Impacts not indicated in the application is a violation of the Buffer Rule. Site specific work should be provided in the application. [15A NCAC 02H .0506 and 15A NCAC 02B .0243(8)] Trees are not allowed to be removed from Zone 1 of the Buffer (within 30 ft of the full pond elevation), unless approved. Exception, those trees that are severely undermined along the immediate shoreline can be removed. Minimal shaping and sloping along the immediate shoreline is allowed. [15A NCAC 02B .0243 (6)] Beaches, impervious patios, impervious walkways, etc. are not allowed in the buffer unless specifically approved by the Division. There are limitation on size for decks. [15A NCAC 02B.0243(4) and (6)] Work to be conducted from land must indicate an access and indicate any trees that are to be removed. The work corridor should be described. The approved access corridor shall be restored. Staging, spoil, construction material must be outside the buffer. [15A NCAC 02H.0502 and 15A NCAC 0213.0243 (4), (6), (8)] Stormwater cannot be piped or channeled for direct discharge to the lake. All constructed stormwater discharges must be at the natural elevation and discharged prior to entering the buffer directed as diffuse or sheet flow at non-erosive velocities to the lake. Date: �+ g Duke Energy Lake Services Guidance for Completing an Excavation Permit Application Step 1: Contact Duke Energy Lake Services Complete "Part I" of the application and contact Duke Energy Lake Services to schedule a site visit. Lake Services will conduct a site visit to determine if Duke Energy will accept an excavation permit application for the proposed work. If the Lake Services representative determines the application process may proceed, he/she will initial Part I of the application. Step 2: Draft Application Development Complete Parts II-III.A-G and Part V of the Excavation Permit Application. Note: If you are proposing excavation in association with the permitting of a facility under the Marina or Conveyance Programs, you do not need to complete this application. Instead, you should incorporate the excavation request into the permit application for the marina/conveyance using the appropriate application forms. Step 3: Agency Consultation Send the draft application developed during Step 2 to the agencies for review and comment on the proposed activity. Refer to the Agency / Organization List available from Duke Energy to determine which federal, state, regional, and local agencies and organizations require consultation or review. Note: Duke Energy reserves the right to require consultation with additional organizations beyond those included in the Agency / Organization List. Each agency / organization must be provided at least 30 days prior notification. Evidence must be provided (e.g., response letter or Certified Mail receipt) in the complete application to show each agency / organization was given the opportunity to review the proposal. Consultation letters must be dated within the two years preceding Duke Energy's receipt of the application. All permits must be valid at time of application and have a term longer than the projected schedule for completing the permitted project. What to Expect During Agency Review and Comment: • You will typically receive a letter from each agency / organization either documenting its concurrence with your proposal, requiring additional information, recommending modifications, or offering no comment. You must address each agency's / organization's comments with a follow-up letter and in your final application as described in part IV. If you do not receive any documentation from an agency / organization within 30 days of its receipt of your proposal, you must provide the agency / organization with a follow-up letter requesting comment on your proposal within 15 days from the date of the follow-up letter. If you still do not receive any response as a result of the second letter, type "NO RESPONSE" at the top of the follow-up letter and include it in the application along with proof of the agency's / organization's receipt of the letter (e.g., Certified Mail receipt). You may proceed Duke Energy Page 1 of 14 rev 6/20/17 Excavation Program. with the application process recognizing, however, that if its comments come later in the application process, you will be required to address them. From the United States Army Corps of Engineers (Corps): (* * Note — The Corps may have additional forms to submit for your proposal and an additional fee.) If the excavation can be done under the requirements of the General Permit (GP) or a Nationwide Permit (NWP), you will typically receive a copy of the Corps' tear sheet documenting authorization and providing any additional instructions. If the excavation isn't covered under the GP or a NWP, you'll be required to obtain an individual 404 Dredge and Fill permit from the Corps. You must receive written documentation from the Corps that your application either (1) meets the requirements of the GP or a NWP or (2) the proper 404 Dredge and Fill permit has been received before Duke Energy can process your application. • From the North Carolina Department of Environmental Quality (NCDEQ), Division of Water Resources: (Note NCDEQ may have additional forms to submit for your proposal and an additional fee.) If the proposal meets the requirements of the Clean Water Act Sect. 401 Water Quality Certification, you will typically