line were positioned as nearly perpendicular crossings in an effort to avoid additional stream impacts. The location of the remaining impacts are primarily at the top of drainages where proposed roadways clip the upper portions. Impacts associated with Impact D are necessary in order to install an intersection with Lake Wheeler Road. Given the location of the property boundaries, the location of the pond, and the location of Lake Wheeler Road; parallel riparian buffer impacts could not be avoided. Construction fencing will be used to define the construction corridor and prevent any accidental additional impacts. Silt fencing will be installed to provide additional protection from runoff. The culvert site at Impact "A" will be dewatered during construction in accordance with Best Management Practices for road construction. The culverts will be buried below the existing stream bed to allow aquatic passage as required. Project Impacts Permanent proposed stream impacts of 120 LF will result from dissipater and culvert placement required for construction of a perpendicular road. The installation of the perpendicular road will also result in 149.5 LF of temporary impacts due to dewatering and work areas. Additional temporary stream impacts of 38 LF will result from the construction of a sewer line. Total stream impacts will total 307.5 LF (120 LF permanent and 187.5 LF temporary). Trilogy Farm Subdivision Page 2 of 3 Overall wetland impacts total 0.2526 acre. Proposed permanent wetland impacts total 0.2293 acre as a result of road fill from the road crossings in four locations. Proposed temporary wetland impacts total 0.0233 acre as a result of sewer line construction. The project is located within the Neuse River Basin. Buffer impacts proposed for the project include 13,437 Square Feet (ft2) in Zone 1 and 9,989 ft2 in Zone 2 resulting from the road construction of a sewer line installation. Impact Area D will result in parallel impacts to the riparian buffers. Resulting parallel impacts will total 2,615 ft2 to Zone 1 resulting from grading, and 4,061 ft2 to Zone 2 as a result of grading, road fill, and sidewalk. Mitigation Permanent stream impacts will total less than 150 linear feet therefore stream mitigation is not proposed. Permanent wetland impacts total 0.2293 acre therefore wetland mitigation at a 2:1 ratio is proposed. All proposed impacts to riparian buffers except for those associated with Impact Area D, are considered "Allowable" therefore no mitigation is proposed for these impacts. The parallel impacts associated with Impact Area D will require buffer mitigation for 13,937 ft2 of buffer. Payment to Wildland Holdings lll, LLC's Grantham Branch Mitigation Site is proposed to satisfy the mitigation requirements for the project. Specifically describe measures taken to avoid or minimize the proposed impacts in designing project. Stream crossings were designed to be as perpendicular as possible to reduce impacts. Proposed subdivision roads and utilities were aligned so as to avoid impacts to streams, wetlands, and riparian buffers as much as possible. Site plans were redesigned to remove initially proposed lot fill and stormwater BMPs. 1 b. General techniques include the use of construction fencing to define the construction corridor and prevent any accidental additional impacts. Silt fencing and temporary basins will also be used to prevent sediment runoff into the streams and wetlands.
