NOTICE OF VIOLATION
CHARLOTTE CITY CODE
Chapter 18, Article III
Storm Water Pollution
Section 18-80(a)
Illicit Discharge(s) and Disposal(s)
North Carolina General Statute 160A-459 authorizes cities to adopt and enforce a storm water
control ordinance to protect water quality and control water quantity.
On August 2, 2012, Don Ceccarelli of Charlotte -Mecklenburg Storm Water Services (CMSWS)
conducted an investigation of your property located at 6601 Lakeview Road in Charlotte, North
Carolina. The investigation was conducted by authority granted under the City of Charlotte
Storm Water Pollution Control Ordinance ("Ordinance"), Section 18-82 Powers and Authority
for Inspection. As a result of that inspection, the conditions described below were found on the
property in violation of the Ordinance, Section 18-80(a), Illicit Discharge(s) and Disposal(s):
Discharge of 460 gallons of diesel fuel to the ground surface and a storm water retention /
process water pond caused by unattended overfilling a mobile equipment fuel tank.
You were verbally notified of the violation on August 2, 2012 and directed to immediately cease
the discharge(s) causing the violation. To achieve compliance with the legal requirements of the
Ordinance, you must implement the corrective actions listed below:
• Immediately cease any discharge contributing to the violation if you have not
done so already.
To ensure identification of impacted areas and impacted piping, develop a legible
storm drainage map of the facility's storm drainage system, and a detailed map
showing the storm drainage piping and oil/water separator piping system at the
diesel fuel loading/unloading area.
Restore areas affected by the violation, as described above, to their pre -discharge
condition.

Take appropriate remedial or preventive actions to prevent future illegal
discharges.
Submit a written response to this office within five (5) business days following a
successful compliance inspection. Your response should outline why the
violation occurred, actions taken to restore the affected areas, and actions taken to
prevent a similar occurrence in the future. Your response will be taken into
consideration in penalty decisions. Send your response to the address on the
letterhead to the attention of David Caldwell.
In accordance with the Ordinance, Section 18-83(c) Civil Penalties, you are subject to civil
penalties of up to Five Thousand Dollars ($5,000.00) per day beginning with the first day of
violation up until you complete all corrective actions listed above. It is your responsibility to
request an inspection from the Inspector (Don Ceccarelli, 704-814-4648) immediately upon
completing corrective actions in order to document compliance with the Ordinance and to
minimize your total potential penalty. Unless scheduled earlier by you, a follow-up inspection
will occur no later than August 13, 2012 to verify progress towards compliance. Please note that
until that verification occurs, you will continue to be in violation of the Ordinance.
CMSWS will take any steps necessary to secure compliance with the Ordinance. One such step
is that CMSWS or a contractor designated by CMSWS may abate a violation and/or restore
impacted areas to their pre -violation condition should you fail to do so, and any expense incurred
for such restoration work in addition to the civil penalty shall be charged to you.

violation, please contact me at 704-336-5452. Please be aware that a meeting request does not
relieve you from completing the corrective actions listed above and does not negate a potential
penalty.
Compliance under this section of the Ordinance does not relieve you from complying with other
local, state, or federal regulations. Your prompt cooperation in this matter is requested.