receive a letter from the NCDEQ Division of Water Resources documenting Sect. 401 Certification and providing any additional instructions. You may also receive a letter requiring additional information or recommending modifications. You must receive written documentation from NCDEQ noting any required Sect. 401 Certification has been received before Duke Energy can process your application. • From the North Carolina Wildlife Resources Commission (NCWRC): If you do not receive any documentation from the NCWRC within 30 days of their receipt of your application, you may proceed with the application process without submitting a follow-up request, recognizing however if comments come in later in the application process, you will be required to address them. • From the South Carolina Department of Health and Environmental Control (SCDHEC): (Note — SCDHEC may have additional forms to submit for your proposal and an additional fee.) The SCDHEC conducts a joint application process with the USACOE in S.C. If the proposal meets any applicable requirements of the Clean Water Act Sect. 401 Water Quality Certification, you will typically receive a letter from SCDHEC documenting Sect. 401 Certification and providing any additional instructions. You may also receive a letter from USACOE requiring additional information for the agencies participating in the joint application process. You must receive written documentation from SCDHEC noting Sect. 401 Certification has been received if required before Duke Energy can process your application. • From the South Carolina Institute of Archaeology and Anthropology (SCIAA): The applicant must wait 30 days after receiving the signed postal returned receipt. If a response from SCIAA has not been received by this time you may proceed with the application process without submitting a follow-up request, recognizing however if comments come in later in the application review process, you will also be required to address them. Step 4: Final Application & Submittal to Duke Energy Following the consultation process, finalize the application. The final application submitted to Duke Energy should incorporate all comments and recommendations provided by agencies and organizations during the agency consultation process as well as copies of all permits received. In addition to the final application include the following: • One check payable to Duke Energy for the application fee and security deposit • If applicable, a separate check payable to the appropriate Habitat Enhancement Program fund • Signed Excavation Program Applicant's Agreement Note: Co -applicants must also submit the application fees and HEP fees, if applicable, with the application. Information Requirements for All Applicants In addition to the completed application form PARTS I & II, the following items must be provided to Duke Energy by all applicants: A. A copy of the deed and registered survey plat or other instrument under which each applicant and co -applicant claims title to the affected property (the shoreline adjoining the excavation area, equipment staging area and the disposal area), OR if the applicant(s) is(are) not claiming to be the owner(s) of said property, then forward a copy of the deed and registered survey plat or other instrument under which the owner(s) claim title plus written authorization from the owner(s) to carry out the project on their land. B. An accurate scaled drawing (1"=25' for projects <1000 cubic yards of material removed or 1 "= 100' for larger projects) of the area to be excavated. The drawing must show at a minimum, a North arrow; a vicinity map; the boundaries and acreage of the proposed excavation area and equipment staging areas; lake, county, city, cove, tributary, road and subdivision names and lot numbers (as applicable); property corners for project front lots; the full pond elevation contour and lines dividing the cove width into equal thirds; approximate volume in cubic yards of the material to be excavated; point(s) of return water re-entry; the boundaries of any adjoining areas that are to be specifically avoided or protected during the work and the location (address) of the disposal area for the excavated material. [NOTE: A copy of this drawing must also be provided to the excavation contractor to ensure restricted areas are not impacted.] C. Each party represents that he or she enters into this AGREEMENT after considering the legal, equitable, and financial facts and cirdumstances of the marriage, including his or her rights under the Equitable Distribution Act, N.C.G.S. Chapter 50-20, and after complete and thorough review of all those facts and circumstances; and WHEREAS, Wife and Husband have engaged in direct negotiations resulting in their reaching this AGREEMENT and Wife has employed the services of Anastasia Cowan, Esq., of the Charlotte, North Carolina firm of ARNoLD & SMtM PLLC (hereafter, at times, ATTORmw CowvO, and Husband has Belk Separation & Property Agreement Page 2 of 18 employed the services of Michael F. Anderson, Esq.; of the North Carolina firm THE ANDERSON LAW FMM {hereafter, at times, APTORM ANDERSON'); WHEREAS, both parties have had the opportunity to review this AGREEMENT and have done so; and WHEREAS, both parties fully understand the terms, conditions, and provisions of this: AGREEMENT and believe and agree that the same are just, fair, adequate and reasonable in all respects. NOW, THEREFORE, in consideration of the reason recited above and the mutual promises and covenants of the parties hereinafter set forth, and other good and valuable consideration, receipt of which is hereby acknowledged by the parties, Husband and Wife hereby agree as follows: CONFIRMATION OF SEPARATION 1. SEPARATION. The parties separated on September 28, 2016, and it shall be lawful at all times thereafter for each party to live separate and apart from the other at such place or places as each may deem fit, or as each may desire, and as he or she may freely choose, from all interference, authority, and control, direct or indirect, by the other party. Neither party shall' molest or interfere with the other party in any manner at any time, nor shall either party compel or - attempt to compel the other party to cohabit or dwell with him or her in any way whatsoever. 2. RIGHT TO CONTRACT AND EWLOYMENT. Each party shall have the right to contract in the future and be contracted with independently of the Other in all respects and to engage in any employment, business, trade or profession he or she may choose as if he or she were unmarried. Except as otherwise set forth herein, all income and profits earned by either party from and after the date of separation shall be that party's sole and separate property. 3. - H U7UAL RELEASE: Wife and Husband hereby waive, release, discharge, quitclaim, and renounce unto the other, their heirs, and assigns the following: a. All and every right to share in the estate of the other party upon said party's death as provided in N.C.G.S. $ 29-14 or otherwise, now and hereafter, by law provided. b. All and every right to elect a life estate in real estate upon the death of the party in lieu of the share provided in N.C.G.S. $ 29.14, as provided in N.C.G.S. $ 29-30, or otherwise, now and hereafter, by law provided. All and every right to a year's allowance on the death of the other party as provided by N.C.G.S. $ 30-15 or otherwise, now and hereafter, by law provided. d. All and every right to dissent from the -will or to take an elective share .of the other party as provided .by N.C.G.S. $ 30-1 or otherwise, now and hereafter, by law provided. e. All and. every right to administer the estate of the other party as provided by N.C.G.S. $ 28A-41 or otherwise, now and hereafter, by law provided. € All and every right to an equitable distribution of property as provided by N.C.G.S. 50-20 et. seq., or otherwise, now and hereafter, by law provided, except as set forth herein. g. All other rights and interests in property, both real and personal, which either party now has or may hereafter acquire out or accruing to either party by reason_ of death of the other party, testate or intestate. h. Except as expressly provided herein, all causes of action, claims, rights, or demands whatsoever at law or equity, which either of the parties ever had or now has against the other, known or unknown. ALIMONY AND SPOUSAL SUPPORT BY HUSBAND AND WWE XXXXXXXXXXXXXXXXXXXX PROPERTY SETTLEMENT AGREEMENT 5. PROPERTY DIVISION. The parties are mindful of their rights to an equitable distribution of their property as provided under N.C.G.S. $ 50-20, et. seg. It is, however, the intent of the parties to reach an agreement between themselves by means of the property settlement portion of this AGR NT as to the division of their marital, separate and divisible property and debt, both real and personal, tangible and intangible, and all other property rights arising out of their marital relationship. In view of the foregoing, the parties have agreed to the division of their assets and liabilities as set forth hereinafter. POST SEPARATION AND OTHER DEBTS. Except as may be specifically set forth herein, neither party shall charge or cause or permit to be charged to, or against, the other party any purchase which either of them may hereafter make, nor create any obligations in the name of or against the other, nor secure or attempt to secure any credit upon or in connection with the other, or in his or her name. Each party shall pay all debts and discharge all financial obligations which he or she may incur for himself or herself'; and does hereby agree to indemnify the other against all debts and other obligations which he or she may incur. Husband represents that he does have current debts from the parties' marriage. Husband agrees to indemnify Wife and bold her harmless with respect to any and all debts in his individual name and shall be responsible for any and all credit card debts in his name, as well as any debts or liabilities incurred and to be incurred in connection with any and all property being conveyed to him pursuant to this AGREEMENT. Husband represents that he did not incur any debt since the parties' date of separation for which Wife is or could be liable. To the extent Husband has incurred any debt since the parties date of separation, he shall also indemnify Wife and hold her harmless with respect to the same. Wife represents that she does have current debts from the parties' marriage. Wife agrees to indemnify Husband and hold him harmless with respect to any and all debts in her individual name and shall be responsible for any and all credit card debts in her name, as well as any debts or liabilities incurred and to be incurred in connection with any and all property being conveyed to her pursuant to this AGREEMENT. To the extent Wife has incurred any debt since the parties date of separation, she shall also indemnify Husband and hold him harmless with respect to the same. This includes any and all real property in which Husband has an interest, whether. individually, in trust, or in the form of a corporate entity, partnership, or other entity, whether acquired before or during the marriage. Such real property is deemed to be Husband's separate property and includes, but is not necessarily limited to, land owned — in whole or in part — by Husband on Camino Real Road in Mooresville (fredell County) (n2cluding but not limited to Parcel 4646-06-4246.000), and additionally a lot or lots comprised of.1.6640 acres situated on Ballantyne Commons Parkway in Charlotte (Mecklenburg County). Husband represents and warrants that no such real property is encumbered by any indebtedness for which Wife is or. may be responsible; in the event any such property may be discovered to be encumbered, Husband agrees to indemnify and hold harmless Wife from any obligations on such land or lands. Husband has or may have interests as a beneficiary of various trusts or other inheritance interests created by members of his family or third -parties. Wife does hereby waive, disclaim, release, and renounce any interests in any such trust, estate, or inheritance interest (or family -limited -partnerships, limited liability companies, or other business entities utilized as estate -planning vehicles) of Husband's, which shall be his separate property and to which Wife releases any and all claims or interest. Reciprocally, Husband does waive, disclaim, release, and renounce any similar interests that Wife may have. 15. LIFE INSURANCE & HEALTH INSURANCE. Husband and Wife both waive any and all rights, claims or interest in the others whole life and/or universal life insurance policy with any cash surrender value. Neither party shall be obligated to maintain life insurance for the benefit of the other spouse.. Belk. Each party shall execute all instruments, including QDR.O's, deeds, car titles, stock certificates, assignment forms for tax exemptions, Memorandums of Property Settlement and Separation Bell, Separation_ & Property Agreement Page 12 of 18 Agreement and the like, that may be necessary from time to time to confirm such transfers as are set forth herein and to effect the terms of this AGREEMW1'. The preparation and signing of these instruments shall be construed merely as a confirmation of a property division properly executed by the parties at the date of the final execution of this AG3=mNT. It is agreed on the part of each party hereto that, in the event of a sale, transfer or other conveyance of property (real, personal or mixed), now owned or hereafter acquired by either party, if it should become necessary in order to guarantee or pass good title thereto for the other party to this AGREEMENT to execute any deed, conveyance, bill of sale, or other legal instrument concerning the dealing in such property, then in such event the other party to this AGRzmaNT agrees to and will sign any instrument or conveyance which may be reasonably required to. perfect title in the party to whom it is sought to be conveyed. It is covenanted and agreed between the parties that each of them shall and will, at any time or times hereafter, make, execute and deliver any and all such other farther assurances as either of said parties shall reasonably require for the purpose of giving full effect to these agreements and to this covenant, so long as no obligation is thereby imposed upon the party whose signature is sought by the other. 19. FREE TRADER CLAUSE. Each party shall hereafter own, free and clear of the other, all such properties which each now owns, or which each may hereafter acquire, and each shall be free to convey and dispose of his or her separate property now owned or which may be hereafter acquired as separate property, without the joinder of the other as fully and effectively as if he or she were unmarried. Should either party materially breach a specific paragraph, then the other party may at his or her election sue for specific performance, sue for damages, or seek other remedies, as by law provided. 26. VOLUNTARY EXECUTION. The provisions of this AGREEMENT and their legal effect have been fully explained to or studied by each party. Each party acknowledges that this AG=wENP is fair and equitable, that it is being entered into voluntarily, that it is not the result of duress or undue influence, and that each party believes that both parties are capable of performing each and every obligation imposed upon them by this AGREEMENT. INTERPRETATION_ No provision of this AGREEMENT shall be interpreted for or against a party because. said party's legal representative or agent drafted the AGREEmENT or a particular provision of the AGREEMENT, and Husband and Wife hereby waive all claims or defenses which they may have regarding interpretation of documents based upon who drafted the same. 32 INFORMATION. Both parties believe this AGREEMENT to be fair and equitable and consistent with the length of their marriage, health, education, estates, earnings, and their mutual desire to go their separate ways without litigation or controversy. In the event the parties were to reconcile and resume the marital relationship (resume living together as Husband and Wife) and then later separate, the parties acknowledge and agree that the property settlement provisions of this AGREMMU shall continue in full force and effect and shall be binding on both parties. Each party commits that, in the event of reconciliation is not successful, they shall be governed by the property settlement provisions of this document insofar as it relates to this separation or a later separation. All provisions contained herein regarding the property division shall be deemed to Have been executed upon the signing of this AGRMdRNT and shall not be affected by a reconciliation of the parties. The property transferred and assigned pursuant to the property settlement provisions of this AGREEKENT shall remain the separate property of the parties as stated herein. 34. SITUS. This AGREEMENT shall be construed, interpreted, and governed by the laws of the State of North Carolina and has been executed in the State of North Carolina 35. BINDING EFFECT. Except as otherwise stated herein, all provisions of this AGREEMENT shall be binding upon the respective heirs, next of kin, executors, administrators and assigns of the parties. 36. ATTORNEY FEES AND COSTS. Each party shall pay their own attorney fees and costs related to the negotiation, preparation and execution of this AGREEMENT. 37. TAX ADVICE. It is agreed that the parties to this AGREEMENT did not receive any tax advice or consultation from ATTORNEY ANDERSON or ATTORNEY CowAN concerning any tax consequences of executing this AGREEMENT. Further, the parties to this AGREEMENT aclmOwledge that it has been recommended that the parties seek advice and counsel from a tax consultant of their respective choice concerning the tax consequences that may arise from executing this AGREEMENT. 38. ENTIRE AGREEMENT. This AGREzmFxr and the ancillary deeds and other documents executed in connection with this AGREEMMT contain the entire understanding of the pasties, and there are no representations, warranties, covenants or undertakings other than those expressly set forth in this AGREEMENT. The excavation will be completed as described in the approved application and within eighteen (18) months from the date of written approval by Lake Services, unless specifically noted otherwise in the application or unless 1/we obtain approval for a single, time extension (maximum of one year) in writing from Duke Energy Lake Services. I/we understand that if the SMP or other applicable rules change during any extension period, Uwe will be expected to comply with the new requirements to the maximum extent practicable. Uwe also recognize that failure to complete the excavation within this build -out period will require the filing of a new application within the then -current SMP and the new application must include any applicable fees and security deposits. I/we attest to be the owner(s) or lease holder(s) of the land immediately adjoining the project boundary or Duke -owned peripheral strip where the excavation activity is to take place, or if not the owner or lease holder, Uwe have included proof of title to the property and written authorization from the owner(s) or lease holder(s) to carry out the proposal within the project boundary adjacent to their land. Duke Energy Page 1 Rev: 6/16/17 I/we understand that all excavation work must be done directly in front of my/our property and within the third of the cove nearest my/our property or within any middle third of the cove that Duke Energy owns, or I/we have written authorization from the owner(s) or lease holder(s) to carry out the proposal within the project boundary adjacent to/on their land. I/we also understand that access channels must run perpendicular to the shoreline while within the third of the cove area that is nearest my/our property. I/we understand that for proposed excavations, I/we must notify the appropriate local, state and federal agencies in advance of the activity by sending them a completed copy of Duke's Excavation Permit Application Form and other required information. I/we understand that written authorization and/or other permits may be required by some of these agencies and such required authorizations must be obtained before I/we submit the final application to Duke Energy Lake Services. 1/we understand that except for maintenance excavations, any excavation exceeding 2000 cubic yards of material removed or any excavation or shoreline stabilization work needed to support an application that requires Federal Energy Regulatory Commission (FERC) review does itself require specific review and approval by the FERC before Duke Energy can issue any approvals. I/we agree that unless specifically approved otherwise in the application, explosives will not be used as part of this excavation activity. I/we understand that every reasonable effort must be made to minimize any adverse impact on fish, wildlife and other natural resources. I/we understand that applicants in South Carolina proposing excavations that are not covered under the General Permit, or are greater than 150 cubic yards, must receive prior written authorization from the South Carolina Department of Health and Environmental Control (SCDHEC) or the US Army Corps of Engineers (as applicable) before submitting the completed application to Lake Services. I/we agree that excavation activities in North Carolina and South Carolina will not occur during the months of March, April, May and June because of the potential impacts to fish spawning areas. 1/we understand that trees and vegetation growing within or adjoining the lake play an important role in its overall environmental condition, and the ecological benefit the vegetation has on fish and wildlife habitat directly supports a sound and healthy lake environment. I/we also understand that unauthorized removal of shoreline vegetation (e.g. button bushes, willows, cattails, etc.) and/or disturbance of the shoreline buffer may result in suspension or denial of lake use permitting requests, forfeiture of security deposits and require re-establishment of vegetation at my/our expense, particularly if the disturbance is found to be in violation of state or local ordinances or impacts FERC project buffers. Duke Energy Page 2 Rev: 6/16/17 I/we agree that all excavated material will be placed in upland areas, landward of the project boundary, and confined to prevent erosion and sedimentation back into the lake or nearby streams. Uwe agree to adequately stabilize all excavated material and all disturbed shoreline to prevent erosion and runoff into the lake. I/we understand that the double handling of excavated material will not be allowed; therefore, all excavated material must be placed above the project boundary in one handling. Uwe have designed the hydraulic excavation process (if any will be used) so that return water re- enters the lake in the same general vicinity and cove as the excavation, to the maximum extent practicable. Uwe agree that the proposed excavation will not be for the purpose of creating additional shoreline, will not alter the project boundary or the full pond contour, and will not impact threatened or endangered species, historic properties, or environmentally -important areas, unless special public entity provisions were made in the application. I/we recognize that it is my/our responsibility to clearly locate in the field and label on my/our work area drawings any areas that require specific protection or avoidance during this excavation work. Examples of these protection/avoidance areas include but are not limited to, any Environmental Areas, Natural Areas or Impact Minimization Zones as identified by Duke; jurisdictional wetlands; historic properties; rare or threatened species; and buried gas, water, sewer, electric or communications lines. Uwe agree to provide my/our contractor with a copy of these work area drawings showing these areas to stress the necessary protection measures. I/we agree that if any archaeological resources (e.g. pottery shards, Indian artifacts, etc.) are discovered during the excavation, work shall be halted immediately. I/we will then notify Duke Energy Lake Services and the State Historic Preservation Office to determine what measures, if any, Uwe must pursue to protect or salvage the archaeological resources. I/we agree that any excavation from within the project boundary will not exceed the volume as outlined in the application and will remove and disturb only what is absolutely necessary to achieve the project's stated purpose. Uwe agree to be fully responsible for the permitted lake use and Uwe understand that this responsibility is considered to transfer automatically along with ownership and leases of the adjoining tract. I/we understand Duke Energy representatives may issue Stop Work Directives for violations of the SMP and other consequences may result from such violations, including but not limited to suspension or cancellation of approved permits, increases in fees, modification or removal of non -complying structures and restoration of disturbed areas at my/our own expense or loss of any consideration for future lake use permits. I/we agree to immediately comply with any Stop Work Duke Energy Page 3 Rev. 6/16/17 Directives, to fully cooperate with Duke Energy Lake Services and other agencies as necessary, and to perform the necessary remedial actions within the specified time frame. I/we agree to develop any required mitigation plans and to complete any required mitigation activities at my/our own expense within the specified time frames. I/we recognize that the excavation work is not considered complete and deposits will not be refunded until the mitigation requirements (if any) have been satisfactorily fulfilled. I/we agree to notify Lake Services by phone when the excavation is initiated and to ensure that during the excavation period, Uwe will post Duke Energy's approval letter in a clear waterproof ba at t the job site and visible from the water's edge. I/we agree to notify Lake Services in writing when the excavation is completed (including any required mitigation measures) and that the excavation was completed per the approved application, so a close-out inspection can be performed. I/we recognize security deposits will not be refunded if any violations of the SMP or this user's agreement occur. 1/we understand there will be no change in hydro project operations as a result of the excavation and/or utilization of the excavated area. I/we agree to maintain the work area in a safe condition and to fully indemnify and save Duke Energy harmless from any and all claims, liability, loss or damage that may arise from this excavation project. I/we understand that this user's agreement does not, in any way, constitute the transfer of any rights in real property and that my/our use and enjoyment of FERC project lands and waters shall not hinder the general public's lawful use and enjoyment of the same.
